    Great video.
    I was caught doing 42 in a 30. I had missed the signs due to poor weather and i thought it was still a 50 zone. I admitted the offence and accepted £100 fine and 3 points, submitting my details online.
    3 months later I recieved a summons to court as i had allegedly failed to provide my details!
    They refunded my original fine took me to court and gave me £700 fine and 4 points!!
    Money spinning scheme and lies if you ask me.
    Anyone else had this happen to them?

      @andrewpawley3872 not surprised. Should've just ignored all correspondence. No contact no contract!
      Unless the police put your door in and physically arrest you. They only have 6 months from the alleged offence date to prosecute you. Otherwise it gets binned

    Great informative video thank you, wished this was around a year ago when I received my first speeding ticket in over 37 years of driving!
    I was doing 36 in a 30 where the allowance was 35 (+10% + 2mph). I travelled that road everyday to work and there would frequently be a mobile speed van but on this occasion it was set up on the other side of the junction (never seen it there before) so was uncertain if this was legal as the time from me coming round the corner to the van was much shorter.
    The prosecution letter said the camera was calibrated and everything was set up as required by law and so you take that as gospel but this video would no doubt have helped me check the facts.

    Thanks for this good advice and well overdue video, I had a few issues prior to viewing this with the Police 'Manned' camera alleging that I was doing 37mph in a supposed '30 mph zone? apparently, its a Dual carriageway, the well-known (signage prior to now removed) was actually 40 mph, however, according to them it is now '30 MPH' How is that even enforceable? it is just a money-making racket to entrap gullible motorists, surely they need to be held accountable.

      I too was issued NoIP for same thing, however I was doing 46mph on supposedly to be 40mph. Do you by any chance live in Morden and was travelling up towards St Helier hospital direction on the A297 St Helier Ave and I was done by traffic light camera at junction of Middleton Road?
      That dual carriage was 40mph they removed the sign sometime between Aug 2022 to May 2024 as shown on Google map. They removed the large 40mph circle sign with small rectangular sign with red background and white writing saying there is 'new 30mph speed limit in force' which can be missed because a tree branch is partially covering the signage.
      Also, I normally turn left at the traffic junction but this time went straight because other route had some road works which have extended my travelling time waiting the traffic.

      @@kbc138 yes i'm a local lad to that Area, it is very concerning that all manner of devious money making racketeering is underway,how can they even getaway with these fraudulent activities, i mean 'C'mon, a Dual Carriageway, no-one about,driving safely with due care, just trying to get on with life, and wallop, Noip and subsequent fines, then Baillifs with the Police turn up on my doorstep, neighbours looking very nervous thinking something truly horrific had taken place, what planet are we on now? People we all need to pool our resources and step in, The world needs to step in to save us all from the real Criminals,,,The Authorities/Govt's, deep state etc.

      @@shizzu5568 i knew of one particular instance where a cop Car had his sirens on and went up a 1 way street, the WRONG way, to an 'emergency' ?? no it turns out he went into a local chippy, save him the detour all around the area 🤔 i guess when their bellies rumble, its time to turn on the sirens and head over to an eatery .

    Speed limits do not necessarily require repeater signs! They are only used when a limit does not conform. Eg. 30 limits should always have street lighting. That's the main way to tell what the limit is. But many lit areas have other limits, 20,40 50,60. In those cases repeater signs are required to let you know it's NOT 30. Similarly, an unlit 30 limit would require repeater signs. You also failed to mention that camera vans can only operate on designated roads, ie those with fixed camera warning signs. If you return to the scen and nowhere on that road it's a sign, you can contest the charge. Signs are placed due to the human rights act.

    Hi.. I was sent 2 NIP's for driving at 24mph for 4 seconds and 2 seconds on a 20mph road.... Can this be appealed in court for dismissal under the 10%+2mph guidelines ??

    The law requires that you must nominate the driver. The law requires that you must not lie:
    *Who was driving?* _Dear chief constable; I HAVE NO RECOLLECTION OF DRIVING THE CAR ON THAT DATE - _*_BUT_*_ - I am prepared to admit it was me who was driving and pay the fine or attend the speed awareness course to dispose of the matter_ ....
    This gives the police a major problem: If they accept this and issue the fine, THEY are "perverting the course of justice" .... And they cannot say you wilfully didn't tell them who was driving!!! When the letters back and forth start: _Of course I would tell you who was driving if I knew - but as I have stated I HAVE NO RECOLLECTION OF DRIVING THE CAR ON THAT DATE but am prepared to admit it was me to dispose of the matter....
    Essentially if the police accept this, then they understand and accept that it may not have been you driving at all - so they can't, can they? So they then have to prove (without your admission) that you were driving when you go to court and tell the bench I HAVE NO RECOLLECTION OF DRIVING THE CAR ON THAT DATE - *BUT* - I have always been prepared to say it was me who was driving and pay the fine or attend the speed awareness course to dispose of the matter_ ....
    Do they convict and risk a miscarriage without other evidence? The "You must confess" has a large problem with this, doesn't it?

    If you don't sign the form that they send there has just been a case in Mold Wales then the court cannot act on the claim.

      The named person will simply be done for failing to furnish, of course the court can act on it. Not signing IS the case.

      The Court, Criminal Procedure Rules and CPIA dictate when (and in what circumstances) evidence should be served. It is essential to a fair trial process that evidence be served in a timely fashion to enable you to consider it, take advice on it and, if you wish, challenge it. The CPS consistently fails to comply with its statutory disclosure obligations or directions set by the court - presumably a result of underfunding and maladministration. As a defendant, you are entitled to challenge the admissibility of evidence that is served late. What are you supposed to do with 50 pages of evidence served one week prior to trial? Is it fair to allow the CPS to rely on evidence in these circumstances? Most courts would agree that it is not. Adjournments are not appropriate in these circumstances either.

    COMMON LAW - the Law of the Land means cause no loss or damage so what, don't accept this corporate piracy.
    You will though have to pay damages for the car and people hurt. It's why drivers need to start a non profit cheap insurance company.

    20mph school road very early on a sunday morning, how to avoid the worst if it was around 20mph over possibly less. Read about a good few of those situations.

    is it still an offence if you fill in the form with the drivers details but dont sign,i heard it is the law that you have to fill in driver details but you are not admitting it until you sign the form

      It depends on your existing points and how things go in court. It is not a definite ban.

      A long time ago I got one week for 79 in a 30!, but the rule was always : 30 over any limit is a ban consideration. I think it may be on percentages now, and if you are 50% over it’s considered. Sorry mate

      The NIP is an "offer to contract" if you don't sign and return you have not agreed to their contract! Everything this world revolves around contracts. The courts and police are Corporations, look up their DUNS number for proof. Corporations can only act on contracts. Its just business to them. Laws/Acts are Corporation rules only.

    Just remove any signs, take photographs of the scene, have them date verified eg by a notary and then ignore all letters for 6 months ...

      A very emotive and simplistic argument that only works where children are evidently at risk from an irresponsible driver. As anyone with a logical and rational brain knows most cameras are sited and/or operate at times where there is no such risk. As for your last comment, that's like me saying - People like you who demand authoritarian government are the lowest of the low. Do you really think the government are motivated by child safety?

    I would just say speeding slightly above the limit is not breaking Common Law, only statutory laws, so we dont have to pay them.

    even easier,,, just ask them what kind of contract is the road traffic act,, when and where was the contract established,, who is the executor, lastly who is the beneficiary of the said contract,, challenge every thing as you are not a slave, contract law is trade and commers, under the Uniform commercial code, learn it and use it , i win every time,,, good look to them who try.

    A 53 years of driving my advice is don't speed, the signs are not target numbers, you should always drive under the required speed,
    If in doubt if no signage stay at 28/29 mph, SPEED KILLS,

      No, if you ignore the nip then you’ll be prosecuted for failing to to furnish driver details, if you respond to the original nip and then ignore subsequent correspondence. It will then go to court and it will be in your absence.
