Adjustment of status is not a visa. K1 is a visa for fiances and if you are already married and outside of the U.S. then you can apply for an Immigrant visa which upon arrival to the U.S the greencard will be mailed. But if you enter the U.S on a non-immigrant visa (student or tourist etc) and then get married and decide to file while already in the U.S it is called adjustment of status and you get a greencard not a visa. It is also advised to be very careful about entering the U.S with a visa and having the intent to marry or immigrate as it can be seen as fraud. How quick someone gets approved has to do with a lot of luck, preparation and location. If you are located where there is a lot of immigrants in that state your local office might be backlogged. Some states there are people getting approved within 2 months. Where as there are others who were very prepared and no Request For Evidence and are waiting for a year or more. Quick approvals or case by case basis.

N you said it's better to be in the US to get your paper work done faster.. do u have to do the permit to work form since it takes months for that n your fiance visa will long be expired, which means you can just go ahead and do the adjustment?. About to embark on this process - I'm from the UK and the mrs is the US citizen petitioner. We got married in Canada (where I currently live) as you can't get married inside the US for a CR-1 visa. Of course, with us being married and still long-distance, we lack much of the typical evidence you'd want to provide (joint bank acc, joint utility bills etc.) We have thousands of photos of us and family/friends though, so we're hoping that's sufficient!
Just stack up as much info as you can! To be honest, you actually can just get married in the US wether it’s by the book or not, if you’re married you’re married and you can start the process inside the US which as we mentioned is easier. But your situation sounds a bit more complex, just stay positive and remember the end is closer every day that goes by.
Also if if do a spousal visa, is there a minimum marriAge timeline for filing? Even if you got married the same day?. Wondering so I can decide between the spousal visa n the k1.. I don't want to have to wait months on end for my partner to be able to work/drive...etc
I married to a US citizen and we file our I130 Sep 2023 it's been over a yr and still waiting to be approved Surprisingly, my brother in law got married a day b4 us, and within months, his I130 was approved Both husband's are US citizens and both wives are Caribbean citizens
That's very frustrating, what you have to remember is that these cases are sent all over the country, some go to better centers than others. Annoyingly it's a game of luck! A year deep though, a decision will come your way soon :)

It took something like 4 months from biometrics to actually getting approved for my Green Card and biometrics was the only in person thing I actually did, it’s not some sort of interview by the way, it’s literally processing.

If you go over the Esta visa timeline and are essentially “illegally” in the US, you can still get married and once you apply for adjustment of status it overrides your overstay. My lawyer advised not to go over it too much though and ideally not at all if possible.

I have to fill my greencard application this month, in my case, can I skip the form I 765 (because I already have a work permit, I was living legally already and I have my biometrics taken and my USCIS ACC already with all my information) and also Im not planning to leave the country soon so I don't need the advance parole either ( the travel permit, I also save $$675) , if I skip those 2 forms, it should be quicker I guess? haha

I tried to expedite my whole process unless your military, government or in the medical profession you can’t expedite. I might be wrong but I’d say this close to an election could be the cause of slow processing. Good luck though, it should come through soon

No, I’m pretty sure they’ll show up separately on your account, but I wouldn’t worry about wait times as they all go to different centers when done separately. It really is a frustrating waiting game.
I actually don’t think this will be an issue. If you want to keep your middle name, just add it, I’d definitely call a lawyer about that one though as I genuinely think USCIS find anything suspicious.

Hey! Are you referring to your case status being "actively reviewed" ? If so, it really varies depending on what is going on with the case, but I would say about 2 weeks to a month.

And on the visa bulletin shows the august month is processing the dates listed as june 15th so mine is prior to that cut of date. Since you are married to a US permanent resident, can take 2 to 4 years. Marrying a US citizen is much faster and they have priority over a US permanent resident

Oh sorry, I do think we mention that you can apply outside the US, but if your in, you stay in and if you’re out you stay out until there’s a decision on your case. I wouldn’t be too worried about delays, things can turn around quickly.

Btw the lawyer is basically just filling it for you and making sure you have the right things… they really don’t do anything crazy, like defend you in court… so 9K they’re trying to play you! Unfortunately this is a very delicate and grey area for a lot of people, hence why we made the video. But some lawyers will try take advantage of people due to the nature of the situation.

You should apply for everything at once! You can do it that way, but it’s just going to take longer!

When I come from the uk I don’t have my middle name on my visa and what happens if I added on my green card or on my marriage certificate?

Yep! We met in Greece on a cruise and then I spent a year traveling as a tourist until my visa ran out and I stayed in the country and got married
