    The ryujinx devs have said they aren’t going to change anything following the yuzu lawsuit. They didn’t make the same mistakes as the yuzu team so they don’t think they’re in danger. They didn’t do stupid crap like selling extra features with patreon subscriptions or bragging about newly released games playing perfectly.

      btw yuzu weren't selling any "extra features".
      EA was basically just a custom build that was built from the main branch + some unmerged work in progress pull requests.
      anyone could have taken the code, code for the wip stuff and merged it together.
      the only actual difference (except the stuff i described above) is convenience and a yellow icon.

      @Octo64 does it count as selling/paywalling if the "paid features" have open code are available to anyone who's willing to spend 5 minutes of free time to compile the emulator? There's absolutely zero reason to pay unless you genuinely want to *support* the project or don't know absolutely anything about c++ development
      or just wait a couple of weeks until the branch with the change you want is stable enough for mainline

      paywalling means that someone who doesn't pay DOESN'T get access to said features.
      if the only perk is "you don't need to put in the effort to merge something" then it's not a paywall, you're paying for convenience.
      the 2 biggest issues the Yuzu team made was #1, profit of Nintendo's name, this is always a big no, especially with Nintendo.
      and #2, they openly tell their users how to dump their games, yes it's legal, but the lawsuit argued that Yuzu was circumventing Nintendo's copy protection, which Yuzu didn't directly do that, but they were directly giving you instructions on how to dump your switch keys and the games itself, which is circumventing the copy protection.
      making copies of something for PERSONAL USAGE is completely legal, distributing it however is not legal.
      Ryujinx doesn't do anything of the sort, they don't advertise how to circumvent Nintendo's copy protection and fairly sure they don't have a Patreon either, which means Nintendo can't bring the argument of "Ryujinx is circumventing Nintendo's copy protection" they're not, YOU need to circumvent the copy protection for Ryujinx to work, regardless if you just download the keys somewhere+the rom, or if you do it yourself, that's on you.
      it's the same when the SM64 and the OOT PC port teams said that you need to bring your own LEGALLY obtained copy, this puts them in the clear since they don't tell you how to do it and are not encouraging piracy.

      Yuzu's devs with the Patreon were essentially piggybacking off of Nintendo Switch's brand recognition at a time when console was still in market - of course they were going to lose...

    Did we all just forget about Bleem? That was a commercial emulator for a then-current console and they won their court case against Sony. Why is the Yuzu/Nintendo situation different?

      Well the Yuzu developers apparently were selling copyright infringing game downloads. Bleem was not selling that, only a mechanism to play games on Dreamcast that required the original PS1 disc to play.

      Copyright infringement only happened on third party sites and software like discord. They were sharing rom on their Discord for "debugging". Nintendo tried to associate "1 million totk downloads" to Yuzu, because it already "ran" it.
      Which it did not... A third party mod made it work and after release of totk the emulator was able to boot totk without a need of such mods.
      Due to having money it gave Nintendo more ammo to file out a lawsuit. They tried to attack the method of decrypting roms and provided thirty party links as an infringement too. But history and others have shown it's a thin argument as best.
      They settled out of court because Tropical fruit LLC was liable for their Discord server. The rest is anecdotal or speculative as best.

    Here's a thing to notice about Harmen, if he wants to rant about his opinions, he will do so with his normal voice, which is high pitched and squeaky. if he wants to rant but with confidence, he will dawn the Mario hat. but if he is reporting on something that Nintendo did which he thinks is a personal win for him, he will dress up in ridiculous clothing like the leather jacket mixed with the Mario hat, and he will try to deepen his voice. he usually deepens his voice on his book promo bit only to devolve back to his squeaky voice. its truly mesmerizing to see a man like him take himself too seriously as in he believes he has a stake in Nintendo. like he's a co owner.

      Emulators are perfectly legal, and also perfectly ethical. There is nothing wrong with writing code, or using code, that happens to behave the same as other hardware or software. There is something illegal about using code that is actually copyrighted. This includes Roms, Disc images, and even bios images

      Same, I'm not a big fan of Nintendo personally, but I like to play retro games in their consoles by hacking the console. That's how I play in my DSi and my 2DS

      I made it my mission 5 years ago to collect every North American Nintendo console, and aside from hardware revisions (I'm only missing the NES toploader, the Wii mini, and the OG 2DS), I've done that.
      But, even with that, their's still a massive upside to emulation of the Switch hardware, and that's promoting competition. I'm not sure what happened, but Nintendo has become complacent in that they haven't cared for the past several hardware cycles about power.
      I've seen it on the Wii U, on the N64, and even on the SNES. When it comes to 3rd party games, they run like ass. Nintendo seems to think that just because they have the absolute power and wizardry to make impressive looking games on lower end hardware, then surely everyone else does too.
      I considered myself a fanboy (didn't know it was a bad term, really) back then, but I recognized their BS and their planned obsolescence, their disdain for a non-profit mental health charity, or the fact that they hate their customers. I saw Nintendo in the light, and I don't mean to sound like I had a religious awakening, but it really is similar to that.
      I do recognize that they make some absolute bangers when it comes to games, and their Directs are always fun to watch, but holy cow, they are terrible when it comes to their fanbase or the people that want to make games for their platforms.

    See, I tried to ride the line of piracy. As of recently I just don't care. These companies are awful and after what Nintendo did, I'm done supporting them. Proud pirate :)
    (Everything I don't emulate I buy on Steam. Even after they take something down you own it if you had if. If they change that, I'll pirate those too.)

      that said, id never pirate a game, cuz if it ain't worth buying, it ain't worth stealing! plus id love to just buy some games from retailers at a cheap price out of spite. its basically me saying "hey big corp! im buying a game i like from a third party dealer and not you cuz FRIK U!" pirating gets the message across too but i still respect the developers who make these older games enough to not steal them, newer games that i would never buy are both the exception and the rule as id rather send the big corp dog eggs in a bag than touch a bad game at all. i mean, i wouldn't understand pirating Modern Warfare III 2023 by infinity turd but pirating the dead space remake is understandable.
      and as long as yall leave indie developers alone, ill leave you alone about it

    Gabe Newell put it best. Piracy is a service issue. Putting measures in your games to prevent piracy will at best hold pirates off for a few months and at worst get more people to pirate your game because the anti-piracy makes legitimate copies worse.

    I'm from a country where emulation and piracy are the most common ways to experience entertainment that isn't normal television, so I know the benefits of piracy more than I should, if it weren't for piracy and emulation I wouldn't be a nintendo fan, neither would I enjoy videogames, because paying 2000 bucks on a console and 300 on a single game is absolutely fucking disgusting, I still pay for indie games, and don't pirate games that aren't for sale on steam, but still, emulation can be a great thing, these people are just crazy

    15:11 This isn't actually true. Xbox backcompat is pretty good, but it's limited, and it's actually not that good for OG Xbox. And as such, Xemu and Xenia are continuing development. Xenia in particular has made huge strides recently. It's now the better platform for RDR1 over RPCS3.

      A Nintendo fanboy is a person who defends and shills for Nintendo no matter how bad their business choices are. They have a bias in favor of Nintendo.
      A fan is a person who still likes Nintendo but is still critical of them and is not biased in their favor of Nintendo.
      Thats why Harman is called a fanboy. Its because he is biased in favor of Nintendo.

    Fun Fact: Emulators were already proven legal in the court case between Bleem and Sony, Bleem was even able to sell it as a commercial product although after losing the court case Sony flexed their muscles to make sure stores didn't actually carry it. Nintendo's argument wasn't that emulation bad, it was that Yuzu's devs were doing things like paywalling versions and especially paywalling versions meant for running games like Tears of the Kingdom ahead of release. Promoting a version that's meant to run a game before release is 100% a matter of piracy, since you're not exactly going to be legally dumping it.

      I think it's fine if you already own the game and don't want to mod your consoles, but if you don't own the game, or haven't in the past, then I feel there's something wrong.

    Any platform that is no longer supported by the company that produced it forgoes the software released on that platform. It is freeware and it should be considered such after a time (15 years imho).
    Games are art and meant to be experienced, I am a software engineer who builds video games and I can attest that when I make a game it's going to be a game that I enjoy playing and want others to play, the money is just a bonus if it sells well because it isn't a guarantee.

    The Yuzu team really pissed me off with how they handled Yuzu, because we lost Citra with it. Honestly I don't think its wise to make a emulator when the system is current gen, just my opinion, but if the main argument of emulation is preservation then the next gen is when it needs to start getting preserved, but I get the counter point working on it now is better before its too late. I see that, but waiting mitigates this problem.
    Secondly Yuzu patreon, which I get they were doing a lot of work I don't begrudge them earning money, it was just too much of a target on top of my understanding was they helped people through that get past some of the locks. They flew too close to the sun, and I'm glad they settled or else Emulation could have been hurt more, but their was damage beyond just Yuzu, they damaged Citra which is a emulation effort we need to have.
    If RPCS3 got the same treatment because of this I would be doubly pissed, because yeah they have a patreon but they aren't cracking anything that is really hurting Sony. You could argue some PS3 games are on PS+ service, but I don't think RPCS3 is really eating into their bottom line that bad.
    I wish they just waited until Switch 2 came out before they started putting out a working emulator. If Emulation in general takes a hit because of this we all lose.

    Things worth mentioning:
    1) Ryujinx wasn't created as a result Yuzu going down (that's how I understood it). Also, Nintendo can't ever go after the Ryujinx developers and try to shut it down because a) Nintendo has no legal power in Brazil where the developers are residing, b) copyright law is rarely enforced in Brazil and c) the developers have nothing done, unlike Yuzu's development team, to ever experience Nintendo's wrath.
    There is more to what Yuzu's development team did wrong: a) they had the leak of Tears of Kingdom on their official discord with a link to the rom file and the discord mods did nothing. b) They advertised on their official website Tears of Kingdom to be playable on Yuzu before it's official launch c) the most up-to-date stable version of Yuzu was paylocked and in combination with the aforementioned advertisement this is actually promoting piracy. To summarize: Yuzu's development team turned a blind eye and promoted piracy while making money out of it. I speculate the dev team quickly wanted to negotiate with Nintendo to prevent further costly damages after more nasty things they have done get covered in court.
    Most emulator dev teams and their mods delete and block any post and user who either asks or makes a post about getting pirated ROMs or a link to a ROM file. They do this on purpose so they don't get into legal trouble. See also the forums of the Playstation 2 and Playstation 3 emulator where they warn users specifically about that.
    2) An emulator is not necessarily meant to play games. An emulator is very similar to a virtual machine. The purpose of a virtual machine is to create an isolated environment. An emulator's purpose is to accurately reproduce the behavior of some hardware. Here is a quote from Dell:
    "Emulation, in short, involves making one system imitate another. For example, if a piece of software runs on system A and not on system B, we make system B “emulate” the working of system A. The software then runs on an emulation of system A."
    3rd party emulators can be technically only illegal if they contain any resource from the target system to run virtually. Console emulators these days circumvent this by programming an emulator without using any copyrighted resource. That, and most importantly: the code of a 3rd party emulator is property to the developers who made it. Hence why they aren't illegal and never will be. There is one note however: Dolphin uses the genuine decryption keys from a Nintendo Wii and they have it openly visible on their Github repo. That looks like potential trouble but Nintendo didn't take down Dolphin yet and it looks like the dev team of Dolphin is untouchable for Nintendo's legal team.
    Last note: As previously said, emulators aren't always meant to play video games. There is an emulator for AS400 which is a software for enterprise resource planning.

    Recently had a discussion with someone about how Nintendo believes piracy to have a direct impact on game sales.
    I told him that anyone who decided not to purchase a game would have an impact on game sales. There's no direct connection between this decision and piracy.
    Of course I was called delusional and wrong. Saying no = piracy, I guess.

    Your point with the switch emulator is very valid. I would like to add a layer to the 3DS part. If anything Nintendo is the one that pushed 3DS piracy since they shut down the shop and now you can’t legally buy those games anymore n you can’t buy 3DS games directly from Nintendo so regardless of how you get it they’re not gonna make money anymore.

    I was able to easily find citra again after it was taken down and install it on my steam deck. Sure, it’s no longer getting updates, but 3DS emulation has been nearly perfected at this point.
    If Nintendo only realized that they could sell PC ports of their games, including their older games at half or a discounted price, that would actually nearly wipe out Nintendo emulation and piracy AND there would be people still wanting to buy their consoles considering how cheap they sell them for the novelty.

      fairly sure PS4 and Xbone still outsell Nintendo consoles, let me quickly check to verify that ... ok, i'm wrong, but only by like 20 mill (give or take) between the switch and PS4, then we also have the PS5 which is basically a PS4 with a lot more power, but those are details.
      PS4's and PS5s are still readily available, especially nowadays, so you don't have the need to really download an emulator for them, maybe a modded PS4 is nice for homebrew and the like though.
      and with Xbox in general, we got the original Xbox emulator and obviously the X360 emulator in Xenia, which both work excelent and you don't see Microsoft actively going against it.
      Also that Microsoft has made a massive effort to bringing their games to PC, either through the microsoft store or through Steam, so we don't need to emulate most games since they run natively on the PC already, you don't need to emulator something that runs on PC already, like what is this guy huffing on about.
      meanwhile the PS2 and PS3 has RPCSX 2 and 3 (i think i wrote that correctly, might be wrong though) which both run amazingly aswell, let's not forget duckstation for PS1 which can easily upscale most games to 4k and make any game look crisp and clean.

    Piracy is not the same thing as stealing. Piracy is when you download a copy of a game without paying for it. Obtaining something without paying for it =/= stealing, it would however be stealing if I took all the copies of a game so that nobody else could have them, that would be stealing, but it wouldn't be piracy. Stealing means taking something that doesn't belong to you. Piracy doesn't fit that definition.
    Also, what's wrong with 720p? Doesn't 720p qualify as HD?

    Not only that he forgets to mention that Nintendo won't put a lot of their legacy content on their eShop there is no buying and paying legitly now here's the thing I have been collecting since I was a kid I've been asked a huge huge huge collection of games across many platforms and yes I emulate the games I own why because I can't get the hardware anymore and if I do it so stupidly expensive. Now I do own an original turbo graphic 16 I do own an original CDI I do own original GameCube Nintendo super Nintendo but there's some systems I just can't get my hands on and there's some games that I have that are extremely rare that I love playing and I wouldn't even put in an original hardware

    The only way an emulator can be illegal is if you have copyrighted system code built within the emulator itself. The PS2 requires you to dump your own BIOS to use it. The Dolphin is an illegal emulator because used Nintendo's decryption keys to launch games instead of another way around it.

    one thing i want to add is
    XBox doesnt have 100% BC, so preservation is still nyeeded in some cases (360 and og xbox have some games that you CANT play on an unmodified later system)
    that's actually why xBox emulators are being worked on, if i'm nyot mistaken (that and the challenge, I assume)
    There are games that cannot be sold nyowadays due to copyright issues (look at the Jet Set games and some releases of Crazy Taxi. pretty sure Twisted Metal III falls in this category too but i may be incorrect)
    so the only ways to enjoy these games are on aging, dying hardware (disc drives and lasers die sadly. ive had to replace a few PS2 disc drives and still have to fix an OG xbox and Dreamcast lasers. as well as the "murder capacitor" on most OG xBox models.)
    Things like YLoD, RRoD(RLoD on slim models), and all related hw failures of that gen as well can lead to issues with playing games, and since they are FAR out of warranty and aren't even being sold anymore emulation is a nyice fall back.
    im all for preservation. i wont talk on piracy or anything, but as a person who backs up my own ps3, switch, ps2, psp/psn, and 3ds games for my own PERSONAL use AND still loves to play on OG hw most the time i can say that there are benefits to emulation. it isn't perfect, but neither is the original hw.

      wanted to also add, i enjoyed the vid but i do think that FPS and resolution isnt the largest thing. a consistent framerate (within a reasonable range ofc) is better than high fps imo. (this doesnt make it a nyon-factor tho)
      there's just more to emulation and preservation than graphics and frames, but it definitely is a benefit of emulation.
      this isnt meant to bash, just wanted to add some input from a different side of the preservation loving/emulation sphere.

    My stance on piracy is if I can't get it legally on a modern system, then it is okay to pirate. If it is on modern systems, buy that version, then pirate the version you want if the modern version has some compromises.

    One thing I wanna bring up, to add to what has been said in this video, is the dichotomy between LEGALITY and MORALITY, because, yes, pirating isn't legal, and considering the circumstances, is not the way you should have access to games on Switch at the moment, and there's a good reason for that : They're easily available.
    But, Piracy, even though illegal, can be morally acceptable, and it's that which becomes a problem, because everyone has it's vision of morality. I'd say it's not moral to pirate a game you can have access to because it is still sold or easily available, or that it still makes money for the devs.
    Now it is, IN MY OPINION, (and as I said, morality depends on who you talk to) moral to pirate games : That are old and doesn't bring the creators any income anymore ; that are unavailable at the time, or in your region, it can also happen (*cough* Mother 3 *cough*).
    I'll give an exemple of what I mean : Switch games shouldn't be pirated, as said previously, because the system is still sold, the E-shop is still accessible, and the console and it's games are still supported by Nintendo, as they're still a source of income. However, Wii U and 3DS games on the other hand are fair game in my book, as the consoles aren't being sold, their E-shop shut down, and no money goes in Nintendo's pocket from those system anymore etc, etc... That is how I see the morality of it all, and you are free to disagree.
    There's also some other factors in deciding the morality of the piracy done that can be largely accepted : it might be done as a protest against a company's actions (and I tend to support it, because devs already got paid, so they're not the one to profit off of the revenue, although do note that they can still be let go because of poor sales) or it might be done to preserve customer rights (I'll elaborate on that later).
    But you should ask yourself : Why is piracy bad actually ? You will surely tell me that's its because of that loss of revenue, but actually, like a lot of serious research have showed, it might not even be a factor. Truth be told : we can't quantify it, because both sides tend to be represented in equally respectable research, so there's no real answer. You will have research saying that piracy results in losses, and some other time, they will actually show that the sales went up because of piracy and the word of mouth it induces.
    Some people can't pay for a game at the moment sometimes, but with piracy they can play it and enjoy it ! And it doesn't mean they can't financially help the creator at a later date*.
    Furthermore, they can say they loved the game to more lucky people which have the money to buy and try it for themselves, which is kind of free advertising (for small indie devs sometimes, that's what gives them that traction needed to actually live from what they're doing).
    Also, another thing : Piracy can get you to have access to the content you paid for.
    "WHAT ?" you will tell me, but I hope you realise we live in an age of digital licences, which mean that the game you pay for isn't yours. If you had a disc or cartridge of said game, they wouldn't be able to prevent you from playing what you paid for, but with digital copies, they can. They can literally steal what you have paid. And IF that's legal because of the terms of service they all make you read and sign, then that means you don't own it, and that is dangerous in the media and art landscape we're in today.
    Censorship might become really easy to do that way for exemple, so being able to get a pirated copy of something you paid for but you don't "own" (you should, that's why I think it moral) should be accepted by everyone.
    Moreover, Pirating isn't stealing at all (not because you don't actually own it like disscussed previously, although it's still a factor), because you didn't take away what they made, you didn't steal their original code or anything, the only thing your infringing is copyright, and that's it's own can of worms (In short : it's a mess, and I'm for a whole rewrite of those laws in favor of the creators and not the companies, but the companies have the money, which in turn give them have control, so we already know where going if it ever happens at all). But still note that copyrights exist for a reason, and should not be disregarded when it is rightfully used. To make it clear, copyrights are fucked, and sometimes (again, case by case basis) the legal hell prevents legitimate routes to the treasure, so I say : To the seven seas we go.
    TL;DR :
    Doing thing illegaly doesn't mean doing it immorally, and in some cases, it might be viewed as a good thing, as piracy can't really be labeled as a reason why some games fail, they can even do the opposite thanks to word of mouth. And pirating content does not mean you are a horrible money stealing criminal, as it sometimes is the only way to protect your right as a consumer, considering the way ownership has evolved in favor of companies and against private parties. They're still very much cases of "wrong" piracy, but always remember it's not always cut and dry, and that there might be moral piracy sometimes.
    *(I'll take myself as an exemple for the anoted statement : I played Solatorobo : Red the hunter thanks to emulation and game preservation (arguably piracy), and I enjoyed every instant of the game. Turns out, the game is a part of a bigger series : Little Tail Bronx, and at the time, CyberConnect2, the devs, had released two new games of the series had just released : "Fuga : melodies of Steel" 1 and 2, which I bought instantly because I loved the universe and the work put into the game I pirated. So yeah. I pirated a game, and it's actually the reason I discovered those two other games that I bought, I wouldn't otherwise (also they're really good, give 'em a try if you love tactical RPGs))

      Can you please explain to me the difference?
      Because the way I see it is that: Emulation isn't piracy as long as you own the game; You're free to emulate it on other devices.
      However, grabbing a torrent of a game and playing it that way or using an emulator to play to-be-released games with no intent of buying it at any point *is* piracy.

      People who do piracy always says they're doing it so they won't pay the capitalist corporations,by this logic they won't buy a game just to emulate.

      Heres the difference:
      Emulation: Software that allows you to play games on other hardware.
      Piracy: The illegal copy and distribution of roms.

      @@ProjectionProjects2.7182 Okay but the BIOS need to come from somewhere. Just because you're using a separate software to play these games doesn't disregard the fact that someone ripped the raw files from a game, copied, and redistributed them to the general public.

      What your describing are people dumping data from the console and games using dumpers and uploading them to rom sites and other illegal sites. Thats piracy and thats illegal.
      Playing a pirated game is not illegal. Its acquiring a game using piracy thats illegal.
      Emulators are not involved with the process of piracy itself.
