The concept of PIL is very noble without a doubt. But we can also see clearly, the way in which it is being filed by the vested interests as a dilatory mechanism. So what is needed is some solid balance in judging whether a particular case deserves attention or not. At the end of the day ,larger interest or common good of society still loom large over the mind of policy makers.Hence, there is a crying need to fine-tune the loopholes in the PIL procedures and give a tough time to crooked advocates who waste Courts' time which is already working overstretched and under-staffed.
Discuss was very beneficial and useful from UPSC aspirant perspective and for other people of society. but time RSTV has allotted to such topic is not enough, there should be more time .
PIL is good but should not be use for private interest and do famous themselves who fill it. before high court or Supreme court PIL should be address by observers and they make decisions ,this step will save the valuable time of courts ...
Totally agree with Mr. Gupta points. SC should solve those pending cases first and shouldn't waste it's time to interfere in Government and Private sectors work.
PILs are a very important instrument of justice for the incapable and of transformation. With the use of PILs, some of the most remarkable judgements have been delivered that affected a large part or whole of the country. Restraint is necessary everywhere, but leaving PILs loose is the way to go, only very mild rwgulations are needed, at most to reject PILs prima facie. In case of misuse, yes, heavy finea should be there.
Supreme court has to take independent decisions.They should not take decisions based on popular opinion.SC generally take up those cases which are highlighted by the media.That should not be the case.They should provide justice to the pending cases.A special body can be appointed to take care of those old cases.
PIL (public interest litigation), which was envisaged as a means of providing access to justice to the disadvantaged is being misused in the recent times. ‘Public Interest Litigation’ denotes a legal action initiated in a court of law for the enforcement of public interest where the rights of an individual or a group have been affected. In India, the first PIL, Hussainara Khatoon vs State of Bihar, was filed in 1979. It was filed on the basis of reports highlighting the pitiable conditions of prisoners awaiting trial for long periods. Over the years, the scope of the PIL has been expanded to include matters that might well affect the public at large 1. effects judgements, orders 2. curt is not following statndard in hearing PIL for eg If any matter is pending in some court then other court should not entertain that issue through PIL but this is happening 3. increasing more nmber of cases in pending state 4. many times used as a handy tool of harassment 5. Right to speedy trial under Article 21 affected. 1.The court must be careful to see that the petitioner who approaches it is acting bona fide and not for personal gain, private profit or political 2. Civil society to play a proactive role in condemning misuse of PILs. It started as an extraordinary remedy has become a tool of massivce abuse and convienent reemdy. PIL now does require a complete rethink and restructuring. Anyway, overuse and abuse of PIL can only make it stale and ineffective.

Supreme Court can interpret under Article 15, A-21 and when court interpret all laws are one side and constitutional morality at the centre
