Owner not using the building after evictiing the tenant on the ground of own use

  • Suppose the building owner neglects to occupy the building he obtained as per order from the court by evicting his tenant under the ground of Own use under section 11 (3) of Kerala Building (Lease and Rent Control) Act of 1965 within one month of eviction of the tenant and vacate or quit occupation within six months. In that case, he may lose possession of the building and the court has the power to reinstate the tenant. The tenant can apply to court for restitution of his right as a tenant and reinstate him in the building if the owner is unable to show reasonable cause for non-occupation.
    Under the Kerala Rent Control Act, specifically Section 11(3), a landlord can evict a tenant if the landlord requires the building for their own occupation or any member of their family dependent on them. However, the act also provides safeguards to prevent the misuse of this provision.
    If a landlord evicts a tenant under Section 11(3) and then fails to occupy the building without sufficient reason, there are several potential consequences:
    Re-occupation by Tenant: The tenant may have the right to apply to the Rent Control Court to be restored to possession of the building if it is not occupied by the landlord or a dependent family member within a specified period (usually one month) after eviction.
    Penal Actions: The Rent Control Court may penalise the landlord for misusing the provision to evict the tenant.
    Loss of Trust: The landlord's future claims under the Rent Control Act may be scrutinized more strictly, affecting their credibility in subsequent eviction proceedings.
    These measures are intended to ensure that the act's provisions are not abused and that tenants are protected from unjust evictions.
