A police or first amendment auditor is exactly what you saw here. Sets up filming so where for literally no reason other than to try to get someone to call the cops, to then fuck with the cops whilst staying inside the bounds of the law, which they are often more educated in that the police they deal with. They're trying to get arrested without committing a crime, so they can sue and/or post the videos to youtube. I don't see anything wrong with police audits but you don't have to be an asshole. These cops, although wrong, we're being cool about it, you can prove them wrong without the belligerent insults.

That was so beautiful. Me and my dad spoke our language "Navajo" when cops tried to illegally search us at the flea market. I called my mom and cousins to come over, and cops got nervous and left when there was like 10 Native Americans slowly surrounding them.
Why not show the officers a copy of the Right of Way, so they could see that he's legally allowed to be there, instead of cussing them and flipping them off? I gave the auditor a thumbs down and I will never watch him again. I understand he has a right to talk any way he wants, but I have the right to not like it and think the auditor is the tyrant here.

Someone said the auditor was rude. The officer had no reason to give unlawful orders didn’t even know the difference between public and private property know that’s scary .

The validity of that complaint may be questionable, but that has no bearing on the the rudeness and unprofessionalism of the auditor. You can tell that was the case as he was still screaming obscenities and flipping off the cops even as they were leaving.

That is the narrative we are being conditioned to believe. In reality, police (irrespective of their origins and politics) are charged with and responsible for maintaining the peace, provide aid and service, and prevention of harmful (to and for the public= us) potential activities which are prescribed based on civil and criminal laws to a degree above and beyond any average civilian. Now, according to their job description, once the officer (not military personnel or you) arrived at the scene and, may have been unsure of whether or not the civilian (not enemy combatant and yes, potentially you) was trespassing or being a menace or disturbing the “peace” (neither of which are a felony) the officer should have informed the individual who called for aid, that no law or infraction had been breached…end of story. However, that is not how the officers handle what may have been a potential minor offence…especially, cuz there was none. If your take away from this is…”wow, look at what incredible restraint the officers had” and not “holy shit, a gang of individuals with guns and immunity just attempted to strip the rights of a fellow civilian (who rightfully was defensive) away and at the same time, our tax dollars just paid for it”. 🚩 Police officers are supposed to keep their heads, that’s a prerequisite of the job! And you still don’t see the problem? Police officers are “civil servants” not head bangers, not soldiers despite their gear or tactics. that is not true at all. there are exceptions but in general your homes driveway is on private property and is certainly not a public roadway. if it was then anyone could use your driveway and that's obviously false.

The woman working at the business claimed the guy was on private property. If the business believed he was trespassing and wanted to press charges to enforce the claim that is their right. The legal determination of the exact location of the property line and any easement would have to be confirmed by a qualified surveyor. It is unreasonable to expect police to be qualified land surveyors and have knowledge of the location and limits of easements. I thought the Police behaved with exceptional restraint and professionalism despite the videographers yelling insults in an apparent failed effort to provoke them.

How about we condense all the time these costumed clowns wasted into a more expedient solution. They receive a call for service about a strange man trespassing on private property. They arrive at the address and observe a man with a camera on a probable easement of the property, then they proceed to contact the calling party to document what caused them to call. They question the caller about their ownership or control over the property, where on the property the the stranger has been, and if they want them trespassed from the property. If the owner/controlling party doesn't indicate that the stranger has been anywhere other than the apparent easement, inform them of the easement and that unless they have documentation indicating there is no easement to their property that they can't remove the stranger but will pass along the trespass warning. They make contact with the Stranger to question, document, observe, and relay the trespass warning. If any suspicions of criminal activity linger they can stick to the area and continue to observe. And all of this could have been accomplished with one unit while not infringing nor neglecting anyone's rights.

Above the gutter and curb there is no "apparent" easement line. This doesn't matter because you have a grudge against the cops and nothing they might do would satisfy you. The cops were respectful and professional with the camera guy despite his best efforts to provoke them and the people at the business. I'd guess the cops would have left sooner if camera guy hadn't been so angry and hostile that they wanted to see if he might turn violent. I doubt your myopic view of the world would ever let you see clearly enough to recognize that.

Easements don't mean it is someone else's or the state's property, it just gives access and usage rights to the land. Public roadways have easements down the sides of them for the public to travel on; just because there isn't a sidewalk installed doesn't mean there isn't room to traverse along a road. What I meant by "the apparent easement" was that the "stranger" was still within a boundary that covers most public easements. In cities where there are sidewalks with some grassed boulevards you're still responsible for upkeep of the grass past the sidewalk even if it isn't within your fenced property line because your plot extends to the street, that is your land. At my current house there is no sidewalk and i can landscape all the way to the curb, but I can't stop someone from walking through my garden if it were that close and it would be in jeopardy of being destroyed if the city ever wanted to do anything on the easement. My neighbors a block down have first hand experience with that when the city decided to put in a sidewalk through the easement in their previously landscaped yard. I have no grudge against law enforcement as friends and family who are/were in it could attest, I simply called out ridiculous policing and those who endorse it. Calm and polite doesn't equal respectful or professional, it's just as easy to politely violate someone's rights as it is to rudely do so. There are too many unprofessional/unqualified LEOs out there and it just makes the job harder for everyone else because of it.
Overall the cops were fairly professional which is admirable, but the willingness to side with a business regarding fairly obvious property lines and accessways shows they really need more education on that.
what was the title of this video? first amendment AUDIT. Are you familiar with the word "audit" the auditor was testing the ego of the cops. Many cops will try to bully people and lead with feelings. I would hope that, after this incident, went down to the police department and gave them a positive review for remaining calm while being berated and keeping his composure. I had to go through the same kind of treatment when I went to boot camp because you have to be mentally strong and not fly off the handle when someone says something you don't like.

I owned a single family home many years ago. I was responsible for trimming the grass adjacent to the street as well as maintaining the sidewalk. If I didn't and someone got injured, I could have been sued for not keeping the sidewalk level and safe. Yet this area by the street was in fact a public easement. Anyone could walk across it, and even stop and film my property. How these police officers did not understand what a public easement is, is beyond me. They are so very stupid.

It is reasonable for people to be concerned about their business. I get that he's legally allowed to do what he was doing, but there's got to be a way to do it without bugging people who are just trying to run a welding company. If he had been in the street when the cop showed up the cop would have made him get out of the street. The cop should have showed up reviewed the scene spoke with the property owner and explained the photographer's civil rights. There was three cops not one of them recognized this guy was an auditor. You better pray to your God that if you're ever in trouble none of those three show up. Between the three of them I don't know if there's enough brain power to blow out a match.

The police are allowed to LIE to you! I suspect they know all about easements.
Someone said the auditor was rude. The officer had no reason to give unlawful orders didn’t even know the difference between public and private property know that’s scary .
Whataboutism is strong. The officer was trying to deal with a complaint. The validity of that complaint may be questionable, but that has no bearing on the the rudeness and unprofessionalism of the auditor. You can tell that was the case as he was still screaming obscenities and flipping off the cops even as they were leaving.
No doubt, it was highly confrontational BUT You don't have to like it.
1: He was within the law from the start.
2: He was on public property.
3: He was participating in a Constitutionaly protected activity.
4: THEY confronted him.
5: All involved in this encounter WILL REMEMBER this lesson, from this day on.
6: The police officers NOW know the laws applying to the first amendment.
All in all, as long as he stays with the boundaries of the written law, I call it a win.

That is kinda of what I am getting at. Unlike you and your friends (thank you for your service), police are not soldiers and not automatically the “good guys” (actions should determine that not a uniform or title) but if you view them as such then you must in turn, view anyone who is suspected or accused of a crime or minor infractions as “criminals/the enemy/bad guys” and so they no longer are one of us and their legal rights (under the constitution) no longer apply. That is the narrative we are being conditioned to believe.
In reality, police (irrespective of their origins and politics) are charged with and responsible for maintaining the peace, provide aid and service, and prevention of harmful (to and for the public= us) potential activities which are prescribed based on civil and criminal laws to a degree above and beyond any average civilian.
Now, according to their job description, once the officer (not military personnel or you) arrived at the scene and, may have been unsure of whether or not the civilian (not enemy combatant and yes, potentially you) was trespassing or being a menace or disturbing the “peace” (neither of which are a felony) the officer should have informed the individual who called for aid, that no law or infraction had been breached…end of story.
However, that is not how the officers handle what may have been a potential minor offence…especially, cuz there was none.
If your take away from this is…”wow, look at what incredible restraint the officers had” and not “holy shit, a gang of individuals with guns and immunity just attempted to strip the rights of a fellow civilian (who rightfully was defensive) away and at the same time, our tax dollars just paid for it”. 🚩

This is not a movie or television show, so just for one moment…imagine the unaccountable financial devastation and/or physical harm they could have done to that citizen/civilian (not enemy combatant or rival and yes, potentially you) who broke no laws and posed no threat, had they arrested him after “they” escalated tensions by ignoring the laws and protocols they are legally responsible and required to follow. I think some of the problem comes from personal freedoms infringing on those of other people.
The courts are quick to tell citizens that ignorance of the law is no excuse, but are just as quick to say the police aren't required to know the law.

The woman working at the business claimed the guy was on private property. If the business believed he was trespassing and wanted to press charges to enforce the claim that is their right. The legal determination of the exact location of the property line and any easement would have to be confirmed by a qualified surveyor. It is unreasonable to expect police to be qualified land surveyors and have knowledge of the location and limits of easements. I thought the Police behaved with exceptional restraint and professionalism despite the videographers yelling insults in an apparent failed effort to provoke them.

It's not unreasonable to expect police to understand the general easement laws in their jurisdictions.
How about we condense all the time these costumed clowns wasted into a more expedient solution.
They receive a call for service about a strange man trespassing on private property.
They arrive at the address and observe a man with a camera on a probable easement of the property, then they proceed to contact the calling party to document what caused them to call.
They question the caller about their ownership or control over the property, where on the property the the stranger has been, and if they want them trespassed from the property.
If the owner/controlling party doesn't indicate that the stranger has been anywhere other than the apparent easement, inform them of the easement and that unless they have documentation indicating there is no easement to their property that they can't remove the stranger but will pass along the trespass warning.
They make contact with the Stranger to question, document, observe, and relay the trespass warning.
If any suspicions of criminal activity linger they can stick to the area and continue to observe.
And all of this could have been accomplished with one unit while not infringing nor neglecting anyone's rights.

Above the gutter and curb there is no "apparent" easement line. This doesn't matter because you have a grudge against the cops and nothing they might do would satisfy you. The cops were respectful and professional with the camera guy despite his best efforts to provoke them and the people at the business. I'd guess the cops would have left sooner if camera guy hadn't been so angry and hostile that they wanted to see if he might turn violent. I doubt your myopic view of the world would ever let you see clearly enough to recognize that.

Easements don't mean it is someone else's or the state's property, it just gives access and usage rights to the land.
Public roadways have easements down the sides of them for the public to travel on; just because there isn't a sidewalk installed doesn't mean there isn't room to traverse along a road.
What I meant by "the apparent easement" was that the "stranger" was still within a boundary that covers most public easements.
In cities where there are sidewalks with some grassed boulevards you're still responsible for upkeep of the grass past the sidewalk even if it isn't within your fenced property line because your plot extends to the street, that is your land.
At my current house there is no sidewalk and i can landscape all the way to the curb, but I can't stop someone from walking through my garden if it were that close and it would be in jeopardy of being destroyed if the city ever wanted to do anything on the easement.
My neighbors a block down have first hand experience with that when the city decided to put in a sidewalk through the easement in their previously landscaped yard.
I have no grudge against law enforcement as friends and family who are/were in it could attest, I simply called out ridiculous policing and those who endorse it.
Calm and polite doesn't equal respectful or professional, it's just as easy to politely violate someone's rights as it is to rudely do so.
There are too many unprofessional/unqualified LEOs out there and it just makes the job harder for everyone else because of it.

Overall the cops were fairly professional which is admirable, but the willingness to side with a business regarding fairly obvious property lines and accessways shows they really need more education on that.
what was the title of this video? first amendment AUDIT. Are you familiar with the word "audit" the auditor was testing the ego of the cops. Many cops will try to bully people and lead with feelings. I would hope that, after this incident, went down to the police department and gave them a positive review for remaining calm while being berated and keeping his composure. I had to go through the same kind of treatment when I went to boot camp because you have to be mentally strong and not fly off the handle when someone says something you don't like.

I owned a single family home many years ago. I was responsible for trimming the grass adjacent to the street as well as maintaining the sidewalk. If I didn't and someone got injured, I could have been sued for not keeping the sidewalk level and safe. Yet this area by the street was in fact a public easement. Anyone could walk across it, and even stop and film my property. How these police officers did not understand what a public easement is, is beyond me. They are so very stupid.

It is reasonable for people to be concerned about their business. I get that he's legally allowed to do what he was doing, but there's got to be a way to do it without bugging people who are just trying to run a welding company. I don't really get what this weird behavior of baiting people into this kind of contentious interaction accomplishes. I'm not a fan of much of how the police do their jobs either, but this mostly seems like it's just a way to get views with videos of himself antagonizing and swearing at cops in a fake stereotypical accent while accusing them of performing oral sex on each other as an insult for some reason. I get that it's legal, but I don't see how any of it is actually meant to improve anything.

Ricky is in line to give his civil and constitutional rights up. The auditor was correct about easement. Anybody who's been a homeowner knows this. If he had been in the street when the cop showed up the cop would have made him get out of the street.
The cop should have showed up reviewed the scene spoke with the property owner and explained the photographer's civil rights. There was three cops not one of them recognized this guy was an auditor.
