Not JUST the company. I hope they go after the specific people involved and sue them as well as it wasn't the 'Company' the broke the NDA, it was the specific people themselves, who then turned around and used it for the company. The company is liable, but less liable than the specific people who broke the NDA. So I hope Valve sues each of the people themselves, on TOP of the Verge, destroying the company and the lives of those who broke the NDA under bad faith. I myself make sure I never ever do anything to get under an NDA specifically because of this kinda stuff. I've only ever been under 1 NDA, for playing 1 game alpha I played for about 1 hour then stopped cause I personally didn't like it. And and never touched or signed anything close to an NDA since, and hopefully never will. NDAs are not your normal contract, it isn't something you just blindly sign and ignore. You make sure if an NDA is involved you sit up, straighten yourself out, and take it very seriously. Next to being charged with Murder, there is no other thing more life destroying than an NDA.

Edit2: Not discussed in this video but I had some time to mull it over more and here is my conclusion about the whole "lol we outsmarted Valve with ESC key because common sense means we can break the ToS". Programmer here. Pressing ESC on a dialog box generally is accepted to mean the "safest" option from the dialog should be inferred as the selection. In this case there is only one option... to agree to the terms and conditions. Thus it is reasonable this is what Valve had intended that to mean (though it's more reasonable they forgot to disable ESC interactivity). It does not make sense that ESC should mean a rejection of the terms and conditions as no such selection option appears in the dialog. Now if you want to argue Valve did not follow UX best practices and had intended for ESC to mean rejection (I find it far more likely they didn't think to disable ESC) you're going to have to provide evidence that that is what they intended, since again it goes against commonly accepted UX guidelines. Edit: Looked up Microsoft's UX guidelines to see what exactly they had to say. Looks like when you close a dialog box, it acts as if the user has pressed a "Cancel" dialog box button, even if the dialog box has no such button. Guidelines are the application should handle these two events the exact same way. What to do if the dialog has no Cancel button is not covered. So I guess that specific condition is left undefined so we can fall back on performing the "safest" action out of the available options. Edit3: I should also mention "dialog box fatigue" which is the phenomenon where users will not read dialog boxes and try to click through them until they get what they want. Pressing ESC or closing the dialog box for the "safest" option automatically is often a part of this. There was a bit of a fiasco where users would close the "Windows 11 upgrade scheduler" dialog box offer thinking the "safest" option was to not update, but Microsoft felt the "safest" option was to update the PC to Windows 11 so it could benefit from the latest security features and patches. It's not an unreasonable approach to take when you think about it but it's also easy to see how it could blindside many people.
Lay person here, computer user since the 1980's. For as long as I can recall, the Esc. button has meant 'cancel' as in, 'I don't want to make a definitive decision at this time' so it is akin to pressing a cancel option. I don't know about gaming programming, or at most I know a very little, but certainly not enough to speak on it, but without the user giving explicit consent by pressing 'Accept or Agree or whatever the devs want to call it, I think Esc. should mean 'cancel/ reject / I do not agree / go away. As a lay person, I think this, because almost everything else we do, from accepting browser cookies, to writing documents, up/downloading pictures, to even a lot of in-game options, that's what a good majority of people think of it as. I think I agree with you, that Valve probably just forgot about the Esc. key when they created the option. If they didn't forget and designed that intentionally, that's scummy and could possibly get them into some trouble.
The short version is: If Valve intended for the terms to be optional, there would be a "Disagree" type button. Because there is not, a reasonable person will understand that they are expected to agree as a condition of playing the game. You don't have to agree. Playing the game is agreement.
The only button on the dialog was also "OK", not "Accept". The "OK" button is the default button you place on any information dialog, as a way to dismiss the dialog after reading it. A common Microsoft dialog would actually use the "Yes" and "No" buttons if it was an actual choice, or have the "Cancel" button to abort. Since the NDA dialog only had the "OK" button, we can definitely assume that this was just meant as information, and not a choice. You can argue that Valve should have just worded it slightly differently, like "By playing this, you agree to not share this publicly." But that is more lawyer territory than it is programmer, so I can't comment on that. But either way, Valve doesn't need a reason to ban someone from their playtest. I am sure they could just ban anyone they want for any or no reason. So rather or not the article writer was banned for posting the article doesn't actually matter in the end, it will only matter if Valve tries to sue them for it.

I don’t regard the in-game dialogue box as a NDA. It’s written as a request rather than demand, does not state it’s a requisite to play the game, and doesn’t present accept/reject options. However, I’m British and don’t know US commercial law. I regard this as Valve controlling their marketing over a game they haven’t released yet. I don’t think there’s any legal aspect between The Verge and Valve, just The Verge were jerks and Valve controlling of information.

Here's the truly funny part: I don't know about Twitter, but it's already been confirmed on Discord that when messages are "deleted" they aren't actually erased, at least not right away. The messages they deleted are simply hidden from all users, but still remain on the server for several months, if not longer. This is so Siscord can cover their ass in case of legal obligations, the messages can be retrieved for quite some time. So, if either party in this case files a lawsuit over the video or the conversations related to it, those messages can be pulled back and verified in court. Checkmate, gaslighters. 😆😁😎

In contract law cases such as this, I do believe that a non clarified 'No', is an insinuated/assumed 'Yes'. Because his answer is 'Yes' in the first place. But I ain't no attorney, so don't take my word on that.

Edit2: Not discussed in this video but I had some time to mull it over more and here is my conclusion about the whole "lol we outsmarted Valve with ESC key because common sense means we can break the ToS".
Programmer here. Pressing ESC on a dialog box generally is accepted to mean the "safest" option from the dialog should be inferred as the selection. In this case there is only one option... to agree to the terms and conditions. Thus it is reasonable this is what Valve had intended that to mean (though it's more reasonable they forgot to disable ESC interactivity).
It does not make sense that ESC should mean a rejection of the terms and conditions as no such selection option appears in the dialog.
Now if you want to argue Valve did not follow UX best practices and had intended for ESC to mean rejection (I find it far more likely they didn't think to disable ESC) you're going to have to provide evidence that that is what they intended, since again it goes against commonly accepted UX guidelines.
Edit: Looked up Microsoft's UX guidelines to see what exactly they had to say. Looks like when you close a dialog box, it acts as if the user has pressed a "Cancel" dialog box button, even if the dialog box has no such button. Guidelines are the application should handle these two events the exact same way. What to do if the dialog has no Cancel button is not covered. So I guess that specific condition is left undefined so we can fall back on performing the "safest" action out of the available options.
Edit3: I should also mention "dialog box fatigue" which is the phenomenon where users will not read dialog boxes and try to click through them until they get what they want. Pressing ESC or closing the dialog box for the "safest" option automatically is often a part of this. There was a bit of a fiasco where users would close the "Windows 11 upgrade scheduler" dialog box offer thinking the "safest" option was to not update, but Microsoft felt the "safest" option was to update the PC to Windows 11 so it could benefit from the latest security features and patches. It's not an unreasonable approach to take when you think about it but it's also easy to see how it could blindside many people.

Lay person here, computer user since the 1980's. For as long as I can recall, the Esc. button has meant 'cancel' as in, 'I don't want to make a definitive decision at this time' so it is akin to pressing a cancel option. I don't know about gaming programming, or at most I know a very little, but certainly not enough to speak on it, but without the user giving explicit consent by pressing 'Accept or Agree or whatever the devs want to call it, I think Esc. should mean 'cancel/ reject / I do not agree / go away.
As a lay person, I think this, because almost everything else we do, from accepting browser cookies, to writing documents, up/downloading pictures, to even a lot of in-game options, that's what a good majority of people think of it as.
I think I agree with you, that Valve probably just forgot about the Esc. key when they created the option. If they didn't forget and designed that intentionally, that's scummy and could possibly get them into some trouble.
The short version is: If Valve intended for the terms to be optional, there would be a "Disagree" type button. Because there is not, a reasonable person will understand that they are expected to agree as a condition of playing the game. You don't have to agree. Playing the game is agreement.
The only button on the dialog was also "OK", not "Accept". The "OK" button is the default button you place on any information dialog, as a way to dismiss the dialog after reading it. A common Microsoft dialog would actually use the "Yes" and "No" buttons if it was an actual choice, or have the "Cancel" button to abort.
Since the NDA dialog only had the "OK" button, we can definitely assume that this was just meant as information, and not a choice. You can argue that Valve should have just worded it slightly differently, like "By playing this, you agree to not share this publicly." But that is more lawyer territory than it is programmer, so I can't comment on that.
But either way, Valve doesn't need a reason to ban someone from their playtest. I am sure they could just ban anyone they want for any or no reason. So rather or not the article writer was banned for posting the article doesn't actually matter in the end, it will only matter if Valve tries to sue them for it.

But it was requesting some courtesy... and by ignoring it, and confirming that (whoever) knew about it, speaks to their character. There might not be a blacklist. But I don't know if they'll be invited to future parties.
Oh... and in my layman's interpretation of slander. If it was a reasonable assumption to make at the time, it's not slander.
But this didn't seem like a question of law... but a question of character... Seems like it comes down to that either way here.

I don’t regard the in-game dialogue box as a NDA. It’s written as a request rather than demand, does not state it’s a requisite to play the game, and doesn’t present accept/reject options. However, I’m British and don’t know US commercial law. I regard this as Valve controlling their marketing over a game they haven’t released yet. I don’t think there’s any legal aspect between The Verge and Valve, just The Verge were jerks and Valve controlling of information.
Not gonna lie, Righteous Indignation SidAlpha is my favorite SidAlpha. I do hope this all works out in a civil way, but given how Mr. Warren has behaved so far, unlikely, but I can still hope.

Here's the truly funny part: I don't know about Twitter, but it's already been confirmed on Discord that when messages are "deleted" they aren't actually erased, at least not right away. The messages they deleted are simply hidden from all users, but still remain on the server for several months, if not longer.
This is so Siscord can cover their ass in case of legal obligations, the messages can be retrieved for quite some time. So, if either party in this case files a lawsuit over the video or the conversations related to it, those messages can be pulled back and verified in court.

Honestly if I was in your shoes after a bit of pointing out flaws in his claims I woulda just been "take me to court for defamation if you really think it is true. You blantently refuse to look at the video properly and instead filter out what you dont like and claim it as what is said when it is not the case, a lawyer would tell you the same."
In contract law cases such as this, I do believe that a non clarified 'No', is an insinuated/assumed 'Yes'.
If 'Tommy Boy' there, can not, or will not, answer that question with the confirming 'No';
- He DID play the game.
- It is NOT false information.
- And he is refusing to answer as such, as he (possibly) realizes that it would incriminate him. Because his answer is 'Yes' in the first place.
