The EVIDENCE has to SPEAK for itself. Otherwise, it is just a story. EVERY defendant that is telling the truth has EVIDENCE that speaks for itself AND there is something in their testimony that RESONATES with the ENTIRE jury and the ENTIRE jury SEES and AGREES with the defendant. That was NOT the case with these brothers. A jury has DIFFERENT people from all walks of life. That testimony and evidence has to RESONATE in such a way EVERYONE on the jury SEES and AGREES with it. In this case the defendants had a CHOICE either to stay in that house and experience consensual alleged "abuse" at that point or MOVE ON AND go live life as independent men. There is no law that allows revenge first degree. heir testimonies PROVE this fact. Lyle said his abuse stopped at 11. Erik said only his father abused him as a teen and as an adult. The charges were for first degree of BOTH parents not just one. Thus, their testimonies provided NO legal explanation for why they killed their mother because neither testified she was abusing them as adults.

Imagine yourself going completely bald at the age of 21. After 30 or 40 I can understand, but at 21? This was definitely a sign of abuse and toxic environment. I also lived my whole life under a rich narcissistic parent. I started losing my hair at just 19 due to stress and abuse. Everyone say it's genetics or hormonal. But I know for sure, kids living under abuse, lose their hairs early. Genetics might play a role but it comes later in life.
I don't understand how the jury or the judge could let this go as this was a huge sign I think.
PS. Just because somebody is a parent doesn't mean they can't be wrong or abusive. I have seen people with normal family dynamics having difficulty to believe the kids who are the victim of their parents.

In CA, motive is NOT needed for a first degree conviction. The FACT is they killed two unarmed people in their own home. The abuse accusations was only a defense strategy to play gullible emotional people on the juries. People that are gullible and emotional value someone's words over their actions whereas objective thinkers value actions over someone's words. IF the parents abused them then objective thinkers on the jury NEED to see SOLID evidence of that and not just words. SOLID evidence is the kind of evidence that convinces an entire jury like medical reports of transmitted diseases that can only be obtained by abuse, eye witnesses testifying they actually SAW the abuse in the bedroom, and third party witnesses like maids, pool repair people, etc testify they saw or heard abuse. In this case the third party witnesses testified the complete opposite and said the brothers were the ones acting like aggressive psychopaths and the parents were afraid of them

I'm afraid your blithe and simplistic comment tells me you have little understanding of the psychological dynamic and aren't equipped to put yourself accurately into such a hypothetical. I sincerely believe you have no idea what you would do. It's the same kind of error those who respond to hearing about abused wives with "Why don't they just leave?" make - and the psychological impairments to escape are even more pronounced when the coercion and threats have been trained in since youth.
I'd also bet the brothers instinctively understood (without anyone needing to tell them) that an abuser is most dangerous when their victims try to escape, and that it's one of the biggest, most unacceptable violations of 'the rules' in abusive families. By the brothers' account, that threat had been made overtly anyway ("try to run/expose this and I will kill you - I'd rather be on trial for murder than molestation"). But kids in these situations also grow up getting pretty good at recognizing what kind of triggers will be the most dangerous - it's a survival thing. Erik had already tried to do what most smart young people try to do in that kind of dynamic - carefully maneuver into a situation where he'd get out of the household without going "against" the parents (a rebellion he knew wouldn't be tolerated). So he'd made plans to move out to go to college. That was his way out. "Problem solved", right?
But... Jose wouldn't let him move out. Every severely abused child of an abusive narcissist parent understands what that means and why it was the beginning of the end. You're probably still thinking "What do you mean, 'wouldn't let him'? Erik was too old for Jose to stop him!" but this takes us back to a lack of understanding of the dynamics in play. You likely still think this is a simple game of checkers, when they were playing a game of nuclear chess, where every square is explosive and the rules keep changing to stop their side from winning. You probably think "It's just not that hard" but you likely won't get it until you're in a situation like that - I hope it's something you never have to learn first-hand.
Even if one waved a wand to remove all psychological impediments and coercive influence, and created a scenario where instead of gunning their parents down while watching TV, Lyle took the that moment to steal Erik away to an apartment instead, that would NOT be 'problem solved'. Again, only someone who doesn't understand these types of abusers would think it so simple. Jose would have, metaphorically or physically, come after them and tried to destroy them in retaliation. Whether it was by using his influence, sabotaging their sports, careers, lives and relationships or outright killing them (as threatened) there was no clean escape - not while he & Kitty were still alive. I'm not surprised it went the way it did when Lyle realized his little brother wasn't going to be "allowed" to escape. That doesn't mean I condone it - I'm just not surprised.
And if those young men genuinely feared Jose was so worried about Erik exposing the abuse if he left that he was ready to kill them both and have Kitty help cover it up, then there's a better chance than you'd imagine that that really was on the cards. Intelligent kids who get abused become extremely good at reading their abusers - I would back their predictive skills over an outsider's any day of the week. For me, the only question is whether they exaggerated the fear of actual death for the purpose of their murder defense.

I was relieved my mum had dementia & was put in a home. She still controlled me after her death in my mind . It's taken me 7 years to get more confidence to express myself. I ended up living with the wrong type of people because I was just trying to escape. It wouldn't surprise me if they felt happier in prison. When your own parent is a monster & hates you , ignored you, abuses you anywhere is better then tolerating their anger. Obviously they suffer from PTSD & having to have lemon on your food to block out certain tastes they are suffering still. From Lyles testimony, it’s also sounds like the parents may have had some underlining mental health, as someone who’s seasoned in knowledge with BPD and anxiety, what Lyle’s explaining about Kitty, is very similar to how people may react in situations; it mostly stems from abandonment, starting from childhood but any sort of betrayal (the affair of Jose) can provoke someone to react the way he’s sharing here, it can be explosive, full of passion but completely irrational. You’re emotions and logic can’t communicate, and sometimes there can be hints of narcissistic tendencies in there.

When men have too much money, they neglect their wife and goes off with other women causing the wife to feel neglected, insulted, worthless and unloved. The root cause for the problem was the father who caused the mother mental health and thereby she took it out on the boys. Between the 4, the dad was thee true monster and he made sure she becomes weak so she can’t leave him since “picture perfect family” is what he lived for. Yet behind closed doors and sound proof walls…all the dad’s plan and manipulation turned out to backfired on him but sadly and tragically the mother was also the victim. Ahe was so manipulated by the dad that she became dependent on the him. But deep down she did love her sons. Thanks to her the perverted photos which the dad had taken of the boys naked were proof of how sick and twisted the dad was. I wish their mother had been saved and had help them she would have been fine and the boys would still have their mother. All moms love their children no matter how hurt or angry they are or the harsh things they say…mothers do love their children. Her final sadness and pained tears in the initial moment of death seeing her two sons in that state, I can only imagined how sorry she must of felt leaving this world, leaving her two precious sons who she couldn’t protect or failed to protect, regretting her wrongs and her final thought how love and family can end this way.😭😭
I feel disgusted that their dad did those disgusting horrible sick things to them. But how does their dad even look them in the eyes or go out in public all those years and smile….as if he is normal or what he did was ok? The dad was a monster and I hope the grim reaper came for him that day with spiked changes….the dad was no dad but a devil a monster a sick twisted inhumane devil who had tortured his very own innocent sons.

Yep. Must be some kind of paid campaign here with all the people who think these "boys/men" were just sweet innocent victims.

Did the brothers ever take a lie detector test?

    • @shannonoreilly4695

No. Lie detector tests are rarely actually admissible in court because they’re not terribly effective. Another thing that people don’t seem to understand is that the prosecution never really went out of their way to discredit their abuse testimony. The prosecution was focused on trying to prove that the murders were premeditated. Other than Pam Bozanich stating that men don’t have the necessary equipment to be raped, she didn’t really cross examine Lyle about the abuse. Erik’s prosecutor tried to imply that Erik was gay and that he would like having sex with his dad and even made a comment about having “homosexual relations” with his brother. Judge Weisberg also never said they were lying - he said they weren’t allowed to use it as a defence because they weren’t women.
As for the second trial, the abuse testimony was excluded because the judge decided it wasn’t relevant because he didn’t consider it a valid excuse for the murders. Not that it wasn’t true. They were never impeached on their abuse testimony in court. Lyle didn’t testify in the second trial for various reasons, but one of them was due to the Norman Novelli tapes. He doesn’t actually say anything incriminating on them, but of course if they had the opportunity to cross examine him on the tapes the prosecutors would attempt to twist his words. They never actually made it into evidence because they were a nothing burger and mostly just Lyle talking shit with someone he thought was his friend.
The prosecutors made some tacky comments both in and out of the courtroom, but the “they made it all up” accusations was heavily pushed by the media.
This aspect of the case is incredibly misunderstood and it’s quite frustrating. They had around 50 witnesses from their family, teachers, etc. who corroborated that their parents were abusive, as well as respected psychological experts who deemed their testimony credible. It’s quite far fetched and cynical to think 50 people would perjure themselves just to get a paycheque, especially considering people in their family - the siblings of both parents testified corroborating the physical and emotional abuse - had been murdered. Several of their cousins testified that when they were younger, they witnessed signs they were being sexually abused, and their cousin Andy testified that Erik told him his father was touching him when they were very young, but Erik swore him to secrecy. The media tends to ignore the 50+ people who testified for the defence and rely on the mom’s one brother who claimed they weren’t abused (and who not surprisingly revealed in his testimony he was not close to the family at all). The prosecution also never bothered to hire their own psychological experts to discredit the brothers’ testimony. That’s quite telling - their focus was proving the murders were premeditated.

I try to figure out how they were ever convicted of anything more than possibly manslaughter, and the only thing I can come up is that the juries jealous that these young men came from money they didn’t have money. They came from a family that had money that’s the only thing I can think of why they were ever convicted

Now we can understand why they shoot their mom more times than their dad. She has violent rages and dump all her frustrations on her failing marriage on the boys. There is no love shown in the house. Ripping off his toupee is the final straw for Lyle. He is done.

So why did they initially say they killed her just bc she would have been a witness and to put her out of the misery the dad caused? They also said she couldn't live without him like as if they did her a favour by killing her
