  • Larry Rosen discusses employment rules for IHSS parent providers. Digging through all county letters and MPPs, Larry answers a couple common questions in regards to two parent households where one parent is a provider and the other is a non-provider.     Thank you I just applied for my daughter. She is 5 with ASD and I made a list and we definitely qualify. My husband is full time working and we are in true need. She is Reginal center. Thank you for this.

    A son become a caregiver and take care of his day. Buy he doesn't take care of his dad. He still collect the cash that was sent to his dad. What should I do to help and who to call for help?

    I am 39 and have some medical issues i was approved my mother takes me to my doctors when i need to and other stuff i need help with, She works but hear job lets her take the time off when ever she needs to to take me where i need to go

    I live in madera Ca. My son was granted ihss services. I will be the provider and my wife works 40+ hrs a week. My social worker just told me i can't claim hour worked if my wife is in the house.

    Can a parent provider go back to school (postgraduate) during the hours that they are not providing protective supervision?

    Do you have to have medical? My daughter keeps getting denied for medical because of my husbands income. She was recently diagnosed with ASD level 2 and I had to quit my job for her school & therapies schedule.

    Sw it’s asking my husband to sign a form stating he gives permission to contact his employer and to confirm information on this form she wants to go on my husbands history for a year , form has no code or no time limit for the authorization.

    I have a question. My wife is the care provider for our two autistic children one severe the other not so severe. We are divorcing and I was wondering can I be a care provider as well for my two autistic children if we have equal Cassidy?

    What if you are a single parent and your child you get protective supervision? He’s over 18 and he’s at school until he’s 22. He’s gone from 6:40 in the morning. He gets home at 4 o’clock in the afternoon. Could you accept a full-time job during the hours that he is not at home and he’s at school and still get IHSS protected supervision hours

    This video was very helpful but a little confusing. I am the provider for our adult daughter. I cannot work due to her need for care. She has been awarded 71 hours per month. We do not receive protective supervision for her. I am considering taking a trip out of the country to visit my parents. IHSS told me that my husband could provide care for my daughter. However, he is employed full time so our other adult children would need to help during his work hours. It sounds like you're saying that my husband couldn't qualify due to working 40 hours per week. IHSS didn't ask about his employment. Are you sure that this rule is correct? IHSS never mentioned any rules regarding employment for either of us.

    Hello! I was wondering if you can tell me where I can find rules /regulations regarding the assets the parent provider may have after child turns 21 with a medical waiver facilitated through the Regional Center. If financial limitations still apply or not. Your help will be appreciated.

      The DDS waiver is the only waiver that I am aware of that originates with a Regional Center referral. The DDS waiver would terminate when a recipient reaches the age of 18. The parent's income is no longer deemed towards qualifying when a minor becomes an adult. At this age, I recommend the recipient apply for SSI and obtain Medi Cal linkage through SSI. Hope this helps...

    Wondering if IHSS would be an option for my daughter with a rare genetic disorder? I’ve pulled her from school to homeschool because she has to be careful about getting illnesses, she has to have a snack every 3 hours or so, and she can’t over do it with exercise to avoid her episodes of severe hypoglycemia and metabolic acidosis as much as possible. Stress is also a trigger. I’m not sure how to know if she would qualify.

      I would apply if I were you. They will let you know if you qualify or not. I receive ihss for both my kids because they harm themselves so they were approved straightaway. However, you can also get approve for medication etc.

      You are allowed to work as long as it's not full time.

    Do the 2 parents employment rules differ for a recipient who is an adult ? We live in the same home .

      At age 18 the child is no longer a minor. So at age 18, the rule that says that, “in order to be a provider, a parent has to be either barred from full-time employment, or prevented from full-time-employment, or left full-time employment”; is no longer a rule. That’s number one. So if you happen to be a Parent Provider and you’ve been forced to work a part-time job because of the need to care for your child, you can now go full time and they can’t do anything with your hours. That’s one change. There’s also other hours that are available to you at age 18. They are gonna be your domestic and the majority of related services. Those are going to be things like house cleaning. We don’t live in the north, but potentially if you where in an area that had snow, clearing snow. It’s those things that you would expect a home keeper to typically do in terms of the care of their home. It’s off limits to minors because it’s assumed that the adults who supervise the minors would be responsible for those duties. But at age 18 when the recipient becomes an adult, that’s not the case anymore

      They reassess you in the new county. But your case moves with you to the new county.

    Can a live in family provider (me) who gets max hours 283 month for elderly can I work aside from ihss part time? We do not have PS . Ty

      There are no restrictions if the recipient is over 18. You may have other full or part time employment if the recipient is an adult.

    I am self employed and work 40hrs a week but my schedule is flexible to where I can watch our child while my wife works part time
    Can my wife be the provider?

      Yes. The non-provider parent (you) must be working full time, going to school, or seeking employment; while the provider parent (your wife) can NOT work full time. But the provider parent (your wife) may work part-time.

    hello! my 5 year old twins have autism. i recently applied in july but havent heard anything back. I turned in my paperwork and doctors form within a week of receiving it. When is a good time to follow up with the social worker? can you advocate for a case without an approval or denial yet?

      You can call them and see what's going on. We don't take cases until they are denied because then you've have to pay us a non-refundable retainer out of your own pocket. And in a lot of cases parents can obtain IHSS on their own. Once you are denied and appeal you will get back pay when we win your case. Our fees are drawn from a portion of your back pay.     I need help. I am a provider for my 14 year old grandson. I take him to school and pick him up every day from school. Only getting 21 hours a month. I cant go to work unless it’s 10-2pm and must be here with him when he gets home from school. What can I do

    Hi Larry, my son was denied 2 times. I have hired an advocate i was just wondering could you explain the difference between severe and moderate hours? How do they determine what is severe or moderate impairment. My social worker denied due to his behaviors being "episodic and infrequent"
    But I believe he meets the moderate category.
    Also my social worker kept telling me that "PS is difficult to get"
    As if to deter me. And after I provided all my documents as well as letter from teachers and doctors she denied me AGAIN!
    I asked her why when she can see all my documentation and she said "I'm sorry I'm not telling you what you want to hear."
    So now I have an advocate group and we are going to hearing.
    She only assessed my son for 15 minutes due to my assessment being done in covid.

      @IHSS Advocates Thank you. My son was diagnosed level 2 recently by tricounties. I have the report but the case manager hasn't even contacted me for a meeting to see what we qualify for. Should I qualify for IHSS ans SSI now, or should I wait for the meeting? She told me she has the phone number and all that stuff, but that's generic info that I can find online. Is it worth it to apply asap? Thanks
