  • Carnell Smith is the International Expert Spokesman on Paternity Fraud, Family Law and DNA testing issues. Smith is a Strategist, Coach, Advocate, Speaker and frequent contributor to TV, radio, newspapers, magazines and film projects Worldwide. The Georgia Law was sponsored by Representative Stanley Watson (HB369, 2002)19-7-54 passed 163-0 House, 45-5 Senate and the Governor Roy Barnes signed into law as Carnell Smith watched in-person on May 9, 2002.

    Men and boys have been successfully sued by mothers and the State Office of Child Support Enforcement (in USA) for paternity and child support.
    This includes males who:
    1. Didn't know the mother and never had sex with her
    2. Knew her but didn't have sex with her during the child's window of conception
    3. Was deployed out of country in Military during the child's window of conception
    4. Born sterile, had a vasectomy or became sterile due to medical reasons
    5. Married but separated and is not cohabiting with the child's mother
    6. Is one of multiple paternity candidates, but this fact was concealed from him.
    There's so much more about this topic than a lot of men and boys are aware of, that he's finally sharing in the first book in the Paternity Fraud series after Carnell's fight all the way to the US Supreme Court seeking a legal remedy for more than 1 million men and boys who are confirmed by DNA testing as not the father of the child tested.

      The women's advocates couch it as being "for the child". But if that same woman had opted for an abortion I would ask, would that be "for the child" as well? Women seem to want it both ways....which ever benefits them the most, fair or not, honest or not, truthful or not. If a man discovers he isn't the father of a child, whether or not he's developed a relationship with the child it shouldn't matter. That relationship came about due to a deception by the mother. And why don't we ever hear anything from these "advocates" as far as the mother's part in this??? They act like she had no part in it, and she's the one who perpetuated the fraud. We need some common sense in the family courts. You won't hear many women talk about this since they know they have a HUGE advantage in Family court. They should call it "woman's court". If the man wants to continue to have a relationship with the child then so be it, but he shouldn't be required to have to pay to do it.

    There needs to be more light shed on this issue. Paternity fraud should be prosecuted to the fullest extent of the law. If you miss child support payments you go to jail and possibly lose your main source of income or perhaps career. The same should be said for deceptively placing the responsibility of a child on the wrong man.

      I'm Carnell Smith. I agree with you 💯 percent that DNA paternity testing at-birth is the best solution.
      It would expose paternity fraud before the child was 1 month old. Moms should not be allowed to use fraud, deception, lies or mistaken identity to get child support from the man that didn't cause her pregnancy per her claims that he did. Moms generally know if there's more than one paternity candidate. Men don't!

    DNA testing at birth regardless of relationship status could be a great thing.
    Imagine how much crime will cease or how much money will be saved in investigations. Someone commits a crime and their DNA is immediately matched, identifying them almost instantaneously.
    And of course, establishing paternity from onset. So if this is not your kid, paternity can be determined by matching collected samples.
    I see this as a win win for everyone involved, even the moms who have no clue which dude is dad and kid grows up knowing exactly who that is.

    • @baltsosser
      @baltsosser 6 ปีที่แล้ว +2

      It could be helpful. Some diseases are present in the DNA at birth, but only manifest themselves later on, sometimes when it is too late to respond appropriately. If we altered the testing done at birth, a small thing since we draw blood on kids for other tests, the results might be enlightening. We could then gather the DNA testing results for research or defense of paternity as in the case of this video.

      Marital paternity fraud examples: Morgan Wise of Texas, 3 of 4 kids not his by ex-wife and Dennis Caron of Ohio, 1 of 1 kid not his by ex-wife. The family law should not contain a conclusive presumption of paternity that a kid born while a man is married to his wife is automatically his.
      Some wives are cheaters or are separated and get pregnant with the other guy's kid.
      If the DNA paternity test shows 0% paternity, the man should win his divorce for adultery and pay no alimony nor child support unless he had agreed in writing for medically assisted pregnancy, surrogacy or formal legal adoption of an unrelated kid.

    "The courts want someone to support the child". OK, how about the guy who ACTUALLY fathered the child? I'd start there first. If mommy doesn't know who she spread her legs for then it's ALL on mommy. The courts shouldn't reward women being irresponsible at the cost of the most convenient man to point a finger at.
    I don't see Carnell or anyone advocating for men to get out of paying child support for children THEY actually fathered......but if a man didn't father a child, he shouldn't be forced to pay for them.

    • @tidefanyankee2428
      @tidefanyankee2428 5 ปีที่แล้ว +1

      Then the other woman (another advocate) says "if you have taken responsibility for the child, if the child looks at you as a parent" etc...etc....etc.... Yes, due to a fraud perpetuated by the mother. Many, in fact most of these men didn't know they weren't the father, they took the mom's word for it. That is a deception and it shouldn't be rewarded.
      No one is saying that a man can't act and behave as a parent to a child that's not his, he just shouldn't have to be required to PAY for the privilege. Again, the courts are rewarding mom's lie.... Can anyone name another situation where you can knowingly, willfully lie and deceive another in court, for financial benefit and the court backs you up??? I can't. The family courts need to join the other courts in the 21st Century where DNA DOES matter, and they can't substitute emotions and "feelings" for facts.....

    • @tidefanyankee2428
      @tidefanyankee2428 5 ปีที่แล้ว +2

      Would this even be a question if a woman discovered they had been given the wrong child to take home from the hospital??? Say there was a mix up and two weeks after each baby was taken home it was discovered? Would a court say "no, you can't switch them back so you have the child that's actually yours"????? No, they wouldn't, the situation would be corrected. But when something ONLY effects men, then the courts get a "bit" more loose with their interpretations. It's not family court, it's woman's court.

    Maybe some of the right to life for us should start supporting these kids they might change their tune. That statement came from a biology instructor I had when I was in college. Also if it’s all about the child then it should be all about the child to know who their rightful parents really are.
    What would be the problem with mandatory DNA testing?
    The way things are you almost don’t even need to know who the father is with the weight DNA is kept at birth you’re already in the database you should be able to find who the father is eventually

    If the DNA test says you are not the father you shouldn't have to pay, and if the father has been paying for a child that is not his and DNA test prooves it's not his baby then the woman has to pay back all that child support money she received over the years for that baby because she new the baby was not her husbands and even if she didn't know the babys was not her husbands she still accepted monies when she knew the baby may not have been her husbands. This should be treated as theft by deception and depending how much money she received determines misdameaner or felony theft and if she refuses to pay back the money she gets sent to jail or prison accordingly, also the mother must disclose the name of the real father in open court, Plus if the man finds the baby is not his after he has fathered the baby he can sew the mother for emotional stress she has caused the man and the man should get paid for this too. Just like the men in jail or prison for not paying child support for they're real babies, this way the woman are held responsable for what they do just like the man, no acceptions.

    Are you serious? The men’s paternal and therefore civic responsibilities to their (assumed) biological children are predicated on a specified biological consanguinity, therefore: not my child, not my problem. It becomes then a state sanctioned de facto reward for infidelity. How is this not, on its face, glaringly obvious? There are even cases where non-consanguine support is still upheld even when the true father is known, shown to have biological progenitor, and is still relieved from any legal and pecuniary responsibility. How is this justice?

      @PaternityCoach  5 ปีที่แล้ว

      Hi Wendy, thanks for your comment.
      Your statement about unprotected sex is true.
      In fact, one of the most overlooked points about Paternity Fraud is that the child's mother is the person having unprotected sex for the child(ren) involved and she oftentimes will not disclose that there are "multiple paternity candidates" to her husband, boyfriend or fiance.
      This is deliberate deception because the child's mother is the usually the only who knows for sure that she had unprotected sex with multiple guys during the "window of conception".
      There's a ethical, fiduciary and moral duty to disclose "material facts'.
      Per Morgan Wise he was married and his wife didn't tell him about her affairs.
      Per Dennis Caron, his wife didn't tell him about her unprotected sex partners before he married her because she was pregnant.
      Carnell Smith's ex-GF had unprotected sex with a guy in another state and chose to hide that information from him when she said "I'm pregnant and you're the father".
      We can't trust that every mother is going to tell the truth about paternity, especially when there's a lot of money and property involved.
      DNA testing at-birth will help every child know the truth about their biological parents and take the profits out of Paternity Fraud.

      Thanks for commenting Kevin. Fortunately, all women are not like this and there are virtuous women with integrity that would NOT participate in the methods that lead to paternity mysteries.
      My friends Dennis and Morgan were married men, that faced the same challenges with unjust laws that refused to use true facts in the Family Court.
      It appears that some states interpret "best interest means the man's right against slavery or involuntary servitude will be ignored'. Note - the Judge stripped Morgan Wise of all parenting time after DNA confirmed 3 of 4 kids from his wife are not his biological kids.
      Warn the men and parents of teen boys that Paternity Fraud exists. CarnellSmith.com

    This is true!
    I just went to see a lawyer yesterday. Turns out my 19yr old daughter isn’t my biological child.
    I was told nothing could be done.
    This is disgusting of our criminal governments.
