  • In Somalia, poverty is forcing women into sexual exploitation as men from the country who've emigrated to the west return to take advantage of them.

Many of the women are refugees who are lured by the offer of a better life abroad. They often go through a fake wedding ceremony. The women are later abandoned as the men return to their families in the West. It's a practice known as vacation marriage. Jamal Osman has been to Nairobi, where he put together this exclusive report. He was assisted by Nick and Deka Hassan.

My father is one of the men who do this. I am ashamed to say that he has "gone home" to Somalia (he has lived in the west for 20 years) and married a 21 year old (younger than most of his 9 children). He drove my mother to be mentally unstable and left his children with no regard for their futures. He has no regrets and does not even see himself as a wrong doer. What's worse is that all of our family, his family, our family friends and the wider community took his side and painted my mother (who was married to him for 30 years) as this jealous crazy lady who is upset that he left her for a "younger and purer" young lady. I wish I could say that at least I had my mother through this ordeal but she has always been a bitter, extremely angry, deeply traumatised and mentally unstable person. I was the 2nd youngest child and I never got to see my mother as a stable and happy person. This is something for which I can never forgive my father.

Secret marriages are forbidden in Islam
In the name of Allah, the Gracious, the Merciful
It is a condition of a sound marriage that it be announced and attested to publicly. A secret marriage, which is only witnessed by a few people in private, is disapproved (makruh) at best and unlawful (haram) according to some scholars. It is potentially harmful to those affected by it, as it almost always involves deception or at least gross omission, especially if a man marries an additional wife in secret and without her consent.
      Allah said:
Marry them with the permission of their families and give them their due as is good, chaste women, neither fornicators nor secret mistresses.
      Surat al-Nisa 4:25
Scholars have said that this verse prohibits secret marriages without witnesses, by drawing an analogy between a ‘secret mistress’ and a secret marriage.
      Ibn Taymiyyah writes:
Malik obligated announcing the marriage in public. A secret marriage is a type of prostitution. Allah Almighty said: Chaste women, neither fornicators nor secret mistresses. (4:25) Thus, a secret marriage is a type of secret mistress.
      Source: Majmū’ al-Fatāwá 32/102
Scholars also refer to the statements of the Prophet (s) commanding the announcement of marriages in public.
Aisha reported: The Messenger of Allah, peace and blessings be upon him, said:
      أَعْلِنُوا هَذَا النِّكَاحَ وَاجْعَلُوهُ فِي الْمَسَاجِدِ وَاضْرِبُوا عَلَيْهِ بِالدُّفُوفِ
Announce this marriage publicly, conduct it in the mosque, and strike the drums for it.
Source: Sunan al-Tirmidhī 1089, Grade: Hasan
Muhammad ibn Hatib reported: The Messenger of Allah, peace and blessings be upon him, said:
      فَصْلُ مَا بَيْنَ الْحَرَامِ وَالْحَلَالِ الدُّفُّ وَالصَّوْتُ
The difference between an unlawful and lawful marriage is the beating of drums and the raising of voices.
Source: Sunan al-Tirmidhī 1088, Grade: Hasan
Abdullah ibn al-Zubayr reported: The Messenger of Allah, peace and blessings be upon him, said:
      أَعْلِنُوا النِّكَاحَ
      Announce the marriage.
Source: Ṣaḥīḥ Ibn Ḥibbān 4066, Grade: Hasan
Based upon this evidence, it is said that a marriage conducted in secret is invalid and annulled, even if it has two credible witnesses and permission from a guardian.
      Abu Bakr Abdul Aziz said:
      نِكَاحُ السِّرِّ بَاطِلٌ؛ لِأَنَّ أَحْمَدَ قَالَ إذَا تَزَوَّجَ بِوَلِيٍّ وَشَاهِدَيْنِ لَا حَتَّى يُعْلِنَهُ
A secret marriage is invalid, as Ahmad said: If he is married with a guardian’s permission and two witnesses, it is not so until it is announced publicly.
      Source: al-Mughnī 7/83
This was also the opinion of Imam Malik. However, most scholars said that a secret marriage is valid if it meets the condition of two credible witnesses and a guardian. It is in legal effect and will not be annulled, although it is disapproved to do so.
      Ibn Qudamah writes:
If the marriage is contracted with a guardian and two witnesses, but he keeps it secret or conceals its attestation, that is disapproved but the marriage is valid.
      Source: al-Mughnī 7/83
      And Ibn al-Qayyim writes:
The Lawgiver has set conditions for marriage, in addition to the contract, in order to cut off any suspicion of promiscuity, such as announcing it, the guardian, and preventing a woman from conducting it by herself. It is encouraged to publicize it, even recommended to beat the drums, raise voices, and hold a banquet.
      Source: I’lām al-Muwaqqi’īn 3/113
This disapproval should not be taken lightly. The important point here is that the legal ‘validity’ of an act does not mean it is ethical or morally sound. If some scholars accept the validity of a secret marriage, that in no way implies they are endorsing or encouraging the act.
Nevertheless, many scholars said that such a secret marriage resembles adultery despite being legally valid. Umar ibn al-Khattab was particularly strict about this matter.
Abu al-Zubayr reported: Umar ibn al-Khattab, may Allah be pleased with him, was presented with a marriage which no one had witnessed except one man and one woman. Umar said:
This is a secret marriage and I do not permit it. If I had known of it beforehand, I would have stoned them.
      Source: al-Muwaṭṭa’ 1136
This was a rhetorical threat to indicate the seriousness with which the matter should be taken. If there were no witnesses at all, the consensus of the scholars is that it is an act of adultery.
      Ibn Taymiyyah writes:
As for a secret marriage, the attestation of which is concealed and witnessed by no one, it is invalid according to the prevalent opinion of scholars. It is a type of illicit intercourse.
      Source: Majmū’ al-Fatāwá 33/158
In sum, secret marriages without witnesses are unconditionally forbidden in Islam as they resemble adultery. If a secret marriage meets the minimum legal requirements of two credible witnesses and permission of a guardian, then at the very least it is morally disapproved if not unlawful. Believing men who fear Allah would be wise to avoid contracting a secret marriage, especially if they are marrying a second wife behind the back of their first wife, her family, and her children.

And you will never be able to be equal just between wives, even if you should strive [to do so]. From quran from Quran...
      Allah said
Verily, Allah orders justice and good conduct and giving to relatives and he forbids immorality and bad conduct and transgression. He admonishes you that perhaps you will be reminded.
      Surat An-Nahl 16:90
      And Allah says
O you who believe, be persistently standing firm for Allah as witnesses in justice, and do not let the hatred of a people prevent you from being just. Be just, for that is nearer to righteousness. Fear Allah, for Allah is aware of what you do.
      Surat Al-Ma’idah 5:8
“A man who has two wives and who is completely inclined to one and who ignores the other emerges with one side of his body paralysed in the Day of Judgment.” (Hadith; Ibn Majah, Nikah, 47; Mishkat al-masabih, 2/196)
A woman does not consent to share her husband with another woman under normal circumstances, and no woman would like to marry a married man unless she has to.
It is a necessity of belief that polygamy is right. However, to believe it does not necessarily mean for a woman to consent to the second wife and approve it.
No believer father would like his son-in-law to marry a second, third or fourth woman along with his daughter. The jealous nature of the woman and the affection of the father for his daughter disapproves this. As a matter of fact, the daughter of our beloved Prophet, Sayyidah Fatima, objected to her husband, Ali’s marrying of a second woman. If it weren’t permissible to object, Sayyidah Fatima, who was brought up by our Prophet, would not have objected. The Messenger of Allah would have warned her and ordered her to consent to her husband’s wish. However, it did not take place like that. On the contrary, the Messenger of Allah, who saw that his daughter was worried, asked Ali to give up his wish and told him that if he did not give it up, he could marry another woman after divorcing Sayyidah Fatima. He did not consent to Ali’s second marriage to depress his daughter.
By considering that act of the Messenger of Allah, it can be stated that Muslim daughters and fathers may object to the second marriage of their husband or son-in-law.
"I heard Allah's Apostle who was on the pulpit, saying, 'Banu Hisham bin Al-Mughira have requested me to allow them to marry their daughter to Ali bin Abu Talib, but I don't give permission, and will not give permission unless 'Ali bin Abi Talib divorces my daughter in order to marry their daughter, because Fatima is a part of my body, and I hate what she hates to see, and what hurts her, hurts me.'" (Bukhari, No. 4887)

Saying "Men are Polygamous by Nature" is against Islam..?
Why do almost all Scholars claim that men are polygamous by nature with no Islamic claim? This makes men think it's okay to open doors and feel for multiple women, when in the west, where everyone is treated "equally" women are equally polygamous, cheating on their husbands, for "fun" not for "love or emotional" reasons as many put it.
This means that both sexes are vulnerable in the same way.
I think the society allows men to behave this way or think this way, because it's a male dominated world, and they supressed women since the beginning of time, when in the end, both men and women are the same, committing the same sins. However, the world makes it okay for men to be this way, claiming its their nature. Ever wonder why Muslim parents will abandon their daughters forever if they caught them speaking to a guy but will not do anything if their son goes out and sleeps around with women? Why is that? In the Shariah, both is a sin, both are haram!
True women may be of more fitnah towards men, because women have more awrah to cover, yet they fail to, but most men are naturally in hijab, hence the reason for lesser fitnah for women.
The Polygamy allowed also speaks about helping widows or orphans, anyone who can clearly study the Quran can understand that. The Sahabah and Prophets mostly married older women who had children from other men who had died. If men want to follow the example of the Prophet, they should follow it in the way he practiced it. Wars were common, many women were left without homes or men to take care of them. Had Allah disapproved, we would suffer social issues.
There are many many many men who are happy with one wife, who dare not think about other women. Even having a thought of a non-mahram while married is a huge sin, how can one approach the thought of Polygamy knowing this is wrong? We see here the clear reasons for Polygamy. Some claim their wife is too fat or too old so they want to get another wife? It's because women are too busy with children they don't have time to even think of getting another man. Though the arab world makes it look like women have no physical desires or feelings.
The fact that society has suppressed this, is proof why they claim "Men are Polygamous by nature" I would like to see any type of proof from Islam that this is true? Men were more free to do whatever they pleased, this is the real reason, before Islam and after Islam. It's not a religious view, its a social view.
We Muslims are taught to follow the Quran and refer to sunnah and hadeeth, if men want to remarry, then why dont they read the verse on polygamy and refer to the sunnah and hadeeth? There are clear hadeeths that our Prophet pbuh the sahabah remarried older women to help them and be noble men for the sake of allah subhanwaltala, not for sexual reasons as Scholars put it these days.
Also when Hazrat Ali wanted to take a second wife for the reasons I put above, it made Hzt Fatima upset and Prophet pbuh forbade Hazrat Ali remarrying a second wife.
So if anyone can show a claim from ISLAM that men are polygamous, I would like to see. Please don't bring sciencists' claims into this, because even they claim things that go against Islam.

My dad tried to do this to my mom, but instead of Kenya/Somalia, they are from Ghana and they were legally married(divorced now). They got married, he got her pregnant, then he disappeared. He didn't think she was smart or connected, but she managed to get him placed on child support and he was arrested in the US for child abandonment and his wages were garnished. My mom moved to the US shortly after, then I came here as a child. To this day(30 years after the fact), he is still resentful that there were consequences to his actions and we have no relationship. I am his eldest but because I am a girl, I am dead to him. He has since gotten remarried and has 4 children, one of which is a boy, and he does not want anyone in his family to have a relationship with me. There is a disease of narcissism and entitlement that many African men exhibit (I understand it happens everywhere, but we are focussing on Africa right now). When our men and women start adopting some of these sociopathic tendencies, it's no wonder the continent as a whole is in such bad shape.

@@jlynch7411 I agree. This is one of the reasons I think Polygamy in the right situations and in its pure form(the way our ancestors practiced it), can really benefit society. Not just 'secret marriages' or religious marriages, but legal marriages where the rights of all the women and children involved, are protected and recognized by governments. That could curb some of these issues. There also needs to be a system of accountability and punishment for men who do these things.

Being a virgin doesn’t give you dignity and honor maybe it’s a system that is messed up that needs to be changed. A woman’s worth is not her body or sexuality. She is worth much more than just this. This happens in Pakistan and India and many other countries maybe it’s the men that need to stop exploiting women and as a society we need to teach them this is WRONG and maybe we should stop blaming victims. Men with this mentality exploit women that are not of their country what makes us think they won’t exploit their own sisters. Look now they are it’s a sick game of power and dominance. This is an epidemic. My heart goes out to these women and all women of the world suffering from sexual exploitation.

He told me that he will give me the world, take me places, rent and furnish a house for me but i have to first get married to him without telling my parents and I'm grateful i was able to discern that his intentions were not pure and refused to accept his proposal. Somali men tend to want to take advantage of young girls and women who are looking to change their lives and it's sad. I hope I'm able to contribute in anyway i can into enlightening our girls and women so that their lives don't turn out to be miserable. @suri m ,
When you’re reading a post from a Somali girl talking about Somali men, it’s quite easy to mistake yourself that you’re reading a post from an EDL or BNP member….the strongest women in the world! We usually see the white man using racial stereotypes to describe the black men ‘they don’t work, they’re lazy and sleep during the day and deceitful with women’ that’s how white men describe black men…black women calling their men lazy criminals is something I’ve never seen in my life, they understand fully the position in society that their men are in and the struggles they face. The Somali girl doesn’t even understand that their people faces a WAR, and seen dead bodies, and had to leave all of their possessions and dreams behind, and had to take lower jobs like taxi drivers and warehouse workers in hopes that they’re children could create a middle class…what they didn’t realise is how strong Somali girls are and the society they’ve created as first generation Somali girls in the west, is one of self hate…because they’re strong.

Shame on ALL men, the concept of a rich old man marrying a poor young girl from back home is seen in every single society across the globe, even old white men who go to Asia to marry poor young women. This is NOT unique to the Somali community, but we have exceptionally strong sisters who hate their men and will gladly tell a European man (famed for his exploits with poor young children across the world) to make a documentary about the evil Somali man, and the European man will HAPPILY oblige and convince them they’ll be raising ‘awareness’…they love ‘raising awareness’ ..as long as nobody raises awareness of European men and their exploits with poor young children in Asia. Don’t let them convince you we’re animals, or that ‘there’s an issue in the community’, you have nothing to apologise for. Back in the day it was the white man who would portray us in a negative light, now he has our women doing his work for him ‘why are they not protecting us, shame on them’ whilst the white man holding the camera in this doc has 1000’s of illegal images of Asian children on his phone

This is sick. The fact that a family's so-called "honor" is dictated by a woman's virginity, rather than the actions of the men taking advantage of these women, is totally backwards. Because there are men love that in countries like Somalia there are still women that can be abused in this way and can get away with it. In the Uk they couldn’t. I often hear men talking about having a wife and saying they will get her in Somalia or Pakistan cos they still find subservient women there. It’s all wrong ! Weak men feel powerful by abusing women that’s what I have noticed throughout my life. So wrong !

My blood boils to see how these young women are being taken advantage of. I'm also seething at just how much people keep saying, "they will deal with Allah." We need to stop blindly putting everything to DEEN and fix our internal issues. Our culture is sexist and this needs to be addressed ASAP. We need to put 100% of the blame on the men, not on these young women that are raised in poverty and are trying to find a better life.
Edit: Diaspora Somali's... Please do not send money to Somali regions to build more "Dugsi." What does memorizing the Quran in Arabic do for these children when they do not even speak or understand Arabic to begin with? Send money to build schools for young children so that they can have a future. Send money to fund businesses, to invest, etc. If you send money to build/fund dugsi then you are a part of the problem.

I travel often if women are under the illusion I will come to rescue them it is their own stupidity. I saw firsthand visiting Kenya women meeting men without the supervision of their father or male relatives. To be frank Muslim women want to operate like modern western women. They don’t seem to understand operating like a modern woman has real world consequences. These women aren’t children. They should have chosen better. Women always want to play the victim pretend they were duped.

This is not a new issue. It has been going on for as long as Somalis have lived outside the country. This is done by all types of Somali men; young and old, wealthy and poor, those in West and those living in the East, and those from all the different tribes and clans. We all know someone who has gone back to Somalia and married a young woman (sometimes under age or inappropriately young), whilst having another family in the city they live in. They are our brothers, fathers, uncles, cousins, grandfathers and sometimes our husbands. What do we do about these men? Nothing. While we continue to welcome these men back into our families, they will not change. We need to shame them in public. If they have no other shame, they need to feel scared about losing their families, being shunned from their communities. Otherwise there will be many more Jamilas in this world.

This is considered as domestic dispute with a lot of twists and turns to it. But I fully applaud chief Jawahir for doing such a wonderful dispute resolution in the heart of Eastleigh.
