    There is not one mention of presidential immunity in the Constitution. The Supreme Court is to decide if a law is Constitutional or not. There is no wiggle room here. Committing a crime is committing a crime whether a private citizen commits it or the president.

      Technically, the Constitution doesn't say that the Supreme Court decides if a law is constitutional. That comes from a SC case during the Madison presidency where the SC gave themselves the right to decide constitutionality.
      And yeag, committing a crime while doing something the president does is still a crime. E.G. if the president orders the DEA to kill the Saclers for illegally marketing Oxycontin, that would still be illegal even though the President can give orders to the DEA. According to John Roberts, the president could do that and not be punished for it.

    Maybe treating the court like a church for the past 200+ years wasn't a good idea if they can decide our laws and amendments do not mean what our laws and amendments are written as; Who'da thunk it? So long as the Supreme Court gets treated on a faith-based mentality, we have no set Constitution, and we have no set Laws. The Constitution does not grant them the last say on anything that Congress or the people are not in agreement with, and it's for a damn good reason.

They created a solid system, but they never thought so many would be so corrupt and do whatever it took to break our system.

That's no way to have a "living breathing document" evolve with time when excess time not reflective of each generation running out for people in government is seemingly the only way to get any change, and not through democracy. Either way, Supreme Court doesn't have the supreme powers it claims it does; Congress and the rest of government just keeps letting them get away with it as IF they did.

The world has changed so drastically since the days when the Constitution was written (and is a flawed document written by flawed humans), and as such sticking to it and not updating it to accommodate a world that has gone beyond the days of slavery and muskets is batshit insane.       the original immunity is sovereign immunity, the king can do what he wants, whenever he wants.
      when monarchies implemented parliaments that's when we got parliamentary immunity, to prevent said king from using the law as a weapon against them.
      today it's mostly a protection from malicious litigation, so that the time governments could spend on policy etc doesn't get taken up by lawsuits. there's also the aspect that while laws are good, there purpose of them is a stable society, sometime a government might have to break those to safeguard the country, like by assasinating Osama or others. That's when governments to something illegal, for which they probably should have some protection. Like how do you engage in spying and things of that nature if you can just be sued or arrested.
      There's further the idea in the us that you can't overrule the will of the people, who elected someone, through courts and instead have to rely on something that is also an expression of the will of the people, namely congress.

    LegalEagle Devon Stone did a video about the legal implications of the immunity ruling and it’s worse than I ever thought it could be. While the president is technically not immune to everything, he is effectively virtually immune to everything because of the way all of the parts interact. It’s frightening.

    One thing I think y'all need to consider is that the court will not evenly apply what counts as an official act to every president. I find it very likely that something deemed a crime and unofficial act by a democrat, would be ruled an official act by a Republican. I don't think this court would allow the rules its creating to be used fairly by each side. I think that's a big reason why most conversative aren't worried about Democrats abusing the rules they are creating.

      However, now a Democratic president can operate outside the Democratic Playbook whenever he or she chooses and change everything all together on a whim.
      The three branches of government are no more at this point. As of now, everything can be easily controlled by the US president. It still appears that we still have three branches of government but that is not really the case.

      In the UK, Parliament is sovereign so the UKSC cannot override government laws, but it can interpret them in a way that is constitutional (based on human rights legislation and fundamental constitutional principles such as the rule of law) so people can appeal decisions if it violates their constitutional rights, but the government cannot change the law.

    Americans keep saying that this will make Trump "a king". The King isn't above the law, in the UK, at least. That's what Magna Carta was about (although it's a bit more complicated than that).

      That's just standard American anti-monarchist fear-mongering. It's insane how king or emperor has become synonymous with dictator rather than a title like President or Prime Minister.     "Official acts" really is short for "official acts as president". Running for president happens in the capacity of a candidate, not a president. Even for a president campaigning for re-election. It's not an official duty to re-apply for President for a second term. That's a personal choice.

    I think it's both fair and necessary to point out that the rule of law has broken down under both parties. Executive orders have been increasingly circumventing Congress, admittedly for far more minor things.

      Executive orders are nowhere near stealing two lifetime justice seats. Then using them to undermine the peaceful transfer of power and declare the executive immune to nearly any prosecution surrounding these actions isn't anywhere near an executive order. To be fair..

      While yes the rule of law has diminished on both sides, the left is far from trying to execute a fascist takeover, as the right is currently and successfully doing. Biden is also a vegetable and has not been capable of knowing when he is doing wrong, IMO. Frankly, I think everything that was accomplished under Biden has been at the behest of his wife, his son and his advisors/handlers. Therefore I don't think it's fair to judge Biden the way a President in full control of his faculties would have. I don't think he's been aware of wrongdoing and is absent from executing his job properly, which is not the same as sustained and calculated effort on the right to take over and destroy Democracy, the United States and our system of government for unfettered power and greed and Christo-Fascism.
