The Big Picture - Pending Cases: Way Forward

  • According to the National Judicial Data Grid, as on Monday, September 17 evening around 23 lakh cases, which are over a decade old, are pending in various subordinate courts of the country. These cases constitute 8.29 per cent of the total nearly 2.50 crore cases pending in the lower courts. Of these, nearly 6 lakh cases are civil in nature and nearly 17 lakh are criminal in nature. Civil cases usually involve private disputes between persons or organisations. Criminal cases involve an action that is considered to be harmful to society as a whole. The National Judicial Data Grid is a part of the on-going e-Courts Integrated Mission Mode Project. The NJDG works as a monitoring tool to identify manage and reduce pendency of cases. The e-Committee of the Supreme Court had launched the National Judicial Data Grid to provide data on cases pending in the district courts across the country. On this edition of ‘The Big Picture’ we analyse the burden of pending cases and what could be the possible solutions.

    Way forward
    1. Judicial strength: Vacancy, Strength, Ad-hoc, Salary.
    2. Court hours at least 8 hours a day( Gujarat Model), More law researcher to supplement judges.
    3. Frequent Adjournment practice should be checked.
    4. Cost of litigation should be high( I believe it's morally and constitutionally wrong argument).
    5. Government should lessen litigation, Economic Survey suggests, restrained litigation for tax officials as success rate just 29%.
    6. Scientific court management, judges should delegate administrative jobs to court managers.
    7. Seating in holidays too.
    8. Improve quality of judges, as efficient judges lead to faster resolution of cases.
    9. Law colleges should be more focused towards producing judges than lawyers (long term solution).

    with due respect,justice narayana was too slow articulating his thoughts.Perhaps that is the reason Frank chose to close the show by the remarks of J sai deepak.
    Completely agree with Sai deepak that cost of litigation should not be increased.Infact people choose not to go court for the very reason of its cost and the cumbersome lengthy process.

    Sai Deepak👍.Special courts can be established for pending cases.Trivial cases has to be transferred to subordinate courts.Leadership qualities have to be groomed in law graduates.

    What Justice Narayana put in:
    1. Conflicts between different wings of Judiciary causing pendency, coordinated efforts required from all the three wings in a synchronized manner
    2. Delayed appointments
    3. Retirement age of judges should be increase or provision of retirement should be removed completely
    4. Both sides are responsible, i.e., the Judges and the advocates.

    The burden on the exchequer can be avoided by increasing the fees that the courts charges especially corporate cases and cases of various profound institutions. These clients pay hefty amount to the advocates then why not they be charged by the courts and let this money be used to meet the further requirements of judiciary.

    Can jury system help in solving pendency? Not for sensitive national or religious cases but atleast in district level cases

      there is a need to solve the pending cases quickly but it must be also taken care that justice is not ignored . I think jury system have a lot of problems because of that this system was removed.

    Why pending?
    At least 5 crore cases are filed every year and judges dispose of only 2 crore
    Current Judge to population ratio is 10 to 1 million but the Law commission report in 1987 recommends atleast 50 to 1 million
    The government is the largest litigant in India, responsible for nearly half the pending cases
    Low judicial quality in lower courts
    ARCHAIC LAWS OR VAGUE DRAFTING OF LAWS
    budgetary allocations for the whole judiciary are a pathetic .1% to .4% of the whole budget and moreover modernization and computerisation have not reached all courts
    Colonial legacies like paid long vacations
    SOLUTIONS
    DOBLE THE NUMBER OF JUDGES AND CREATE ALL INDIA JUDICIAL SERVICE
    MORE COURTS_ FTCs,lok Adalats, and Gram nyalayas
    JUSTICE DELAYED IS JUSTICE DENIED AND JUSTICE HURRIED IS JUSTICE BURIED

    I am appalled at Ashok Bagaria's view to increase the cost of litigation ! He is advocating bringing down pendency of cases by denying millions of poor access to ustice by raising cost of litigation.
    We must encourage time bound institutional as well as freelance mediation by specifically licensed and practicing advocates as an alternative to institutional litigation. If the matter is mediated within 6 months there should be no cost to the parties. Beyond 6 months each party must be penalised RS 5000 per sitting.
    The licensed mediators should be felicitated by the Govt for good performance and punctuality of completion of matters and will recieve remuneration from the Govt.
    For civil matters, we must be open to commercial mediation.
