    Hello Terry, I have watched you speaking of "Duty of care" - if there is a clear breach insofar as, for example, a recipient of a service was put at real risk - but the risk never came to anything, is there still a case for breach of duty of care? Or does the person put at risk actually need to have suffered?

      Generally, you have to show loss. But there are situations where statute imposes 'strict liability' and loss does not have to be shown. In negligence claims you must suffer loss.

      @@terrygorry A workman, for example, leaves exposed live wires near children playing - but mercifully nobody is injured. Is the workman innocent in legal terms? (Sorry for asking a second question) (I've looked and looked but can't find any reference online to breach of duty of care - but without consequence.

    One thing you miss Terry about Irish Law that no matter waht Laws say they are exploited and abused to ensure ordinary Irish people have no Rights under the law, no right to Employment, no right to housing, no right about who lives in your Comunity. The law is meaningless, innocent people are being sent to Jail while Solicitors get rich off them. I'm beinf charged with an offence I haven't comitted for lodging a Negligence complaint with Irish Medical Councl.over my Mothers standard of Care, that is the Law in Ireland

      Yes, negligence is a civil wrong
