      I would like clarification on Firearm Owners Protection Act 1986/Peaceable Journey Law,Federal interstate Transportation of Firearms/18USCss926A.
      If you have a license to carry in your state or other and you have a long rifle such as the AR Sporting Rifle or a AR style Shotgun.And that firearm is legal in your state and the one you are traveling to and that state also recognizes your license to carry,are you still covered under this if you make no stops on your journey through a state that does not allow this type of firearm?

      This happened a couple years ago to me before I got my ccw.
      Walking down a public street in the middle of town a guy on his porch (his property) pulls a gun and points it in my direction at the ground (not directly at me). Told me to walk faster or I won't be able to walk anymore. If I had a firearm could I have defended myself and been justified?

      If you have kids in the car and a mob starts smashing windows but you don’t have a way to get out because there are other cars or members of mob surrounding the car, would the use of deadly force using a firearm or your vehicle be justified? Would USCCA still cover it if the deadly force was not a firearm but the vehicle?

      I'd love to know the legal aspects of using deadly force when the defender has been drinking and would legally be over the BAC limit to operate a vehicle. As a Wisconsin concealed carry license holder, I know the rule is "if you're loaded, your gun shouldn't be" but what about in a self-defense situation in the home or other private premises? What if you were grilling out in the yard, drinking and minding your business when a belligerent neighbor or house-guest began to attack you with deadly intent? What if you went out to the bar, Ubered home, and were still legally intoxicated when you were woken up later that night and shot someone in self-defense in an attempted home invasion? What if you and your buddies were out at the bar and your DD was carrying but was incapacitated in a violent carjacking? Could you take his gun and use it to end the threat of deadly violence even if you were buzzed? In other words, If it was an otherwise clearly justifiable use of deadly force, would the self-defender be open to prosecution or exposed to more risk of civil liability in such a case?

      @@NotForYouToKnowToday sounds to me like in most places, you'd have a legal duty to retreat (in this case, just continue on your way), and just from a practical self-defense standpoint, it's always better to avoid, escape, or evade than to respond with force. Get to a safe place, call 911, report it, and make yourself available to law enforcement to answer questions. The other person's action in this situation would qualify almost universally as assault at a minimum, with the firearm being an aggravating factor, and potentially also qualify as brandishing or other more specific violation of weapon laws.
      If he began to raise that weapon in a menacing way which would lead a reasonable person to believe they were in imminent threat of death or bodily injury, and you had the legal right to be where you were and were not committing any criminal act or presenting any threatening behavior, a "stand your ground" jurisdiction would probably find use of deadly force in self defense to be justifiable. But youre gonna get arrested,, taken to jail,, and put in front of a judge and jury 99% of the time if you respond with deadly force against someone on their own property... that's disruptive and expensive unless you have CCW insurance and still will f up your life for a while. Your best bet is to escape and evade and let law enforcement officers handle it. In a 'duty to retreat' jurisdiction, just keep on walking, no questions asked, and call the police once you're in a safe place.
      That's my understanding of the law, anyway. I'm not a lawyer. Read and understand your state and local laws, but also make sure to look at these situations pragmatically and recognize that de-escalation, escape, and evasion are usually the smarter way to go if they're available options.

      EVERYONE, including most LEOs, take unarmed suspects for granted. NEVER underestimate anyone and their unknown abilities. Hell, how many times have we seen someone knocked to the ground and suddenly everyone is kicking that person in the head? In most states, that felony assault which could result in grievous bodily harm and/or death. And never overestimate YOUR skills; even MMA dudes get knocked the f*** out!

      Any sort of hostile force can be deadly. I did a few months training at a hospital and have seen someone w/ no known health issues go into a coma because his wife slapped him. (Turned out to be undiagnosed issues that then caused a stroke) but it was just a half hearted slap.

      @@58HUSTLER It's obvious that most LEO's hope that their (stinking) badges and Batman utility belts will save their ass, so they have VERY weak "Kung Fu." Our LEO's need weekly combative training (BJJ/Hapkido) and must be forced to stay away from the donut shops.

      I always tell people “please do research on self-defense, stand your ground, or castle doctrine laws before you get yourself into some trouble. A lot of people are facing life sentences for situations they thought was self defense

    These days it almost “seems” as though you first have to allow the attacker time to put a shot into you or grab you before you can legally defend yourself. I know it’s not the case, but it seems like the laws work in the criminal’s favor.

    I had to use deadly force when I and my two schnauzers were confronted by a cougar just 35 feet in front of my garage. Dog leashes in left hand, I'm yelling and screaming as the big cat comes two steps toward us. Sig in pocket. Grab gun out of pocket, safety off, aim as cat makes a left turn to get away from crazy old lady and I fire one shot missing but manage to scare it off. Never fired a gun with just one hand. Keeping cool was a plus except for the commotion that I made on purpose.
    I live on 10 acres in a rural area. Took a CCL class 4 times over the last two decades.

    Related to training, USCCA has some great dry fire tools. I own their barrel blockers and they are easy to install/use. They have all common calibers. Really useful!

    Thanks. I had not thought about proving my aging body until you mentioned it here and then I reflected to the VA had MRIs and xrays already on these very issues.
    But even before then, I went a paint ball arena with my son when I was about 40-45 and noticed I don't move as fluently as I did 20 years earlier. I expected some of that but it was far more than I thought it would be. Makes me wish I had stayed in practice.

      In NJ if you moved you must change your address for firearm permit.
      In order to do so, they force you to jump through all that loops again.
      It's easier to move back and change you DL to the previous one, then get a new firearm permit.
      I moved to Florida and get my handgun after 3 days waiting period without any problems.
      Now I'm waiting for CCW.
      F*k NJ!

      Ever heard of Ruby Ridge? Waco? Im sure you have... how about the Louisville Police Department shooting of Breonna Taylor and her boyfriend (the boyfriend shot at people breaking down his door who he assumed were home invaders but were actually police serving a night-time no-knock warrant on the actual suspect's old address and had the real suspect in custody before the raid, and who didn't identify themselves as far as I can tell).
      In other words, yeah you can go all in, guns blazing, but you're either gonna get killed or face decades if not life behind bars if you don't follow legal procedure. That's your call and I'm not judging you for wanting to fiercely protect your loved ones, but I think everyone would rather you come out of it safe and without a criminal record. Be safe out there man.

      Let's say you decided to use deadly force because you felt it was justified. The perp dies, your okay, great. Now an investigation is going to take place. If there is a grey area you'll likely end up in court with a "jury of your peers" (please let that sink in for a moment) and they may end up deciding whether your actions were justified or not. Just something to think about.

    Scene: I'm in a residence I'm legally allowed to be in & a co inhabitant has company over, company gets rowdy & I request them to leave... company makes threats to harm me. What extent can be used to remove from my home tho company was let in by co habitant... 😒

    I was shot in the back and let off one warning round instead of killing two teenagers with pistols carjacking people. This resulted in my getting shot in the back and neglect discharge charge because I didn’t want to kill the two kids....I stopped a life threatening enemy and lost my riffle to the cops....be prepared the cops can say whatever and do whatever they want....don’t think just cuz ur doing the right thing it will all work out in favor.

      Probably because warning shots are dangerous and pointless. Very irresponsible to just be blasting shots. If you pull out your gun you better know where those bullets are going.

      That will get you killed. It takes 2-3 seconds for most police officers to draw from a holster, bring the gun on target, and fire a round. The difference is they train every day you don't so take a guess how long it's going to take an average person? statistics say an average of 5 seconds. Therefore, if there is a "possible" threat the gun is already out and aimed if you're smart. Rather there's a reason they teach against "speed drawing" in any competent firearms course.

      @@Harlem55 Cops don't train everyday. They kind of aren't good shooters, as a wide generality. Keep your gun concealed until you decide you're going to use it. Draw for no other reason than to use it. Don't break concealment and give up that advantage otherwise.

      @@Outdoor-Tactics you'd be wrong about that - cops have to shoot reasonably well to "qualify" under the training standards. The majority of civilians with no military experience can't qualify and in fact firearms qualifications with handguns are a significant issue in police academy that axes a lot of people.

    A young man at the age of 13 showed me if they break into your house, their dead meat. Don't think twice. Just don't shoot them in the back .point blank as they are in the house. He got one the other ran. When you have a split second you have no time to reason what if.

      I am a short woman with a bum knee and most men could probably cause me fatal injuries with just their fists. So I carry concealed and will try to get away from a person making threats or acting crazy. If the person keeps after me, that is a deadly threat of immediate and/or imminent harm.

      Whether duty retreat is law different situations call for different methods. De escalate should always be foremost. Aggressors positions move back in forth who is which in the blink of an eye. There is a higher probability of wrong reaction when ignorant. Pre determining scenarios should be pondered in the possibility of events as much as possible.

      This isn’t legal advice and I’m not a lawyer, but when taking my CCW class my instructor made a good point regarding this subject.
      Let’s say you come across two people on the ground fighting and one points a gun at the other. You may be inclined to use force against the person pointing the gun. But what if that person was getting robbed at gun point by the other and they managed to wrestle their firearm away and use it on the attacker? If you had decided to use deadly force you may be inadvertently targeting the victim because you weren’t aware of the entire situation.
      Personally I would use extreme caution with deciding whether or not to get involved with a situation like this because of potential vital information like the example given.

      Each situation can be very different, Scott. Venom1933 made some great points as well. If you dont fully know what the situation is, you dont know who is the onocent person and who is the bad guy. Sometimes, it's best to be a good, reliable witness.     If someone were to break into my house that has a 16 year old that has access to firearms is he protected by the castle doctrine in NC

      Absolutely. There is no difference between him defending himself and you defending yourself. Some states have "laws" that make it a crime for a 16yr old to have access to firearms (usually handguns), but I don't believe that's the case in NC... and even if it was, it would be foolish to obey. Also, if you're a member of USCCA, you are protected (by USCCA) both inside and outside your home... but your family (who are not direct members) are protected within the home for any "weapon of opportunity". The weapon used does not have to be owned by the person that uses it in self defense. I'm not a lawyer and don't work for USCCA, but I hope that helps. Hope USCCA answers directly and corrects me if I'm wrong.

      I believe castle doctrine applies to anyone even felons you won’t get charged for murder because it’s in fact not murder but you still may get charged with being in possession as a felon

    That's crazy. My car is my livelihood, I don't have full coverage if I get car jacked I can't go to work pay my bills end up homeless and probably commit suicide so I can't use deadly force to protect my car/livelihood because no imminent threat

    I'm 57 on disability due to back and knee problems my running and fighting days are long gone that's why I carry a gun not because it's fun I wish I didn't feel the need to but I do I am an USCCA member and if you carry, I would recommend it even if you are not charged the family can sue you in civil court, they get great reviews we pay insurance for other things this is one insurance I hope I never need.

    Thank you for this info. Glad i found this video. You have a new subscriber. Last month i had a situation. My parents live next door. A guy went on parents porch and attacked my stepdad. I went over there had my pistol in holster. We got the guy off the porch he then went to his truck and got a crowbar. I pulled my weapon and pointed at him stopping him from coming back into the gate of my parents property. Police came and held my firearm for a short period. We had security cameras that caught it all thank god. The police gave my gun back and said i protected my family and property. I never wanna have to do that again lol but i definitely would if needed.

    Imminent danger. What if a big guy, with no gun starts wrestling with you and he finds that you have a concealed gun on you and he tries to take it. If he's trying to grab your gun, wouldn't that be considered imminent danger?

    EVERY state that offers concealed carry permits should provide at least 16 hours of force-on-force training using the "Force Continuum" to civilians. Today, deadly force seems to be more about what you say in court than how you really react during a confrontation. Force-on-force roll playing would bring self-defense actions into a clearer perspective.

    As long as you can articulate WHY you used "DEADLY FORCE" (YOUR / OTHERS Lives were in danger of death or serious bodily harm) your attorney (YOU BETTER HAVE ONE) should be able to defend your actions. Unless of course you used deadly force against someone less "privileged" than you. Then all bets are off and you are at the mercy of a jury already predisposed to hate firearms and those who own them!

    One does not have to be facing a person with a gun to reasonably feel there is a deadly threat/great bodily harm present. Case in point (and not the only one) in NYC a perp used a cobble stone to hit a victim over the head several times, victim ended up in the hospital with a traumatic brain injury and a big scar across his skull from a craniotomy. There are any number of weapons that are not ordinarily thought of as weapons with lethal potential. Always stay in condition YELLOW in public spaces. Be safe.

    I would like to know, what defines an eminent threat for somebody permanently disabled in home defense? I’d like to narrow down those shades of gray. I know what my home state laws are because I live in Florida, however there is still shades of gray that I do not understand. For example if someone is breaking into my premises threatening. Do I have the right do you use deadly force? Because anyone more able than me is a Threat if they’re breaking into my home.

      Yes. It comes down to intent. If they are breaking into your home, it is reasonable to believe they are there to cause you harm. A reasonable person would also believe their intent is to harm you. Being disabled places you in a vulernable victim population, like females and the elderly. The law can be more forgiving in the use of deadly force for people in these populations.

    Imminent is a lower threshold than immediate threat. Must be an imminent threat of great bodily harm or death, must be an innocent party, must have not means of retreat, and no lesser force option available.

    I am currently disabled. If I was being threatened by a much larger individual who was also skillfully trained in hand to hand, could I start by letting him know I’m armed, and I’d like us both to go home tonight? Adding I don’t want any trouble. In that case is it ok to warn the potential attacker that I’m armed?

    In Michigan, we cannot use it to defend property, but we can to protect life or prevent rape. Great bodily harm or protection of property that preserves life, (like an oxygen tank,) aren’t legitimate places for deadly force in this state.

    What to do if you are in an area you are not allowed to have a firearm but you do and it's about to be discovered. Such as on your way to work you drive by a school (or maybe drop your kids off on the way) and a car wreck happens. You are within the 300 feet (or whatever distance for that place) and the police ask if you have a weapon.

    How many people--outside of Wyatt Earp-- are able to draw and fire accurately when an assailant already has a gun out, the threat of lethal force? I'm not trying to be a smart ass, I just think that that is the dilemma in concealed carry.

    The way the laws are written in Maryland and many other States, the only "LAWFUL" or "LEGAL" discharge of a weapon is for target practice or hunting during approved hunting season, with approved hunting permits. Even in the case of hunting there are limitations.
    In the case of a self-defense incident, in which one would need to discharge a firearm, it would "at best" be considered "JUSTIFIED", but not "LEGAL". We cannot say we shot them "legally"... All we can say is that we had to defend ourselves against an immediate and unavoidable threat the death of great bodily harm, and if all conditions are met, the courts would consider the shooting as a justified use of deadly force. Never legal use of deadly force.

    Road rage is becoming more common everywhere you go. The one that sticks in my mind is the guy who threw a hatchet through the guy behind him's window. I have come to the conclusion that any time someone gets out of their car it signals a threat. If they have any type of weapon I will draw on them and tell them to get back into their car. If they don't I shoot.

    "Why don't they shoot them in the knee?" Well it's not like just shooting them knee is exactly something which is all that easy anyway especially when a persons under stress.Granted I am no firearm expert but judging by the fact that the knee or the leg makes up a whole lot smaller of a target then what the torso or center of mass would so based on that I would naturally assume that just simply shooting someone in the knee or even the leg in a self defense situatation is most likely not as easy as what some people think.

    Question related to the unarmed attacker tho.. I’m 6’4” 230 lbs. in shape. But I’m no ju jitsu master or anything. We shoot to stop the eminent threat. Is it justifiable to shoot ju jitsu guy in the leg to stop the threat instead of shooting to kill? Or does that still say the threat was not eminent? And therefore you would be in trouble?
