After watching several yard transformation channels, I've determined that there are more people who WON'T help their neighbors than those who do. I’m 70 and can’t do my yard anymore. I have Tommy do it for me. Small yard and no trees. So Thankful he does it for me. If I was able to of course I’d help my neighbors out.
It's a shame folks don't help neighbors anymore. 😢 I am 68 and in a powerchair, and I am weedwacking outfront of our home. The neighbors are out mowing and weedwacking, but never offered to help. When I was young like them and I saw my elderly neighbor needs help, I would go help. I know since the tree was in her yard and she's responsible, but talk to her. If it fell on my property, broke the fence, I would call my homeowner insurance and see if it’s covered and if it is I would have it removed ( tree) and the fence fixed. If I can’t use my insurance and I could afford to get it cut up, I’d tell the 86 year old neighbor that I would take care of it. I would hope she would say bring me the bill and I’ll pay for it but if not I guess I’m stuck with the bill. I don’t know her finances at 86, or whatnot. Either way if I wanted it cleaned up I’d would do that. BTW Erik you and Mark are doing a great job on her property. It’s beautiful. Maybe you could set fire to it but have the fire department around just in case.

My neighbour is 94 and lives with her daughter that is 65. If something like that would happen we would help her.Thats a no brainer! Here in OK we help each other. We live in the country. Ive been blessed with my neighbours.

Here in FL if a tree falls from a storm and causes damage it falls on the owner of the property that was damaged as it's considered an act of God/Nature and is a no fault issue. Each owner is responsible for the clean up on their own property. This is due to the Hurricanes, tropical storms and tornadoes that we have here.
My nephew had a tree from a bad storm come through ,it fell half on his neighbors yard.it was consider an act of God,each responsible for their side to clean up,but they worked together and got it removed.That is how it should be,neighbor helping neighbor.She is elderly,maybe she could have helped with half of the cost to have the tree removed.But she at least got help from you,good job on the clean up.That is a really big tree,big chain saws will be need to remove that monster.Thanks for helping her.🤗❤️
I'm sure her neighbor doesn't have a saw big enough. Perhaps the homeowner could have called her insurance company and had the fence fixed for her neighbor.

in my state that tree falling is an act of nature, he would be responsible for the fence and removing the tree on his side, you can cut anything over the property line. now days most do not help not even family

I do live next to an 87 year old woman and she's not only my landlord, but also my MOM!! And yes I help her all the time! Oh and if a tree damages anyone's property, the owner of the tree is liable, at least in my county!

NC law states that if your tree is damaged by decay and falls and damages the neighbors fence; then the tree owner is responsible for the damage as it should have already been removed. If an act of God; such as strong winds; then you are responsible for any damages on your own property.
I just talk to my insurance company a couple months ago about our neighbors tree that is rotting out if it falls on my house or deck who is responsible? Your insurance company is wrong that’s why you have insurance to fix damage to your house if it’s the tree from neighbours property your insurance company will claim off the neighbours insurance company. If not change your insurance company.
I do help my elderly neighbors... I own and operate a lawn service business, and I do three of my older/elderly neighbors' lawns for free... Here in Sarasota, Florida, I charged no one for any storm cleanup for the past 6 years...!!! Thanks for sharing... Keep up your awesomeness...!!!

Not exactly, that’s jurisdictional upon laws, as well as even simple overgrowth onto another property. Essentially once that part is on your land you are responsible for it. Assuming you know is what gets folks in trouble, resources and research is being knowledgeable rather than uneducated neighbors and keyboard cowboys.
Not sure about the state you are in, but in Mass. the owner of the tree (where the roots reside) owns the tree. If the tree crossed the vertical property line, the neighbor is responsible for the portion of the tree that is on the neighbors side of the vertical line. If a HEALTHY tree falls onto the neighbors fence, the neighbor is responsible for the portion of the tree on that side of the property line, and needs to fix their own fence. HOWEVER, if the tree is SICK or UNHEALTHY, and the tree owner knows it, or the neighbor calls the tree owners attention to it, then the damage is the responsibility of the tree owner (where the roots reside) due to KNOWN DANGER and is considered NEGLIGENT for not removing the danger. From what I understand that rule is common throughout most states. In this case, it appears that the willow tree may have been sick before falling as willow trees tend to have short lives and cause all kinds of problems when they start unraveling. So, did grandma know the tree was sick? Did the neighbor inform her of the potential hazard? Probably not, but no matter how viewed, nobody should plant a willow near a property line. The wreak havoc with their shallow roots, fall over easily due to the shallow roots and dense foliage, and rarely last more than 25 or 30 years in good health. Plus they attract bugs by the billions.
If I was able, capable, yes I would help my neighbor out and if I couldnt I would help her to resolve the issue at hand. Nobody wants to help their neighbor(s) anymore and its more than a shame. You guys made those bushes at the front of the house look so much nicer. If it were me I would remove them and the tree that’s so close to the house. Roots and foundations are not good bed fellows. It would also make daily maintenance a lot simpler. Thank you for what you do.

I think people don’t help their neighbors anymore because they have to work too many hours to make ends meet. Why in the world did he not cut it up himself when it happened. His homeowners insurance should cover something like that. He seems like he wanted something for nothing. He had to have known she was elderly.. People are so nasty nowadays, when I was growing and up and in my younger years, neighbors helped neighbors. I remember getting groceries for and older lady who couldn't do it herself. I asked nothing in return. When I mowed the lawn I would help the neighbor out. People are so selfish. I'm glad I grew up in a time when it was a beautiful country and loving each other. I'm older now but if it was me I would get that tree out for her, even if I could only work for 5 mins at a time. The owner of the tree usually has to pay for damages. The removal of the tree though is on the property owners shoulders. That is if it was an act of God and the tree was in good health.
25:25 From the many episodes that I have watched of the court tv show, The Peoples Court, if a tree condition is questionable, the neighbor needs to write a letter or email to the lady about the tree. If the tree, then does damage to the neighbor's property, they have proof (via the letter or email) and they would win in Civil Court. Also, the neighbors property line is from Hell to Heaven, meaning that they can cut away any shrubs and trees, that reach past that imaginary line, and into their property.

Chances are his insurance paid him for the loss of the tree already, at least they USED to do so.

It is also due to common sense. If you want the part of the tree that is on your side removed. Then do it yourself.

I just talk to my insurance company a couple months ago about our neighbors tree that is rotting out if it falls on my house or deck who is responsible? Well I was told it is my responsibility to fix the damage. Go figure. People just don’t care to help neighbors like it use to be anymore. It’s an inconvenience. The property looks fantastic. Your insurance company is wrong that’s why you have insurance to fix damage to your house if it’s the tree from neighbours property your insurance company will claim off the neighbours insurance company. If not change your insurance company.

I do help my elderly neighbors... I own and operate a lawn service business, and I do three of my older/elderly neighbors' lawns for free... Here in Sarasota, Florida, I charged no one for any storm cleanup for the past 6 years...!!! Thanks for sharing... Keep up your awesomeness...!!!

Not exactly, that’s jurisdictional upon laws, as well as even simple overgrowth onto another property. Essentially once that part is on your land you are responsible for it. Assuming you know is what gets folks in trouble, resources and research is being knowledgeable rather than uneducated neighbors and keyboard cowboys.
Not sure about the state you are in, but in Mass. the owner of the tree (where the roots reside) owns the tree. If the tree crossed the vertical property line, the neighbor is responsible for the portion of the tree that is on the neighbors side of the vertical line. If a HEALTHY tree falls onto the neighbors fence, the neighbor is responsible for the portion of the tree on that side of the property line, and needs to fix their own fence. HOWEVER, if the tree is SICK or UNHEALTHY, and the tree owner knows it, or the neighbor calls the tree owners attention to it, then the damage is the responsibility of the tree owner (where the roots reside) due to KNOWN DANGER and is considered NEGLIGENT for not removing the danger. From what I understand that rule is common throughout most states. In this case, it appears that the willow tree may have been sick before falling as willow trees tend to have short lives and cause all kinds of problems when they start unraveling. So, did grandma know the tree was sick? Did the neighbor inform her of the potential hazard? Probably not, but no matter how viewed, nobody should plant a willow near a property line. The wreak havoc with their shallow roots, fall over easily due to the shallow roots and dense foliage, and rarely last more than 25 or 30 years in good health. Plus they attract bugs by the billions.

If I was able, capable, yes I would help my neighbor out and if I couldnt I would help her to resolve the issue at hand. Nobody wants to help their neighbor(s) anymore and its more than a shame. I think it is her responsibility to repair the fence if was from her tree . Homeowners insurance may cover damages. I would think he would approach her about how to handle it and perhaps offer some assistance. Thanks for all you guys do, Eric.
You guys made those bushes at the front of the house look so much nicer. If it were me I would remove them and the tree that’s so close to the house. Roots and foundations are not good bed fellows. It would also make daily maintenance a lot simpler.

Why in the world did he not cut it up himself when it happened. His homeowners insurance should cover something like that. He seems like he wanted something for nothing. He had to have known she was elderly.. People are so nasty nowadays, when I was growing and up and in my younger years, neighbors helped neighbors. I remember getting groceries for and older lady who couldn't do it herself. I asked nothing in return. When I mowed the lawn I would help the neighbor out. People are so selfish. I'm glad I grew up in a time when it was a beautiful country and loving each other. I'm older now but if it was me I would get that tree out for her, even if I could only work for 5 mins at a time. Which is where I'm at now. I could use a lot of help and not one neighbor has ever offered me help. ❤️🦋❤️🦋

Tree ownership is key in this circumstance Erik. It's grandma's responsibility.
It depends on the state.
The general rule in most states is that the owner of the tree is liable for any damage caused by the tree, regardless of where it falls. And if this neighbor's tree falls on your fence, they are responsible for removing the tree and paying for the damage. Act of God or Act of Nature

The owner of the tree usually has to pay for damages. The removal of the tree though is on the property owners shoulders.
That is if it was an act of God and the tree was in good health.

25:25 From the many episodes that I have watched of the court tv show, The Peoples Court, if a tree condition is questionable, the neighbor needs to write a letter or email to the lady about the tree. If the tree, then does damage to the neighbor's property, they have proof (via the letter or email) and they would win in Civil Court. Also, the neighbors property line is from Hell to Heaven, meaning that they can cut away any shrubs and trees, that reach past that imaginary line, and into their property.
The neighbor didn't talk to her in two years??? He saw all that damage... knew she was elderly... Here in Newfoundland we would call him an arsehole, But you aren't in Newfoundland... Too bad...
