Hi. Yes. Some benefits also apply to nonimmigrant visas. However, not all the benefits are applied the same. For example, Green card (GC) holders can live and work in the 🇺🇸 permanently, are eligible to apply for US citizenship in 3 or 5 years, can work at any employer that they are eligible and start or work at a separate business as well. H-1Bs cannot live in the U.S. permanently, cannot apply for citizenship, and are generally tied to one sponsoring employer. H-1Bs can own a C Corp or LLC, but generally H-1Bs cannot work for their own business, unless it is the sponsoring employer. There is much more flexibility and certainty with a GC than an H-1B. With a GC you have many more benefits and peace of mind.
@@Subhanlaw I apply for my son adjustment of status since December only thing I got t is he receipt I got my greencard though vawa I thought by now he would have done his biometric
Hi Kerisha. I'd recommend creating a USCIS account and seeing if a biometric notice was ever sent. Also, check his USCIS case status online. Lastly, you can call USCIS Customer Service. Hope this helps.
I have an USCIS account and I check it all the time to see if they need out anything but it haven't shown I will give it again until the end of the month thank you
Please make sure that your son has a USCIS account too. He would need to check on the I-485 through his USCIS account to see if the biometrics have been sent. Hope this provides clarification. All the best!
Good Morning sir I am a Lawer in India. Now I am USA I like to work in USA in legal office How to convert Tourist Visa to Work VISA. I have 5 months to stay in USA. Advise me Sir
This is a very great video,I have never applied for a green card before, but this time around I will do so because of this educative video and my dream is one day to become a U S Soldier thanks
for those who won the US Green Card Lottery DS260 and want to relocate to US, is it possible to enter US to a State different from that mentioned in the application.
When completing the DS-260, you must provide a U.S. "permanent address" and a mailing address that you want your green card mailed to. You are not required to live at the "permanent address" permanently. However, you should move to the address listed on the DS-260 and then you can later move to another residence and update USCIS. By not moving to the permanent address upon entry, you may leave your subject to issues of "misrepresentation" down the road. Book a call with an immigration attorney who handles DV cases to discuss in more detail.
Hi Don. Yes. Enlisting in military service is also a great benefit for green card holders. With 1 year of military service, green card holders may be eligible to apply for citizenship as well.
Thank you for this video. And could you tell about travelling of green card holder. Which countries the green card holder can visit without visa and which countries may be approve visas easier?
Hi Diana. Glad you found the video helpful. Also, entry into another country outside of the U.S. depends on your country of citizenship, not your green card. Whether or not you need a visa to enter a certain country is based on your citizenship. You'd need to check with the Embassy for the country you wish to travel to in order to determine if a visa is required. Hope this provides clarification.
Great video! I have been a permanent resident with a green card for 40 years I would like to travel from Florida to Italy on vacation what other than my green card would I need to do that? Please help thanks 🙏
Thank you Anabell. Much appreciated! Also, to travel outside the U.S. for under 5 months and 30 days, you would need your valid passport, green card, and you may need a tourist visa from Italy depending on your citizenship.
My green card was approved last march 21, 2021 as a Filipino...My question is when can i visit Philippines...and how many months can i stay Philippines ...
Congratulations on your green card approval! Once you receive the physical green card, then you can travel outside the U.S. for up to 5 months and 30 days. If you plan to travel outside the U.S. for more than 5 months and 30 days, then you need to apply for a reentry permit and receive your reentry permit before traveling. Please also review CDC guidelines and the traveling guidelines for the country your traveling to. Hope this helps you.

Hi Cecy. Yes. You can travel by plane anywhere within the 🇺🇸 with your green card and a valid passport. Also, you can drive anywhere in the 🇺🇸 with a valid driver's license. If you move to Texas, you'll need to go to your local DMV and apply for a Texas driver's license. Hope this provides clarification.
Your welcome. That's great. Watch this video th-cam.com/video/VwJxLLPec9M/w-d-xo.html to help prepare for the marriage green card interview. Wish you all the best!
A green card holder has the right to change his or her employer upon receiving the physical card. However, whether USCIS would consider the change in employment so quickly as fraud or misrepresentation based on "intent" depends on the specific facts and circumstances of your particular situation. Therefore, it would be good idea to determine whether such a quick change in employment may have immigration consequences in the future when filing to renew or applyjng for citizenship. Hi! Great video I learned a lot from you. I am a green card holder and currently resided here in the us for more than 2 years now and working a full-time delivery driver at amazon. I am married to an American but we live in Canada. Is there a point of benefit of getting it if we are living in Canada ? Would it just complicate my income tax returns ?
Hi Julia. Thank you for your question. To become a permanent resident of the U.S., you must intend to permanently reside in the U.S. Once you permanently move to the U.S., you become a tax resident of the U.S. after residing in the U.S. for 183 days and then you become a non-resident for Canadian tax purposes. If you are outside of the U.S. for more than 180 days (6 months) in a year, you could be regarded as having abandoned your legal permanent resident status. Therefore, if you do not intend to permanently reside in the U.S, then applying for a green card through marriage is not recommended. Hope this provides clarification. Can I know how much money we usually need to come to the US after winning the green card lottery? Approximately how much would a person going to America for education need for its accommodation and education? Will the US government give an allowance to someone who has won the green card lottery? Thank you!
Thanks for you question Chamathka. It depends on the location you choose to live in the 🇺🇸, public or private school, rent or own, transportation costs, food, medical, etc. The U.S. government wants to ensure you have enough funds to support you and your family. There is no set amount of money under U.S. law. However, a good guide to follow is to have enough funds to meet the federal poverty guidelines, which can be found here www.uscis.gov/i-864p Please note that the U.S. will not provide you with financial assistance, you must show you have enough funds on your own either in the bank, through selling assets, etc. Hope this helps you.

A green card also known as "legal permanent residency" allows you to live and work in the 🇺🇸 permanently. If you have a green card, then you can travel outside the U.S. and return. Once you are approved for an immigrant visa, then you receive your green card after entering the U.S.
Good aft.. i left my green card sponsoring employer after 1 month or so getting green card and joined another company with the same skill set.. Hope it will not impact my citizenship appln?
Hi Santosh. After receiving your green card, you are free to choose different employment. There is no minimum duration that an employee must remain with the sponsoring employer after the green card has been approved. However, moving to a different employer shortly after the green card is approved may lead to issues with "intent" during the naturalization process. Please do schedule a consultation with an experienced immigration attorney to discuss further.
USCIS grants a 2 year conditional green card if at the time of the approval you've been married for less than 2 years. Based on your comment it sounds like you were married for less than 2 years when USCIS granted the approval.
Great question! Some common options include: 1.) working on OPT, 2.) being sponsored for a work visa such as H-1B by an employer, 3. ) starting your own business and applying for an E-2 visa, if eligible, or 4.) continuing your education for a M.S., M.B.A., PhD., J.D., M.D., etc. Some students may also be eligible to apply for a green card through EB-1 or EB-2. For more options, see my other videos on common visa options for entrepreneurs and other visas.
Hello.Great video and one of, if not only video that clearly demonstrates the perks of having a gc. I just got card yesterday in EB1A category. I intend to continue to work in my current role in a univ for another 6 m. Am I eligible to hold multiple jobs like biotech consulting and/or college adjunct? Also, my wife, is she eligible to open her own business? Thank you
Hi Marty. Yes. A legal permanent resident (aka a green card holder) may work as many jobs as s/he is eligible for including starting your own business. However, if you signed an employment agreement with restrictive covenants, it may restrict having another job. Without any employment agreements with restrictive covenants, you can work mutiple jobs wherever you are qualified. In addition, if your wife also received her green card, then she can start her own business. We'd be glad to help you and or your wife form a U.S. LLC or corporation the right way to make sure your in compliance with U.S. immigration law. Hi Chikku. Sorry to hear about your job. Also, you are correct. Green card holders need 40 credits of work, which is equivalent to ten years of working and paying Social Security taxes to be eligible for social security benefits..
Thank you for the great informations it was very useful ❤❤ i just have a question.. So a family of four just won the opportunity to get a visa and have the green card and they didn't do the paper work for getting the visa to travel to the USA yet because they are concerned about the family incomes because the father is 62 years old and it's hard for him to find a job in his age so is he qualified for social service benefits as soon as he arrives to the USA ? and if not is there an opportunity for him to work even if he is 62 years old??
Hi Rawan. Glad you enjoyed the video and found the information helpful. I appreciate your comment. Also, it sounds like you know a family who was selected in the diversity visa lottery. That's great! Also, an applicant for a diversity immigrant visa does not have to file an affidavit of support also known as the form I-864. However, an applicant does have to prove that s/he is not likely to become a public charge. To satisfy this requirement, an applicant can show: (1) that s/he has funds to support the applicant and family members or has sufficient funds to provide support until employment is found, (2) the applicant has arranged employment, (3) friends or relatives will assure support, or (4) a combination of the above. Hope this helps you. To get answers to any other questions, please book a call with me here subhanlaw.com/book-call-page

@@pataranda9583 a valid passport, your green card, and depending on your citizenship a visa. If you are a German citizen, then only your valid passport and green card. Have a great trip!
Hi. Thanks for your question. Your mother may be eligible for social security benefits if she has 40 credits which is equivalent to 10 years of work in the 🇺🇸. She may also be eligible for Medicare benefits if she's lived in the U.S. for at least 5 years and has the 40 credits of work.
According to the U.S. Embassies in Canada and Mexico, it states that "Non-essential" travel includes travel that is considered tourism or recreational in nature and “Essential travel” includes: work and study, critical infrastructure support, economic services and supply chains, health, immediate medical care, and safety and security.
Hi Nasir. EAD processing times are currently between 7-15 months depending on the form category and USCIS service center adjudication the case. See EAD processing times here egov.uscis.gov/processing-times/
A green card serves as proof of a person's legal status and it permits a person to work and live in the U.S. permanently and it also allows for travel. An EAD is no longer needed once a person obtains his or her green card.
Once you become a U.S. citizen, then your green card becomes invalid because you are no longer a permanent resident. You will return your green card to USCIS at your oath ceremony because you'll receive your Certificate of Naturalization.
Hello, i am Asif from Pakistan going to apply NIW-EB2 visa. I have a question if i apply with my children and they also got the green card with my application. is it mandatory for them to live in the USA for a certain period of time. they are getting an education in Pakistan and I don't want to move them to the USA at this moment. May be after 5 years,if i want to invite them for their higher study, what will be the procedure at that time. I hope you understand my issue. Thank you
Hi Asif. Spouses and children under 21 can apply to receive a green card with the EB-2 NIW applicant. Green card holders are subject to "immigrant intent" (i.e. their intention to live and work in the U.S. permanently), as well as the physical presence and continous presence tests in order to continue to remain a green card holder. It sounds like your current plan for your children would not meet the immigrant intent standard nor the physical and continuous residency tests. I'd highly recommend speaking to an experienced EB-2 NIW attorney before proceeding. We focus on E-2, L-1A, and EB-5 visas. Please go here to search for an EB-2 NIW lawyer ailalawyer.com
my father was greencard holder reside in las vegas n.v .. had a social security.. i liked to ask if my mom eligible to received his benefits if ever something happend they been seperate but not legally and my mom was in another country.. please enlighten me.
It depends. Your parents must have been married for 10 years, your father must be receiving benefits, your mom must be at least 62 years old and not remarried, and then she may be able to collect social security benefits. However, if your mom is living outside the U.S., then other rules also apply. For example, in general, for foreign spouses to collect Social Security benefits then the foreign spouse must be a U.S. citizen or green card holder and not have lived outside the U.S. for 6 months. There may be exceptions for foreign spouses that are from a country that has a Social Security Agreement with the USA or if the foreign spouse and US spouse lived together for at least 5 years. Your mom can contact the Social Security Administration or a Social Security benefits lawyer for more information.

Does that mean with my results, I will be able to continue in my 4th year or I will have to restart from the first? Thank you
Hi Agape. Congrats on applying for the DV lottery and starting medical school. Whether or not your courses and credits would transfer is something you'd need to discuss with the school your interested in attending in the U.S. Contact them to discuss in more detail.
Congratulatuons! Also, to receive in-state tuition rates, you must be a U.S. citizen or green card holders and meet that state's residency requirements. Residency requirements vary by state. For example, Arkansas requires 6 months, California requires 12 months, and Alaska requires 24 months. Some states let you count your first year to meet the residency requirement for your sophomore year. To learn more, contact the school's you are interested in and speak with them about the residency requirements for in-state tuition.
Hi I had a question. What about Green Card Holder? Can you Apply for foreign tax credit as a green card holder. Will this be a red flag when you are applying to get your citizenship??
Hi Divyansh. Great question!👍 Green card holders also known as legal permanent residents may be eligible for the following under certain circumstances: (1) foreign tax credits, (2) foreign earned income exclusion, and (3) foreign housing exclusion. Claiming legal tax benefits does not affect your citizenship application. With that said, to be eligible for some of these tax benefits, you need to be living and working outside the U.S., and such time outside the U.S. can affect your eligibility for citizenship. Speak with a tax advisor for more information on the taxes. Book a call with us to discuss your citizenship eligibility subhanlaw.com/book-call-page
If applying for adjustment of status within the 🇺🇸, the marriage green card process currently takes between 10 to 40+ months. The time frame depends on which USCIS office is processing your application. For example, if you live in Tampa, FL, it may take apprx. 12 months, but if you live in San Francisco, CA, then it could take 36 months.
It depends on what you are trying to qualify for. Generally, domicile is based on intent and some period of physical presence. In New Jersey to qualify as a "resident" for voting you must reside there fo 30 days prior to the election, registering your vehicle (60 days), filing state tax (183 days), receive in-state tuition (12 months), etc. There are different time frames to establish residency depending on what your looking to qualify for.
@@Subhanlaw I may consider joining the New Jersey Army National Guard and the education benefits they offer is federal tuition assistance and state tuition assistance. In order for a soldier to apply for state tuition assistance, they must be a resident of that state.
Your 1099 income would count as earnings that could be used to calculate your Social Security benefit amount provided that you report the 1099 income as self-employment earnings and pay self-employment taxes on your net profit. The earliest a person can start collecting social security benefits is 62 years old. Speak with your tax advisor to make sure your paying self-employment taxes on your 1099 income. Also, contact the Social Secuirty Administration to discuss your eligibility for benefits. You can also discuss calculating the difference in benefits if you decided to start collecting at 62 years old versus later. Hope this helps you.

Applying for a family or employment based green card depends on meeting the eligibility requirements and submitting the proper documentation to have the best chance of success. If applying for the DV lottery, then your chances are based on a random lottery. There is no limit on how many times you can apply for a green card. Each case is judged on a case by Cass basis. Hope this helps.
Generally, there are two ways to obtain legal permanent residency in the USA: (1) through family or (2) employment. Other ways include humanitarian relief such as refugee or asylum status. Yes. Green card holders are eligible to apply for in-state tuition for public colleges and universities if they meet that state school's residency requirements. Otherwise, out-of-state tuition will apply. For private schools, private tuition rates apply. Contact the schools you are interested in and ask about tuition and scholarships.
No. A green card is not required to immigrate to the 🇺🇸. To immigrate to the 🇺🇸, generally you'll need to apply for temporary or permanent residency. A green card is also known as legal permanent residency. Some work visas allow foreign nationals to live and work in the 🇺🇸 for between 1-7 years, which is known as temporary residency. Therefore, you'll need to decide on your intentions to immigrate and then determine your eligibility for a visa. See my other videos for some visa options.

for those who won the US Green Card Lottery DS260 and want to relocate to US, is it possible to enter US to a State different from that mentioned in the application.
What about serving in the military?
Hi Don.
Nice n very informative video. Thxs for sharing 👍👍👍

A green card holder is eligible for any job that he or she is qualified for. You can live and work anywhere within the 🇺🇸.
My green card was approved last march 21, 2021 as a Filipino...My question is when can i visit Philippines...and how many months can i stay Philippines
...
What legal activities can H4 Visa holders can do?
Hi Nasir. H-4 holders cannot live in the U.S. permanently, cannot apply for citizenship, and are generally not able to work, unless they have an EAD. H-4 holders can own a C Corp or LLC, but generally H-4 holders cannot work for their own business, unless it is they have an EAD, otherwise they'd need to hire a manager to oversee the daily operations. There is much more flexibility and certainty with a GC than an H-4. With a GC you have many more benefits and peace of mind. After getting employer based green card, can I quit my job or still need to work for my current company for at least
a few months? Thanks
To discuss your options, book a call with me here subhanlaw.com/book-call-page

If I get a green card,do I get benefit like fast visa in a short time for travelling ??

If your F-1 Student visa holder, what are some ways for international students in U.S. to stay in the United States 🇺🇸 after college graduation?
Great question! Some common options include: 1.) working on OPT, 2.) being sponsored for a work visa such as H-1B by an employer, 3. ) starting your own business and applying for an E-2 visa, if eligible, or 4.) continuing your education for a M.S., M.B.A., PhD., J.D., M.D., etc. Some students may also be eligible to apply for a green card through EB-1 or EB-2.
Hi Rawan. Glad you enjoyed the video and found the information helpful. I appreciate your comment. Also, it sounds like you know a family who was selected in the diversity visa lottery. That's great! Also, an applicant for a diversity immigrant visa does not have to file an affidavit of support also known as the form I-864. To satisfy this requirement, an applicant can show: (1) that s/he has funds to support the applicant and family members or has sufficient funds to provide support until employment is found, (2) the applicant has arranged employment, (3) friends or relatives will assure support, or (4) a combination of the above. According to the U.S. Embassies in Canada and Mexico, it states that "Non-essential" travel includes travel that is considered tourism or recreational in nature and “Essential travel” includes: work and study, critical infrastructure support, economic services and supply chains, health, immediate medical care, and safety and security.
How long does it take to get EAD after applying?
Hi Nasir. EAD processing times are currently between 7-15 months depending on the form category and USCIS service center adjudication the case. See EAD processing times here egov.uscis.gov/processing-times/
What happens to EAD once a person becomes a green card holder?
A green card serves as proof of a person's legal status and it permits a person to work and live in the U.S. permanently and it also allows for travel. An EAD is no longer needed once a person obtains his or her green card.

Your mom can contact the Social Security Administration or a Social Security benefits lawyer for more information.
thank you.
