Yes Moses was resurrected by Jesus soon after his death and taken to heaven. For how could he appear later on the mount of transfiguration along with Elijah if he had not resurrected. Which the book of Jude makes clear.

No Saul perceived Samuel. This was a demon. Not the prophet. Think about it. How is it that a Satanic person can sumumon from heaven or the grave anyone, yet alone a man of God. Think about it. This was done by the power of Satan. Satan can't summon men of God nor resurect the dead, but he can impersonate them. And the beholder, like Saul, will perceive a deception. The period between Moses's death and the dispute over his body might have been 3 or 4 days. It takes at least 4 days for a human body to see corruption

Moses was raise from death by Jesus, so Moses is no more dead but he is living in heaven. When Moses and Elijah came to Jesus transfiguration, they were not coming as the death person but as living person so Jesus did not talk with dead person. Therefore Jesus never sinned. Do not mock God .
