    Why do TS bring on an actual expert on the subject and have Jim interrupt at every opportunity and Simon try to pretend he knows more than the expert? Simon thinks because he was once in a court, it makes him the expert. It’s like me getting a speeding ticket and thinking it makes me Lewis Hamilton. You bring the expert on…let him speak and give his learned opinion on the subject.

      Because it’s radio not a podcast they have ad breaks every 8 minutes. Businesses pay tens of thousands for radio ads therefore broadcasters have to comply with the ad breaks. Can’t just let matey boy waffle on all morning unfortunately.

      You mean the expert that conveniently forgot to mention that the main reason CAS overturned the UEFA verdict was because UEFA had broke their own 5 year cut off rule (that the prem doesn't have) and it wasn't because "there was a lack of evidence" like he says. The guy clearly has his own agenda whether because he is a City fan as he says.

      I was looking for this in the comments.. you’re spot on, I tend to like Simon when it’s just he and Jim, when the experts come in and Simon tries to prove himself to be more of an expert in their subject than them it’s just cringe, he speeds up his talking and tries to show of his vocabulary and get big points across while the guest takes a breath. He comes across as a teenage boy arguing with his Father, has to have the last word

    I don't know why the media hasn't better explained this to us regular fans. Forest/Everton have been charged with spending outside their means but they accept this but believe they have mitigating circumstances. City are being charged with fraud, which they dispute, which is a much more serious matter and adds up to 115 charges. That's 1 of the reasons it's taking so long to solve

However, to be found guilty, the PL will need cogent evidence that the allegations are true. Everything he said was bang on the money, whether he is a City fan or otherwise.

    Stefan knows what he is talking about.
    Back when the usual football journalists were reporting that UEFA had a slam dunk case to take to CAS, Stefan proved the opposite. These 'journalists' (Miguel Delaney, The Sporting Intelligence guy et al.) laughed him off when he went into detail about the flimsy nature of UEFA's case. He was proven right. Everton fans and journos told him he was wrong. Again, he was right. He will be right about Chelsea too - unless Chelsea pull a rabbit out of the hat.

      But UEFA found them guilty, it was CAS that had to throw the appeal case out because man city failed to cooperate knowing they could get off on a time barring technicality.
      An innocent party fully cooperates with proceedings and has nothing to hide

    Football fans aren't financial experts. Stefan knows about it. Suggest people listen and understand rather than just say strip titles etc. There is a legal process to go through and the burden of proof is huge.

      The burden of proof under the umbrella of the “law”. Frankly we all know city cheated, which is why I’ve never been bothered about them winning it just never seems to mean much. They won the treble recently which is an extraordinary achievement but it just seems kind of meh, meaningless. They’re quick to charge Everton and forest to avoid another city debacle.     What we have here shows you the problem that crops up with Simon a lot, he's in a conversation with someone who works in law and has worked in football finance(advisor) yet he still wants to come across as if he knows better(listen to the tone, his heavy breathing when he doesn't like what he's hearing... he's so petty). The only people remotely fooled by Simon's interruptions and desperation for the last say are those who want their pound of flesh regardless of whether the allegations are proven(they haven't been proven). He's always putting a dishonest spin on what happened at CAS. He likes to say UEFA found City guilty but leaves out the biggest takeaway from CAS was that they were told(13 instances) they didn't have the proof required to come to their verdicts of everything that wasn't time barred(this included most of the Etihad stuff and a few Etisalat claims). When someone is smart enough to pull him up on that he reverts to trying to inflate the importance of the tacked on non-cooperation charges, which ISN'T a major breach or a sign of guilt at all... As Stefan pointed out it's actually a normal legal tactic in complex cases. All the complaints about how good City's lawyers are and disingenuously dismissing the notion that they are acting on expert legal council for every action taken in response to this witch-hunt.

    For a student of law premier League in this case the fa better have some level of proof for the level of accusations. This is not a case of everton overspending, this is a case of inflated sponsorship. This literally means you are accusing someone who runs some reputed firm of lying about actual figures. If you don't come up with legal proofs or if the independent commission comes out with a wrong assessment, i see city dragging it to the supreme court. Nobody in business will want their image tarnished for some agenda. In all i hope the hearing is fair and clean, otherwise if it's not but driven by other motives fa will be screwed. They better get it right the first time because if any court later on proves city's innocence the amount of penalty someone has to pay for dragging one's name to the mud is hefty. Moreover it's the image of the body which will be tarnished once and for all. They better have substantial proofs. Any malicious intent will do the opposite.

    I think City's case is frivolous and vexatious on the part of the football authorities. As with all authority, football authorities have a similar grandiose view of their own importance and it's this that is at the root of the case. Basically, it seems to me, that City has looked at the rule book and found a way of complying with the rules whilst injecting huge sums of money into the club. This is only possible because the people behind City have these huge sums at their disposal so they've injected the money in a legitimate manner by setting up other enterprise organisations that can pass the money under the normal rules of business. Obviously the authorities have found out and are typically annoyed that there are people in charge at City who are smarter than them. This is exactly the same sentiment that leads finger-wagging judges to scold accused individuals for "breaking the spirit of the law" because they can't find them guilty of a crime because they actually didn't break the law i.e. they didn't break the letter of the law. This is how all authority works - they don't like when people are smarter than they are and they act in typical fashion by trying to contrive legitimate behaviour into criminality. I predict City will be acquitted and the football authorities will rewrite the rule book to stop them doing what they're doing. City will probably be expecting this and will likely be working on different methods to achieve the same goals whilst complying with the new rules. This is what all companies do when authorities introduce more and more regulation.

    City refused to cooperate on the emails because it was ruled by a Portuguese court that they should not be used in a court. However Uefa's case was held in Swiss rules and Cas determined that under Swiss law the evidence could be used.
    They also decided the evidence was deliberately misleading.

At least one of the "emails" published in the paper was actually made by taking selected bits of at least two different emails and pasting them together.
      However, none of that actually mattered in the end, because CAS obtained the original versions of the emails and made their ruling based on those, not the doctored versions.

    Simon is once again either wrong or ignorant. CAS had the information. They admonished City for not giving it to UEFA but CAS got everything. City simply didn't trust UEFA to be fair and paid £9m to stick our fingers up at UEFA. If you read the CAS report, it is clear that CAS had access to the transactional level of data and also interviewed many of the people involved. Simon's trying to paint a picture that CAS essentially ruled with no evidence before them and that is manifestly untrue.

City was cleared of all FFP charges that was not time-barred, the stuff that was time-barren was never considered (hence why they call it time-barred). The only thing that was proven correct and that City was force to pay, was the charges that had to do with non-cooperation. This is basically the same that will happen now. About 30 of 115 charges are about non-cooperation, and if any charges actually can be proven in the case, it's these that deal with non-cooperation. The rest is basically impossible to prove without several people coming forward and testifying to cooking books and getting payed under the table- and that would mean both City and globally recognized auditors testify to have done criminal acts (from tax evasion to fraud), and that as likely as Wrexham being the PL-champions of 23/24...

    This will drag on for a long time and will end in some out of court/tribunal fine that will at least give the premier league some sort of face saving. The burden of trying to prove the allegations and the amount of people companies executives they would have to put in the dock suggests this won’t go any further as it’s nigh on impossible and could result in various slander cases. What will probably happen is some sort of rule change in transparency of commercial and sponsorship deals going forward but ultimately City will walk free of near all charges

      Yip, the panel of 3 are about to be hit with what CAS was hit with. A plethora of top lawyers and witnesses that will be like a legal hurricane that will overwhelm them and tie them in knots and make it impossible to prove and convict. Too complicated and the PL know it

      @@mana3735City have a greatly increased turnover in recent seasons only because of their previous (and supposed fraudulent) spending and accounting behaviour, which then enabled them to win silverware and put the club on the world map. That cannot be overlooked or go unpunished otherwise other clubs (Newcastle being the most obvious candidate) could repeat that behaviour going forwards.

      Of course people have it for City. A club that only has success because a sugar daddy owner... Respect is earned and city haven't earned it. Yes City are a great footballing side but they will never be in the same category of clubs like Liverpool and Man United.

      If the case is indeed very similar to the one that went to CAS, as Stefan says, then yes, the accusations would imply a serious criminal conspiracy involving senior executives from multiple international companies.
      Interestingly, one of the first rulings at CAS was about the standard of proof required. City argued that the allegations were so serious that the standard should be "beyond reasonable doubt", but CAS rejected that and set the standard lower at "comfortable satisfaction". And UEFA still got nowhere near meeting that standard.

They will not be proven guilty of the substantial charges, will get a fine for not cooperating and maybe some points deducted but as for relegations and 50 points and the nonesense spouted by some of the Dullards on this thread.     This is exactly whats wrong with the media surrounding football. You bring on an expert to the show, have a 12 minute segement of getting him to explain the situation, whilst he only ends up with about 1 minute and 30 seconds to make his statement, because for the other 10 1/2 minutes he gets constantly interrupted by a guy who thinks he knows anything about everything and additionally get disruppted by the other guy, constantly putting words in his mouth to get a headline, which he finally got at one point, while continually ignoring everything he says. Worked out well for talksport cause the other media outlets picked it up in a split second, but ofc only used the parts (of sentences) that generae interest. This is exactly one of the reasons why the athletic is one of the only reliable outlets out there. Integrity in media begins and ends with the journalist and in the world of football media, theres very little of that.

    To summarise the allegations are of such a serious nature. The premier league have very much bitten off more than they can chew, it will be extremely difficult to prove against city and an outfit like the premier league don’t have the wherewithal to bring this to a satisfactory conclusion in their favour.

    City do not need to clear their name. The onus is for the PL to prove beyond reasonable doubt that such a fraud took place. That will mean a very high level of proof.

    Sounds dodgy as hell, inflating the sponsorship from a company that is also owned by the same owner was just an effort to circumvent the FFP rules, but like Stefan said, it's going to be difficult to prove conspiracy. Sounds like the Prem need to close that loophole so that there are no conflicts of interest from sponsors, directly OR indirectly, if that hasn't already been done.

      It won't matter if the rules change they have been charged with breaking past rules during that relevant past time period. What I think will happen is they'll be charged and punished so the Premier League get their headlines but then City's lawyers will appeal their way out of it and they'll end up with nothing more than a fine equivalent to the price of a player

      This is just false. The alleged breaches will be judged against the rules for the season they were alleged in. A rule change means nothing. If you actually looks at the 115 alleged breaches, you'll notice the breach number for the same alleged incident changes because the rules changed.

    Lawyers view in short.... The charges are massive... If proven would result in relegation... But the quasi-court of the PL won't be able to make the allegations stick as too big...
