    No ID to file a home deed documents but you need ID to vote, by alcohol, etc... Come on Georgia! Something needs to be done about this!

      My sentiments exactly like we do in Michigan, you can not walk into a county clerk office without identification and your deed talking about you own your property or someone else property in which the deed has to be notarized with the notary along with your signature and the third party. The state is working against the people.

      First, when living in a big town verses a small town-this makes a major difference because in small Townes the clerk pretty much knows there people and the office clerks are there in they position for years. BUT “THERE IS” a website in many counties that you can sign up to get notified or notifications if or when someone try’s to change your deed or file something on your deed. In my town (a small town) they do asked for identification per my clerk person.

    So glad my Dad's real estate agent told me to constantly check my Dad's deed after he passes away to make sure things were in order for this very reason. To cash a check you need a pin number, identification. Just to login to your email you need two step verification. They are targeting older people, especially people of color. This is heartbreaking.

    Owner affidavit, drivers licenses and letter sent to home owners would fix all this..30day wait period..Shame on the state if this is allowed to happen... get a lawyer....no way in he'll I'm paying rent on my own home..just like squatters ...sick...CHANGE THE LAWS

    This is a simple fix! It's obvious that the state is allowing this to happen. All the state has to do is add to the process whatever needs to be done to cut out the fraud. When I make certain changes to certain accounts, they send an email and mail to both addresses the information that is being done. Something can be done if the state really cares! It should not have gotten to this point without the home owner knowing. This is the STATES for you.

    I live in Michigan and someone stole my home in 2012. We went through Hell! Then the local Landbank tried to say it was abandoned when actually it was in litigation trying to correct the theft and prosecution of the person. Check your deed 1-2 times a year. It’s worth it.

    This has happened to a family member here in Dallas Tx as well. Dallas county just started requiring people to give their ID when filing July 2023. People are also filing that you've sold your property someone as well. There as many civil suits going on right now due to fraudulent deeds that have been recorded.

      b/c it’s an open secret that Black people get the least amount of justice and support in the court system. and therefore, it’s harder for Black people to fight these things.       Based on what title insurance does I don’t think they’ll help if someone steals your deed. But I believe your chances are better with having it in a trust. Title insurance is still a must because they’ll comb through documents to make sure the property is as advertised (no current liens or potential mishaps) but not if someone decides to put right impersonate you and steal your property

      @@Love-scriptureI don’t know how title insurance would help in these situations. Title insurance is typically purchased at the time you buy the house and presents you with a guarantee of a clean title and no “known” liens (because there can be private promissory notes, etc. never publicly recorded at the court house) at the time you close on your new property. Whatever happens after that point isn’t covered by title insurance.
      These poor people presented here are on their own and it’s sad! The way titles and liens are recorded needs to be updated and pronto! Maybe not officially recorded for 45 days to give the current owners notification that some entity has put liens on the property, etc. This was frustrating to see happen to people.

    For educational purposes only. The Fifth Amendment of the U.S. Constitution provides that "[n]o person shall be ... deprived of life, liberty or property without due process of law; nor shall private property be taken for public use, without just compensation."
    What they are doing is 'Criminal". It is called a non judicial foreclosure which is a direct Violation of the 4th Amendment of the United States Constitution. All these 'Out of State' "Corporations, Banks, LLC businesses ect..." have absolutely no Standing in courts against the real man or woman who resides in the alleged "foreclose property"
    For educational purposes only I would first file a "Lis Pendens" in the courts ( a Lis pendens is an official notice to the public that a lawsuit has been filed and a property has a claim against it....aka 'a Lien against my own home' ) and challenge "Jurisdiction" and make them prove that they have jurisdiction ( and they Do Not ) because they have No standing against the real "Man or Woman." For educational purposes only is my disclaimer for this comment....I pray it help someone...Most High God bless...peace be unto you all!

    I am here in California and I had a similar situation that someone showed up the property and said that the where a new owner - the first thing i did I attempted to get them arrested #2 I went to the police station and filed police report for grand theft ( keep in mind that the police station may tell you that this is civil and not criminal - at that point you need to insist that this is a criminal ( grand theft ) so therefore a police report must be in place for your safety
    3 I was in court in less to 14 days in front the judge to plead the case - once the judge was clear and understood that this was a scammer he continued the case to the point that no one can move one and proceed in any manner this got me to prosecute the thieves and got 6 of them in jail included a prominent attorney- I got my property back and reinstated the original title - it was not easy but was worthed I got 6 people in jail included an attorney in which got disbarred -

    A simple 2step authentication process would stop this overnight
    The original owner must download the app and will receive a pin and a text to the number on file with the county then be force to provide the pin that was text by entering it into the app
    This confirms the legitimacy that the owner of the property is really the owner

    Republican legislators passed laws that require identification to exercise your constitutional right to vote, but someone can steal your home with absolutely no identification at all.

    Bell County TX - my parents home - In 2019 Whitney Benson forged a document making it appear that my father signed it, in fact he was deceased before she filed the document and filed it against my parents home in Bell County Texas. The house is in Killeen, TX.
    In 2020 she was arrested with her mother while they attempt to sell it at a title company.
    She was charged and found guilty, judge gave her probation.
    In October 2023, Bell County filed a lawsuit against her and her mother for tax delinquency.
    She just recently retained a lawyer to help her sell the house and wanting to negotiate with me by giving me 50% of the money.
    First of all, I am not selling my parents' home knowing all of this was fraud. Second, I just want my home back that I inherited from my father, who was a Vietnam veteran. All she needs to do is remove her name off the property and change it back to mine. Simple as that. It is sad there are people who can easily steal your home with a stroke of a pen.

    Obviously the laws need to be changed.
    In the meantime - sign up for the notification system.
    Also - don't ignore strange foreclosure statements or debt statements just because you think they don't apply. Contact the bank institution about the notices. Maybe working with them can get the issue resolved before the property falls into full foreclosure and goes to auction.

    How is it legal to walk into the clerk's office, wave papers that "look official" and the clerk is not allowed to even ask for ID? Now the true owner is left having to fight the false claim and spend legal fees (maybe for years) to disprove the deed that was recorded. Same deed that was simply put on the table. I own this. See the "notary" stamp? We are talking about someone's home. The absence of logic in the 'process' is mind blowing,

    What’s shocking is that they are by paying their city/town to record documents and the town has no responsibility to ensure their recording are genuine or accurate. They could throw them up on the air and see where they stick to determine ownership. Change the law make somebodyresponsible for doing their job.

    The system need to do TF better because this doesn't make any sense at all. It shouldn't be this easy for someone to do this!! Make a law against this ASAP!!! Like send a code to the actual homeowners phone or give them a unique ID that only the real homeowner would know and have it in your system (The unique ID should not be on the deed) but the homeowner will have it in their file for situations like this!
