    These camera's are a financial trap for authority, they are disgraceful, hidden away in trees and bushes, I was flashed in a 30 mile zone for doing 31 😡, which I wasn't aware as I was more concentrating on the road and pedestrians being careful, and not on the speedo. The amount of money we are CONNED out of for these is criminal.

      @Lancashirelad I used to work at a motor auctions so have also driven most of those myself, apart from a HGV, I gotto a 7 and half ton when I moved homes myself, but my husband was a heavy goods driver, so I will still disagree and they are all a ruddy con!!

    i got caught by a speed camera and sent back the form when it came though. surrey promptly lost it and sent me a letter telling me to fill it in again. i said no and they said they would see me in court. that was ten years ago and i and still awaiting my summons.

      @Richard Fox no still drive at the speed appropriate to the conditions not the posted speed.
      so i'm the guy doing 15 past a school as the kids kick out and 3 mph in the supermarket carpark. or bombing down the A3 at 80. because why not is good weather and 3am. or running down a country road with a 60 speed limit. at 30 because its to dangerous to go faster and the only reason the road is posted 60. is because some twat in the planning department couldn't be bothered to think and wanted to knock off and go down the pub.
      the road i got flashed on was the hogs back outside guilford. a wide, straight and open duel carriageway with no off's or on's on that part of the road. it was a bright sunny day with no wind and i was at most going 10 mph over the speed limit.
      speed cameras are just a lazy way to look like you are doing something and make a shed load of money at the same time. what we should have is lots of oldbill in unmarked cars and teens band from driving cars that can go faster that 40mph. we could also do with banning drink drivers for life and make everyone take a driving test every year.

      @Richard Fox your being very presumptuous in your judgment of me. you assume i would drive at 30mph in a built up area and then go on to vilify me for that. thats just silly wooly thinking and directly contradicted by my own statement to you. but it is allowing you to take the morale high ground. so making yourself feel good. why do that are you just trolling? if so you are not very good at it son.
      if you are, as you assert, a member of an organisation attempting to get the 30mph zones changed. what organisation is it please. also what is your connection with it? or is it just a lie to make you feel good?
      also why, again, if you genuinely are involved in a campaign to reduce speeds posted incorrectly by planers. do you go on in your second paragraph to holed planers up as a standard to be judged against? {quote :- "The problem with people like yourself who think you are a better judge of what speed is appropriate than planners"}. this seem a very inconsistent line of thought to me. or is it just that you are looking to take the high ground on the point by siding with "authority".
      if you had gone though my response to you carefully. you would have noted that i gave ample examples of my reasoning and m.o. when driving. this you have clearly have omitted in your consideration of your response to me. why? did my reasonable approach to driving not fit your narrow narrative? did you need to omit it so you could admonish me and so by pump your low self esteem a bit more?

      @@tommyfred6180 for me it's a lot about using common sense. There are some areas around London that are now 20mph zones that used to be 30, and 20mph is just too slow. Frankly some of them could be 40 zones.
      I agree with what you are saying and I honestly think people are just a sucker for rules. If a sign says 20 they will not go more than 20 under any circumstance, even if the road is wide and clear. Obviously you should slow down if you see speed camerad and police cars, but for me that's only to avoid the inconvenience of getting done for speeding, not out of respect for the rules

      Dont be complacent , in Australia they got a computer to sort out unpaid driving offences people got speeding fines from ten years ago , cant believe it's legal dont know end of story

    Ask for proof of camera accuracy, certification of officer taking speed details if by an unmarked car, also certification of speedometer. If a handheld unit same as car only handheld unit not speedo. If a roadside camera then ask for certification of it working that time and day, ask for certification of officer conducting test, also certification of equipment used to enable test of camera with certification of officer involved with testing.
    It has saved me on three occasions when they replied with on this occasion we feel it is in the public interest not to pursue this matter. I didn't ask why.

    If the first time you realise you have been caught speeding is by your insurance going up and some points, that would also mean that you never received a NIP, and summons.

    Firstly you don't go to a magistrates court for a trial where speeding is concerned, it's a hearing. Secondly you have the "right" to remain silent, it's the first thing a copper tells you when cautioning you. Thirdly you are innocent until "proven" guilty, so if you exercise your right to remain silent and the police have no proof of who was driving at the time of the incident, how can they find you guilty? I have used the right to remain silent defence in this situation and the case never went to court and I never received any points nor fines. On the subject of fines, I would like to point out that the Bill of Rights 1689 states under Grants and Forfeitures " All promises of fines and forfeitures by particular persons before conviction are illegal and void" Therefore if you haven't been found guilty of a crime (convicted) then the fine is illegal and void. That is why none of the fines issued for covid are valid. People only pay them out of ignorance of their rights and the fear of the consequences of non payment.

      This argument has run out of courts to go to - so don't waste your time on that track. Right of Silence is only for proper criminal and even that has been watered down in recent years. If you do try it on make sure you fill and send the form in as Daniel says you commit an offence by not returning the form - send it recorded. These camera scams are run by civilians not real traffic cops they are bloodsuckers and will twist what you say and what you do and do not send in.

      Correct me if I'm wrong but isn't the owner of the car responsible for letting anyone else drive his car? Therefore the owner gets fined regardless

      @@aisjdoaidf1490 No. Everyone is responsible for their own actions. Lending someone your car is not a crime in the same way lending someone your kitchen knives is not a crime. Both can result in criminal activity but those crimes are the responsibility of the one committing them, not the one who owns them.

    It's the statutory declaration thing that I have difficulty in filling out.. I found 6 points on my license one day and called the courts and accused them of fraudulent activity as I did not receive any correspondence but was fined £800 and given 6 points. I don't see why I should be the one running around and doing admin

    All great advice, but if you're not sure you committed the offence ASK FOR THE PICTURE. The last NIP I received was for a completely different vehicle. The Police's excuse was someone probably "GUESSED" the license plate incorrectly..?

    I never received my first letter, when the second letter came through with a court summons over the speeding offence, I went to court and explained I never received the first letter, they accepted that and that was the end of it. No speeding offence, points or fine.

    My wife went on the course, she was told she was the slowest speeder they had ever had, she accelerated to 35 mph then pulled into a bus stop to let an ambulance go past. they all thought it the course was a harsh punishment.

      They were just being nice. 35 is the standard speed at which the cameras will be set at a 30 speed limit. So it's very common to end up on a speed awareness course for doing this speed

      @@_Mentat Actually I think you will find it is the blue light vehicle that has the exception to traffic laws not other vehicles around them. Trying to use that excuse for the speeding here would likely have the same results as when people have tried to contest red light tickets where they have moved slightly over the stop line to use the buffer space before hitting the junction proper to make a gap for the emergency vehicle to proceed through and that went poorly.

      I know a man who moved through a red light to let a ambulance pass he got a summons and got banned since that I wont let a blue lighter vercle bully me on the road I do same speed and dont panic there is no protection for normal vercles they dont see it as helping out it's just another fine to hand out to us stupid tax payers I'm sorry that your wife was helpfull and nice now shes been punished she will think twice sadly like others who have been fined

    My advice is to carefully check the Notice of Intended prosecution and Section 172 notice. My paperwork alleged I was driving a car I’ve never owned in place I could not have been. At the time of the offence I was in the air between Amsterdam and home. You’ll not be surprised that there was no box to tick to say that I had never owned this vehicle.

    I did a speed awareness course a couple of years back for doing 57 in a 50, The guys running the course said the cameras were set higher than say 10/15 years ago as common sense appears to be applied much more.. I had no issue with the awareness course for being 7 over.

      @@nweikee I Was done on a Tuesday morning. got the notification on the Friday and was allowed to choose a date to do the course. It was three and a half hours when i did it 830/12

    I always found Section 172 to be curious.
    The cornerstone of the British Justice system is the right to remain silent, yet here we have a demand to provide information as to the identity of the driver.
    But....as the Justice system allows me to remain silent, surely no offence is committed if I do not respond.
    Thoughts?

      You have the right to remain silent yes, but when you get a legal document through the post asking for information then you can still pick up a pen and fill it out while holding your silence.

      @@jacko717 so regardless of the crime if we all stay silent then it didn't happen? I think the problem isn't the justice system it's people not accepting responsibility for their actions. Evidence does not lie and you would have to speak at some point, now I'm not too sure about what happens if you choose to stay silent but it's not advisable. They have a picture/video of your vehicle soooo either way an offence was committed, what that form is for is to find out if it was you or someone else.

      @@cavemanfury3155 I'm not sure what you're struggling with here. The cornerstone of the British Justice system is "you have the right to remain silent." The burden of proof lies with the accuser, not the accused. Or if you prefer- your innocence is automatically established, your guilt must be proved. Section 172 states- "Where the driver of a vehicle is alleged to be guilty of an offence to which this section applies-
      a) the person keeping the vehicle shall give such information as to the identity of the driver."
      Also- "a person who fails to comply with a requirement under subsection (2) above shall be guilty of an offence." But as we both know, you have the right to remain silent. You do not have to say anything. Your guilt has to be proved. Clear enough? It's not about taking responsibility for your actions (which I fully advocate.) The issue you have is with the legislation, not other peoples virtue, or perceived lack of.

    1:00 "Make sure that you respond to these letters as soon as possible..." Well, because there are various time limits in play, you maximise your chance of running the clock out if you respond to these letters as LATE as legally possible...
    ... and, points expire three years from the time the offense was committed - so if you take it to court that court date might be 8 months later, and you get your points back 8 months "earlier" than if you were faster in replying.

      Prove you were somewhere else. You could also prove that your car couldn't have been the one in the picture if you prove that it was somewhere else at the time the cloned car was caught. -Not a lawyer

      My work colleague tried using his own CCTV footage from his home & car, but it was thrown out because he had master authority that allowed him to change dates and times on the system. He works nights so his car is home normally. The fine was not a problem it’s the points. It’s never happened since

      You are required to name yourself as the driver. You may still plead not guilty. However, even being required to provide the prosecution with evidence violates natural justice. They should get their own evidence.

      @@normalwisdom4048 No, it's not an 'old law'. It is still the first thing the Police say when you're arrested... "You do not have to say anything...". It is impossible to make someone speak if they don't want to. Further, it is for the prosecution to prove your guilt - a static photo does not prove speeding.

    Form a limited company and register and insure cars your family or business staff use - companies can't get points just fines. Show due diligence when assisting the police with their investigations into who was driving or if the car was not using false plates etc.

    I was 8 miles over the speed limit which was 50mph on the motorway fined £100.00 do a course £85.00 . A total rip off con . They should at first just caution you don't do it again and let you off but no . You can not remove human error . They just want your money . They don't care.

    Question: we were sent 2 speeding fines for the same location, same car, 2 different times , 1 fine was for 8am the other was 5pm. Speed limit was 40mph. Morning fine was caught at 52mph (my partners fine) evening was 55mph (my fine) my partner received a speed awareness course but I was not given the chance for a speed awareness course just 3 points and a fine. I find this unfair and unjust. I have taken it to court. What is your opinion of my chances of me receiving the same punishment

      You were possibly over the threshold for the speed awareness course, or have you done one in the last 3 years? Anyway (a) nobody has the right to be offered a course and (b) the court don't offer the course you will get the fine and points plus court costs so you'll end up paying more.

    There's a nasty hidden camera behind bushes at the end of a dual carriageway on a steep hill in Wiltshire. You have to speed a little to overtake slow lorries and to complete the manoeuvre. It is placed there on purpose to generate money. Fine, have cameras in towns, etc, not in the middle of the countryside.

      @@SNORKYMEDIA Because it's a dual carriageway going up the hill with no central reservation. You have to speed up to do the move and the camera is at the end to catch everyone. They knew exactly what they were doing placing the camera there.

    How do we know that the speed measurement was accurate? How do I know if my speedometer was functioning properly? I find this whole speed trap thing pretty bogus. Drivers should never be summoned for speed; they should instead be prosecuted for possible reckless driving, which can be easily determined from a video recording.

      @Richard Fox Fact is if one sticks to the speed limit on the speedo, real life will be lower and thus fine/points avoided. However, what of the ridiculous nature of the speed limits themselves?..to not question or challenge and just follow like good little sheep is exactly why the lawmaker WE put in to place, use our hard earned tax money to pay themselves to pass laws which in turn use more of our hard earned tax money to prosecture us lol..oh the irony…daylight robbery. So Mr Fox, its refreshing to see that you pay for the lunches and travel expenses and obvious living expenses of the people that have instilled such fear in you! Happy living mate

      @Richard Fox That is fairly typical for a modern digital one as their variance tends to be around +/- 1-1.5 mph depending on the model so they typically calibrate them to read half that interval high. This way your true speed is likely to be somewhere between 0 and 3 mph lower than what is displayed even if you happen to get a particularly low reading unit it should never show lower than true in theory. Naturally this is to protect the driver from the fact that relying a false low reading can get you into trouble but a false high reading wont as nobody is going to get prosecuted for doing 27 in a 30 for example.

      Agreed. Australia is the same. It’s the governments that enforce this and the police just carry it out.
      Speeds on many roads have been reduced here, most roads now post 10 kmhr less than several years ago.
      Of course they say it’s for your safety but we all know it’s revenue raising.

    You say that there is no point making a stat dec to plead guilty due to increased costs, however surely in most cases it would be worthwhile for the credit for guilty plea, opportunity to mitigate, and in some cases an accurate indication of means to calculate a fine, which is based upon national average in absence.

    The prosecution is expected to prove your guilt. Static photos do not prove anything related to speed (unless 2 or 4 wheels are off the tarmac of course). Further, the accused has a right to view the up-to-date service records and celebration records of the cameras used. In my experience, when this request for evidence is made, the matter quietly 'goes away'. Hmmm 🤔

      The formula for speed is speed = distance ÷ time so as long as the secondary markings are on the road your speed can be worked out from a picture.

      @@NoBody-gf8ie I would agree, however, the cases I've dealt with only had one image - therr were no second 'timed' images showing the car in a different location. When the Police were asked for the 'service records' of the camera they used and its most recent 'calibration records', they went silent and no further action occurred. Very suspicious.

      @@IanMcFerran possible, I know all camera van ultralite 2000 cameras are tested twice a day and then sent away for an official service with certificate of calibration once a year. Would love to know why the cases went cold though as this would usually not deter most forces and evidence would be provided by the camera technician in court.

If you get to court and argue common law confidently and competently, I hear they do not like it because they know that the system is rocky in terms of legality and you take control.     Here in Texas they had to take these red light cameras down. It is said you have to have a policeman at the place of the speeding.
    Some people were putting big black trash bags over the cameras.

    Nearly got run off the road today, and then flashed when I went for the gap between the kerb and another motorist. I would've been caught in a collision if I hit the brakes, and the engine was up to rpm to get me out of the closing gap. I accelerated and got flashed immediately when passing the gap. I then gestured a sincere wtf was that at the driver who then decided to tailgate me (on a motorbike) a long way up the road. My bike isn't registered to my current address and life is in shambles with family in and out of hospital. I need this case to be dropped otherwise I'll be forced into a worse situation. I hope I don't receive any points..

    Excellent. So what about if you are targeted by non-Police persons supposedly acting for the local Council and using speeds guns? I was slowing to the speed limit recently and was hit by persons in yellow high vis jackets (civilians) using a speed gun. I later received a letter advising me of the capture and that details would be kept for the next 12 months. Any further violation would result in possible prosecution! I thought only authorised Police Officers or in the case of Airside areas of an Airport, Airfield Operations Officers could target you for speeding ?

      To answer your question based on 100% fact police officers do indeed use speed guns but all police forces across the country employ police staff (civilians) to man and operate the speed camera's and present evidence in court if needed. While on duty these camera technicians are classed as policing support officers so trying to obstruct then in their duties is now an offence and publishable by receiving a fine.

They wrote to me, so I wrote back and told the chief constable that the old boys hand was shaking around with what looked like the onset of Parkinson’s, and that unless they can prove the speed wasn’t affected by movement, they can get stuffed.       They have recognised parking exemptions issued by the local authorities so they’re not parked illegally but even if they didn’t have exemptions the location of where the vehicle is parked is not a defence to speeding.

    I got one from the state of Maryland back in 2017, never paid it. Why? It was sent with the wrong first name. Second, there’s no points assessed for such a “Civil Infraction” in the state of SC. It’s wasn’t issued by a bonafide law enforcement agency of the state of MD. It’s like getting g a parking ticket in Atlantic City, NJ or Philadelphia, PA; the civil infraction only goes against the license plate, which in SC has no tie to my actual DL number. Oh, sure I got a total of three letters from the state of Maryland, but ignored all three. Since then, I no longer have that vehicle or license plate. I’ve reregistered my new plate several times without a problem.

    I am an HGV driver and was accused of driving at 58 in a 50 although my vehicle has a limiter which only allows a top speed of 55!!! I had to swallow it and send off my license and fine as I couldn’t afford the court costs, I have now lost my license and I have to pay 20 quid for a replacement license, it’s all a complete con to get more money.

    I just been done for 57 in a 50 this was due to preventing an accident which would have closed the A1 off. And backed up traffic for miles when I put in a defence it was dismissed which I am disgusted at.
    As you said offered 100 plus 3 points an awareness course with no cost or duration and Not a single venue within 150 mile of me. Looks like I have to take the points or take unpaid holiday to attend plus the petrol and parking fees no doubt

      Get a solicitor immediately. It sounds like something CCTV and a specialist’s statement can help with. If you’re unable to pay for one, there are plenty conditional fee arrangement solicitors willing to take cases like yours (no win no fee).

    I got done maneuvering my bike at traffic lights, doing 34 in a 30. Didn't know there was camera there. Did speed awareness course. Total waste of time. Would be OK for thickos. Cost me £70. I was amazed how ignorant many are of signs and basic road survival. Everyone should have a year on a motorbike.

    Had a fault with my car one day last year lost all power and the speed camera picked up car handed the name of the driver over and the evidence that the car was faulty which they did say wasn't the driver fault but he still had to take a drivers awareness course even though they had the evidence from everyone I think it's stupid that they still treated the driver like it was his fault even though it wasn't they are just after to punish u even though there are times it wasn't there fault

    Simply don't speed cos speed cost lives should stop speed awareness course and hit the driver with points and fined

      I was 7mph over 40 on dual carriageway, I found the course useful and friendly, I drive more aware and slower now. I thought the paperwork that I had to fill in was extremely fomal for such a low end offence. Then on TV some moronic prick steels a car hit other cars and when caught the Police say come on buddy out of the car. l lost no pionts and my insurance stayed the same. a good out come.

      Some speeding convictions are really unfair. I know somebody who got done for doing 23mph (that's right a mere twenty three miles per hour). It was in a school zone with a 20mph limit but the "offence" took place late on a Sunday evening when there were obviously no school children around.

    This is incorrect: acts and statue law are only applicable/enforceable if BOTH parties agree (consent) to them, this is the reason that e.g. councils never go to court and get court appointed debt collectors for council tax, as they know they have no legal standing. This is what Black's dictionary says and it is right on the money. The UK is a common law country, thus acts and statue law only applies when you consent. Prove me wrong ... Don't reply, don't send anything back, don't consent. Register your car to a UK trust, this way you also avoid a letter addressed to an individual person (person = fiction of course) ...

      Although this is strictly speaking true, parliament has "assumed" the right to override common law so the forces of law and order will eventually take you to prison if you disagree with them for long enough. In the end, might is right.

    This guy should be telling how to mitigate the fine or get around not paying it: IE: asking when was the speed camera last calibrated, using what method . What if you said you were not going that speed?? What if you go to court???Instead what he is telling you is just common sense.

      When you receive a NIP it will normally have 2 or 3 options on it 1 take a speed awareness course (if eligible) 2 take 3 points and a fine or 3 go to court if you choose court you will be sent a copy of the calibration certificate, however you can ask for it at any point before you decide to what option to take, 99 times out of a 100 it will be calibrated.

    Register your car in some fake business at an address no one lives at then insure your car at an address different to your license job done.     I was fined for driving at 28 mph in a 30 limit , no way to prove it unfortunately at the time. They stated that I was driving at 35 mph. Bunch of crooks.

      They have to prove you was doing that speed … you don’t have to prove your innocence go to court, what your saying is they had no evidence so they would of thrown it out that’s without any lawyers/solicitors 🤷🏼‍♂️, with a lawyer/solicitor you can get away with most things theirs people driving about with more than 50 points on their licence it’s all about the money
