    What USPS envelope to use in sending my documents and what size is the self addressed enveloped with stamped?

    For my situation, it's going to be 4-6 weeks since that I have sent my documents for the Advisory opinion to the State Department, but since then there is no update. The main thing is that I have been provided with the CASE Number.
    Can someone tell me how to get the Case Number for my Advisory opinion? Is it automatically generated?? Or how to obtain Case Number??
    Any help/guidance will be highly appreciated. Thanks

    Im a J1 student, what happen if I stay in the USA as an undocumented person and my passport (visa) says: IS NOT SUBJECT TO SECTION 212(E), TWO YEAR RULE DOES NOT APPLY?
    What can I do in that case to be a legal person in USA?

      In order to maintain legal status in the U.S. you must abide by all the rules and regulations of your visa. This includes departing the U.S. before the end of your 30 day grace period (as a J-1 visa holder). The 212e rule doesn't have anything to do with overstaying a visa. Good luck!

    Hi,
    I am subject to 212e rule on my DS2019 form but on my visa I am not subject to 212e rule. I am going to start my exchange program 2023 spring. Can I apply for advisory opinion while I am still in India? Because when I am trying to fill the advisory opinion the online form is asking me to entry start date of your program but my start date is Jan 11th 2023. When I enter that it is not allowing me. Please advice

      Hello. It's best to request an advisory opinion once you have started your program and you're already in the U.S. That's probably why you're getting an error message. Good luck!

The USPS tracking ID indicates delivery, but the status hasn't been updated to reflect acknowledgment. Could you guide me on reaching a live agent for updates on my Advisory Opinion?

      Hello. Wait times can take several months for an advisory opinion, so please note this is normal. You should be able to check the status of the request online or email the DOS advisory opinion unit. Good luck!

      Yes i got my advisory opinion i send my documents on 2nd april and got my decision on 19 th of june ​@tasveerahmad5002

    I applied for an advisory opinion 3 months ago but until now I didn’t get any feedback :( what should I do? Is it always like that or is it normal?

    Hi, thanks for the information!
    I have a question. My husband, a J-1 holder from country X, is subject to the 212e rule according to his DS2019 and visa stamp. He has applied for/received his visa in a third country (Germany), where he spent the last 4 years and did his PhD. Should he still apply for the Advisory Opinion? And in case he needs to wave the 2-year requirement, which country X or Germany should provide a No Objection Letter?

      Hello. It sounds like he is subject to 212e since both of his documents are stating this. However, if he wants to check and request an Advisory Opinion, he's certainly able to do so. There are several factors which tie into which country he'll need the No Objection letter from. Good luck!

    Do we need to submit the application fee for advisory opinion. I know there is a $120, but not sure it is for advisory opinion or for waiver application. When I generated a packet for advisory opinion, it says I cannot check application status until the fee (money order) and application is dispatched.

    Hello, thank you for this video. just one question
    If my DS-2019 and my passport has the 212e rule print but my sponsor just gave me 7 months and He didnt want to extend my visa. Could I request for an Advisor Opinion to find the possibility they remove this rule because for 7 months I cant go back during 2 years to the U.S ? This agency deceived me.

      Hello. An advisory opinion will only tell you if you're subject the the 212e rule or not. It will not change it because of the duration of your program. The length of your program doesn't affect the 212e decision. Good luck!

    Hi my ds2019 does not have a waiver but my visa has a waiver so I had my attorney to send advisory opinion. I know you said its ideally to wait for 4- 6 weeks however they are more than 4-6 weeks so how long do I wait for them?

      @@moldirsmagilayeva4961 I did get my advisory opinion and it took 4 months for them to reply. Weirdly I got the 2 years rule applied. So I did the no objection statement. Now I have to wait for 12 - 16 weeks.

    Hi there!
    Both my J1 sticker and DS2019 say that " Bearer is not subject to 212e". However, if I understood correctly as an Indian I might fall in the skill list country category. Could you please suggest how to be sure about this? Or I can safely assume that I won't need waiver in future?

      Hello. If both of your documents state you aren't subject to 212e but you are an Indian national with a skill on the skills list, you should get an advisory opinion to be sure. They will review your documents and give you a definitive answer.

      No, you only need the advisory opinion if you want to get one. If both of your documents state you aren't subject, you shouldn't be subject to the rule.

      Thank you, I hear you say that for an advisory opinion, one needs to send their passport, In the instructiuon it says a copy of the EV passport, Isnt htis just a photocopy of the Visa Stamp? Because if it were to get lost, then I will be stuck in the country.

    Hi, My wife is J-1 and the Visa officer did not check 212(e) on her Ds-2019. Later she was subject to 212(e). I am J-2, and the visa officer checked that I am not subject to 212(2). Later I was also subject to 212(e) based on my wife's visa. should we apply for advisory since this information is contradictory?

      It sounds like you both are subject to 212(e) but if you want a final answer you should request an advisory opinion.

    Hello, both my visa and ds2019 says Im subject to 212e. I just filed for an advisory opinion since I am not government funded nor skilled worker. I

      If both of your documents state that you are subject to the rule, you probably are. You should wait for the Advisory Opinion to come back. If you are and want to stay in the U.S. upon completion of your current J-1 program, you will need to file a J-1 waiver. Good luck!

    Have a question, on my first DS 2019 it says that I’m under the 212 e but not in the others
    It also says ally in my visa
    I think I shouldn’t be subject of this rule because I came here as an aupair
    Do u think I should do the advisory opinion? Or just the waiver?
