    Hi Phil,
    Great video! I just had a few questions about applying within the UK.
    If a someone received a curtailment letter from the home office do they have to put the new date as their bpr expiring date or the original stated on their brp?
    Also is it considered a immigration problem on the application? If so which optioned should be chosen out of the ones given on the application.

      The BRP date I doubt would matter, probably I’d put the expiry date on the BRP and explain the situation about the curtailment letter which obviously needs to be mentioned. I can’t remember every question on the application so send me the options from the drop down menu. I presume your partner has changed visa categories so Google if she/he is eligible to apply in the UK after being told to leave the uk.

    Do the bank statements have to be UK banks? I'm from the UK but working abroad and all my money/savings is in a foreign bank, is that an issue you think?

      Probably you are fine but the questions you might want to consider are, are you paying UK taxes, if your based overseas, what documents to meet the financial requirements are the equivalent, you will be expected to live in the UK with your spouse. Your question is not so clear cut

      Watch the completion of tourist visa video, it shows you how to upload your documents. Basically you complete the application, pay the immigration health surcharge, pay the visa fee and then you will be transferred to UKTLs website or Vfs global web site (depends which country you apply in), you open your account, book your appointment to pass biometrics and choose to upload documents yourself or pay extra and visa center will upload them for you when you pass biometrics. This is known as assisted service and self service

    Hi there, thanks so much for your time in doing this.
    I meet the financial requirement but I’m on a casual work contract which varies each month (so not permanent salaried). I’m paid by the hour depending on what work I do. I’ve been there for a year. The bit in the application form where it asks you if you’re ‘permanent’ or ‘temporary’ I’m not sure what to put because I feel like I’m neither?

      To me it seems like your permanent. The definition of temporary is just that, temporary and generally for a pre-determined time at the time of hire. Usually 3, 6, 9 or 12 months, but it can really vary depending on the organization's needs. Whatever you put, use additional information to explain your situation

      @@MaggieT455 financial and employment when meeting the financial requirements, they have no discretion. Although A simple mistake like yours, often entry clearance officer would correct it themselves. I don’t see any issues but obviously do further research if your worried

    Hi I bank with HSBC, the online PDF statements are exactly the same as what they send out in the post. Can I not just upload the PDF versions? Do I still need a cover letter?
    The bank gets a bit funny if they need to print and stamp, I remember the headache when I tried for my mortgage application. Thanks

      Probably you can. If they exactly the same, the first page should be the covering letter with all your details, name, address, account number etc?

    Hey, maybe a silly question. The sections at the first part, is that filling out as the sponsor, when you put in for "I rent" "I own", I'll be doing the application for my wife. So little confused there. Any answer appreciated.

      If you as the sponsor are the owner, then put I own. If not sure put other and write my husband who is my sponsor is the owner of his home, see his title deed

    Hello!
    When I select what the sponsor earns, there were 4 different options. I (sponsor) have been with the same employer for 6 months earning a salary above the threshold. However, in one of the months I received a bonus for overtime. So does that mean I now have to select the option that says "not the same amount continously, above the financial requirement amount"? Because if I do, doesn't it ask for 12 months payslips? I want to apply Cat A salaried and use only my last 6 payslips. I hope my question makes sense!

      Without seeing the application, I would click the same amount continuously at the same level and supply 6 months bank statements and payslips.

    Thank you very much for all your information. Could I please ask a couple questions. Would really appreciate a response .
    I currently started a job and am earning over the threshold. I only want to use that for the application. But it does state that if you want to add previous employment within 12 months. Do I add all my previous employments in the 12 months as I only worked in my previous employment for a month and another only for a week before changing jobs.
    2. Also it states to show payslips for previous and current employments within the last 12 months. Do I have to provide the payslips of my previous employer during this time period 12 months if I don’t want to use it for my application?

      Unless you have been employed with your current employer less than 6 months, do not combine income. Just give 6 months payslips, 6 months bank statements, employment letter

      Once you pay immigration health surcharge, the visa fee it will take you to either VFS global website or TLscontact website depending which country you are applying for the visa. You book your appointment at the visa centre to give passport and biometrics. Before your appointment you can upload documents

    I am British and applying on behalf of my wife, she lives in Syria and when I apply and pay, then upload the docs online,
    does she needs to go to Lebanon for the passport check?
    do they book an appointment in Libanon for the applicant to pass bio-metrics or interview or both?
    or when she gets the visa to Uk, then she needs to go to the post office for Bio-metrics?
    you said we pay by Dollar for visa fees and IHS?
    also, for rental income, shall I provide a self-assessment and tax return showing the rental income per year
    does the Home office need to interview the applicant or just check the passport at the UK visa office or the company that deals with docs?
    is the appeal free of charge if the application gets refusal please?
    if I change my work after I submit the application, do I need to wait 6 months if the application has inquiries about work please?

      You complete application, pay immigration health surcharge, pay visa fee, book appointment, upload documents. Then the applicant will travel to the visa centre and pass biometrics and give the travel passport where the visa will go.

      Regarding rental income, it is hard to advise without a full set of documents in front of me. For example, Is this the sole income or are you combining incomes, are you allowed to combine incomes, was the correct tax paid, are you employed or self employed, was the income paid through a company, was the tenancy registered etc etc

I was wondering, when they ask 'what do they earn' are they referring to the monthly income or the annual income? for example, my montly income changes a bit every month but my annual income is still the same.       The online application is poorly worded. If, every month you earned above 1550 pounds gross and if only the spouse is applying, click the first option, the same amount continuously above the financial requirements. Unless you have been with your employer less than 6 months. Then they will look at your income over the past 12 months

    A question about the payslips and bank statements. I receive both of them in electronic form. No stamps are present. Would they still be considered valid or do I need to present them as a hard copy to my bank so that they can be stamped?

      Payslips should be fine, electronic bank statements if they don’t come with covering letter from the bank, I’d get them stamped on every page

    Hello. I hope you are well. I applied for my Child's British Citizenship. She was born in the UK and my husband got recently his EU Settled Status after my child was born.
    I have also uploaded my passport and brp in Other Folder. But I am so worried that my passport and BRP contains my father's name (patronymic) as per my full name. But in the application I provided only my first and second names as they were requested. My child's UK birth certificate has only my first and second names as well. And she does not hold any other passports.
    Can you please let me know if that can cause any issues to her Citizenship approval?

      My only experience is dealing with passport applications overseas. Many people make mistakes and they were always given up to 10 weeks to correct them. So my feeling is, if your child is eligible for a uk passport, any errors that you have made, the HomeOffice will contact you and ask you to supply additional evidence. I very much doubt they will refuse without giving you a chance to fix the problem.

      I didn’t get your question but pre settled status, your sponsor has lived less than 5 years in the UK and settled status means they have lived more than 5 years in the UK and have the equivalent of Indefinite leave to remain under European law. In all probability you will have to apply for a family visa to settle in the UK, about 1600 pounds and the immigration health surcharge, about 2000 pounds. Nothing free unless you were married before the cut off date of Brexit.

      Only online forms unless in the very unlikely event you were applying from North Korea. Then paper versions might be required.

      Spouse visa are taking approx 5 months but things are expected to speed up. Check if the visa centre where you are applying has submission without passport service, in the good old days it was 40 pounds. You need to take a colour copy of every page, including blank pages of the applicants passport. You can then keep your passport till the decision is made. If this service is not available, unless you have a 2nd passport, you can not travel ((.

She has been working for 6 months at her job, which is paid hourly and generally gets £1600 per month. We are still confused if with that she could be proving her income or would she have to be working another 6 months to prove that her income is above than £18,600 required:
    £1600 x 12 = £19,200 (Knowing that the maths would be like this) Because i saw about the 6 months rule when You are non-salaried, so i would love to understand it a bit more.

      If paid by the hour, she can take the average monthly income over the last 6 months which must be not less than 9300 pounds. In theory she could make 9050 pounds in month 1 and then the following 5 months only 50 pounds each month, bringing the gross to 9300 pounds. If she had fixed monthly salary, then the minimum each month would have to be 1550 pounds. Make sure employment letter clearly states she gets paid by the hour and at what rate

    Hope you doing well. My husband is about to sign a tenancy agreement where he will move in to an apartment on the 12th of May. My question is can we use the tenancy agreement and apply for the spouse visa application before he move in to the apartment ? We plan on submitting the application before the 12thof May. Just wanted to know if that would be fine ?
    another question regarding the bank statements. Since he will not be in the new address until the 12th of May...is it still okay for him to have my current address on the bank statements ?
    Or do the bank statements must have the address where he will be living at on the 12th of May ?

      Regarding Tenancy, in my opinion it will be fine, I can not see any problems with that but you will needed to be added to the agreement or a letter from the landlord giving his consent to you staying at the property. Bank statement will be fine but I would supply a council tax bill from the old address and explain the whole situation in the additional information section

Is the PDF print outs of my UK bank account enough for the application (It has my income which is sent from abroad and matches the payments in my UK bank account & the paystubs for my current job) ?

      Bank statements must be on official bank stationery. (So it depends how they look)?
      Alternatively, electronic bank statements can also be accepted for all bank accounts (the account itself does not have to be exclusively online) as long as they are either accompanied by a letter from the bank on its headed stationery confirming that the documents are authentic or which bear the official stamp of the issuing bank on every page.

      Arrears should not matter but you will probably need the consent from your hosing association that your husband can live at the property

Please can i ask how many payslips I need to provide if i’ve been with the same employer for 8years, however i received a promotion and a new job role/title 4months ago. Previous and current role both above the £18,600 so should i include only 6months payslips? And do i need to mention this job role change in the employment letter? Thanks

      I would supply 7 months payslips, 7 months bank statements and in the employment letter mention that the payslips are genuine and what the old yearly salary was with dates and the new yearly salary from start date till the present time

      I did not fully understand the question. If he is supplying the applicant with accommodation and does not have a passport, probably it will be ok. Birth cert might be better. Explain it in the additional info section

      I didn’t fully understand your question but at Initial application stage (overseas), the applicant puts the address where they live In the country they are applying from and when it asks where she will stay in the UK or her sponsors (partners) address she will put your address in the UK

Now recently I have been offered a skilled worker visa from new employer and i'm about to join new employer in few weeks. I need to raise dependent visa for my family. As I'm yet to join new employer how can i show the pay slips? The pay slips I have my old employer. Do I need to show the old employer pay slips?

      Your partner or child’s visa will not automatically switch to this visa if you switch yours. If they do not switch their visa, it will be valid until its original end date.

      If you have been in the UK 1 year, you will probably not need to meet the financial requirements. The easiest way, if you have not been in the UK for 1 year, ask your employer to sponsor maintenance.

    So am putting in my uk spouse application in a few days but I've just come back from abroad from my marriage after 1 months of no employment due to being on annual leave holiday for my wedding and 1 month of looking for an accommodation. So I was told we put in application straight after employment. But I have that gap due to my marriage happening. Does submitting the application now put any rejections on it? Plz want to know.     My husband will apply in a few months, we are just waiting for my 6 payslips.
    My question is: Im employed by the NHS, so I get paid hourly, 37.5 hours a week(full time), but my anual salary is 22.383 basic rate , any enhacement (nights) is not included, so every month is never the same amount, what should i do?.
    And sometimes I do bank, for the same employer, should I add that employment and payslips even if I meet the financial requierement with my permanent?

      If you are paid hourly they normally take the average income over the last 6 months. As long as your gross salary never fell Below 1550 pounds in any given month, you will be fine. Just put annual salary as 22383 pounds and explain things in a covering letter or additional information section. If you need further advice, my WhatsApp is +79257808976

      You need to apply in your home country. You can not switch from a general visit visa (tourist) to initial application to settle in the UK as a spouse.

      Question 1, I haven’t had to answer that question in a very long time but I believe the answer is yes. To cover yourself explain in a covering letter that my father is my sponsor and his employer is covering maintenance. Check in the COS if your employer is 1 month maintenance for just you or all the family. Then download consent form and sign. Without researching it, I am not sure of the answer. I would probably put no and explain that accommodation will be organized on arrival in the UK with the assistance of my employer. You could also do a hotel booking and cancel it if you find a place to stay before you arrive in the UK

    1) for the bank statements is it ok to download them from the bank app? Or do we need to go to the bank to ask them to stamp them?

We will Iive at my husband parent place for a while so would the letter signed by both of them be enough( saying that they are happy I will move with them and there are enough rooms etc)? There is a section before you pay the fee where it lists all the documents they’ require and they don’t say about the evidence of the relationship …As far as I can understand it’s up to us what evidence we provide?

      Only if you never mentioned it on a previous UK visa application. So if you applied for your last UK visa and then later got refused, mention the refusal. Normally it is not a problem being refused a visa for another country unless you were refused for something criminal or breach of laws etc

    Hi thanks so much for this video. It really is so helpful! I'm currently in Thailand about to get married and everything should be ready to submit the application after the marriage papers are translated/certified etc.... we are speeding things up due to the recent announcements about the major changes to the financial requirements in this visa category! One question or problem I have is BANK STATEMENTS.
    I'll be relying on cash savings alone for the application and being currently located in Thailand how do I get physically stamped bank statements? I bank with Lloyds Bank in the UK. I also thought of getting some paper statements ordered (through the banking app), then sent to a family member who could then bring them to a branch to get them stamped, and then the family member could send them to me by post to Thailand. But I have come across information from people saying that Lloyds refuses to stamp bank statements nowadays??! Apparently they sometimes even refuse to supply stamped ones when you order in person in branch, which i can't do anyway.... What can be done about this and if I were to submit the application just with paper-printed bank statements (NOT STAMPED) would this constitute grounds for refusal?

      Since the video was made, they now accept electronic statements send out by the bank in your app or to your email. Make sure they are statements, similar to those that you would get in the post.

We have established that it will be easier to change all of her legal documents (passports etc....) while here in Thailand before submitting the spouse visa application. One thing that I don't think we can change is the maiden name on her A1 life skills test certificate. Would her A1 test certificate being in her maiden name rather than her married name like all of her other documents cause any issues during the application? Thanks. Vince

      I doubt, you should be fine although I never personally had such a situation. Just make sure you evidence her maiden name. Also note, in spring, financial requirements increase to 29000. If it will delay things and you wouldn’t meet the new requirements, don’t mess around, change the name once your both in the UK

      It will take you to either Vfs or uktls website where you choose what city to pass biometrics and upload documents. All she needs to bring to visa centre is passport, checklist (download after paying), and proof of payment, appointment which will be sent to your email

      Yes, for the past 6 months, the minimal monthly salary should have never been less than 1550 pounds gross. This should be shown on the 6 months bank statements. Where possible I always ask my clients to provide 7 months.

      @@EverydayDoll when I researched a similar question 2 years ago it was as follows. If you are paid a fixed monthly salary, it is the lowest months salary in the past 6 months that counts. For example in month 2 you earned 1000 pounds, then your yearly income would be calculated as 12000 pounds despite earning a lot more in other months. If you are paid hourly, it is the average income over the 6 month period. It would not matter if you earned less than 1550 in month 2 if the other months make up the difference

    Hi, hope you are well. I commented on your post a few weeks ago regarding me and my wife using my father's apartement which he rents from a housing association with the help of universal credit. Last time you said that my father should declare that Im living with him if he has not already. My dad had declared me and my brothers a long time ago. I spoke to my father to let him know that as part of the visa application for my wife...I need a permission letter from the landlord and my father is rejecting the idea of me contacting the housing association as he thinks that they will reduce the amount of universal credit he earns. Is this true ?
    All we need to inform the housing association (A2dominion) is that my wife will be joining us at the apartement and we only plan on staying in my dad's apartement for short period until we decide to move out. Would this cause issues ?

      1. although not my area of expertise, probably they could reduce his universal credit. 2. Guidance says you should supply land registry title deed or mortgage statement, or tenancy agreement along with letter from the landlord if your wife is not on the tenancy agreement.

    Hello, please I have married to a Moroccan citizen that also has British citizenship, we married In Morocco as two Moroccans not as a British and Moroccan, now I will come to uk with student visa is it okay to change it with spouse visa although he married with his Moroccan citizenship or they will say he have to marry as British citizen so the marriage act will be approved.cause in our marriage certificate they put only his Moroccans ID they didn’t mentioned he is British.     I have another question that's causing me a lot of worry. I'm wondering if you can help answer my question.
    My question is can I fill out the application form and submit it and then later add the supporting documents. If I do, do this, then when will my application be counted as submitted?
    I have ALL required documents, the only thing I'm waiting for is his English exam which will be in another 2 weeks but that means we'll be reaching another payday and I don't want to be editing the bank statements and wage slips again.
    So my question is can I submit the application, and most of the supporting documents and then before the biometrics appointment is booked can I quickly upload my English exam results? Will the supporting documents and application only be reviewed after his biometrics appointment? Should i submit what i have so far?
    What date will the application submission be, will it be the day the form is completed and paid for, or will it be when all supporting documents are completed and uploaded? Lets suppose I'm missing an important support document, can i add it at anytime after the submission?

      The rule is, everything stops when you pay the embassy fee. You couldn’t supply financial documents dated after that date (date of submission, very strict rule). Regarding the English test, you would be hoping the entry clearance officer who will be handling your application will turn a blind eye. Personally I would not risk. You would have to wait if you were my client

      It is poorly worded but better supply 12 months bank statements showing salary and at least 6 months bank statements show savings. The lowest amount in the 6 months is what they will use for calculations

      For spouse visa bank statements are required and payslips are required if you are basing it on employment. When you complete the application it will give you a list of what is required.

      If the child is yours and British then that is the correct amount. If you are also sponsoring the child, where your not the biological father, then where it mentions don’t include children on the application, you must put yes and then add the number 1. It is a poorly worded question where it asks don’t include children that are mentioned on the application. You do have to mention them if they are not British

      From memory, it is very important to use payslips unless the sponsor is employed overseas. Then the equivalent in that country could be used. The payslips must correspond with the income shown on the bank statements. Alternatively if you have held 625000 pounds in savings for 6 months or if you receive dividends then they can probably be used

    Hi Phil, just a quick but important question. I'm on a zero hours contract. I work for the NHS and have been working with them for over 6 years in the same role. My wage slips add up to over £20,000 pa. Will my zero hours be a problem?
    My employer obviously cannot write down the exact annual income because I'm on a zero hours contract. Will it be enough for my employer to write, 'the named person is expected to earn over £22,000 as confirmed on the wage slips? Or what can they write?

      I presume obviously you are paid by the hour so they will probably take the average income over the past 6 months which must be above 9300 pounds. Ask your employer to confirm your income over the past 6 months and what you have also earned in the past 12 months, start date, position and that pay slips are genuine etc. Include your P60, last 12 months bank statements, last 12 months payslips as a precaution. Home office is more interested in your earnings, taxes have been paid by your employer and not they type of contract that your on.

      1 year business bank statements for the financial year, probably 06 April till 05 April 2023 or the financial year of the company if Director of specified limited company. One extra, recent pay slip and bank statement to show ongoing employment. Order divorce certificate, it is needed unless it was used in a previous family member visa application. I personally never highlight earnings unless it’s not clear that they are earnings.

      If you are paid by the hour, it is the average over the 6 month period. If you have fixed salary each month, then it is the lowest month that counts. For example 1060 pounds x 6 months. They do not take into account the higher months if it’s fixed salary. In all events, I would wait even if you are paid by the hour (2) It does not matter, print them out, scan them in PDF and upload. All documents end up in the same account (applicants application)

    The financial requirement of 18,600 will change to 29000 on April 11. So if i for example submitted the application 1 day before the deadline and the decision takes up to 9 weeks (which by then the rule will have changed) will it be an issue?
    And just one more question. If the application was successful under the 18,600 financial requirement, at the time of extension after 2 years and 9 months, will my spouse still be under the £18700 financial requirement? Or will i need to provide the new £39,000 financial requirement?

      In most instances you can switch if your husbands income is above 29000 pounds per year and he has been employed 6 months. Because you are legally allowed to work in the UK on your current visa you might be able to use your income in the uk as well to meet the financial requirements.     •intended travel dates, how important is this for your application? I accidently put 3months and fews day from the date of submission ie. 15th June 2023 , will this cause an issue? And will the visa start date start from the date of approval or the intended travel date?

      I haven’t checked for any rule changes recently but if you wanted to travel in 92 days time, you would need to wait 3 days before you could submit online. My feeling is that they would not be strict on a spouse visa but a tourist visa would probably be refused if you applied to soon. If you have 90 day visa, then that would be fine, you can travel anytime before it expires. It use to be issued for 1 month, thank you for the update

      I didn’t fully understand your question. For example, if you are extending her visa,/BRP in the family 5 year route, the Home Office will have concerns why you are not living together. If it is an initial application and you are allowed to switch into the family/spouse visa route, then I would need to understand why she has your details on the BRP but living at her parents.     Getting the bank statements stamped is a major headache for me. I’m with RBS and they have a policy where they don’t stamp PDF bank statements, and nor do they provide a cover letter confirming authenticity of the statements. I’ve been to three branches in case a kind bank manager would do it for me, but nope. I’m going to have to order paper copies and then scan them in. Argh! 😭

      @@gentianasokoli7902 Yes and no. The rules were written when banks sent out those small paper statements on the bank paper… you know. You used to be able to order statements in that format. Now though when you order statement s they essentially just send you a copy of what you can print off online, though all six statements are on one document rather than the six documents you would print off yourself (that’s what RBS sent me anyway). So there’s no real difference in the documents you’d send.
      But it IS still in the immigration rules as a mandatory requirement. And they can reject visa applications for not following the rules.
      RBS didn’t stamp mine, but they did send a printed PDF that looked slightly different from what I could have downloaded at home. I submitted that and noted in the cover letter that those statements had been sent from RBS, not downloaded by me. Probably doesn’t make a difference but this is too important leave it to chance!
      I’ve heard that some people call to query it prior to submitting their application and are told it doesn’t matter these days. But if that’s the case they need to update the damn rules!!!

    Hi Phil I appreciate you a lot for making this video. I have a quick question but this has been bothering me.
    So I already applied and did biometric for my Fiancé visa. in the application, in the relationship status I choose “unmarried partner” but I read people said I should chose single. However in the guidance, single means “Never been married or in a civil partnership, and that you don’t consider yourself in a relationship” and we are clearly engaged. So it was very misleading.
    In other part of application when they ask what is my relationship to the sponsor, I chose fiancé. And also chose that we intend to get married.
    At the end of the application, it didn’t generate the IHS fees so I thought I applied to the right visa.
    My question is, does my choice in the relationship status (unmarried partner) will lead to rejection because the HO thinks we applied for unmarried partner visa?

      Normally entry clearance officers correct small mistakes themselves although yours was quite a big one. My feeling is you have a chance that they will correct it themselves if it is clear what you are applying for. Did you put the wedding plan details, in the invite letter, did you mention your FIANCEE on more than one occasion. On the unmarried partners route, you pay the IHS, but on VFS global sites I have heard that often they don’t take the IHS charge, it’s a glitch. In brief, you have a 50/50 chance.
      As part of the application process, the applicant are required to pay the immigration health surcharge giving them access to UK healthcare.

      @@user-kq7dy3ny7s then I would say you have a reasonable chance to get the visa as long as the financial documents were in order, you met the financial requirements. Many entry clearance officers have a heart and understand the application process can be complex.

    I would to ask if I paid a short payment for my IHS on my first application that hasn’t yet submitted then I restarted my application because of some errors that I made on the first one. Instead of choosing “OUTSIDE UK” i chose “INSIDE UK”. Is it refundable? Or can I just pay the short payment?

      You will need to claim a refund on the visa and I believe the IHS will be automatically refunded. Overseas applications, once you book the appointment, you could claim a refund if cancelled. If you were to change the appointment time and then cancel the application, you would not get a refund on the visa fee but would get a refund IHS

      I haven’t paid the visa fee. That’s the problem I encountered. I cannot proceed on that part. That’s why I decided to restart my application. No appointment date yet either. After paying the IHS, I couldn’t continue my application on the last part which is FURTHER ACTION where I can pay the visa fee and the only indication where I see my progress. It keeps on telling me to review my answer. I already did review my answers many times. And still there no other option for me but to restart. 😞😞😞

    Hi, thanks so much for this informative video.
    I had a few questions,
    - I am applying for a spouse visa for my husband to join me in the UK and will be using my mother's home which she owns and is mortgage free for the accommodation requirement. I have a signed letter agreeing for my husband and I to live there. The letter mentions how many bedrooms there are (3) and states she agrees for us to live there, a scanned copy of her passport as well as my brother's as he is also residing there. (is my brother's passport necessary to include?) and land registry. Is there anything else to include under this requirement?
    - In terms of bank statements, can I just save them from my online banking app or do I have to go to the bank to get them physically and have them stamped and then scan them onto the computer?
    - I have created a collage of photographs showing all photos and have labelled the photographs stating who is who, is this okay?

      Bank statements must come with covering letter or every page stamped. Include brothers passport and consent letter, he must also agree that your partner can live there

    Hello my British wife is in receipt of personal independence payments which makes her exempt from reaching the 18600 and it qualifies her for an adequate maintenance, she is now working, she claims PIP and ESA, housing benefits and she doesn't have to pay council tax, plus she is renting, we have done the adequate maintenance calculations by citizens advice and the calculations said that we meet the adequate maintenance requirements, which is A minus B should be either more or equal to what a British family can get as a weekly support, so what do we need to provide for it in our visa application, and also what proof of relationship we need to provide, as I am Moroccan and she's British, and we are married, she has visited three times in Morocco and we are more than 4 yrs together in a relationship, we just got married and we are very confused how to apply for a spouse visa and what are all the documents we will need...       Please note I work on a need to know basis. So without ever handling such a case as yours and not knowing the documents you have available to you, I would guess at. A letter explaining your financial situation and explaining why you believe you are exempt. Any correspondence from Citizens advice, All evidence of income that is shown on the bank statements. All correspondence showing your eligible for these benefits, how much they pay your wife etc. I would supply bank statements etc from 06 April 2021. Proof of relationship, evidence of travel and hotels together, lots of photographs, entry stamps in passports, proof of any assets you own together

      Probably yes, the application will be refused if your sponsor in the UK does not meet the financial requirements. Exceptions might be if she is an invalid or has a a care allowance to look after an invalid. Your wife in the UK must earn 18600 pounds per year if she is meeting the requirements through employment

      With the limited info I have, as things stand, probably only two routes. 1. Savings of 62500 pounds (it will increase in Spring) held and never fell below that in the last 6 months or you are currently earning 18600 pounds a year, and have a job offer in the UK. If you can’t meet that requirement, a lot of Brits take their spouses to Ireland. Brits despite leaving the EU have always been allowed to work there

      The issues are why your wife didn’t join you in the UK 3 years ago if it’s a genuine relationship? My apologies, I don’t know the answer to your question. Probably I’d visit your wife a couple of times, go on holiday together, rebuild the relationship and then apply.

      With renewals, the home office use common sense or will normally request extra documents if they are not happy. With the limited info I have, persons above 18, I would supply birth certs and a simple letter to say they have no objections. Expired document would probably be fine as well. Normally housing report not required (just mortgage statement or title deed) unless you are sponsoring her children as well. If you have it though, does no harm to include

      Your husband can complete the application on your behalf from anywhere in the world, but it is still an overseas application, if the applicant will pass biometrics outside of the UK. If you the applicant were in the UK on a visa that allowed you to switch in the UK to the spouse visa, only then is it a within the UK application. In brief, when it asks are you applying in the UK or outside of the UK, in your instance he will put outside of the UK

      It’s a poorly worded application. If the dependents are the applicants only and applying, then yes you mention them and complete a separate application. If they not applying, still mention them. If their the sponsors, add them, answer as best you can the impossible to answer questions that following, click you can supply evidence although you probably can not and then explain in detail the situation in the additional information section. For example, Due to poorly worded question, I confirm that I have two children named ……… who live with their biological mother who I am no longer in contact with etc etc. basically just truthfully explain the situation

In the visa, the expiry date is mentioned just after 3 months (I need to renew after reaching the university).       You would mention the date of expiry on your Bio Metric residence permit and if unsure, explain the situation in a covering letter. I presume you had a CAS and will collect your BRP on arrival in the UK.

      You will need to use the last 12 months income (not last 6 months) and you must meet the financial requirements if overseas or if applying for extension in the UK they might put you on the very expensive 10 year route if your husband can not meet financial requirements. Supporting documents are Employment letters, payslips and all bank statements for all period

      Are there less than 5 share holders? If yes, then you are the Director of a specified limited company and it’s quite complicated. If more than 5 share holders, 6 months payslips, employment letter and 6 months bank statements are the main documents to meet the financial requirements

      @@user-dw1qp5vm8r I never had this number before. From memory the HomeOffice guidance is less than 5 shareholders so you should be fine. You may want to to issue 1 nominal share to a friend as a precaution but I will check the guidance tomorrow

      It would be ok. If it’s initial application, add you to the lease or a letter from the landlord that you can stay there. If it is an extension and you lived in UK with him for 2.5 years, you both need 6 proofs of address from your previous place you lived at. Basically very simple if this is your first time applying

    while filling the application as i am the sponsor, i have two under 18 boys from my previous marriage, but they stay with my ex wife and i give her £400 per month as maintenance. On the form it is asking me if i have dependent children from previous marriage. Not sure how to answer this. Q1. Are my children my dependant children even though they live with my ex.
    Q2. If i answer yes then the application is assuming that those 2 children are living with me who do i tackle this.

      1, yes, add the kids. 2. It’s a glitch on the system or very poorly worded application which hasn’t been remedied for many years. Just go through and answer the questions as best you can. Trying to be as descriptive as possible and when not possible just put Not available. It will then probably ask you to supply some form of proof of address for your X partner or kids, just confirm you will supply. Then use additional information to correct the incorrect information you added. I normally used the wording. Due to what seems like a glitch in the application, I had no options but to answer yes too ………………… but actually my children …………I never supplied any evidence of x proof of address but divorce cert is very important

    Hi Phil,your video is quite informative and helpful.
    When I returned to UK from Tenerife Border security stopped me and detained me more than 8 hrs.From wrong sources I assumed that if I leave UK for shòrt period in return my visa will automatically start another 6months. But it's totally wrong informations. I was shocked. I showed 2 emails from Home Office extended my visa and my marriage certificate . They released me in one condition that's I've to apply UK spouse visa within 14 days. We applied but rejected by stating that COVID-19 is over ,I can go back to Canada.
    I returned to Canada voluntarily, 15months ago.My question is can I apply uk spouse visa now??is it complicated or different than normal uk spouse visa??
