    The ATF didn't say you would be a felon after 120 days. They said you are a felon NOW, and they want you to send them a picture of your felony, along with your fingerprints, name, and address. THINK ABOUT IT!

      Haynes vs US (SCOTUS 1968): a person that can't pass a background check cannot be required to register, nor can they be punished for failing to register. It's a FIFTH amendment thing: you cannot be compelled to testify against yourself or punished for not doing so. They can still get you for having the thing, but they gotta find out about it in the same way they would have if registration didn't exist.

      It’s a “forbearance”. You technically owe it, but they are opting to not collect it. This is because they can’t “waive” it, as you pointed out. At least that is how it was explained to me.

      They somehow forgot that they signed off on millions of Federal Excise Tax payments for pistols, and are now fraudulently trying to use ex post facto (illegal) to reclassify those FETs from manufacturers.
      Then they violated FOPA with this silly abortion, which is thumbing their noses at Congress, but they weren't done yet.
      They figured they could just pretend that SCOTUS didn't recently determine the Bruen vs EPA case, which guts their ability to change rules on matters of this magnitude.
      They also concocted this low IQ monstrosity as if the 2nd, 4th, 9th, and 10th Amendments don't exist as well, then threatened NFA penalties on non-NFA items.
      That's another tax code violation on top of FET, because they accepted pistol FETs for 11 years and are now arbitrarily trying to ex post facto millions of FETs into NFA tax code.
      They're literally in violation of CFR 26 for Manufacturer's excise taxes, and in violation of the NFA taxation provisions by arbitrarily declaring millions of articles that they accepted FETs on as NFA items, after these items have been transferred legally under CFR 26 for 11 years.
      What kind of effing retards concocted this 293 page ruling? Whoever they are, anyone trying to implement this is in violation of the above laundry list of USC, CFR, Bill of Rights, FOPA, and SCOTUS actual laws, not made-up ATF, "see what we can get away with" rulings.

    If you sue the ATF all the time, why aren't you suing over the unconstitutionality of the entire NFA? It's no different than a poll tax for owning firearms of certain types. Closing the registry for transferrable machineguns in '86 meant that I was prohibited from making my own by the fact that I was 11 years old at the time. My rights were stolen from me before I could ever exercise them.

    First of all, it shouldn't be 88 Days. It shouldn't even be 88 micro seconds! But.. when that deadline does hit without a decision, it should be an AUTOMATIC APPROVAL!
    We, the people, are innocent until PROVEN guilty and the onus is on the Government to prove we can not have ANY weapon!

    🤯 Goes deeper than I originally thought. Was unaware of the 88 open automatic denial. Here I was thinking it was free registration and automatic approval. Damn shame I lost my stuff a few yrs back in a house fire.

      i understand completely. i lost every firearm i owned in a deep sea fishing trip. it was a real shame. i brought them along so me and my buddies could clean them while we fished but then a few big waves came about and tossed them and myself overboard. it was either swim to safety or risk losing my life to save my firearms. still regret it to this day.....

    GOA did not "uncover" this flaw. It was profoundly obvious the second the rule was published by anyone with a seventh grade education. Don't take the $200 bait. If you want to comply, remove brace, file for SBR stamp, pay $200, don't admit to crime.

    Honestly, I think they know EXACTLY what they were doing with this rule. It's a temporary trap to get as many SBR's out of the us as possible, and maybe aiming to make them not "Common use" if EVERYONE registered, like what they are hoping for.

      A lawsuit against BATFE would be a civil action. Not criminal. After years and tens of thousands of your fiat dollars you finally get your jury trial. The jury is unanimous 8-0 in your favor. You won ! So you think. The .gov appeals your "win". They make use of a manipulative legal wording in their appeal to the judge. The .gov judge sides with his fellow employees of the government. He throws out the jury verdict !
      He throws out your "winning" verdict on a bullshit technicality. You appeal. The government judges on your appeal rule for guess what ? The "losing" government defendant ! You are screwed !
      You cannot afford to continue to fight the scum of government. The .gov "wins" again !
      How do you think "government" wins 97% of all jury trials. Just look where the judge's paycheck comes from.
      The Amerikan judicial system is corrupt. Simple. No matter how righteous you are in challenging .gov you are not part of the government cabal. Your jury "win" becomes meaningless. The scum of government will continue with their illegal actions. It will continue to be .gov business as usual. Your righteous lawsuit was for naught.

      It would be a jury trial in federal court. Possibly out of state, in which you will be away from your sources of income. All while being forced to spend tens, if not hundreds of thousands of dollars for your defense. All while they have a blank check to make sure you pay the price for standing up against the government.
      That's why it's key for the "big guys" like GOA to file law suits before it comes down to regular people being charged.

    It's long past time for a massive class action lawsuit against the ATF, arguing that Congress never had any authority to create this agency, and cannot have conferred rule making authority to it, because congress itself did not, and does not, have the authority to make those same rules.
    Arguably, they do not have the authority to amend the 2nd amendment.
    If they could, they would have done it by now.

      No "arguably" about it - Congress doesn't have the power to amend the 2nd just by passing a law. The process for amending the Constitution is spelled out, and has to be ratified by 2/3s of the states. Unfortunately neither the NFA nor the GCA have been held by courts to be, in themselves, unconstitutional - yet. It needs to happen.

      @@rogercole5054they won’t do it because they are too corrupt. Just look at the Heller decision. It ain’t as great as everyone says. Scalia blatantly made crap up in his opinion that was NOT based on the text, history, or tradition. He was NOT an originalist.

      Forget lawsuits. They're a colossal waste of time and money in front of judges and juries who mostly couldn't care less about the issue, the people it affects or the laws it violates. We need a cleansing, a Constitutional purge to remove the infection from every legislative body in this country. That means recognizing all the people who repeatedly infringes on both natural and lawful rights as traitors. Only when they understand that we will not tolerate their frivolous disregard and disrespect for our rights, and that such treatment will be regarded as treason, will they begin to back off.
      Of course, their followers will scream and rant because they're too blind to realize that they're being taken for fools. The one thing they either don't realize or don't care about is the fact that most of their followers share their view on disarmament and will be unarmed, giving us the advantage in a fight because we will show up armed with every weapon we can carry. Both sides will suffer casualties in this encounter, but they will by far suffer greater losses.
      The thing they're most banking on is our reluctance to kill our own countrymen, so we have to be resolved to recognize them as a threat but remember that they've been utterly brainwashed and thus rendered blind to any possibilities outside of what their masters have shown them and incapable of recognizing that their masters' goals are the threat and not those who oppose them.

    I just submitted a form-1 prior to this "rule" with electronic fingerprints and got it back is 10 days, approved.

    They already started doing this with form 1 suppressors.
    They want all kinds of incriminating information to file a form 1 for a suppressor! Been this way for a year now!
