- The high-level panel on data protection framework on Friday submitted its report to the government, suggesting steps for safeguarding personal information, defining obligations of data processors as also rights of individuals, and mooting penalties for violation. Headed by Justice B N Srikrishna, the panel handed the report to IT Minister Ravi Shankar Prasad, wrapping up nearly one year of deliberations that touched upon sensitive and controversial issues. Justice Srikrishna said privacy has become a burning issue and therefore, every effort has to be made to protect data at any cost. He added that report straddles three aspects - citizens, the state and the industry. He stated that this report is the first step and as technology changes, it may become necessary to fine tune the law keeping with the changes. On this edition of ‘The Big Picture’ we analyse data privacy and the suggestions of the Srikrishna Committee Report.

Consent,Exemptions,Childrens data,Right of portability,Privacy by design certain important ideas according to BN Srikrishna.
Positives: Localising sensitive personal information,Importance given to Child security and guardian fiduciary responsibility and local storing of atleast one copy of data,
tries to balance potential for innovation and sanctity of persons privacy,encouraging transparent data processing by startups,right to purpose limitations,penalties on non-cooperation by fiduciary stakeholders .
Concerns: Vague terms referring to government's discretion and Social media,differentiating between Aadhar and Social media data that involves consent,watered down right to forget, initial difficulty for startups which have evolved in different setting of privacy.
Way forward: .Clarity on right to forget
.Dealing with Vagueness on data of deceased person.
.Tighter laws on the lines of GDPR with temporal aspect
.Responding rather than haphazardly reacting to dynamic
nature
.Yearly updating of laws and institutions to implement
.Penalties should go higher with time.
A welcome first step to tackle a great challenges to democracies all around the world as it concerns individuals autonomy over his life.

Institution indeed need to given a solid foundation as it will deal with a great amount of data, clear cases in time-bound manner and also take care of budding start-ups in this ecosystem.
Another issue is reducing the ambiguity regarding the usage of data by govt, define it in clear terms and subsequent amendments with RTI and Aadhar if any.
Last tip regarding compliance mgmt was amazing but I think except UPSC aspirants, very few people in this nation has time for actual discussions like this.
According to Goyal, We should avoid going out to avoid an accident.

Three worlds of data protection : Private, Citizens, State.
Wrt State, a consent is not reqd for the larger benefit. Line is not clearly drawn.
Wrt private, right to be forgotten means right to delete the data. but, the Bill talks about only stoppage of use rights
Wrt citizens and social media, many personal data are shared voluntarily. Restricting usage rights to third or fourth party is overlooked
RTI and data protection. Section 8 to be amended to include 'any personal data that cause harm to data principal. Wide discretion.
Delay in redressal of grievances. Time bound disposal of cases of Data Protection Auth is important.
Right to confirmation and access; Right to connection; Right to portability; Right to be forgotten
Strict punishment of 5Cr may thwart start ups which were evolved w/o privacy laws. Transition issues.
Penalty. 5Cr may be small to Google and co. EU imposes 70Cr.
Cross border jurisdiction. Currently, Mutual Legal Assistance Treaty is there. It is complex. Act has not given out a modus operandi.
Will the Govt institutions and schemes change quickly within the data protection framework.

Exception for the government is an inherent flaw in the bill. Ambiguity prevails over some terms in the bill which could be tweaked by the government, as in the aadhar
