Retired Law Enforcement here and a fellow BMW owner (2021 M440I). Sadly this happens all too often. Never accept a cashiers check and turn over car until the check officially clears. Many scammers out there (I have investigated quite a few in my career). The checks always looks legit - even to a bank employee at first glance. But ALWAYS wait until the check officially clears before releasing car. Hopefully the car can be recovered and not put on a container ship heading to Africa or the Middle East.
Did you not watch the video? He said he went to the bank and deposited it, and the cash CLEARED into his bank account. Then 3 days later the cash was removed from his account. How would you recommend avoiding that?
Would you just draw up a simple contract, wait for it to clear and then hand over the vehicle? Couldn’t the scam be pulled in the other direction, so how do you buy safely too?
the fact that the bank said it was good with out even checking the routing number. it wild. I think only a bank from the original maker of the cashier check can truely verify that a bank check is good. I hope you get this car back.
With a police report or detective calling, bmw can most likely track it via satnav or idrive system. If you do get it back I’d tow it in case they trashed the motor with something. At least tear it down again. Everything. Also, check for tracking devices like AirTags or similar…happened to a friend. Stolen recovery, they put tag in it and car jacked him next day. Best of lucks 🤙🏼
Hope there’s a positive update to this unfortunate situation. I never accept cashiers checks unless the car and title remain in my possession until the check has cleared.
He looks like a New Yorker. My car was stolen in july of 2023… wasnt found until 4 months later in Yonkers , NY. I bet you money its around that area right now being hidden somewhere. Its not on the rode that is for sure… I would imagine it being hidden for now until some time passes by for the local authorities to lay back a lil and not have so much heat on the car. Best of luck finding it Bryan.. nothing worse than being scammed/violated for the hard work you put into a passion and a career you made for yourself.
What a shame. So sorry Kies for what you’re going through. Must feel like a punch to the soul. I don’t get it. How can a bank cash a “cashiers check” then couple days later say “oh sry that was actually a fake cashiers check” How does that even happen?
The right thing to do with a cashiers check is to call the branch that issued the check to verify if it's legit. Usually the branch name is on the check. Unfortunately nowadays you can't trust anyone.
Hope you get the car back !! Nobody can be trusted , next time you sell a car hide a $25 AirTag in the car somewhere , then when all is good contact the buyer and tell him to remove it, My friends car was actually stolen and in his knapsack in the trunk he had an AirTag and he found it and got it back , he actually knew the guy 😮
In this day and age of social media, he knows he's already caught and just trying to buy time. You gave him a chance.Hope you fully prosecute. Hope you get that beauty back. We are with you Brian.
I scammed too 2 years ago I sold my 2011 e90 and a dude gave me fake money orders and I didn’t know. Filed a police report 12/22 and it was located in queens ny finally got it back last week after being missing for over a year.
What a stupid thing to try and get away with. Not only did they mess with the wrong shop but they messed with the wrong community that kies has built. Hopefully this gets resolved sooner than later and you come out on top💪🏼
Although far, it's not unlikely. I'm in Palm Beach county located in south east Florida. I'll share the video here and we'll be on the look out. Hope you get her back unscathed. Prayers your way 🙏.
That is so sad. So many opportunities to right a wrong and still no remorse. I hope you, Keith, are able to locate the car and pursue to the full extent allowed by law.
NJ has a nasty car theft ring. See posts on Bimmerpost constantly about M car thefts in that area. Some thought the individuals had a tie to dealerships and were cloning keys. They have been very savvy. This breaks my heart and I hope you can find justice and be made whole. Not sure why bad things happen to good people.
I work at a BMW dealer in central Jersey and our dealer is a main target of thefts. We’ve had armed robbers attempt to steal cars straight out of the wash bay (broad daylight, all of the techs were still at work) but failed. We’re now facing a problem of thieves following customers home and stealing their cars as soon as they get out of them. What they’re doing is really messed up
That's very true about NJ. Last year in August a good friend of mine had his very clean 180sx stolen. Another guy in the neighborhood I lived in, Jersey City, had his Lexus Rc-f stolen. From both accounts I was informed the police are no help and do very little to assist.
These banks... Please explain us how money can appear and then just disappear. Even without the whole bank thing, why do aniencent payment systems like checks still exist?
I suggest to everyone reading this to install an Apple AirTag as well as a Tile tracker in 2 separate, discrete locations inside your vehicles, that way if one tracker gets located, they’ll be less likely to look for the second. Apple AirTags will sometimes alert the person if it determines an unwanted AirTag is following them. Even when you sell your car, leave the trackers inside the vehicle and once a week or 2 passes and the sale turns out to be legit, you can text the new owner and let them know to discard the trackers. I got AirTags on my pets too, they work well and are very inexpensive. Sooo damn happy you recovered the car and hope there was no damage done😔🙏🏽
Bryan this might help you!!! Call BMW give them the Vin number ask to get the BMW connected drive subscription, and let them locate the car and they should give all the info to the Police that’s what we did when my brothers BMW was stolen! Do it it only takes 5min. All Modern Cars have built in GPS so before it’s too late and they remove the battery 🔋 do it.
I feel it for you guys. When I tried selling my STi, a lot of these sites tell you not to NOT to accept cashier's check, personal checks or even money orders. I was confused because I thought these could never be fake once a bank is involved.
Sorry Bryan. This is what makes people meet at the police station and someone to pay in cash. Crying shame. My wife is a banker and I cant tell you how many falsified account transactions that she tries to recover lost funds. More than likely you will not get the funds back. I hope at least you will get the car back that you graciously poured your sweat and tears in. Did the bank call the bank that the certified cashier check was made from? The teller or branch manager should had automatically flagged it, held it for ten days, or made a note on the processing portion into the system with it being over 10K, unless you had the 75K in your account already. I hate that you got scammed out of the money and the car. I hope you get either one back, but after watching this video, I think you would like to have the car back. Good luck with finding it. You might want to offer a reward for the person who screwed you and his whereabouts or where the car is..... Just a thought....
My tip to community: I've been flipping cars for a while now and people have offered cashier checks, wires, venmo, zelle, etc.. the only way to ever 100% safely do a transaction, especially talking about thousands of dollars, is cash. If buyer disagree with selling method just wait there will always be another. There are some escrow accounts you can do now but have never tried that route. Payment security is a HUGE problem that needs a solution and banks will never be liable..
I'm sorry this happened to you Bryan. I wish I was in the area. I would drive around for a bit to try and look for it too. This POS will be found and I hope you make a vid when it happens. Stay positive brother.
I sold a car recently and was worried about this exact same thing. I felt silly for even thinking that someone could scam me, but I guess it does actually happen. When I sold mine, a consultant at the bank randomly called me (just about investing that cash I just received from the car) and advised me to immediately transfer it into my savings account. I am not sure if his intention was to ensure me protection of my cash in case of a fraud like this, but I think that would be best practice if doing that will actually protect your money from being pulled back out by the bank. Kind of like if the cash was cleared, then technically you can immediately withdraw that money in cash and walk away. The bank can’t come after you after you pulled all that money in cash. Just thinking out loud here. Trying to find ways for all of us to sell a car safely.
Didn't you have a tracker on it ? Hate to hear this, but like many others here, isn't the bank taking any responsibility ? I feel bad for you, i would be on the lookout if i lived near you.
Yeah, nope... wire transfer is the only method of payment to agree upon when selling any valuable goods... especially the car of this caliber. Bank verifying it 4 days later only shows that releasing the car should have happened once that cleared the bank... I will go a step further and question if the bank is responsible for your loss...
A lot of high dollar BMWs are being stolen in the tri-state area. I have a friend that works at a local BMW dealer that has confirmed this. A lot of times the vehicle tracking systems are disabled within miles of the theft, and then end up at a port to be shipped overseas. Best of luck.
Never, EVER, take a cashier's check. If you absolutely must, wait a business week for the money to actually clear. When a cashier's check is deposited, the bank credits your account the money under the assumption that it's legit, but this check HAS NOT ACTUALLY YET BEEN TRANSFERRED FROM THE BUYER'S ACCOUNT. This is how the typical cashier's check scam works. If the check doesn't actually clear, that money is taken back to the bank that wrote the cashier's check. When taking a check for a large sale, always ask for a CERTIFIED check. What's the difference? Cashiers check draw upon the BANK that the cashier's check is from, NOT the buyer's account. So if buyer A gets a cashier's check from bank A, and gives it to bank B, bank B draws the money from bank A, and bank A then "refunds" itself from buyer A's account. This process obviously takes a bit. If bank A can't refund itself, the transaction is fraudulent, and the entire transaction is reversed. A certified check draws from the actual account - meaning what you see on the check has ALREADY been deducted from the underlying account, and it is essentially a stack of cash in a single piece of paper. Legit buyers won't really care about having to get a certified check, since the money is being given away anyhow. However, for thieves as mentioned in this video, they can't do that, since they obviously don't actually want money to change hands and likely don't even have that kind of balance in their account. So if you have a buyer who pushes back on giving you a certified check and insists on a cashier's check, walk away (and possibly notify the police that this person might be trying to steal from people).
Back when i worked in banking, i would have told you the ONLY way to determine if the check is good is to call the bank it's drawn on to verify it and cash it there. Otherwise people can still place a stop check on it. On the other hand, your bank clearly did nothing except deposit it, because the acct, routing and check number could have been verified with a call to the other bank. Likely, your teller thought that depositing the check without an automatic hold by the bank somehow meant it cleared.
This is the bank’s fault. I can tolerate both sides but given the details of the bank initially telling you, “looks great” then deposited the funds - yeah no. They should have done a more thorough search. Hey, though…I’m not a bank clerk nor do I sit on a board at any financial institution. So what do I know. I hope the vehicle is recovered!!!
this is on the bank. Yes John is of course to blame for bringing a bad check as well as still not turning over the car. But whole point of cerified check and going to the bank is to secure the funds before handing over the car.
Man! This is SICK!!! IMHO, the bank is at fault for not practicing due diligence to make sure the check was legit. Have you considered notifying Port Authority to be on the lookout for the M3 , just in case there’s an attempt to ship it to Dubai or some other overseas location. Good luck to you. You’ve got my support…
So sorry to hear about this , glad you got it back today , I’m getting ready to sell my BMW and this is what I’m scared of happening , is there any actual 100% safe legit method to sell your car privately and not get scammed ? Appreciate any tips or info you may have now in hindsight after your ordeal that can save one of us from experiencing the same possible situation
I had a check that was removed 10 days after it was deposited. It wasn't even pending anymore. Bank is protected so they are not liable. Their answer was pretty much, do business with reliable source. Luckily I didn't spend it or else then you owe the bank.
Trackers are a worthy item these days. Not apple air tags.. those are not enough, not everyone has an iphone and some times u dont have crucial time to wait for a Ping. The best thing to is a hidden wired in tracker with its own built in 10000mah batt along with a yearly data, call/sms sim card and set up the number.. itll ping wen u call it to ping on command
This is exactly what happened to my q50 3.0t right now it got stolen last month and insurance totaled it and now I’m waiting. You guys need Keyfob frequency cancellation
Lessons learned. Only do bank transfer or cash (do not release keys until cash is paid into the bank account). Cheques just offer too much room for fakes…… and it takes a while until the cheques are cleared too. Not the banks fault, the checks only happen in the background and the deposit in your account is provisional…. I hope you get the car back, it is a dream car to many of us and certainly to you!!
This is so wrong and I am sorry you have to go through this 😢 in my opinion the bank you dealt with also has to take accountability with this recovery process.
One thing the community has learned by this, is make sure the money clears if they are using a cashiers check, before you give them the car. I’m so sorry guys that’s devastating.
Nah the bank got some explaining to do
That's the bank's fault!!!
Wouldn't this be the banks fault for not verifying it properly?
This is insane.
Retired Law Enforcement here and a fellow BMW owner (2021 M440I). Sadly this happens all too often. Never accept a cashiers check and turn over car until the check officially clears. He said the money was already deposited into his account
But what's stopping the seller from running away with the money? I think an escrow service might be the only way to be fully safe
Did you not watch the video? He said he went to the bank and deposited it, and the cash CLEARED into his bank account. Then 3 days later the cash was removed from his account. How would you recommend avoiding that?
Yeah but he said that this check actually cleared then later on issues appeared
Would you just draw up a simple contract, wait for it to clear and then hand over the vehicle? Couldn’t the scam be pulled in the other direction, so how do you buy safely too?
Hope you get this sorted soon Bryan! You’ve done so much for this community, it hurts to see this happen to you man.
damn… can’t imagine the insurance payout being anywhere close to what it’s worth
the fact that the bank said it was good with out even checking the routing number. it wild. I think only a bank from the original maker of the cashier check can truely verify that a bank check is good. I hope you get this car back.

That is 100% on the bank. They checked it and cleaned it. The BANK it responsible.
Wow, so sorry to hear man. Sharing this now on M3List and I'll make a post too.
How was the cash even deposited into your account if the routing/account numbers were fake?! This is entirely the bank’s fault
This is horrible! I remember when I sold you this car at my dealership in Chattanooga. I hope you are able to track it down!
Bank screwed you over with that cheque... Hope you get the car back man. Great creators like y'all don't deserve this!
I'm in Virginia, I'll make sure to keep an eye out, very sad seeing this happen to a fellow bmw enthusiast.
Hope there’s a positive update to this unfortunate situation. I never accept cashiers checks unless the car and title remain in my possession until the check has cleared.
Watch the Short

I don’t get it. How can a bank cash a “cashiers check” then couple days later say “oh sry that was actually a fake cashiers check”
How does that even happen?
They were probably trying to buy time so they could sell asap. Hope you guys get it back. That thang was special
Sorry to hear mate, too many scumbags out there.
So sorry, Bryan! What a horrible ordeal. Hope it is resolved quickly in your favor.
Bummer, eapecially to someone that least deserves this happening to them. Doing everything I can to help you out brother.
No it's a beamer
Just saw your shorts video. So happy for you to find it back! I hope in a decent state. Pretty emotional for all of us. Take care Brian!

What a stupid thing to try and get away with. Not only did they mess with the wrong shop but they messed with the wrong community that kies has built. Hopefully this gets resolved sooner than later and you come out on top💪🏼
Can’t wait to see the follow up to this video when you visit him in jail.
Together with the bank.
BMW community lets rally together and find this car!!!!
Although far, it's not unlikely. I'm in Palm Beach county located in south east Florida. I'll share the video here and we'll be on the look out. Hope you get her back unscathed. Prayers your way 🙏.
So sorry to hear that!... All kinds of people out there. Hope you recover the BMW, wishing for the best.
The bank should be held responsible!
That is so sad. So many opportunities to right a wrong and still no remorse. I hope you, Keith, are able to locate the car and pursue to the full extent allowed by law.
Congratulations. Very lucky to get the car back.

BMWs are very popular in the NY area

You dont 4even need a dealership to do that these days

Oh so with an AirTag, they’ll definitely know I have a tracker?

actually, he is right! The car does have in built in GPS and BMW could track it down.
This is why these days I rather take an L sell it to a dealership 🤷♂️ to avoid this. I have notice this is getting common in private sales.
Only accept cash
Why is no one accepting cash nowadays 😂😂
That sucks dude. Hopefully you get your car back soon!
I wish you all the luck to get your car back, stay strong brother
I'm sorry, why are you not suing the bank? Cashiers check is prepared by the bank. No way this makes sense
I'm so sorry about your car. I loved that thing! Praying you get it back and it's unharmed.
Sick world man. Sorry Bryan. Hopefully it's found.
I feel it for you guys. When I tried selling my STi, a lot of these sites tell you not to NOT to accept cashier's check, personal checks or even money orders.
I was confused because I thought these could never be fake once a bank is involved.
The fact his face is on camera it's only a matter of time before the car community finds exactly where he lives.
That’s why I put AirTags in my cars
That person shows up with a bank check im telling him to cash it and hand it over.
I hate that you got scammed out of the money and the car. I hope you get either one back, but after watching this video, I think you would like to have the car back. Good luck with finding it. Until you get handed a wad of counterfeit 100s.
I'm sorry this happened to you Bryan. I wish I was in the area. I would drive around for a bit to try and look for it too. This POS will be found and I hope you make a vid when it happens. Stay positive brother.

Good point. I wonder if theyy would be able to take it out of a Savings if you had moved it over quickly.

Wires solve all those issues sorry to hear that hope justice is served
im in Virginia ill keep an eye out shouldn't be hard to miss with that Ferrari red still sorry to hear this happened though
Def some issues with the bank. Can you post the update video of what happened because now it says the car has been retrieved.
Bro now that you have the case back I think it’s a sign to keep the thing. Thank God you got it back
Are we going to get an update video????
Hope you get your car back.

That's crazy. Hope you get your ride back. I used to lived close by exit 7. Best of luck from Boston. I'll keep an eye out
No way 😢😢 it Hurst hope u find it so much time on it
Exit 7 in Bordentown, glad you recovered the vehicle🙏🏽
For everyone who dont know, they posted on there instagram that the car was found thank god

This happen to me I sold my m4 and I was literally in the same situation that kies was in
yes. take cash or go to the bank with the buyer. meet somewhere public, bring a friend.
Just make sure the cheque clears before handing the keys over
Wow the grace y'all gave dude😮
Bryan I'm so sorry. Prayers and luck to you getting the car back. B~
So how was it retrieved?
I had a check that was removed 10 days after it was deposited. It wasn't even pending anymore. Bank is protected so they are not liable. Their answer was pretty much, do business with reliable source. Luckily I didn't spend it or else then you owe the bank.
I’ve had more scrutiny from banks over a $1000 cashiers check let alone $75k!!
Why did you just call BMW they can track the Car in seconds. The only way to disable bmw tracking to to remove antenna and module.
This is exactly what happened to my q50 3.0t right now it got stolen last month and insurance totaled it and now I’m waiting. You guys need Keyfob frequency cancellation
Sorry to hear that Brian. Hope you'll get car back.
I really wish you guys the best. My deepest condolences 😮
Always go to buyers bank and have them get a check in person.
Dang man. That's a horrible situation to be in. I'm not from your area but best of luck with your search. I hope you guys get the car back.
wish you the best of luck mate, sorry to hear. Cheers!
What a horrible thing and feeling! I hope it works out!
One thing the community has learned by this, is make sure the money clears if they are using a cashiers check, before you give them the car. I’m so sorry guys that’s devastating.
I hope you get it back! I hate scammers!
This is crazy. Sorry this happened to Brian. I hope you get the car back.
So what's the story!? Don't leave us hanging! Tell us how it was found.
Those last few words hit hard.. this car built up your brand, blood, sweat, tears. And put it up for sale.. If found it is an obvious keep.
I’m in New Jersey. I will keep an eye out. I’m located in Newark New Jersey.
It's already retrieved.
