    Sorry it really should not be easy. The owner should have to show up in person and bring a number of identification before all is finalized. They should also be required sign a deed in person. The people involved that except or sell the property without verification of the true owner should be held responsible for any and all legal fees

    Why do home owners have to hire attorneys to get their properties returned to them after paying (and being forced to pay via their Lenders) TITLE INSURANCE?

      Response from Attorney Patrick MacQueen: That’s a great question. Basically, why isn’t my title insurance company paying to defend my property from title fraud/title theft? Title companies have come up with policies that provide coverage for title fraud/title theft, but these policies cannot be purchased in all instances and in all states. I think the reason that title companies don’t regularly insure these claims is because the title companies have the potential to lose a lot of money by defending the claims. There’s no real avenue to collect from the criminals after the title company pays out a loss.

    Bell County TX - In 2019 Whitney Benson forged a document making it appear that my father signed it, in fact he was deceased before she filed the document and filed it against my parents home in Bell County Texas. The house is in Killeen, TX.
    In 2020 she was arrested with her mother while they attempt to sell it at a title company.
    She was charged and found guilty, judge gave her probation.
    In October 2023, Bell County filed a lawsuit against her and her mother for tax delinquency.
    She just recently retained a lawyer to help her sell the house and wanting to negotiate with me by giving me 50% of the money.
    First of all, I am not selling my parents' home knowing all of this was fraud. Second, I just want my home back that I inherited from my father, who was a Vietnam veteran. All she needs to do is remove her name off the property and change it back to mine. Simple as that. It is sad there are people who can easily steal your home with a stroke of a pen.

    This is how blockchain technology can make a difference. the solution to all these title fraud is to tokenize real estate assets on the public blockchain with smart contracts. We have the technology, time to start implementing.

    My husband filed a release deed on our property and we still owe on it. That's strange to me

      That is interesting as only the lien holder can file a deed releasing their interest in the property. This usually happens once the loan has been paid in full. If you have additional questions about what was filed and the impact, you may want to contact a local real estate attorney.

    Do I need home title lock if I have a living trust?

      Response from Attorney Patrick MacQueen: These are really 2 different things and serve 2 different purposes. One is a monitoring service; the other is a deterrent. A living trust may deter someone from stealing property or forging documents, whereas title lock will let you know when it occurs.

    That is why a national registry by the federal government is a must. It can have sophisticated software that can scan documents for fraud and forgery. It then can identify the person who provides a special ID that can't be forged when they sign into their account. The special ID can be used at the local recorder's office who have access to the national registry for the purposes of scanning documents into the system.

    I'm not sure that he gave any good info. He chose to never truly share how to protect ur property before it's too late. We have no protection. You find out after it's been stolen, n then u hire a lawyer that u can't afford because ur shit just got stolen!!!! The laws are crap and doesn't protect anyone. U say how u can protect but u can't. Bad video didn't offer any proactive answers at all.

      Response from Attorney Patrick Macqueen: An LLC or a Living Trust may be enough of a deterrent to a criminal wanting to steal property. Either of these options requires more “checks” on the ownership of a property and more eyes on a transaction, which may result in someone moving on from your property to another.

    Total bs! It is not an easy thing to do. There is something called title insurance, a real notary, real title companies el al….. caveat emptor, let the buyer beware!

      There is no way to provide absolute protection against someone who wants to commit fraud. Those committing fraud will come up with new and innovative ways to steal real estate. That said, the goal for homeowners concerned about this issue should be to make things more difficult for the fraudsters and have them go elsewhere. Having a recorded document, title in the name of a trust, a loan secured by the property, or an LLC may require more effort to commit fraud and more involvement from lenders and title companies, which will hopefully deter someone from targeting your property.

    My fiances mom recently passed, and we discovered a deed that from my fiances grandfather towards my fiances mom. The deed stated that when he passed, she would get his land and rights to sell the oil on its property in Texas, and she gave him $10 in exchange. Unfortunately, my fiances mom and her grandfather had a falling out. She hadn't spoken to him in years. When we went to see on the property after she passed, we learned that he had passed some years earlier, and my fiances mom was never informed. After my fiances mom and her dad became estranged, a special warranty deed was created for a woman her grandfather was dating to get his land and oil with no exchange of funds involed and no notification to my fiances mom who had a deed prior to the special warranty deed. Which deed would hold up as the true deed in court?

      Response from Arizona Attorney Patrick MacQueen: Unfortunately, this sounds like it occurred in Texas and would require application of the laws of Texas. Best to speak with a Texas attorney and ask whether written notice of revocation of a deed is required and whether the recording of a new deed somehow defeats and existing, un-recorded deed.

    The elderly should always have a close family member help them with selling and buying things after they’re over the age of Seventy!!!!!! So many things have changed which can easily be a huge problem for senior Citizens!
    Even Insurance companies take advantage of seniors!!!

    Hi I'm a victim of this right now some one make fake documents and contract a title company to perform the transaction now I'm in problems cuz the county starts the process please helme with this problem with my land

      @@kellyzitlow hi is in California lake Elsinore unfortunately I contact 3 lawyers already but no one take the case cuz the property worth around 70k and they charge per hour around 300 and unfortunately I don't have money to cover the expenses a lawyer a this time that land was the heritage to build a house for my special needs kid
