False, She agreed to take the job of being a pet sitter, its her responsibility to only take work from dogs she can handle watch and manage which is apart of the job and work responsibilities she accepted if she was not capable of stopping the dog doing damage (Which is highly unlikely only case here is eg an agressive cane corso) Then she had the resposnibility to not take the job which she took. If a dog does that there is a behavioral issue the pet sitter failed to account for or recognise.

Dogsitter. “Hmm I really need to go to the bathroom but would feel uncomfortable for the dog to be with me while I’m shitting. I will just leave him laying in the living room for 5 minutes, no big deal. 5 min later to the room is a mess.” Obviously it’s unrealistic to be with your pet or children 24/7 without a moment to yourself. You’re not endangering your pet under your care simply because you felt like using the toilet by yourself for a few minutes.
The problem is there is simply no proof. Of course the dogsitter loses the case because for all anyone knows she could have tore her living room apart deliberately to get money for a home makeover blaming the dog. There would need to have been reported complaints or people to testify that this dogsitter tricks people. That is also a possibility.
Though I’m biased to think the dog owner deliberately didn’t tell the dogsitter that she knew her dog behaves like this on a casual basis and purposely had the dogsitter care for the dog in her own home instead of the dog owners home. I believe the dog owner took advantage of the law and may have had a history of doing so and may continue to do so. That’s just my opinion. I can’t actually no what happens. The Judge simply carried out the law. I bet she personally feels the dogsitter got hoodwinked. But the law is the law. No proof. No history of repeated allegations and reports. No other witnesses or anyone else to testify. It’s what it is.

If she's watching the dog, it's also her fault if anything happens to her home while she's shitting. Did she have a choice to agree or disagree to a dogsittibg? She did. Could there be a possibility anything could happen? There could.
Whatever happened is unfortunate but is NOT on the owner. Because it goes
"Can you watch over my animal while I completely don't watch what it does and it can do anything?"
      "Yes"
So, as I said, unfortunate, not on the girl who's things got damaged, not on the dog owner as well. @@user-ni7td7lm1r

I had my own proof but as you can see I didn’t get a chance to stand up for her. Sadly my lab passed away at 5 but this will always be a silly story to remember her by and she luckily wasn’t traumatized by people after this. This woman’s dog destroyed her shit and clearly wasn’t properly trained. She brings up the point that she is responsible for having trained the dog to not be destructive, or at the very least she should take responsibility for the animal and the damage caused

  • @francinereinke

I need a real Layers Reaction to this!!! I feel it was definitely cut short. I think that even if you accepted a dog sitting job, there are reasons that you wouldnt be liable for certain damages, and someone else would be.....
and really, what if dog sitting girl wasn't informed that the dog had very serious behavioral issues when "put in stressful situations", like going to a new house with a new person. How could she have denied the job if she didnt know?
Id be pretty upset, too, if a person who I was supposed to be trusting, gave me their pet to pet sit and didnt inform me of their needs. Every animal is different, right?
Boom. You feed the dog the normal brand of dog food that you feed all the dogs, and this dog dies. Owner says "you shpuld have known!! They were allergic to that dog food!!" But.... they didnt tell you. How could you have fking known? Are you liable for that dead dog now?
Or your walking the dog on a leash, on a side walk, safely, and a random drunk driver spins out, drives ONTO the sidewalk... hits and kills the dog......... are you liable for that, too?
Now, those examples are all damage to the pet owners property.... but look at it the other way around, too.
Person takes dog to pet sit. Owner leaves. Dog goes crazy, causes serious damage to persons home...... but they weren't informed that this dog would have behavioral issues as such, which would not be deemed normal for dog behavior... meaning, it would have been the dog owners responsibility to make sure the pet owner knew of this (like with the allergic reaction to the dog food), and thus.... would it not then be the pet owner at fault?
    Down to discuss.

The dog was under her watch, it was her responsibility as she was dogsitting, clearly she wasnt paying attention or the dog wouldnt have ruined so much. @@emhoj97 if someone’s kid broke or ruined something, even with your best efforts to watch over and look after them, unless it was small stuff or a genuine accident that scared the kid and didn’t upset you, then you’d want some kind of responsibility put on the person who is overall responsible for the child.
Hell, if we go even further, it’s the defendant’s job to put her dog with someone who she knows will do good- we don’t know if she paid the plaintiff to do it or how bad the damage was that she’s taking the time and money to sue her friend in court over it. It must have been bad if she couldn’t agree anything without legal action, and whatever legal counsel she got before making her case at all fucked her over by convincing her she has a case at all if there is zero legal precedent for it

If the dog bit her, would they still be this flippant? What if they’re a frequent floor wetter, or what if they throw up in certain circumstances? What if the dog needs certain medication the owner doesn’t explain or provide? It feels a lot less clear cut than “oh dogs do that”. She has a point that not all dogs do that, and she should have at least been informed of behavioral issues if they were going to result in destruction of property.
Judge Judy was wildly unprofessional. She wasn’t willing to hear out the case at all, and had certain notions going in. The defendant didn’t even have to say anything. There’s a reason she’s a TV judge, this would have raised so many issues if this was a legitimate court.
