    The ATF came to my house because I was accused of trafficking guns to the cartel. they couldn't have been more wrong. Alcohol, Tobacco, Firearms. ATF is a corrupt unconstitutional organization that has way too much power in our country.

      I completely agree I go out of my way to follow every law that I am aware of as I understand them. I'm not willing to bet my freedom or my life that I am 100% correct as it's possible that there is some rule I'm unaware of or a recent change that I missed in the news.

      it depends on the unit itself. a regular unit yes they will go after you in any way shape or form.
      these guys seem to be on heavy duty, going after basically highest level of offenders in their field. they dont crap around with that.
      they simpyl have bigger fish to fry and a different focus and different orders.
      and it make sense. you cant have your unit that is supposed to go after the big guys overload with the crap they put on regular people.

    I vehemently disagree with your allowance to let the ATF...or any law enforcement...search your domicile without a warrant. They were on a fishing expedition, and if you were at ALL in violation of Federal law regarding firearms, your permission to search without a warrant would go against you in court. They have to ID to a judge what they're looking for to get a search warrant. If they had probable cause, they'd have a search warrant. Since they didn't have a warrant, they had nothing...no probable cause. If you let them search without a warrant, anything they find is admissible in court.
    You don't have to prove anything. Under the 4th Amendment, the ATF has to prove everything to get a search warrant. If this doesn't develop further, you go very lucky. I'd call this an example of what NOT to do.

      @@dragonf1092 The exclusionary rule doesn't apply when you give permission. Only in rare circumstances, if you can prove duress, or persuasion under color of aurhority. The exclusionary rule is more useful in instances of search incident to arrest, or a Terry stop. A judge would likely find, especially since permission was given, that anything found is admissible.

    The ATF came to my house and wanted to ask questions. I told them to talk to my lawyer and they &^$#ed off. Then sent me a cease and desist order that contained too many lies to count. I guess that made them feel better about not being able to do anything worse. DO NOT TALK TO THEM. DO NOT INVITE THEM IN.

      They are not friends. They will never help you. This is the best advice anyone can give. That, and to have an attorney or sub to a firearm legal protection group. No matter how well you feel you have insulated yourself, the ATF is masterful at creating new offenses, even for lawful firearm owners.

    My law enforcement friend almost had felonies because a fellow officer would plant drugs during traffic stops.
    Dude would let the backup officer on scene “search” the car to be the dupe that found it.

    I've been a police officer for almost 10 years. If I came home from work and there was the ATF at my house, you bet your ass the only word that would come out of my mouth is "lawyer". It is unethical and illegal for law enforcement to coerce someone with the good ol' "Sign this consent form or we'll come back with a warrant" fable. If they had probable cause to obtain a warrant, they would have. They bluffed by making it a big Hollywood Production and you fell for it. If you are an innocent, law abiding citizen and you are reading this, please know your rights and respectfully assert them and invoke them if you ever find yourself in a situation like this. Be respectful and courteous, but most importantly be an American.
    P.S., if you're a criminal dirtbag providing guns to the cartel, ignore the previous paragraph. Law enforcement is your friend, tell them everything.

    I can understand why you decided not to send the agents away to get a warrant, but I highly recommend that others request a warrant and a lawyer. You may think you're good and not breaking any laws, but there are always ways for them to find some technicality to pin on you. I really wouldn't be shocked if they come back for another visit now that they've cataloged your armory.

    First, the fact that they LET you put your kid inside isn't an indication of how cool they were, it's an indication that they had NO CHOICE because you weren't detained or arrested. Standard practice dictates that if you have the ability to arrest a suspect you do so when you have the advantage. Allowing you to go into your home swings the advantage into your favor because if you were who they thought you were you could have loaded up your firearms and blasted the shit out of the front side of your house. That would be STUPID, but the point is, if they had the option to arrest you THEY WOULD HAVE.
    Secondly, You should have let them go get the warrant and immediately contacted your lawyer and SHUT YOUR FACE HOLE. Your agreement to comply with their requests is founded on a basis of the trustworthiness of the government, IN ERROR. In my personal opinion you should never have spoken to them without your lawyer present. You should never have surrendered your 4th Amendment rights. You should have FORCED them to conduct their investigation in accordance with the same federal laws to which you are held. Do you really think that after those months of investigation and evidence they compiled against you that they would have shown up at your door ASKING to look at your collection if they actually had sufficient evidence to obtain a warrant? Non-Sense! If they did, you would have arrived to your home invaded by the ATF and all your shit being bagged and tagged.
    Third, They always argue from thier perspective that if you don't comply it makes you "look guilty," but that's an LEO tactic to scare you into complying so they can continue thier dead ended investigation. You DO have things to hide. Not because they're illegal, but because it's YOUR RIGHT to remain FREE from this type of invasion of your PRIVACY. You could also argue that refusing to comply makes you look like a private citizen who wants his privacy respected. If you standing on your right to be FREE of this type of bull-crap makes you "look guilty" to them, then so be it. Tell them, thier sloppy investigation of you makes THEM look lazy and INEPT.
    Fourth, When you waived your 4th amendment right, you legally opened yourself up to prosecution at the whim of the AIC. I hope and pray that this is the end of your ordeal, but I fear that it is not. Telling yourself that you have "nothing to hide" as a way to capitulate on your constitutional rights is a cop out for standing on your God endowed rights. Solely from a legal argument, you made a HUGE mistake. Once you waive your 4th, everything they find as evidence against you is no longer challengeable in a court of law because you AGREED to it. If you haven't contacted a lawyer and started discussing options with them, do it now. If you have cash, keep it somewhere other than your house and bank accounts. Make a retainer payment right now before they come and confiscate it all and you're left with no ability to pay for legal counsel.

      You have to think like a cop. That type of behavior is exactly what gives them the idea you have something to hide. If you're innocent, they expect full cooperation and anything less makes them suspicious. If he didn't comply, they would've came with a warrant and seized everything. Costing him years of litigation and possibly hundreds of thousands in legal fees. Letting them in put the issue to bed and they left realizing they got it wrong. I'd say it was the right move.

      @John Stevenson as someone who has been on the other side of the law I can tell you that not my experience at all. They were already completely convinced he was guilty. He even said they couldn't come in and they threatened a search warrant if he didn't comply. He ended up complying and he was let go. Sounds like standing up for his rights didn't really work out here.

      If they’re investigating you for trafficking firearms, it’s because you’ve made numerous purchases from an FFL or multiple FFLs in a short period of time. They will probably tell you that when they arrive and begin questioning you. They are going to have a list of firearms you purchased through the FFLs, they are required to give that information to them in an investigation. There is no technicality if they say you’re illegally selling firearms and you can show them any firearm that they think you have sold from their list. If that’s not the reason they’re there, then no, don’t let them in without a warrant and your lawyer present.

    I'm fuzzy on the specifics, but I remember someone facing something similar where the feds were looking for specific serial numbers that were purchased within a certain timeframe. As the guy had never sold any of his acquisitions, he still had them - so, he asked for the serial numbers they were looking for, told them to wait a moment and he would bring them out to show them that he still had them. At no time did he allow them into his home, which was well within his rights in the absence of a search warrant. They saw, and noted that the firearms they then witnessed that were in his possession were the ones in question . . . and left. The issue I have in this situation is that they now know exactly what he has; and at some point, some - or all - of those firearms could be made illegal to own . . . and they know exactly where to find them in his neighborhood. Truthfully, I feel the same way he does about being law-abiding and honest and upfront with law enforcement; I'm pro-LEO . . . but I'm also not a fool to believe that every human being dressed as an LEO is good, moral, and just - so it behooves one to err on the side of skepticism sometimes, unfortunately.

    I wasn’t going to comment, but I decided to anyway. Not all government agencies are out to get you. I live in a small town where strangers are just friends you haven’t met. If a car gets stuck in snow, people with trucks and tractors will come over and pull you out, and won’t take a penny for doing it. Not speaking to an officer if you get pulled over would be a huge mistake. If you’re not paying attention to your speed, just say so. I have been pulled over several times but haven’t received a ticket since Bill Clinton was president. I want to abolish the ATF, but not all of them are jackbooted thugs. Warrants are a joke. Sometimes it’s not even a magistrate who signs them. A person with absolutely no law degree can sign one in their absence. You 100% did the right thing by letting them come in and explaining everything. You aren’t dealing with a raid, seizures and trying to get your property back. A little respect will get you a long, long ways. Not every government agent is out to ruin your life.

    So if you did nothing wrong, nothing illegal, how did they have you pinned down ?, and why would your first thought be you were getting arrested at first glance ?, especially if they had nothing on you. Father is retired boarder patrol, you know what the going rate is for what specific firearms, point out one specific rifle in general, you're giving them more then enough reason to make a follow up visit with a warrant and screw you over anyway, I think a lawyer might say the same. In 2005, when Katrina hit, LEO's along with federal agents swept across the effected area and confiscated firearms from home owners who stayed to protect themselves, and what the storm didn't take. One of those instances happened in front of a film crew interviewing an elderly woman inside her home, I don't think her, or Katrina, was under investigation for possibly smuggling arms to the cartels.
    Why would you plug your company, on a video you're making about your experience with the ATF ?, I don't think people are going to want to seek your services, let alone seek employment, if they could possibly end up getting visits from ATF, for simply one or the other aforementioned reasons.
    Surprised you didn't include video footage of them at your place aswell, I'd find it hard to believe you don't have camera's posted up around the place, especially with all that you got going on. Have to admit, I understand why people think there's a weird smell in the air.

Listing zero restrictions in a document that oaths are taken upon and then adding restrictions totally voids everything written in it if that makes any sense. I agree that I can and probably did just state my opinion that will draw lots of criticism to me but I’m wanting nothing more and nothing less that what is stated in our amendments and that goes for all of them not just the second.

    Here's the deal. This goes to you and to any young weapons owners. If they had the ability and actual need to get a warrant, they would have. This story is great. He let them in and they left. All it took was one thing slightly out of place to turn this story down a dark alley. Do no ever let law enforcement into your home without a warrant, without first consulting a lawyer. It may seem innocuous, but it is giving them the confidence to force people to let them violate your rights. Had he said no, sure they may have just gone and got a warrant, but more likely that would have not happened. This is a tactic they use when all they have is circumstantial and no ability to get a warrant. Remember, if we don't use our rights, we will lose them. They feel comfortable doing this because people like this who allow them to. If no one ever let's them in without a warrant, they will stop this intimidation tactic. That's what this is. Come with a lot of cops and guns, threaten the target, and get the target to contemplate the worth of demanding their rights. If you this we will this. This will do this to your life. You will have to take time to do this. These are threats. Only used when they know they don't have the authority to force you. I understand it's inconvenient to stand up to a tyrant but shame on you for giving up your power to the atf though in glad it worked out for you, you set the rights of the American citizen back and broadened the power of the atf. They intimidated you into letting them violate your rights through fear tactics. That's shameful.

    As people mentioned below, never talk to or answer questions to any law enforcement agency without an attorney. Do not assist in their investigation. I read something a few months ago that said even if they have a warrant and they want you to unlock a gun safe do not do it. Yeah they'll destroy the safe but as the article said it shows compliance and if something happens later in court say you sued they can use your compliance against you.

    Glad it worked out for you. It looks like they were going after cartel members. As other have alluded to, they still could come back. Remember when police are working a case, they like to elicit friendly conversation and look for things that they can use. Do not go buddy with them. You did not specifically mention what the red flags were, but multiple gun purchases of pistols will get their attention I know. I can remember years ago someone that smelled like a fed offering to sell me a gun or two. One time he claimed he knew some anticommunist slavic people that had a MP44 for sale. This was in the Chicago area. I truly had no interest in owning something like that due to the illegality and gave an absolute NO!.
    It also depends on what you are buying. I doubt that high end weatherby and german bolt action rifles along with expensive english double barrels rifles and shotguns would elicit any interest from them.
    I have been buying for 60 yrs and i doubt that all of it put together would reach anywhere near $40k that you spent in a year. I know people that have collection that are in excess of a million dollars, but like most people the value of mine is quite meager. One fellow has a machined cut out demonstration of a C96 mauser pistol that was on that WWII famous train carrying the mauser museum collection that got seized by the brits and then raided by american officers looking for souvenirs-loot.
    Unfortunately you seem to live in a border area or at least an area where some cartel guns originate. It has been a year since I last filled out a 4473 for anything. I also have not sold a gun in a very long time. You can get flagged for selling if a criminal ends up being arrested with one.
    Also when an agent tells you to just bury anything you have, he may be fishing. It could the ATF office in the metro DC area tells them that they better charge someone or else.
