      Yep, it definitely approaches the absolute nonsense that was the Dred Scott case. Where the Supreme Court decided to settle the issue forever and calm down the tensions between the north and south by finding that black people were not citizens and had no rights.

    This is heartbreaking. Millions of people being denied healthcare, and now this? Disgusting. Horrific. I'm in tears. All those people, having their lives and healthcare stupidly limited by horrible, uncaring politicians.

      When I lived abroad, the socialized medicine was being attacked by right wing politicians by stealing medical records to find immigrants illegally in the country. Immigrants, even legal ones, stopped going to the doctor and were dying in droves. So the doctors stopped taking personal information at the hospital if you weren’t a citizen. I went in with an eye infection, and they never asked my name, age, birthday, etc… they just treated me and gave me hand written records of my medical condition for my own keeping.

      Indeed, wasn’t the Supreme Court decision that overturned Roe v Wade, saying that it is up to the states to decide? This looks like some states saying that they can decide for other states, that’s exactly opposite of the Supreme Court decision. Oh, and Massachusetts was the first state to pass “medical safe harbor” laws, saying that any medical procedure that happens in Massachusetts doesn’t get shared anywhere else legally.

    I'm in Canada and I fear for when these states start looking to other countries to provide those records. Where is the right to medical privacy. What about mental health records, what about basic health care records. Where does this stop? I'm so very sorry for the citizens that are watching their rights and privacy eroded a little bit more every day.

      Well, if your country's healthcare data security/healthcare privacy is robust enough, it simply won't be possible to share medical records without the patient's consent. Certainly in the UK it would breach a few laws and we simply would not do it. Though give our rotten Tory Government enough time and they may come up with a workaround .... 😢

      If the ruling goes that way (fingers crossed) it is easy to foresee the next move: A travel ban for fertile women. Starting with children under 18 to prevent them from getting healthcare most of the voters don't understand.

      What happened to that privacy thing that,every time one goes to a doctors office, there's papers that you sign specifying just who can have your medical information? One cannot even go into a hospital and ask if certain people are there,because they'll be told that information can't be given out unless the patient has okayed it! I couldn't even get in to see my husband after his heart surgery unless I had a number the hospital gave me to allow me in! So how,besides a court document, are these attorneys general going to get this information? I smell some lawsuits arising from this! And I bet Vanderbilt Uni. Hospital will be the first ones getting sued over releasing private medical records!

    I've been trained in HIPAA of 1996 and i don't understand how TN (or others) have circumvented the federal statue involving medical privacy. how did they take these - or any - records at all baffles me, it's a clear violation. Federal supersedes State

    My concern with these "abortion bans" is the law actually says "women's reproductive care". Will that include tubal ligations, PAP tests, hysterectomy, what about an ectopic pregnancy (I had 2). This is so broadly written it leaves alot of unanswered questions and horrific possibilities

    This is a very dangerous direction that our country is heading into. Accessing someone's medical records against their will is a HIPPAA violation, but to use it against them legally is fascism, pure & simple.😢

      Giving them to AG from another state is illegal. You can request any ones records with a warrant if its part of a case investagation that has merit. You can select info from that request not all of it. But yeah if abortion was illegal you could ask for any and all records and they got cough them up. But its why no one does them once its illegal in that state lol. But in that state its legal and AG from another state has no grounds, unless they prove they paid for it there, and they drove over state lines to do it lol
      Its how it works if they want records and they need them a judge has to sign off and then hospital lawyer or law team has to agree with it or they can fight it, and some times it takes long as time but they can get records but only info that regaurds to the investigation deemed important by a judge they need to know. HIPPAA isn't magic if I pay a doctor for something shady, a judge can order them to hand over records of that shady thing. Just in this case there is no case. State laws don't apply in other states.
      If I have gun in my state legal no permit in many cases, I got to a state I need a permit I can't go "in az I don't need one!" No I get fined, and depending on state I can get back for a fee or whatever when I leave the state but you got pay for some speacilist transport of it and its not cheap and varies from state to state they got right just take it and not give it back. But they can supina my state for bill of sale of that gun, they can run serial number of course. Same deal just because I got permit in one state don't mean it works in another that needs it.
      Only thing that cross state lines really is your drivers license, but you cross that border you got obey all their laws and ignorance of them doesn't make you exempt either but a judge might take pitty on you and give you a warning same with a cop for some things. But 100% if this was a federal law thank god its not a fed could supina any hospital in the USA and might take a bit but legaly could get the info.

    What scares me more than the privacy issues (and that does scare me) is the fact they want to prosecute you for actions conducted out of state. This is not a slippery slope but the bottom of a deep canyon. They must believe that as a function of residency, they own you. Just as corporations tend to be legally created in a state that is not among the state the corporation does business in the people will set up a state that you can be a resident of. The small government party wants total control. Is there any precedent for a state to be able to prosecute one for out of state actions?

I know somebody that was going to buy a classic car drove from Massachusetts down to Tennessee, got pulled over by the Tennessee State troopers the decided to call dogs which they got to false alert to nothing because he had nothing. but it was their way to search his car they found his money 25k in cash and seized his money that he had on him to go buy a car. He had an enclosed empty car trailer on the back of his truck he was towing to go pick up this car and they still robbed him on the side of the highway for his money. he’s still fighting to get it back almost two years later.

    In 2022 elections, only 25% of voters age 18-25 showed up. Only 52% of registered voters overall showed up. So... thanks to nationwide apathy, here we are.       Only Oregon has a seamless system for mailing ballots to **all** eligible voters.
      Address the systems that are in place to disenfranchise voters, if you sincerely want to improve voter turnout.

      HIPAA laws are some of the strongest privacy laws in our country. Its not legal and anything that has to do with sharing of resources between states is under the purview of Federal Law.

    I work in cybersecurity for a large hospital, and have to deal with HIPAA regulations daily. I also can attest that MANY state government and law enforcement websites/ servers do not meet current cybersecurity standards. If any of these hospitals give any medical records to out-of-state law enforcement without the time-consuming process of due diligence, then they should be fined for HIPAA non-compliance.

      The server security features are irrelevant. The police have no jurisdiction to investigate/prosecute the "crime" of abortion occurring in another state so the hospitals should refuse to turn over patients' records because there is no threat to the life of the patient or another PERSON that would compel breaking confidentiality.

So why not go after people who travel out of state for guns, I’m sure plenty of those have been used in murders. And if you consider abortion murder, then I don’t see a difference. Because it’s not about preventing murder, it’s about controlling women’s bodies and cementing us as second class citizens, otherwise we’d have to take a hard look at the gun society and production in America. And we wouldn’t want that, otherwise we’d have to admit to some very hard truths and make massive changes in order to actually keep people alive in this country.

    I'd ask how we got here, where politicians can override medical professionals and doctor-patient privacy laws, but when you have insurance companies and pharmacists deciding if you have insurance coverage or can even have the medication prescribed by your doctor, here we are. Personally if some politician received access to my medical records, I'd get a lawyer and sue. A judge would have to explain to me how politicians can access my private records by enacting some legislation. My wife literally shattered her elbow and the doctor told her the state laws had just changed days earlier and he could no longer prescribe pain meds, she would need to take Tylenol and allergy pills to help sleep. Now in fairness to the doctor, he thought it was "a clean break", and not shattered, but you see my point. Just as politicians think everyone is an addict and lying to get pain killers, now they think everyone is trying to have abortions; in other words we are all breaking laws. SMH

    It makes no difference what state any of these medical procedures are performed. Anyone accessing someone's medical records other than the patient or their doctor is violating federal HIPAA regulations. There is no way the federal government is going to allow this. In fact if they actually do this in their own states, these attorney generals can be charged and put in federal prison. And they should be jailed.

    I run a logistics business that provides transportation to women from pro life states to pro choice states for these procedures. We have gotten a couple of letters from two states asking us for records, we have never cooperated and likely never will. This is a state issue, what one does outside of the state is none of their business.

    How do they circumvent the HIPPA laws? Any time you visit a Doctor the first time you sign a HIPPA form it covers privacy, security of records and a breach of notification rule. Biden needs to enforce those rules and prevent non medical people access to PHI.

    I am a Belgian. In Europe. My grandmother told so many stories about the second world war. She was head of the resistance in Antwerp. It has made our family very conscious of anything that could possibly lead to conflict. This kind of behavior has a strong smell of fascism. This is not conservative. Conservatives want to limit what government can do. This is pure fascism as a result of plain religious extremism being stuffed down the throats of all Americans. Even if you are not religious, the religious nuts' train of thought is that everyone should live according to their dogmas. This needs to be stopped for the world's sake. Not only for the USA. Stop it by making these politicians accountable by voting. Voting for those who respect the freedom of thought and respect people in general. You can do so much better America!       In the United Arab Emirates, prenatal care is only provided to women with marriage certificates dated before the conception. Women who weren't married at the time of conception are deported, and the men jailed! This is because their government is based around their religion.     How do they seize records from another jurisdiction?
    Why would they turn the records over?

    That move (of having access to medical records) would be illegal up here in Canada.
    This is horrific. I just can't understand how a normal person keeps voting for the GOP.
    I thought The Handmaid's Tale was...a tale.

      All of you eluding to the hand maids tales don’t realize how insulting it is to people/ women in real life who have real historical stories that aren’t fictional books or tv shows that you somehow don’t know about but you choose to use the example that doesn’t actually represent real people and is just a show…😅 please learn the stories of real survivors and reference those, please. It just feels sad and lazy and depressing as a survivor to see you all do this. Face real stories hold the complexity or shhhhh please 😅🙏🏾🥺

      @LafemmebearMusic Don’t let good become the enemy of perfect for you. The Handmaid’s Tale is a very well known book. If you want people to quote other books, then suggest those books for people to read. Phrasing that suggestion with something like the following will avoid putting people on the defensive for no reason, “If you want to see how far they’ve already gone in the past, check out this real life story…”

      Same across most of Europe. Especially in Germany it is no medical records of any kind for any authorities, unless there is a very well explained court order or you voluntarily (meaning you really have a choice and no negative effect in any way if you do not agree to do so) agree to a defined authority or institution to get insight.
      When it comes to medical records in our European General Data Privacy Rules, those are even considered especially sensitive data together with other things like gender for example. and companies can get hefty fines if even only storing such data without a good reason (which most don't have) or spreading auch information. In many cases except on voluntary base they are not even allowed to ask.

    My big question is how is this not a HIPAA violation? My immediate family can't see my medical records without my written permission so how can some government entity have access even my family cannot?
