Hello Dr. Singh, I got a form I-7979C , notice of action letter saying that my form was submitted with an extra remittance that is not required to process my application and the payment has been returned to m with the notice. I didn’t get any money in the mail but I had filled the right amount 700 dollars for eb2 .
However the previous day I had also received a document from USCIS saying they application was received and money received I am confused. Please guide me on what this means

There is no online platform. You have to mail your petition.

You do not need a job, but the chances of getting a green card increases significantly if you have a job or an offer.

I have double MBA and a job offer from an American company. Is it wise to apply for EB2 NIW? Or just go for EB2 skilled worker?
Yes. PhD is not required.
NIW is mainly for STEM, so better to go for skilled workers. If you have a job offer, you might want to get to US and try other categories depending on what your employer suggests.

I think you should contact a lawyer. There are ways by which you don't have to go back.
Are we supposed to do credential evaluation for our education outside US.
From Pakistan
If you have it, attach it. Otherwise you can wait. They will ask for it if they need it. More important is to provide evidence that you have the degree. Attach university verified/attested certificates.

I am senior software engineer from Canada, Am I elgibile to apply for I-140 from Canada? If No, Can I apply after I start working for US employer? If yes, How long do I have to work for that employer to be elgible to apply for this status?
You can apply from canada. You can also wait till you get to US. If you are sure of coming to US, I would suggest to wait. The wait time will depend on which visa you come to US.

I did my Ph.d from China and I have degree varification from World Education Service (WES) Canada. Do I need a separate verification for US or that would be enough ? Do I need verification of degree before applying for i-140?
WES is accepted in the US. You can send the current evaluation. If they need a new one, they will ask you for it.
My wife need filling the I-140 too?
You only need one application. She would be a dependent.

Thanks for sharing in detail but have question. I have explored more than 20-25 universities, and most of them mention that if your degree is not from a U.S. institution, you need to translate it and send it for evaluation. Is it really necessary to translate the transcript and make it equivalent to a U.S. degree? In Pakistan, the GPA system is out of 4.0, so why are they still asking for this?

Hello Dr. Singh, I sent my petition and according to the UPS tracking number, I see that it was delivered. In the application, I added the form to allow me get messages after it is received but I have not received any messages that they received my application. After how long after USCIS receiving the application do they send a message
It takes a few days for the application to get into the system. If you sent a check, you can track the bank account to see if they have deducted the money. That is generally a better way to see if they started working on your application. Once you have an application number assigned, then you will get email. Good luck. Let me know how it goes.

Hello Vijay. I really appreciate your kindness, wonderful nature, and generosity. I read your petition letter, and I have a question regarding the language used. Although you are the petitioner yourself, the wording gives the impression that someone else is writing on your behalf. For instance, instead of saying "Dr. John Doe is an assistant professor," shouldn't it be "I am an assistant professor"? what would be the best way to proceed?
I used the third person to keep it formal. You can use first person if you like.

The e-notification form is the form you put in your petition so that you can get an notification when the petition reaches USCIS. The whole petition has to be sent.
Is form ETA-750B mandatory if no job offer or working professional in the case of EB1-A?

Currently, I have not applied for any jobs or postdoc positions in the U.S.. In which category would I be eligible to apply for a visa? EB 1 or EB 2? And what is the difference between the two? What about the waiting periods? Kindly guide.

Dear Dr Vijay, its was very informative. Thank you for that. Could you kindly tell me how to write the address if you are applying from outside the US, becasue when you are writing mailing address on the I-140 Part 1 section 3, it does not take state address and country outside US, you cannot change it. (Ref 3e and 3i).
Leave the state and zipcode part empty (3e and 3f) and use province and postal code options 3g, 3h.

Depending on the path you choose, if you have bachelors degree and 5 year of experience that would work too.
