  • A grand jury in Ohio is weighing whether to indict a woman who had a miscarriage. She was two weeks pregnant when she miscarried at home, after a doctor told her the fetus was no longer viable. Now she’s facing criminal charges for abuse of a corpse and up to a year in prison. Dr. Kavita Patel joins to discuss what this case means in a post Roe v. Wade world.

    Apparently the already dead fetus was either left in the toilet where it fell, or put in her backyard because the toilet was at risk of clogging. She was feeling deathly ill when she miscarried, after days of carrying an already dead fetus that the doctors would not take out of her. She wasn't abusing the fetal remains, she just didn't know what she was supposed to do with them, and the court STILL has not told women how they are expected to treat fetal remains. Tell me again about how abortion bans are not a sign of a state hating on women.

She's heartbroken, and now traumatized by lawmakers on top of the trauma of losing her pregnancy. If it was your family member, you wouldn't want them treated like a criminal over something they were incapable of preventing and poorly advised on how to handle. This is inhumane to the max. Please think about that before asking that question.

    How the heck can you charge a woman for a miscarriage. Her body makes the decision it cannot handle the baby for whatever reason.     We lost our child from miscarriage at 21 weeks and it was (and still is) devastating. But to think of my wife having to potentially face criminal charges for something she desperately did not want to have happen is beyond cruel. FOR SHAME!!!!!!!

    My heart breaks for this young lady! Making women out to be criminals for miscarrying means women are less likely to go for prenatal care, less likely to announce a pregnancy, less likely to allow themselves to get pregnant or to have relations. This is so draconian!

    Many of us women have suffered miscarriages, even losing our babies late in our pregnancy like she did. I lost six MUCH WANTED babies.
    One of our babies died at 18 weeks, and I had to carry the dead baby for a month because no one wanted to touch it. When they realized I could die of sepsis, I was finally operated on to remove the dead child. The miscarriage was very traumatic as it was. Carrying it while people patted my belly, congratulated me on the new baby coming etc. was horrendous.

      I am so sorry that you dealt with losing one but so many is just no words. I'm sorry you had to deal with practically losing your life also. I can't imagine how this must feel and don't want to say I understand because I just don't and that's not right. I hope you have children eventually since you obviously want them. Good luck and know that you did nothing wrong and if comfortable please let people know your story so hopefully there won't be another you or another Britney.

      We just lost baby No 5 was me at to be born on feb14 2024 but Even My husband looked at me and was like "this is not right, u do know i would wait for u to get out right?" this was 110%not her fault i feel so bad for her and the family 😢😢😢😢😢❤❤❤❤❤

      We named every one of our children that died, and I will forever remember those dates in my heart. Both the expected delivery, and the day we grieved their loss.
      I pray you will have support of the ones you love on your precious baby’s due date.
      Remember, grief is a process, and there is never a time limit. Allow yourself to grieve, and don’t listen to those who don’t understand that this was more than just a fetus. This was your beloved child.

      @@Katfancy40 Thank you for your kind words. After a doctor figured out what was wrong with me, we were able to remedy the medical issue, and eventually had four wonderful sons. There is hope.
      Besides the fact that many women have abortions due to medical issues of their own, what I am angry about, is that women are thought to be smart enough to be a mother, overseeing children, and the household, but apparently not smart enough to make life and death decisions about our own bodies with our doctor.
      The lawmakers didn’t figure this out before making such a drastic change.
      Who is paying for the cost of medical insurance for that pregnancy and delivery?
      Who cares for the pregnant woman during her pregnancy if she is sick?
      Who will pay her bills if she is told to remain on bed rest (as I was for 3 months with our last son)?
      Who is paying for the baby’s formula if the mother can’t nurse? Diapers? Education?
      Who is paying for the baby’s medical insurance if the child is born with serious medical issues?
      Since most adoptive parents want newborns, who is taking care of the hundreds of thousands of kids left in foster care?
      Who is paying for the adoptions?
      The list of questions goes on and on, yet when asked, they have no answers.

      It's not just a Republican problem, though. The Democratic party distanced itself from the abortion issue for a long time, passing up countless opportunities to enshrine abortion access in statute. I'm not saying they're AS culpable as the Republicans in this problem, but they do deserve a fair amount of condemnation for their inaction.

    She was told by a doctor her fetus was no longer viable. She should have been in the hospital and induced to deliver her fetus in a safe sanitary environment. She was sent home to do what??? Was she given information on what to do in the event of a miscarriage at home?
    My heart hurts for her and what she is going through. I hope if this ever goes to jury trial she is found NOT GUILTY!
    THIS IS ABSOLUTELY DISGUSTING!!

      according to the report I read- not posts made on social media- she went to the hospital 3 times, and all 3 times signed herself out, against medical advice. The first 2 visits while they were planning to induce and handle this. She chose to leave, on 2 occasions, and the 3rd time went back, thinking they would go ahead and take care of it. At that point, she was on the cusp of it being "too late" per the state law for allowable abortions. She assumed wrong and she should have stayed and had this handled when the hospital wanted to do it- the first 2 times she went in.
      Are they being heavy handed- perhaps. But very few people seem to be aware of the full set of facts, and this is being weaponized to further an agenda.

    Not only was she forced to have a miscarriage at home, which had to be absolutely horrifying considering how far along she was.... she now is having her entire life be ripped apart, during a time where the ONLY thing she needs is empathy.This is exactly why other first world countries, have warnings for when people travel here, that it is a dangerous place for pregnant women to travel. This is absolutely horrifying.

    I am so heartbroken for this woman. No help, no healthcare. She had to carry the fetus for days, it was toxic to her system. She was horribly sick and now she’s up on charges after one of the most devastating ordeals a person can endure. Why is she under attack, this is crazy.

    You wouldn't ask a prosecutor to perform surgery, a defense attorney to prescribe medication, or a judge to provide a medical diagnosis.     Any hospital that refuses to provide healthcare and sends a woman home with a nonviable fetus inside of her should be sued for endangerment of her life. Sepsis is a very real possibility and can be fatal.

      Imagine what the foetus looked & smelt like after rotting inside her for days too! Just think about the smell & decomposition of a rat or even mouse under your fridge, then imagine if it had been at body temperature for days, would be sickening for even a healthy person to try to deal with, let alone the poor woman with sepsis from carrying it! Absolute malpractice to let her go home with that inside her!

    Had she miscarried in the hospital the fetus wouldn't have been burried or cremated. It would have been disposed of in the medical waste bin.     Women who are actively miscarrying who are denied medical care can easily die from blood loss (our sister-in-law almost died twice from horrible miscarriages - and she had to have medical treatment now denied - and both were highly wanted pregnancies) as whatever these men imagine miscarriages aren’t clean little neat affairs in which a perfect little baby plops out. Ffs. There is massive blood loss and pain. There is tissue from the uterine lining and blood clots that are large. A dead fetus can go septic - and these politicians would rather see this woman die without medical treatment than allow standard medical procedures to save lives. Because they want votes. Disgusting.

    Twice I missacarried at 20 weeks. Both times I was alone and flushed the remains. No one held my hand. No one held me as I cried. I could never imagine being charged with anything. This whole country needs to support this woman and every other women who go thru this. I marched 50 years ago for women's. rights.. Politicians are not doctors and should never act as if they are.       My heart goes out to you. I miscarried at about 14 weeks many years ago. Peter (my husband) cleaned up while I cried in the bathroom, and then held me while I cried some more. I had to go to the hospital for a D & C because I was bleeding profusely afterward. I'm so grateful that I was given compassionate care. I hope none of this nonsense spreads to Canada.

    My mom had two miscarriages in her life,…I had one at about 6-7 weeks pregnant. I didn’t even realize that it came out of me and into the toilet with lots of blood. I was able to deal with it at home, and I was actually surprised it happened. The state policing women this way is unacceptable. Vote them out!

She now has a happy , healthy, wanted baby boy. She lives in Tennessee. If it were to happen again today, I'm scared they would just sit there and watch her die.       If a fetus is not developed enough to be viable outside of the womb, it isn’t a baby. It’s not developed enough to be medically considered a person yet. Anything that passes during a miscarriage during this period is considered “medical waste”. Like a tumor or a dead organ that was removed from the body. There are regulations in place for disposal of these materials, but not because the materials themselves are sacred, it’s for safety in regards to the spread of disease, like any biological waste.
      After a fetus has developed enough to have been viable outside of the womb, but has died before labor has begun is considered a “stillbirth”. And this is also not medically considered a person- because it was never born and was never independently alive. A parent can emotionally or spiritually consider their stillborn or miscarried fetus their “baby”, which is their right to do, but in medical terms, a stillborn isn’t a corpse, it’s medical waste, particularly if the fetus has been dead long enough to begin decomposition.
      A corpse is the dead body of a person who has been born and independently alive outside of the womb. A fetus can be colloquially considered a corpse depending on its level of development, but there is a point where even colloquially, it doesn’t make sense to call a fetus a “corpse”, because it isn’t a person yet. At certain early stages, calling a fetus a corpse would be like calling an extracted teratoma a corpse. It’s dead human tissue, but that doesn’t mean it was ever a person.

I am of the opinion when any medical professional, a doctor, nurse etc. violate the hippa oath, they only lose their license to practice their medical profession rather than actual prosecution. The AMA would strike them off. It does not preclude medical practitioners from going to another country to continue in their chose field medicine. The nurse could lose her position in the hospital of course.

    I flushed my miscarriage because it happened on the toilet and was comparable to passing endometrium on a period. Flushing is normal. There would have to be something quite large to even consider retreival. Can you imagine the trauma of it all? I don't think we should judge.

I may not fully understand, but I do understand how I would feel if my wife and I lost our unborn baby and I can only imagine it would be multiple times worse.     It should be recognized this Mercy Hospital is part of a national Catholic Healthcare corporation. The clinics & hospitals have an administrative religious policy that selectively over-rides the human need for healthcares. These hospitals send women home to wait for a "natural" miscarriage. There is little or no medical care advice offered for either the pain, duration & drama of the doomed pregnancy or the medical complications of birth or discharge of the placenta) when a fetus has been found to have died. This medical negligence didn't start with present homicidal cruelty of the republican leadership in the state of Ohio. This is a longtime anti-woman policy of the Ohio Mercy health system.

      I had experience with a Catholic hospital in Ohio when my brother was dying and on hospice care. His actual doctor became very upset at what we were told and what was happening when her back was turned. I am so glad we had her to treat our brother with dignity and respect. Some of the hospital administrators and staff are rabid and horrible people in their misconstruction of "life" and what is required for care. And I say that as a Catholic myself. My heart goes out to this young woman. Condolences on the death of the baby she was carrying and the death of her dreams for a happy healthy baby; and best on getting through the torture chamber Ohio has become for women.

      I remember when abortion was a Catholic problem, not a protestant one. An ex-priest told me that abortion was a mortal sin in the catholic church because the unborn baby could be male, but the mother was only a woman. He could have just been bitter, but it does sound right.

      Texas has already proven that their bs claims of "exceptional circumstances" were always lies.
      This is about Christofascists starting their crusade to turn the USA into the Handmaids Tale. They will not stop at women's rights either.     There are MANY similar cases where women are being denied appropriate care that are not being publicized. Women are scared to come forward, and medical professionals can't. Sometimes, the only way women can get help is through a sympathetic doctor who helps, but the woman then can not talk about all the difficulties they had getting care because they risk exposing the doctor. We are already back to the back alleys... but now it's not just for abortions but for life-saving care. I live in a similar state, and my primary care doctor and I are on friendly terms and talked about the issue. She gave examples of similar cases where women are being denied appropriate care due to hospitals being scared to do what is right. For instance she had a patient that was showing signs of miscarriage. She tried to get her in to see an OB. All the OBs here are part of hospital systems. All the local OBs said the couldn't take her as a new patient since she was going to miscarry and would need a DNC. Their associated hospitals didn't want to get involved. My doctor said she was eventually able to find a private OB in a neighboring state that would help her. Having to eait like that put her life at risk and increased the chances she could hemorrhage; become infected; and possibly never be able to have future children.
