True but the key word here is 'transform'. TH-camrs typically want to believe that minimal transformation is ok. But in reality, you need to transform the clip enough for it to be unrecognisable. So if i watch your video and it's pretty obvious that your clips are from a TNT or ESPN coverage, they are not transformed enough to classify as fair use. Basically, making a mixtape with a bunch of visual effects is not transformation.
Facts, i subbed! Bottom-line is that there are no shortcuts to success, putting in work is best way to not worry about copyright! eg research, dedication and hard work!

What about on Streams? I stream live sporting events for local teams, and when I do this, they sometimes have a DJ. So, technically, I am not PLAYING the music, but my crowd mics are picking up the music, which is causing TH-cam to flag the nat sound. Now, obviously, I could turn off the nat sound, but then i'll lose the ambience, so I don't want to do that.
Unfortunately that's pretty standard for situations like yours. It doesn't make any difference for TH-cam (or for the rights owner for that matters) if the music is there on purpose or if it just happens to be playing in the background. It's the same thing. Like you said, you can either turn off the mics or you could wait to see which parts of your stream are claimed and mute only those segments through TH-cam studio.
Great video, as always. I film a lot of full hockey games for some local Rep teams here in Canada. They use popular music during any pause in play (i.e. faceoffs), how would copyright apply in a case like this?
Well what is most likely to happen is that one or more music tracks will get detected and claim the ad revenu from your video. Worst case scenario, your video could be blocked because of the use of one track in particular but, in that case, you would be given the option to simply mute that part of your video which in your case I assume wouldn’t be a big deal.

I had my recent videos of UFC 285 taken down after only about 8 hours of being uploaded. I did upload the video footage of a few fight and it had the original comentary. They straight up blocked all 4 videos right as they were getting up in the thousands of veiws. I did however reach out to see if they woukd retract it of if there was any way to get permission to use the content. I havnt heard back yet but I just sent the email about an hour ago.
I hate to break it to you but that’s never going to happen. The UFC’s #1 source of income after maybe their ESPN deal, is pay per view revenue. Letting people upload fights for free would destroy that. Especially within 24hrs of the fight taking place. The only difference for a viewer between watching the fight on TH-cam and watching it on pay per view is that one is free and the other one is $60. So the UFC is always going to do everything they possibly can to stop people from doing what you tried to do and I can totally understand why.
Didn't the NBA, more specifically Adam Silver, say that it's allowed to be used for marketing? I found that I got a strike on one of my shorts, and another does not.
I don’t know where you got that information but there’s absolutely no chance of it being true. It would be a terrible business move to charge certain people millions of dollars for something and then give the same thing for free to others. The fact that you got a strike once and not the other time just confirms what I said in the video. This is not an exact science. Sometimes you get away with it and sometimes you don’t. But it doesn’t mean you’re doing the right thing and it doesn’t mean you can’t eventually get a strike a month or a year down the line.

@@realkingproductions yes exactly. If you just get a copyright claim you can still use the video but you won't make any money from it. The money goes to the copyright owner who triggered the claim. That's exactly what I said in the video. Same rules apply to the channels you just mentioned. Just because they are getting a lot of views doesn't mean they are making a lot of money. Or, if they know what they are doing, they are making money another way like with sponsorships for example. But ultimately, no matter who you are, if you use NBA footage you can't know for sure before posting a video if it will get a copyright claim or if it will be blocked or if you'll get a strike. It's a gamble every time.

Amazing video bro I made a football(not the american football) edit and TH-cam gave me a hint to cut out a part that may block the video. I did it and one day later, the video got blocked for a different part anyway lol But at least I know know it and Im going to try to change it up(blur logo, shorten it, add my own bit to it) and see if it helps. I shot my own handheld video of the worlds strongest man. Years later the organ action got purchase and about 40 of my videos were said to be copyright infringement. Yet I see load of self shot videos all day on TH-cam channels.

I'm watching a live baseball game and long story short, the broadcaster had said something funny and I rewound the stream and and recorded it and immediately uploaded it. I'm only about 1.5 minutes behind the live view and the video still got a copyright claim instantly. So, now I'm here

I think you just need to decide what the purpose of your channel actually is and the rest will take care of itself. And even if you end up deleting the videos and lose the associated views, what difference is it actually going to make?

Unless the schools are happy to send you their game recordings, you'll have to film it yourself I'm afraid. Or you could reach out to students and get a student at each school to film the games and you would take care of the youtube/editing side of things.
I just had a quick look at your channel. I think you're on the right path if you're just looking for views and having fun editing WWE videos. But if your goal is mainly to get rich doing this, I highly doubt that will happen. But who knows, maybe in a few years the rules will change and you'll get richer than Vince McMahon!

Question so I’m 11 and I love making sports edit’s I’m not worried about money right now but the only reason I’m worried about copyright is because one I’m scared I might get a copyright strike and then my channel will get deleted and two if I do start making money down the stretch I don’t know if these copyright claims are going to affect that. Unfortunately I don’t think I can give you much more advice than what’s already in the video. You can either play it safe or take some risks. But ultimately it’s up to you and what ever makes you feel comfortable with your decision.
I just got into doing nba highlights clips, but a decent amount of my vids get copyright claimed by BBTV NBA. But I believe if I partner with NBA playmakers which is owned by BBTV my copyrights will go away, and hopefully I am correct

Using anyones IP, within reason, is 100% legal and fair use as long as you're commenting on it. "Within reason" is essentially "you can't upload an entire work just because you're commenting on it." You can't record your own audiobook for a book that's not in the public domain. You can't upload a whole movie even if you have a commentary over it. You can't use an entire song in your video even if you're discussing it in the video. But you can legally cut together clips of all these things as long as you're commening on it. This is legal because commentary and discussion has intrinsic value to society. Sure, if you're just doing a supercut, then no, that's not fair use. But if you're giving commentary, it is 100% legal, and the vast majority of copyright claims are on fair use videos, because TH-cam allows corporations to throw their weight around. Using copyrighted material that you're not commenting on but are using to supplement your content, for instance using music you don't have the rights to, just to have in the background, is not fair use, and is an *actual* infringement on copyright. Cutting together highlights from a basketball game, or a hockey game and commenting on it, while using music that you recorded yourself (or royalty free music) in the background, is 100% legal and fair use, but because Google is pathetic they let other corporations bend them into giving them power over copyright that they don't legally have. Corporations claiming ad revenue on *fair use videos* is, and I can't stress this enough, *copyright infringement in and of itself,* because they are claiming the copyright of material they did not create, and is not legally theirs. They do not own the rights to the commentary on their property, and the hours of work that the creator put into that video. TH-cam is complicit in creating a piece of technology that allows for mass and immediately copyright infringement on the general public. We should all have the ability to see who is using our content, and we should be able to claim content by hand. And NOBODY should have the power to automatically claim anything with their IP in it, unless it detects that the vast majority of that content is presented within the claimed video - *thus making it very obviously not fair use.* It's like nobody cares about copyright law anymore since TH-cam/Google decided that they get to say what is law and what isn't. --- 8:25 "if you want to make TH-cam a business, then treat it as such, and don't cut corners." 🙄🙄🙄 Cut corners? I'm sorry but I don't have the billions of dollars it takes to be on TH-cams good side so I can cut corners by mass claiming fair use videos, and claiming money from the hard work of other content creators. I'm just not rich enough to have the privelege of cutting corners.
I totally get your frustrations around the topic but I also think you are confusing two very different things which are 'TH-cam' and 'Fair use'. TH-cam is a privately owned company, so ultimately they can make the rules that they want on their own platform and it's up to us to decide if we want to be a part of it or if we rather take our talent elsewhere (e.g. Instagram, TikTok, Twitch, etc.). Fair Use is a law that is only enforced by the courts, not TH-cam. So you are right in saying that many videos are legally fair use and still get copyright claims on TH-cam but TH-cam doesn't pretend to enforce the law. They make it very clear that, if you can prove with a legal document that your video is fair use, they will remove the claim. But they won't do all the legal work for you. So if you have a video that you believe is fair use but still gets copyright claimed on TH-cam, the due process would be to go to court. Obviously most small creators won't do that so my advice is to create content that is going to avoid that situation all together or simply keep making NBA videos but don't expect to make money from them. Regarding the 'cutting corners' remark, my point is that if you are trying to build a sports videography business that entirely relies on using other people's content for free and turning it into your own profit, I'm sorry but you are cutting corners in my humble opinion. It doesn't make it a bad idea, but it's not a business model that I think is particularly fair for everyone involved. It's all fun and games when the content comes from a huge company like the NBA, but what if you start using the content of other small creators who are potentially smaller than you and make less money from their original content than what you make transforming it? I just think it's a slippery slope... But again, I'm talking about profiting from all this, not just making videos for fun.

You’ll definitely get a claim and your video might be blocked but I doubt you’ll get a strike (no guarantee though). The difference is that you can get as many claims as you want but a strike will get your video deleted and 3 strikes will get your channel deleted permanently.
Really good video! I have a question,, i have 3 channels in 1 account and only 1 channel uses NBA clips which are not monetized, the other channels are clean. What if for some reasons in the future that the channel with NBA clips received 3 strikes, will the other 2 channels will be taken down as well? or just the channel that has 3 strikes?
To be honest, I wasn’t aware that you could have multiple channels on the same account. Are you sure they are all connected to the same Google account?
As long as you didn't get a strike, a blocked video doesn't affect your channel as a whole. You can even leave it public if you want but obviously no one will see it.

I made a football(not the american football) edit and TH-cam gave me a hint to cut out a part that may block the video. I did it and one day later, the video got blocked for a different part anyway lol
But at least I know know it and Im going to try to change it up(blur logo, shorten it, add my own bit to it) and see if it helps. If not, then its going to stay "an edit for personal use" 💀

Just because there are ads doesn’t mean the money goes to them. If there’s a copyright claim, the money from the ads goes to ESPN & FS1.

I shot my own handheld video of the worlds strongest man. Years later the organ action got purchase and about 40 of my videos were said to be copyright infringement. Yet I see load of self shot videos all day on TH-cam channels.
They probably have copyright infringements as well. Just because they are getting views doesn’t mean they are monetized.

Yeah, my edit was blocked all over the world. I made an edit about john cena announcing his Retirement. I don't care of money I am just a fan of john cena. I was sad because video was blocked . I wish they copyright claimed the video but they blocked all over the world. I'm watching a live baseball game and long story short, the broadcaster had said something funny and I rewound the stream and and recorded it and immediately uploaded it. I'm only about 1.5 minutes behind the live view and the video still got a copyright claim instantly.

Unless the schools are happy to send you their game recordings, you'll have to film it yourself I'm afraid. Or you could reach out to students and get a student at each school to film the games and you would take care of the youtube/editing side of things.

There’s no way to guarantee that you won’t get copyright claims. You probably won’t get any strikes but I would assume you’d get a lot of claims.

I just had a quick look at your channel. I think you're on the right path if you're just looking for views and having fun editing WWE videos. But if your goal is mainly to get rich doing this, I highly doubt that will happen. But who knows, maybe in a few years the rules will change and you'll get richer than Vince McMahon!

Question so I’m 11 and I love making sports edit’s I’m not worried about money right now but the only reason I’m worried about copyright is because one I’m scared I might get a copyright strike and then my channel will get deleted and two if I do start making money down the stretch I don’t know if these copyright claims are going to affect that. Any advice?
Unfortunately I don’t think I can give you much more advice than what’s already in the video. You can either play it safe or take some risks. But ultimately it’s up to you and what ever makes you feel comfortable with your decision.

I just got into doing nba highlights clips, but a decent amount of my vids get copyright claimed by BBTV NBA. But I believe if I partner with NBA playmakers which is owned by BBTV my copyrights will go away, and hopefully I am correct

This is wildly disingenuous. You do not ever need permission. Using anyones IP, within reason, is 100% legal and fair use as long as you're commenting on it. "Within reason" is essentially "you can't upload an entire work just because you're commenting on it."
You can't record your own audiobook for a book that's not in the public domain.
You can't upload a whole movie even if you have a commentary over it.
You can't use an entire song in your video even if you're discussing it in the video.
But you can legally cut together clips of all these things as long as you're commening on it.
This is legal because commentary and discussion has intrinsic value to society.
Sure, if you're just doing a supercut, then no, that's not fair use. But if you're giving commentary, it is 100% legal, and the vast majority of copyright claims are on fair use videos, because TH-cam allows corporations to throw their weight around.
Using copyrighted material that you're not commenting on but are using to supplement your content, for instance using music you don't have the rights to, just to have in the background, is not fair use, and is an *actual* infringement on copyright.
Cutting together highlights from a basketball game, or a hockey game and commenting on it, while using music that you recorded yourself (or royalty free music) in the background, is 100% legal and fair use, but because Google is pathetic they let other corporations bend them into giving them power over copyright that they don't legally have.
Corporations claiming ad revenue on *fair use videos* is, and I can't stress this enough, *copyright infringement in and of itself,* because they are claiming the copyright of material they did not create, and is not legally theirs. They do not own the rights to the commentary on their property, and the hours of work that the creator put into that video.
TH-cam is complicit in creating a piece of technology that allows for mass and immediately copyright infringement on the general public.
We should all have the ability to see who is using our content, and we should be able to claim content by hand. And NOBODY should have the power to automatically claim anything with their IP in it, unless it detects that the vast majority of that content is presented within the claimed video - *thus making it very obviously not fair use.*
It's like nobody cares about copyright law anymore since TH-cam/Google decided that they get to say what is law and what isn't.

Cut corners? I'm sorry but I don't have the billions of dollars it takes to be on TH-cams good side so I can cut corners by mass claiming fair use videos, and claiming money from the hard work of other content creators. I'm just not rich enough to have the privelege of cutting corners.
I totally get your frustrations around the topic but I also think you are confusing two very different things which are 'TH-cam' and 'Fair use'. TH-cam is a privately owned company, so ultimately they can make the rules that they want on their own platform and it's up to us to decide if we want to be a part of it or if we rather take our talent elsewhere (e.g. Instagram, TikTok, Twitch, etc.). Fair Use is a law that is only enforced by the courts, not TH-cam. So you are right in saying that many videos are legally fair use and still get copyright claims on TH-cam but TH-cam doesn't pretend to enforce the law. They make it very clear that, if you can prove with a legal document that your video is fair use, they will remove the claim. But they won't do all the legal work for you. So if you have a video that you believe is fair use but still gets copyright claimed on TH-cam, the due process would be to go to court. Obviously most small creators won't do that so my advice is to create content that is going to avoid that situation all together or simply keep making NBA videos but don't expect to make money from them. Regarding the 'cutting corners' remark, my point is that if you are trying to build a sports videography business that entirely relies on using other people's content for free and turning it into your own profit, I'm sorry but you are cutting corners in my humble opinion. It doesn't make it a bad idea, but it's not a business model that I think is particularly fair for everyone involved. It's all fun and games when the content comes from a huge company like the NBA, but what if you start using the content of other small creators who are potentially smaller than you and make less money from their original content than what you make transforming it? I just think it's a slippery slope... But again, I'm talking about profiting from all this, not just making videos for fun.

You’ll definitely get a claim and your video might be blocked but I doubt you’ll get a strike (no guarantee though). The difference is that you can get as many claims as you want but a strike will get your video deleted and 3 strikes will get your channel deleted permanently.
Really good video! I have a question,, i have 3 channels in 1 account and only 1 channel uses NBA clips which are not monetized, the other channels are clean. What if for some reasons in the future that the channel with NBA clips received 3 strikes, will the other 2 channels will be taken down as well? or just the channel that has 3 strikes?
To be honest, I wasn’t aware that you could have multiple channels on the same account. Are you sure they are all connected to the same Google account?

Yeah I can do that too but it doesn’t mean that the account you are using in the one associated with the channel.
So to answer your original question, I don’t think the other channels would be affected.

As long as you didn't get a strike, a blocked video doesn't affect your channel as a whole. You can even leave it public if you want but obviously no one will see it.
