Methods for Determining Nonself Direction & ORD-0822-06
The state is proposing adding a qualitative definition of nonself direction and requiring all recipients who have Protective Supervision to be deemed nonself directed. Qualitative definitions are often misinterpreted. This allows an Administrative Law Judge to arbitrarily determine how they'll deem a recipient nonself directed.

    I have a question, related to disabled adults and IHSS, not sure if you work with adults. I hired my boyfriend 7 years ago as my IHSS worker. I've received IHSS for 10 years since becoming mobility impaired and serious health issues. We moved in together for finacial reasons. In the last two counties we lived in, he receives IHSS pay for domestic, transportation and paramedical services. We're moving counties again and are worried about his losing hours. I've just read that because he is my live in boyfriend (but not a spouse) the spousal rule applies and he should not be paid for these services. How then, with them assessing me in my apt with him living here, how has he been able to receive compensation for domestic services (which I cannot perform). Thanks.

    Hello sir. My son was diagnosis with moderate to severe autism. He NEED 24 hours supervision from the doctor notes,AND aba notes...He was born in 2011. I didn't know anything About ihss until i took him to regional center in 2016...then they show me HOW to apply FOR ihss,so my husband can stay home to HELP him... approximate in 2017 my son qualify FOR supervision 24 hrs. But the first 4 to 5 years ,they only give my son 110 hours, We thought ít IS suppose to be like that....never know HOW to fight....i wish ,i watch THIS VIDEO that time....until now,he is not receiving 283 hours, eventhough he NEED 24 hours care....He IS an active boy with behaviors...

    We don't have protective supervision. Severe ASD, and no IEp. When we said we have no IEP the SW didn't understand that homeschool is even legal, then they were deflated that our last IEP is from years ago. They acted like now if the medical document isn't amazing, we will get denied. Well we hardly go to the doctor anymore, thank goodness. We haven't had therapy, it was a break at first since our decent therapists left the school, and the others did more harm than good, we were happy to take a break form it for homeschool and it's been a blessing overall. We still consider therapy in the future, especially ST but now we can't afford it. Our main doctor would've no doubt filled out the forms wonderfully, but now she's on leave! So we are left scrambling to get a provider that will fill out the forms relevantly. I'd love to know suggestions, if certain providers are better for primarily mental issues, and if this is required every year. We didn't plan to necessarily engage with professionals on that level, it doesn't mean it's not a struggle. It means we learned that we are disappointed more often than not and left to pay a lot of money to providers that can't do anything. I don't see why that should mean we don't get IHSS but based on the SW so far I'm not feeling optimistic. Our child is almost 12 years old, so it's a long time coming. Feels upsetting seeing people with toddlers with less severe dx getting IHSS but we are struggling.

    Larry, has the outcome been determined? I so agree with you on the combined score of 6 or higher (Nursing Facility level of care) for determining level of non-self direction, but I think it should also be used for level of need to qualify for PS. My son has had max PS for 15 years, he's 27, and it's never made sense to me that someone would need a score of 5 in all three areas. What difference does it make if someone doesn't have severe memory issues, if they exhibit issues with orientation or judgement? Or vice versa. If they have the ability to put themselves in danger or harm due to having a higher level of mental disability that should be enough. I never really worried about In Home Assessments because I could always rely on how my son would respond to their questions. However, these days, I'm seeing so many people have to fight to keep their loved one safe at home, that now I'm stressed out a month before they even come. Also, I think the way the requirements were originally written, using the word, "or" instead of "and", made so much more sense. I hope your suggestions for determining non-self direction are heard. Please let us know.

    .I know this video is old but I've been requesting protective custody for some years now and my IHSS worker seems to always block me from getting more hours. She'll come to the house and do the assessment pretty much shoot me down. I have tried with the regional center to advocate for me and help me get the documents I need and every time I turn it in to get an increase in hours, she will call and try to pretty much challenge me you know and make it seem like I don't deserve the hours. I have paperwork proving of self-interest behavior I have notes from the doctor as well as the regional center has provided me with those documents as well. I just don't understand why this IHSS worker has been hard pressed to not give me anything. I've given IEP psychological evaluations recent doctor visit notes proving that she needs this but I've been refused every time. Today I considered requesting for a IHSS worker change hopefully I will get someone else that will be understanding. But I have turned in three protective order requests and they've all been shot down. Thanks for this video I'm going to subscribe to your channel as well because I feel like I probably should have been taken care of this but I was just so busy with life and I gave up😅

    Since Covid restrictions for in home assesments have now possibly been removed, we are due for our in home assesment. When I initially have communication with the IHSS assesor, I am going to ask for an outline for the meeting. Just like an IEP meeting, when we go into the meeting, I want to be prepared for questions and concerns and review. It is not fair! for a family member to be put "on the spot" when someone comes into our homes and "evaluates". I want to be as transparent as possible and be ready for concerns and questions, just as if I went into their home and asked questions! I live in CO but many of our protocol are the same as CA. Hope this helps families!

    I have listened to this again. This is very good Larry. If my son called 911 (he's legally blind, with prior brain surgeries) I am prepared to ask them how he could get out of the house safely and know how to get out of the house safely if there were an obstruction, etc. I recently had a HVAC person in the house and I saw my son "run away" when he saw him. This could also apply to a firefighter, 1st responder etc. we definetly need to keep thinking "out of the box" thx Larry!

    What if you are a single parent and your child you get protective supervision? He’s over 18 and he’s at school until he’s 22. He’s gone from 6:40 in the morning. He gets home at 4 o’clock in the afternoon. Could you accept a full-time job during the hours that he is not at home and he’s at school and still get IHSS protected supervision hours

    There are so many issues involved with this it's making my head spin. We are nearing retirement and if anyone in the family has "access" to company "full time" employment, 30 hours or more? even with lower income such as SSI and IHSS, one may still not be able to qualify for "subsidies" in the "marketplace" simply because they are full time employed and thus don't need marketplace subsidy access. I am so confused. Thank you!

    I have been researching for days and I cannot find any answers. we are hopeful, since you are so absolutely brilliant! that you might be the only one that may possibly be able to answer this question! Here it is! Hubby is employed full time for many years. When his open enrollment period for benefits happened in Oct, we signed that I was part time IHSS Caregiver IN HOME for our adult son. Fast forward to mid Nov. I was now assigned 31.5 hours which is "full time"? I had 28 hours prior to this for 4 years. So Question is: Are IHSS Family caregivers "exempt" from "spouse work tax/ACA" if they change from part to full time. My husbands employer says this tax is 1200 a year if I qualify as a full time "worker" and "deny" the IHSS benefit program which was offered also, which is 4x what we pay for me to be on my husband's plan. Thank you!

    I have an adult son with autism and epilepsy. He cannot take his seizure meds on his own. One day he took it upon himself to take his meds and took 4mg of Ativan. (Numerous times I’ve caught him trying to take excess ibuprofen for his headaches) Needless to say, I took him to the ER. Social worker said that he does not qualify for supervised supervision because that is medical. He is a danger to himself. Does that disqualify him from protective supervision??

    Sw it’s asking my husband to sign a form stating he gives permission to contact his employer and to confirm information on this form she wants to go on my husbands history for a year , form has no code or no time limit for the authorization.

    A social worker for the county we are applying for our son at 1 of 3 workers told me to take the safety wheels off, let the worker if it’s her or someone else see what it’s like without us blocking him or stopping it. Because we recognize all his tics and stop them.

    My son is 2.5, hes autistic. He doesnt have a diagnosis yet, though. He is in inland regional center right now. He is self injurious and injurious of other's. His behaviors are aggressive, extreme and unpredictable. The ihss worker who called me for the in home visit, kept telling me he may be denied based off his age, almost to discourage me from appling. I told her i am applying and i will keep applying because he needs this regardless of his age. He is 40 inch tall which is tall for a 2 year olf, hes strong and will just do things with out asking for help. Hes smart too, he knows bow to remove the putlet covers, open the stove knob covers, so i just remove them, unlock and lock doors.... oh and he eats things he shouldnt. Deodorant, lotion, cleaning paste, mop water, pool water, sand.... i have to. Carry him to and from the car because if i set him down he will run to the street. If i have a leash on him, he will just drop his full weight to the ground in a ball and i have to pick him up. He head bangs when throwing a fit, throw his body around, bites, scratches, kicks any harmful contact he will scratch ankles or faces, whichever is closer. he does so much in one day its hard to keep a record. If i am denied, should i re apply. I feel these are all valid reasons to receive ps.

    Please can you explain what they mean when I have to right his 24-hour plan for protective supervision hours? Do I write down his basic/daily schedule? Do I write down his respite care session hours? The social worker was rude, did not explain, told me my son is a smart child he knows where he is etc. belittled and I am a shy person to ask. Although I have all the documents from CHLA and UCLA MDs that prove he is non-verbal, has developmental delay, ASD, ADHD and is almost 15 years, I never applied it before. Even though he was escaping the house and was using diapers for many years. I could not sleep many days to provide for his safety but nobody ever told me that I could receive financial aid.

    Guess what when the social worker from IHSS came home that day I gave to my non verbal teen who just learn to write or recognize his family members his ipad, cell phone and coloring supplies so we would not behave badly :( Becasue I did not want people see my son act inappropriate, thanks to my ego. She said he is great very smart can do everything. I didnt want to say negative things about my baby, although nobody care about me while I was changing his diaper until he was 12 years old or still dealing with his grooming( nail, hair etc).     My son is going to be 5 and what I feel is high on the spectrum as in behind in learning/comprehending and completely non-verbal. Does this help with getting protective supervision? He elopes and hits his head on whatever is close including whoever isn’t understanding him to the point of complete frustration.

    My child is 5 and was born with spina bifida. He is in a wheelchair and is in diapers. He is going to start catheters and peristine system for bowel movements. He also has a shunt in his brain and has frequent appointments. He is also behind when it comes to his speech and we do get SSDI for him. I had never heard of IHSS until his last visit to the Spina Bífida clinic at Valley Children’s Hospital this past week. I applied today but I have no idea if any of this qualifies us.
