time to invest in a dash cam, i was rear ended and the guy thought it was my fault, but the reason why i had to brake was because the car in front of me braked and then swerved right to take an exit… i didnt hit the car in the front though…. good thing there was barely any damage…
I was involved in the end of a 3 car chain collision. My vehicle hit last. There was a Toyota Corolla in front of me and a Honda Civic in front it. I saw that the Honda had one its signals on, but something caused the Toyota to rear end it. I couldn't change lanes and I eased off the accelerator and tried brake gently, but wasn't able to avoid rear ending the Toyota. This happen on the freeway in the afternoon when the commute traffic was about to begin; however, traffic flow was still smooth. I was not distracted, was traveling with the flow of traffic, and had proper space between vehicles. My mother was the only one with me in the car. I'm in California.
Probably at fault. It shouldn't matter. Unless someone brake checked you it's your responsibility to slow down. Now if they changed lanes abruptly and it was provable then ya, dash cam.....

Hey so i hit a truck not to hard prob 3-4 mph in. Red light i thought green light had turned but no i have a truck the guy i hit had. A truck too but he had a towing ball hitch i know he felt the hit i felt it of course my truck got a big dent but the thing here is that. When that light turned green he left even do i hit him i was confused so i fallowed him he never sed nothing i waved at him but he just kept driving i fallowed him for 10 min or so never stoped to talk or nothing so at that point i turned around back home and he kept on driving i was so confuse i did check his truck when i was following him did not see no damage with my eyes i got the damage bc of that towing ball hitch did i do the correct thing ?
I was rear ended last month. I merged onto the highway connector and had to take a right onto the interstate within the next quarter of a mile. So I merged successfully and logically stayed in the right hand lane for 30 seconds. Upon the merger the light turned red and the car in front of me slammed on their breaks. I slammed on my breaks and avoided the accident. The box truck behind me couldn’t stop in time or change lanes so they tried to avoid the accident by swerving and angling toward the shoulder of the right lane. The brunt of the collision accorded on my rear right side (the bumper, side panel, knocked my wheel off the axle). The driver got out an apologized and said he was sorry. We took pictures and the police showed up. The driver then told the police I cut him off and it was my fault. I told the truth on what happened and the police stated there were conflicting stories so insurances would have to work it out. He sited the driver for having a suspended licenses so the drivers boss had to pick the vehicle up and mine had to be towed away. Now their insurance company is denying liability and claiming the drivers story matches the story that I cut him off despite the distance/direction I came from after merge doesn’t make this possible, the damage on his vehicle (left side fender) doesn’t support the physics of someone who was cut off and only hit a vehicles rear right side, and the driver was literally driving illegally for a company.
Sounds like typical insurance company b.s. Two options 1. File a claim with your own ins to get the damage repaired 2. File a lawsuit against the defendant. Did you suffer any injuries? If you did, you'd likely be able to find a pi lawyer to help you b/c this stinks of typical ins co tactics.

So I was involved in a rear end accident where I hit the driver that stopped on a 4 lane roadway for a school bus on the opposite side. Tgis is very informative. I got rear ended after making a legal u turn the other driver was far enough to safety make the turn a few seconds later the other driver hit me from behind. I was trying to get out of his way as he was speeding. So I assumed that driver was at fault.
We were rear ended today. We were backing out of a ‘back out only’ parking place and onto the main road. We backed out into the center divider and a car came behind us and hit us while we were reversing. They claim we are at fault because they were ‘backing up’ to make room for us but we didn’t see them there when we were backing out. They have a witness (a passenger) and I was my husband’s passenger. My biggest worry is my husband didn’t exchange info with them. We don’t have car damage and they do. They wanted to exchange info but said it was okay for my husband to leave but then followed us home after the incident. Getting our plate info possibly.

I was rearended on i64 headed east from Winchester Clark co to Mount Sterling Montgomery co just to give a freind a ride because he was walking to his sons birthday party. He had messaged me around 7:45 p.m. on 11/26/2019,i picked him up right around the 106 mile marker,then around the 108 mile marker,a little before it,was when we got hit,HARD....i had seen headlights coming far off in the distance behind me,knew they were speeding because looked in mirrors a couple times,car getting closer quick,I'm going around 70 and about to get over,so i can exit at the 110 exit,turn around n take my buddy to his destination,and go back home. I remember everything. Im waiting for this ford ranger to go on by in the slow lane ,then i was gonna signal and switch lanes,before he got by me,BAM we are hit,the rear of my 94 chevy 3/4ton 4×4 ,went up in the rear,in the rear veiw mirror i couldn't see anything,me and my passenger were threw forward,I'm pretty sure my feet or one foot,hit the brakes when getting thrown forward,and my truck went end over end,probly 15 times. Landed right side up. I'm still breathing,scary as it could be. I crawl out the biggest hole i can find because my buddy is no longer in the truck. So i get out carefully,and go around the back of the truck,and their is a heavy set lady,kinda leaning on her knees,and right by the passenger door of my truck. How she got there so fast,idk. Who she was,idk for sure,but was probly riding with the guy who hit me. I asked her if she knew weather the people that hit me were ok or not. She said not a word. Took off back up the hill from the other side of the median to the side i was traveling on. So i found my buddy,looked like he was sitting Indian style,and had been tipped forward,struggling to breath. I know your not supposed to move someone after an accident,but he really couldn't get any air,Dave was planted firmly in the ground. So very carefully,sat him straight back and sitting indian style like his legs already were. Hee started to reach for my hand,i said no buddy,don't get up,the ambulance is coming I'm sure,the whole interstate is backed up. Then when they were taking him to hospital,i walked up to the road to look at the car that ran up under me. (The whole rearend of my truck was 60 or 70 foot behind it), I think that when they it me,they were going so fast,they knocked the thing out of my truck. The car was a big buick lasaber. The whole front end was demolished on it. Alot more happened,id like tip tell you,my lawyer dropped me couple months later(the hammer)said it was determined to me partially or my fault in a letter. The police report shows that after being questioned by a deputy sheriff for probly an our while i got blood allover me,that he gave me a breathalizer test,then sent me to 2 state troopers who had looks in their eyes that something's not right here,this ain't on nothing. But they gave me three sobriety tests,and the report does show that they said i passed them all. Then i was released.. The report says that my statment was only that i was rearended. And the other guys statement was,idk what happened,i just know i was in an axident.
Hi so I was in a rear end accident yesterday. I literally just signed a lease on a brand new hyundai elantra and was driving back from the dealership. I was driving on the highway when the car in front of me stopped due to traffic. I also stopped. About 2-3 seconds later I felt a sudden impact and was pushed forward to the car into front of me as well. Turns out I was rear ended by a Corvette and my car was totaled. Also, there was a 3rd car behind the Corvette that apparently rear ended the Corvette as well however their damage wasn't major. Hi. We rear ended into another vehicle on a highway in NZ while driving at 80km/ hr speed. The driver claimed that his emergency braking system activated that causes his car to stopped so suddenly. He then sent us a footage of his front/ rear camera of his car. The footage reveals that before his emergency braking system activated, the car in front of him was slowing down to take the right turn. However, there were still plenty of space for him to safely brake (approximately 20 metres), but instead his car came to a complete stop from 70km/hr to 0 within 2 seconds from the emergency braking system. We were driving under the speed limit/ safe travelling distance but because our car does not have the same emergency braking technology, we were unable to stopped in time. At the moment, the insurance company has determined that we are at fault (given that they have seen the footage) but we feel like we were not in the wrong and are looking to take this further to disputes tribunal. Any suggestions is much appreciated. Thank you.

Same thing happened to me yesterday !! The car infront stooped suddenly from 60 km/h to 0 km/h . And as my car is old from 1998 suzuki , even when applied breaks my car hit the Toyota Prius i front ,it got just a hand size dent in the bumper . But my car's bonnet got bent and upwards my car's front was damaged !!
I got rearended about a year ago by a woman who claimed I "cut her off" which I didn't. Refused to talk to me or give me any kind of insurance info. She then drove off and I couldn't follow her due to traffic. Two days later a cop shows up at my job claiming I caused an accident and ran. I did NOT run. I drove off after the lady drove away. Now I'm being harassed by her insurance company who's info I was never given and is wanting me to pay for this lady's car. I have insurance and gave the police my insurance info.

Hi i was driving home from school and this lady in her car an her husband in a truck seemed to have a accident or maybe the truck jus died on the road and wasnt working . A cop followed them off the main highway onto a back street tht i was takin an then left . Whole time i was stopped behind them waiting for them to go . They sat their for 8 9 mins blocking traffic and even almost caused some accidents because people behind me were goin into the other lane to pass since she was stopped . I waited another 5 mins then she started driving behind her husbands truck tht was damaged . I had a two car gap and started goin when she started puting her foot on the gas . She then slammed on her brakes an came to a complete halt and i slammed on my brakes and my car slid but their was enough time cause she jus picked up speed and then stopped . The truck and tow truck infront tht was with her speed off. I went to her window to make sure they were ok. Their was nothing infront of her to make her stop like tht . I talked to the tow truck people tht came an they said they were jus here for her 5 mins ago and were sayin she was a danger on the road . Hi I'm not sure I entirely understand the fact pattern. But, sounds like you just rear ended the person in front of you though there were extenuating circumstances. You can try and file a claim against their ins I guess - though since you rear ended them I would assume they'll deny the claim. What is your ins co saying?
Hey, I was involve in an accident this week... what happen was that the traffic was stopped because the light was on read, and after that light the police had close one of the lines to make to one, so I was in the first line, and the line that they left open was the second line, since the traffic was stopped I put my left turn signal on so maybe someone left me merge in to the line. I was on my mirror that a car stoped, and left a big gap, so I thought she was giving me space to merge in to the line, so I changed lines and my car as almost fully inside the second line, let's say almost 80% of my car was already in (I was driving a Toyota Corolla LE) soon after, the light change to green so I advance as traffic was advancing, and i felt that someone hit me on the back, I stopped, got out of the car and I find out that the girl behind me had hit me right on the left back corner of my car. It was nothing but scratches, so I ask her what did she wanted to do and if she was okay, she said that I hit her and that she wanted to call the police and involve insurance, so I said okay. Since the police was after the light, a police officer came by and the girl went running to the police officer saying that I had hit her. I want to where they were and the police officer never wanted to her my side of the story and said that everything was my fault. Then she said she couldn't do the report because she was supposedly doing traffic... another police came and started doing the report, and her comes the funny thing, remember the police officer that said she couldn't do the report, she stayed the whole time taking notes, when she said she couldn't do nothing. And she never let me talk with the police that was doing the report.... Now once the report was done (With only the version of the girl that hit me) the police that was doing the report game a ticket for reckless driving 😤, I ask him he was giving a ticket if i was the one that got hit, he said I should fight it in court... so I said okay am gonna fight it in court. Then I was that the ticket had my dad's name, not my. So we suppose that that happen because I was driving my dad's car... we got home, I finish fixing my other car, and the police that made the report called my mom asking for me (she was with me when the accident happened) I talk to the police officer, and he said that he was gonna void my ticket, because it had the wrong name, and that he wouldn't give me another one. So I said " Okay I was going to fight it on court and I also going to fight it court that you never wanted to take my version of the story..." he came to my house took my ticket with him, and ask for my version of the crash... Now, you think that the girl was innocent for rear ended me? Or should I open a claim against her because she hit me? Because even though I was changing lines, the traffic was stopped, I had my turning light on, and she left a big gap between car, so I thought she was being nice and letting me slide into the second line. I think that she was distracted with her phone or doing something else, because impossible to not see a blue car right in front of you.
hi. i was recently involved in a rear end accident on the highway. i pulled over into the emergency lane to get directions because the traffic was aggressive and people where switching lane. I had right of way to enter the lane and when I was coming to a complete stop. About a car length apart the other drive involved, hops in to the emergency lane carelessly and tried hopping back after noticing my car was already in the lane. I slammed on my breaks trying to avoid the accident but the passenger side of the others drivers rear bumper was hit. This accident totaled my car but just barely causing damage to his. I was involved in a rear accident, and my company gave me a write-up, because they said I was not paying attention, but nothing happened to the car I Was driving, and the accident happened because three cars stopped in front of me as it started to run back on the road, while we were all stop because of heavy traffic. I don't think I was at fault because I didn't hit the car in front of me and the truck didn't hit me in the back either so but the other cars in front of me were heavily damaged due to their impacts. Alright so, thank you for the information. I was just involved in a accident. I was turning left onto a street, there was oncoming traffic, suddenly a car comes flying out of nowhere. I hit his rear, causing damage to the rear of his car and the front of my car. I swear the oncoming traffic was far back enough for me to turn or else I wouldn’t have turned. The car came through so fast, of course the insurance is saying it is my fault, they’ll cover my car and his car. Also, the light was yellow, it had turned yellow while was approaching the line. The thing is, I feel like it’s not my fault. Also, I didn’t speak to the driver nor the witness so, I don’t know what they said, I just spoke to the officer. I can’t afford any of this, like my car insurance possibly increasing and I don’t have rental coverage 🤦♀️ so, I’ll have to pay for that too. I want to fight it in court, any suggestions please?
Good morning, sorry you're going through this. Unfortunately, if you were taking that turn, it's going to be very tough to overcome fault for this accident if you don't have an independent witness or video to show the other guy was speeding or otherwise ran a red etc etc. However, if you really feel you were not at fault, you certainly can file a lawsuit against the other party. What if you had to reverse because it was unsafe to merge into the busy intersection and whilst reversing you got rear ended by a vehicle? That pulled up from behind you and seemed to be trying to cut you off based on the placement of the incident ? ( front car right side back bumper , back car front side left bumper ) what do you do then ?
In LA I was in a 5 car rear end, cop on scean asked where was the fifth car and iwas the second car. I stated it's the one in front of me. But when I was hit from the rear I felt 3 impact's.. I was coming to a hard stop but came to a complete stop from the car in front of me. Then 2 to 3 sec later was hit with the first hit which pushed me into the first car. The only damage it had was a scratch on it bumper. My truck took the main hit with two other hit. Which pushed me forward. Am I at fault

I hydro planned on a wet road into a vehicle who came from the right lane into my lane, I thought she was just panicking a little and slowing down because a garbage truck was pulling into the right lane, but she came to a full stop with no vehicle in front of her and the garbage truck never crossed into her lane. So there was nobody in front and no reason to stop. What do you think?

I was just rear ended. The light was red and I was stopped to make a right turn onto a street. The light then turned green and there was a pedestrian with his dog standing to cross the street. He pressed the button to cross and the cross walk changed for him to cross. I waited for the the pedestrian to cross and the pedestrian was halfway crossing when the car rear ended me. I recently was involved in an accident where I was braking for a stop light down a hill, with increased stopping distances for the heavy snow at the time, and my tires hit some ice hidden under some loose snow, causing me to unexpectedly hydroplane into the back of a pickup truck. I was already taking precautions given the weather that day, and if the ice wasn't hidden and I could have seen it, I would have increased my stopping distance even further, so based on these factors, would I still be at fault for the accident?
I was in a recent accident. I was on a 3 lane road, in the middle lane. I moved to the outside lane, which was all clear. A driver rear ended me on back fender on driver's side. He claimed that I pulled in front of him which I did not. No damage to my driver's side, just back fender. The Hwy Patrol assigned all the fault to me! Please advise. Thanks.
Morning. Sorry you're going through this. What is your ins co saying about it? It's tough to overcome with the ins co's when the police find you at fault for an accident. But if you really feel you were not at fault you can file a claim with their ins co. They will likely deny you. You'd then have to file suit to 'get your day in court' so to speak....
I was rear ended,and my insurance is saying that I was at fault. I do have a witness, a friend who was in the back seat(I was giving a ride) when the coalition happened. The other driver, the one that hit my vehicle was spreading and even though there were other lines with out vehicles coming….this driver did not change lines nor slowed down. Instead, this driver hit the brakes and ended up hitting me. I am a disable person, and my vehicle is the only transportation I have to go to my doctors appointments. Is there something I can do.

So I was in an accident where I was taking a green light intersection. To my right is a “exit ramp” to get off the freeway. So a right turn exit. It’s a two lane road. Left and right. I was in the left lane. I took my green light and proceeded to drive when I saw a car speed through the exit and jumped to my lane and it was too late. I hit them. The weather had been snowing the last couple of days and my son was in the car. I couldn’t evasively maneuver because I would have put my son and I in greater danger. Would that put that person at fault ? Or is that still my fault ? He failed to stop, yield to incoming traffic and improperly lane changed.

I was told by witnesses he was a drunk driver and was not going to stop. My car spun and hit the median. Do I need an attorney? What are your advise for my case? This is my first highway accident.
It have not been confirmed that my car is a total loss since it’s only been a few days and I haven’t heard from the adjuster/appraisal. But from the pictures and videos I’ve taken the car is beyond repair.
I would also like to add my husband and 2 children were in the car 14 and 1y.o. Insurance reached out and said they would cover medical expenses. I still haven’t received the state police report in the mail yet. So I’m not sure if the witnesses left a statement to help my case.

I have a big truck and I live in Louisiana. I was doing a job in Texas and stopped at a turn signal to far and had to back up I didn’t see anything behind me so I backed. I am getting letters saying I backed into a car and there was 3500 dollars in damage from the insurance company ( now a collection company) I didn’t see anything that made me think I hit a car no one come to stop me to say I hit them. I was rear ended on Thanksgiving night as I stopped at yield sign. Minor damage to my bumper however I have a cervical strain, lumbar strain and lower back pain. Being examined for a concussion. I was driving at about 55~65 MPH on the California highway (lane 3), when I saw the traffic (those car are completely stopping) in front of me about 1/4 km away, I starting to brake, and eventually stop my car. But about one second later, the car behind me crashed on my car from behind (rear ended) and rollover. Who will be at fault in this accident? Thanks!
Good morning, well, if I understand you correctly, you were braking for traffic and got rear ended. I would think that the party that rear ended you would be at fault. Is there some other factor involved that might cause the ins co to put some fault on you?

Hi! Recently I was in traffic and a red light had turned green and the cars in front of me were ready to move. As I started to move, I hit the car in front of me. Her rear bumper was damaged (dent that’s not too large) and my license plate was bent. We exchanged information but she has my insurance information and I only have her name and number. Should I just wait for my insurance to contact me about the incident to explain what happened or should I go ahead and file a claim myself. The reason I ask is because I don’t know if I’m at fault or partially at fault and whether the other driver would’ve been considered stationary or not. If it helps, I live in Virginia. Thank you!

Hello, I got into a 3 car rear collision in 101 south Cali. I was the 3rd car to crash and receive a heavy crush in the front of my car. None of us got hurt. These are observations A. the middle Benz cargo van was almost at 0-5 miles /hour and had no brake lights at all as I remember the moments before the crash. B. He was either too slow/standstill like 0.5 miles away from an accident-prone exit [414A]. C.Both the first and second guy insisted not to call the cops. I believe I genuinely did the max best when I crashed [slamming the brakes so hard, without changing lanes]. There was no traffic jam before or after the accident. Do you think I have a better standing in the case? D. it was too tough/late to determine if the second car was standstill/slowly moving due to the brake lights not on. E.There is also not enough information for me to determine if they both already had quite a bit of bumper touch and seconds later I as well crashed on them.[Glad none of us got hurt but it's discouraging my confidence as I have never been in an accident in the last 7 years] Please share your opinion.

It will very hard for you to overcome being held responsible for the accident unless you have an independent witness who can verify those cars stopped for no reason and/or some other reason that you were not at fault. 4 cars mine was the 4th involved the 3 ahead of me had already crashed when i notice the car ahead of me wasn't moving I went to jump out the lane was blocked by somebody flying out the blue to make the light this car ws behind me and jumped next to me and I had to slam of breaks but ended up hitting the person in front of me not who was already crashed and stropped, i know i may be at fault but how much of this is mine

My daughter was in a rear end collision. She rear ended someone she says cut her off. They automatically put her at fault. The other vehicle did not have too much damage but the one she was in was left in horrible condition. Worst thing is that we had her excluded from our policy. Ok, i have a curious question. This was aroused by a scenario that happened to me on a truck simulator I was playing, but, I'm driving my semi on the freeway, doing the speed limit (80kph), ant the traffic was pretty far ahead of me. Traffic all of a sudden comes to a dead stop on the freeway. I lock down my brakes, but my loaded truck won't slow down. I utilized the "last clear chance doctrine" and attempted to swerve, but i still collided with the truck in front of me. In a real life situation like this, would I be liable for the collision, or the car(s) stopped on the freeway?

I got into an accident today in the rear ended somebody what happened was he was a big truck in front of me and the green arrow turned on for the turn lane and we were in the far left lane and he pulled off with the cars turning basically running a red light and I couldn’t see over his truck and out of nowhere. @@LawFull nothing yet it happened five days ago and the insurance adjuster told me they would reach back out to me within 48 hours and they didn’t. now I can’t get a hold of them because apparently they don’t answer the phone on the weekends to provide information, so I’m planning on calling back on Monday to see what they’re going to say but that’s not good news haha I’m really hoping I get lucky somewhere because he was in the middle of breaking a huge traffic law when I rear-ended him but you’re right, the fact that I rear-ended him makes it bad for me, but right now I’m counting on the fact that he was running a red light and slammed on his brakes because of a mistake he made in the first place, breaking the law. Someone was speeding up behind me in the left lane in bad weather conditions. They honked for me to move and as I safely merged into the right lane they continued their speed (much quicker then I was going) did not break, and hit the rear drivers side of my car. It’s clear that he was at fault, but their were no witnesses and the officer that made the report took the other drivers word over ours and assumed that we cut him off and chalked it up to unsafe lane changing. How can officers claim who is at fault if they did not witness the accident and their is dispute between both parties about what exactly happened? The officer said that if he flew behind us going 100 and was speeding I would still be at fault because the damage shows we weren’t in the center of the lane when he swiped our back end. I believe the other driver is at fault for not adhering to traffic especially considering the weather conditions. What do you think? What can be done? Thanks in advance
Hi Patty. It's impossible for me to know. The one thing I can tell you is that if you don't agree and if their insurance denies your claim, you do have the option of filing a lawsuit against the other driver. Check your local rules on filing small claims lawsuits - you can do it your self. That way you get your day in court so to speak....
I was driving on a snowy day following a vehicle in front of me. The vehicle slowed down and while I tried to hit the brakes the car skidded and I rear ended another parked car on a highway. The car was parked because it was stuck in ice and the driver was in the car. Would it still be my fault?

I was in a accident last month. This is how it went. I was driving down the freeway and an exit was coming up with sudden traffic because many people were exiting there. The truck in front me swerved because of the sudden stop then I turn on my right blinkers to switch lanes but the truck who was behind did the same but rear hit me. Now thier insurance is putting me at fault and my insurance is not covering my damages because i don't have full coverage.

They are saying I switched on the truck's lane so it puts me at fault. And yes i don't have collision coverage. They closed my case but reopened it because I reminded them that my witness in the back got hurt. I also want to add that i had two passengers and the truck that hit me was a big Isuzu.

I was driving in the left lane and a car in the right lane cut to the middle lane and as he drifting to the left lane there are two cars in front of me the front car swerved into the turning lane so they wouldn’t get hit by the car from the right lane. The car from the right lane is halfway into the lane and the mini van in front of me starts braking and cuts quickly into the left hand turning lane to also avoid hitting them. I saw the car from the right lane slam on their brakes when the mini van cut into the turning lane I tried slamming on my breaks and I skidded into the car from the right lane. The two cars in front of me were able to cut back into the left lane and continue to go straight. I have all of this on my dash cam. Can I prove that the right lane car made an unsafe lane change that caused that to happen since there wasn’t a safe amount of space for him to merge into the left lane?? Hi, impossible for me to know what the insurance company will do. Though you do have an independent witness to support your story. However, generally speaking, again very generally, you may be found at the very least partially (if not fully) at fault. I'm sorry to say. But I'm just speculating. Hello, I was in a rear end accident yesterday this lady stoped on the highway but not on time slammed on her breaks. Which made me hit her from the left side since I tried to avoid hitting her and couldn’t break completely to a stop causing a minor accident. I do have a dash cam which shows her actually using her phone while she was driving during the accident and also shows she was still breaking I’m I at fault? I live in Texas. @@LawFull yes, both my insurance company and the other cars said it was my fault. So I fought it. Then they changed it to 50/50. Making it seem like that was doing me a favour. However, now, I am having very difficult time getting insurance because it keeps coming up as an at fault accident.
I called again this week and the person on the phone said it's listed as 50/50 because it says in the paperwork, when I pulled out, the other car had the right of way. Hi, I'm not really sure. It is all so fact dependent. Have you seen the police report? Does the police report verify what you just said? If so you may have an argument that you're not at fault. However it's still goingna be tough to win.

hello i was hit on the back, and i end up hitting the car in front, my question. i when to the doctor 7 days later because some pain i had from the accident, i told the police at the time i was ok, but later on started feeling some pain, shoulder and lower back, so i when to the doctor and use my health insurance, im still going to therapy exercise for my issues. can i do something against the insurance from the guy that hit me.? i auto insurance is taking care of everything about my car for now , later they will collect from them, and it looks like my car insurance is going to refund up to $2000 to my health insurance, and how can i get a compensation for this?
You can file a claim against the other guys insurance theoretically for your meds and your pain and suffering. But I would strongly suggest that you check with a local attorney to learn your rights. Your state may also have laws that dictate how you can recover....
I was rear ended before (more then once) the one time the person took the fault as they know they were in the wrong and their insurance paid for it. The light turned yellow and I hit the brakes to stop and the person behind me must of hit the gas thinking we both could make it thru and bam there went my bumper and I didn't see a scratch on their car. and the other time I was rear ended I had my first car and we had the first snow I ever drove in so I was seeing how my car would do in the snow. So I went out on these side streets. I stopped at a stop sign and here the person flying down the road couldn't stop in time and rear ended my car knocking it into the intersection. Luckily it wasn't a busy road intersection and no one was coming. My car didn't have a scratch as their grill met my rear bumper. I told them not to worry about it as I was fine and my car was fine. Not sure if they turned it into their insurance company or not. This was back in the late 90's.
@@LawFull not injured in any car accident Ive ever been in. I've been in my fair share of them when others were the driver. With me as the driver I rear ended a truck one the car hydroplaned easily. After switching tires never had that issue again. You could be going like 20mph and with those tires the thing would hydroplane. And they were like new tires. I hydroplaned so badly all the time. I thought it was the car. But once those tires wore out and I bought new tires it stopped hydroplaning. That bumper on that car had the imprint of a pickup truck receiver hitch. There was no damage done to the truck at all.

Have you talked with your ins adjuster about this? You should theoretically get your deductible back if your ins co subrogates against the 3d party.... Talk with you ins adj about this issue and let me know what she says.
I was in a work zone that had an exit ramp merge into my lane and I had to slow down because I would have ended up rear ending them but two cars behind me rear ended the guy behind me who got pushed into my car. This man swore up and down I had the right of way when I explained the merging car was already partially in the lane and had to continue to let them in. Was I wrong or the rear driver wrong?

Hi Joshua, well, hard for me to say. But if I had to guess, I'd say your friend was responsible for the damage he caused. And that the car behind him is responsible for whatever happened after that. How the ins co's figure that out however is a different question and one I'd say I'd have to leave to them to figure out. I couldn't speculate on what percent of the damage was caused by your friend. Hi Barry, I hit someone from behind coming off the interstate going uphill to the service road. A lady was slightly parked on the left side of the road, talking to a homeless man and I hit the passenger back side of her car. I tried hitting my brake but to no avail. I rear-ended a semi a couple days ago. And I as write this it makes sound as it was completely my fault. But couldn’t it be possible that the truck in front of my is partially at fault for completely stoping in the middle of the road all of a sudden? A dust storm came in a matter of seconds, visibility went from good to poor. As I slowed down and reached for to press the hazard lights visibility went to zero and before I knew it the semi was in front of me. I tried to avoid him but it was too late. The dust storm came in too quick and it blinded everything.

Good morning, if you were the last car in the line then there's not too much you can do. You can state your case to your insurance company. But chances are if they deny coverage you'll get sued.

I was involved in a collision. Road rage. The car behind me was honking at me. Went to the left turn lane. I could hear the rpm raising. Made no eye contact to avoid him. There was no one in front of me. He then cut me off and slammed on his brakes. I was able to stop, but he dud it again. The second time I made contact with him. I rear ended someone in the back. I was definitely at fault. I understand my insurance has to pay off the other party’s damages and rightfully so. But my biggest concern is having to pay the citation to the court! They want over $250 for the citation!! I live in South Louisiana. That is ridiculous for a fender bender! Hi. A couple of years ago, I was in a turn lane at a traffic light, and red light turned to green arrow, cars started flowing, and once it turned yellow, the driver in front of me slammed on her brakes to stop at the yellow light, perhaps 1-2 seconds into a 5-6 second yellow light cycle. I hit her car causing fortunately only slight damage to her bumper ($1,500). After the accident, the lady told me "I always stops for yellows lights." I could tell she was a very inexperienced driver and did not fully understand the nuances of how other drivers on the road have reasonable expectations about how others drive (not slamming brakes at first sight of yellow light), etc. The police wrote me a ticket for following too closely, and my insurance company paid her claim. Seems to me I should have had anywhere from 0-49% liability, and that she should have had anywhere from 51% to 100%, since her erratic actions, IMO, caused the accident. Thoughts? Thanks.

But I will say that if all drivers drove like her, and if all of the rest of the drivers had to give more car length separations to keep from hitting her, then in the end, only say 3 cars will get through a green light (yellow), whereas with normal drivers that number would be perhaps 10. So I just got in a car accident today , a lot of traffic so it was slow the truck in front of me was already braking a lot and there wasn’t even a car infronf of him. Hi, well first, since you hit him from the back, you're going to be at fault unfortunately generally speaking. Question is what type of coverage do you have on your policy. You need to file a claim with your insurance company and see if you have collision/comprehensive coverage. If you do you'll have to pay your deductible but you'll be ok. I was about ten yards away from the vehicle in front of my vehicle , the traffic was so heavy that the lady in front of me could not go out from the parking lot to the main drag, she was angry slammed the transmission into reverse and kept backing up in the direction of my vehicle , In the Heat of the Moment I tried to reach for the horn in which I did not get to it on time , I was thinking of a parking spot to go into the restaurant , she backed into me , she had a witness in the passenger seat I had none , she apologized and wanted to drive away which I refused , there is the chance that there's a security camera somewhere that caught my license plate and eventuality she will find out that whoever hit from behind is at fault , I've been there before in which someone refused to give me their information then call it in as Hit and Run , luckily I have called the police before he called in . with this memory in mind I insisted on calling the police , luckily she was young and could not keep her mouth shut , before the cop asked her what's going on she opened up apologizing profusely saying that she didn't realize I was behind and she put it in reverse backing into my vehicle , the officer says "oh yeah "in a shocking way , he knew that she have just screwed up , we ended up with exchange of information , which I decided to settle it without involving the insurance for $300 worth of repairs , in which she quit her job and vanished . what about evidence collected from a rear view mirror with front pointing cameras ? and rear pointing cameras ? what weight do they carry in a court of law ? are they as clear-cut or are they as ambiguous as anything else in the legal system ? thank you

If it really is a 'governmental entity' it may have different rules than normal - so I strongly recommend you talk to a local attorney about what is required asap. Just type 'personal injury attorney near me' in Google. There should be many options to talk to. Well generally speaking if you rear-ended the car in front of you regardless of what happened in front of him you are probably going to be found responsible for the accident I'm sorry to say.
I often have people cuting me off because most the time they think it is enough space between me and the vehicle in front of me and/or because they want to merge from the last left lane to the exit at the last minute, I have dash cam on my cars, if I rear end one of this smart aholes would I be at fault ?
I have a question so I was cruising the speed limit the car in front of me swerves in between lanes to the right because the cars in front of her were braking. There was no indication that she was merging and I had no time to react to the braking as I couldn't see through her car. So I ended up hitting her left quarter panel with the far right of my truck. The police were called out, but they didn't take a report. I did some more research though and technically she was merging as she wasn't fully established in the lane. I'm going to point this out heavily to my insurance. They haven't made a determination and I'm just gathering opinions. Thank you for responding

Sounds like you are doing the right things. Get them the photos and see what they say. They will decide if it is totaled or not. Then you'll get the vehicle fixed or figure out a value of the car.
Hi Barry, I was involved in a rear end accident where there was an accident that already happened. This happened at night where there was a heavy down pour of rain if that makes any use. So what happened was there was a car that stopped right in front of the first vehicle that was in an accident already, then the vehicle behind that stopped immediately hitting that car, and finally me not reacting fast enough hitting the car in front of me. all this happened on the high-way on the left lane. Am I at fault?

@@Jose-pt8gb Hi Jose, I can't answer the 2d and 3d question - that depends on the situation. As far as not having insurance, in CA so far as I know, you can't recover for pain and suffering if you don't have insurance but I believe you can recover for your economic damages and property damages.
My vehicle is completely totaled. The guy clearly smash me in the back on the right corner side. Or should I say the right corner side took the blunt of the damage. He then told the police upon their arrival that I pulled into his life but it is clear to see that he smashed in my whole vehicle which means that I have to be at a complete stop. The officer didn't give anyone a ticket and said no one was at fault for the accident because there was conflicting statements. What would happen if my daughter was leaving school and the boy in the car in front of her moved up and slammed on the breaks. She hit him, but he drove off and did not say anything for 2 weeks. (I only found out about it today when he finally contacted her) There were no pictures taken at the scene. No police were called. Nothing until today. If this was done properly when it happened, I'd take care of it, but it's been weeks. I don't know what damage she caused, if he was under the influence of anything, or what I should do. It's not normally the one who was hit that drives off.

I have a question I rear ended the right side of the back bumper of a car in front of me. I drive a 2002 Honda cr-v lx The scene: so keep in mind that about 50-100ft ahead was the distance it took and I noticed the car completely (thought the car was like in motion like driving because no break lights so I was driving down a two lane back road of a industrial Rd with a bunch of warehouses and mechanic shops. To the right there's a ditch /lake pond deep water no fence and to the left of me there was oncoming 🚘 traffic. The car in front was stationary in the middle of the Rd but no break lights on whatsoever. There was mini Cooper that I didn't see as the second vehicle in front of the vehicle of the car I was driving in back of. So that mini Cooper is the first, the car in back of that one is the one I rear ended on the right side of the edge bumper very minor and I'm the last* the Cooper was making a left turn to a warehouse parking lot to the left and as soon as it turned left was when at the 50-100 ft simultaneously I saw the car in back had no break lights indicating he was breaking for someone in front of him to make that left turn because the car was absolutely stationary. It scared me at the last few seconds before impacting the bumper a little to the right side of it and at the same time avoiding a ditch of a non fenced pond lake to the right of me on this narrow road 🛣️,. So I had no choice but to swerve just enough to the right side of his bumper while slamming on the breaks 😞 and avoiding the deep ditch/pond to the right of me. When I finally was able to make a safe stop after tapping his side bumper I parked and and got out of my car asking the driver what happened he says you hit me thats what happened! I saw that little mini Cooper park right in the parking lot short distance from us literally few steps away and he didn't even care since he didn't have any damage he left the scene. So I thought that the driver in front of me who I hit had also hit the guy in front of him the mini Cooper but he didn't. I told the guy that I didn't see his break lights and he nodded like he didn't care. He called the police and so did I because I feel this guy is partially at fault. Cops came and I explained what took place and I told the cop there's something wrong with his tail lights, you're supposed to see the lights coming on when you're breaking for someone in front of you and I didn't see that so I didn't know this guy was fully stationary also he had a mini Cooper in front of him that I didn't see until last second when it turned left and i had to avoid landing in a ditch-deep pond and avoid getting totaled myself due to water damage. So the cop tells this guy go park your car out of the side of Rd and into the left side of this parking lot where I moved my car also waiting for the cop to arrive. When I told the cop that I didn't see his break lights he suggested if I wanted him to check it with the driver. I said yes. So when the cop comes back he tells me what happened is unfortunately his car is an electric car. Some china manufactured car. And the cop tells me that he must have had it on some different mode cruise or something that the car doesn't show the break lights on. When pausing the car. I was like that's ridiculous so us gas driving vehicles have to now be extra careful because a car could be 💯 stationary and not demonstrating and breaking tail lights and I'm at fault. I was given a careless driver ticket and I immediately went to a ticket lol lawyer to let him fight this ticket. This happened a week ago and I have yet to give a recorded statement to my insurance "bristol west" because I was trying to buy time by letting my lawyer fight this ticket first. And now I got an email today from my insurance company saying that ive Been avoiding them and I haven't given my statement to them and that they may disregard the claim and also I haven't paid the renewal yet because it went from 171 to 264. Just because I recently bought this 2002 Honda cr v and that upcharge to having this now only car is really high. So I've been shopping around. This all happened within the first 2 weeks of me purchasing this car for work. And mind you I was on my way to deliver an auto part because I'm a independent contractor delivering auto parts daily. So I was also on the job doing a route. So after all this I investigated that electric vehicle and the main problems it has is the computer module of the car is defective. If in what they call regenerative mode the car automatically shuts off meaning at the moment of prolonged breaking it doesn't show break lights in the back and the driver of the car has to tap on the screen of his car to accelerate at which point the car gets out of that mode and drives but clearly i saw a bunch of complaints about this electric car enough to realize that this is one of the rarest occasions for me because i have never rear ended anyone and have never been involved in an accident. I'm 37 and I have the Florida state minimum of a policy. Do you think I should just give the recorded statement version of above but not renew the policy because of the fact I don't like the ok increase of even having this price hike from adding this one car to my policy. And should I or can I just give the statement and can they proceed with the claim without me staying with Bristol West" because like I said I was shopping in the middle of all this and found a better deal state minimum - policy for $161.000 cheaper then the current 264 renewal price! I was involved in the end of a 3 car chain collision. My vehicle hit last. There was a Toyota Corolla in front of me and a Honda Civic in front it. I saw that the Honda had one its signals on, but something caused the Toyota to rear end it. I couldn't change lanes and I eased off the accelerator and tried brake gently, but wasn't able to avoid rear ending the Toyota. This happen on the freeway in the afternoon when the commute traffic was about to begin; however, traffic flow was still smooth. I was not distracted, was traveling with the flow of traffic, and had proper space between vehicles. My mother was the only one with me in the car.

Probably at fault. It shouldn't matter. Unless someone brake checked you it's your responsibility to slow down. Now if they changed lanes abruptly and it was provable then ya, dash cam.....

Hey so i hit a truck not to hard prob 3-4 mph in. Red light i thought green light had turned but no i have a truck the guy i hit had. A truck too but he had a towing ball hitch i know he felt the hit i felt it of course my truck got a big dent but the thing here is that. When that light turned green he left even do i hit him i was confused so i fallowed him he never sed nothing i waved at him but he just kept driving i fallowed him for 10 min or so never stoped to talk or nothing so at that point i turned around back home and he kept on driving i was so confuse i did check his truck when i was following him did not see no damage with my eyes i got the damage bc of that towing ball hitch did i do the correct thing ?

I was rear ended last month. I merged onto the highway connector and had to take a right onto the interstate within the next quarter of a mile. So I merged successfully and logically stayed in the right hand lane for 30 seconds. Upon the merger the light turned red and the car in front of me slammed on their breaks. I slammed on my breaks and avoided the accident. The box truck behind me couldn’t stop in time or change lanes so they tried to avoid the accident by swerving and angling toward the shoulder of the right lane. The brunt of the collision accorded on my rear right side (the bumper, side panel, knocked my wheel off the axle). The driver got out an apologized and said he was sorry. We took pictures and the police showed up. The driver then told the police I cut him off and it was my fault. I told the truth on what happened and the police stated there were conflicting stories so insurances would have to work it out. He sited the driver for having a suspended licenses so the drivers boss had to pick the vehicle up and mine had to be towed away. Now their insurance company is denying liability and claiming the drivers story matches the story that I cut him off despite the distance/direction I came from after merge doesn’t make this possible, the damage on his vehicle (left side fender) doesn’t support the physics of someone who was cut off and only hit a vehicles rear right side, and the driver was literally driving illegally for a company.
Sounds like typical insurance company b.s. Two options 1. File a claim with your own ins to get the damage repaired 2. File a lawsuit against the defendant. Did you suffer any injuries? If you did, you'd likely be able to find a pi lawyer to help you b/c this stinks of typical ins co tactics.

The driver stated they seen the bus and the last minute and suddenly stopped. Tgis is very informative. I got rear ended after making a legal u turn the other driver was far enough to safety make the turn a few seconds later the other driver hit me from behind. I was trying to get out of his way as he was speeding. So I assumed that driver was at fault.

We were rear ended today. We were backing out of a ‘back out only’ parking place and onto the main road. We backed out into the center divider and a car came behind us and hit us while we were reversing.
They claim we are at fault because they were ‘backing up’ to make room for us but we didn’t see them there when we were backing out.
They have a witness (a passenger) and I was my husband’s passenger.
My biggest worry is my husband didn’t exchange info with them. We don’t have car damage and they do.
They wanted to exchange info but said it was okay for my husband to leave but then followed us home after the incident.

I was rearended on i64 headed east from Winchester Clark co to Mount Sterling Montgomery co just to give a freind a ride because he was walking to his sons birthday party. He had messaged me around 7:45 p.m. on 11/26/2019,i picked him up right around the 106 mile marker,then around the 108 mile marker,a little before it,was when we got hit,HARD....i had seen headlights coming far off in the distance behind me,knew they were speeding because looked in mirrors a couple times,car getting closer quick,I'm going around 70 and about to get over,so i can exit at the 110 exit,turn around n take my buddy to his destination,and go back home. I remember everything. Im waiting for this ford ranger to go on by in the slow lane ,then i was gonna signal and switch lanes,before he got by me,BAM we are hit,the rear of my 94 chevy 3/4ton 4×4 ,went up in the rear,in the rear veiw mirror i couldn't see anything,me and my passenger were threw forward,I'm pretty sure my feet or one foot,hit the brakes when getting thrown forward,and my truck went end over end,probly 15 times. Landed right side up. I'm still breathing,scary as it could be. I crawl out the biggest hole i can find because my buddy is no longer in the truck. So i get out carefully,and go around the back of the truck,and their is a heavy set lady,kinda leaning on her knees,and right by the passenger door of my truck. How she got there so fast,idk. Who she was,idk for sure,but was probly riding with the guy who hit me. I asked her if she knew weather the people that hit me were ok or not. She said not a word. Took off back up the hill from the other side of the median to the side i was traveling on. So i found my buddy,looked like he was sitting Indian style,and had been tipped forward,struggling to breath. I know your not supposed to move someone after an accident,but he really couldn't get any air,Dave was planted firmly in the ground. So very carefully,sat him straight back and sitting indian style like his legs already were. Hee started to reach for my hand,i said no buddy,don't get up,the ambulance is coming I'm sure,the whole interstate is backed up. Then when they were taking him to hospital,i walked up to the road to look at the car that ran up under me. (The whole rearend of my truck was 60 or 70 foot behind it), I think that when they it me,they were going so fast,they knocked the thing out of my truck. The car was a big buick lasaber. The whole front end was demolished on it. Alot more happened,id like tip tell you,my lawyer dropped me couple months later(the hammer)said it was determined to me partially or my fault in a letter. The police report shows that after being questioned by a deputy sheriff for probly an our while i got blood allover me,that he gave me a breathalizer test,then sent me to 2 state troopers who had looks in their eyes that something's not right here,this ain't on nothing. But they gave me three sobriety tests,and the report does show that they said i passed them all. Then i was released.. The report says that my statment was only that i was rearended. And the other guys statement was,idk what happened,i just know i was in an axident.
Hi so I was in a rear end accident yesterday. I literally just signed a lease on a brand new hyundai elantra and was driving back from the dealership. I was driving on the highway when the car in front of me stopped due to traffic. I also stopped. About 2-3 seconds later I felt a sudden impact and was pushed forward to the car into front of me as well. Turns out I was rear ended by a Corvette and my car was totaled. Also, there was a 3rd car behind the Corvette that apparently rear ended the Corvette as well however their damage wasn't major. In my situation, the Corvette or maybe the car behind the Corvette is at fault right? I should get paid in full by the other driver's insurance?

Did the insurance company deny her claim in writing? Sounds odd. Go through her own insurance to get the property damage fixed or file suit against the driver. Again, if there is a formal denial.

I was wrongly accused by American Family Insurance of stopping for no reason. It seemed odd that they believed such an odd claim in congested traffic.
Hi. We rear ended into another vehicle on a highway in NZ while driving at 80km/ hr speed. The driver claimed that his emergency braking system activated that causes his car to stopped so suddenly. He then sent us a footage of his front/ rear camera of his car. The footage reveals that before his emergency braking system activated, the car in front of him was slowing down to take the right turn. However, there were still plenty of space for him to safely brake (approximately 20 metres), but instead his car came to a complete stop from 70km/hr to 0 within 2 seconds from the emergency braking system. We were driving under the speed limit/ safe travelling distance but because our car does not have the same emergency braking technology, we were unable to stopped in time.
At the moment, the insurance company has determined that we are at fault (given that they have seen the footage) but we feel like we were not in the wrong and are looking to take this further to disputes tribunal. Any suggestions is much appreciated. Thank you.

Same thing happened to me yesterday !! The car infront stooped suddenly from 60 km/h to 0 km/h . And as my car is old from 1998 suzuki , even when applied breaks my car hit the Toyota Prius i front ,it got just a hand size dent in the bumper . But my car's bonnet got bent and upwards my car's front was damaged !!

I got rearended about a year ago by a woman who claimed I "cut her off" which I didn't. Refused to talk to me or give me any kind of insurance info. She then drove off and I couldn't follow her due to traffic. Two days later a cop shows up at my job claiming I caused an accident and ran. I did NOT run. I drove off after the lady drove away. Now I'm being harassed by her insurance company who's info I was never given and is wanting me to pay for this lady's car. I have insurance and gave the police my insurance info.

Hi i was driving home from school and this lady in her car an her husband in a truck seemed to have a accident or maybe the truck jus died on the road and wasnt working . A cop followed them off the main highway onto a back street tht i was takin an then left . Whole time i was stopped behind them waiting for them to go . They sat their for 8 9 mins blocking traffic and even almost caused some accidents because people behind me were goin into the other lane to pass since she was stopped . I waited another 5 mins then she started driving behind her husbands truck tht was damaged . I had a two car gap and started goin when she started puting her foot on the gas . She then slammed on her brakes an came to a complete halt and i slammed on my brakes and my car slid but their was enough time cause she jus picked up speed and then stopped . I talked to the tow truck people tht came an they said they were jus here for her 5 mins ago and were sayin she was a danger on the road . Hi I'm not sure I entirely understand the fact pattern. But, sounds like you just rear ended the person in front of you though there were extenuating circumstances. You can try and file a claim against their ins I guess - though since you rear ended them I would assume they'll deny the claim. What is your ins co saying?

Hey, I was involve in an accident this week... what happen was that the traffic was stopped because the light was on read, and after that light the police had close one of the lines to make to one, so I was in the first line, and the line that they left open was the second line, since the traffic was stopped I put my left turn signal on so maybe someone left me merge in to the line. I was on my mirror that a car stoped, and left a big gap, so I thought she was giving me space to merge in to the line, so I changed lines and my car as almost fully inside the second line, let's say almost 80% of my car was already in (I was driving a Toyota Corolla LE) soon after, the light change to green so I advance as traffic was advancing, and i felt that someone hit me on the back, I stopped, got out of the car and I find out that the girl behind me had hit me right on the left back corner of my car. It was nothing but scratches, so I ask her what did she wanted to do and if she was okay, she said that I hit her and that she wanted to call the police and involve insurance, so I said okay. Since the police was after the light, a police officer came by and the girl went running to the police officer saying that I had hit her. I want to where they were and the police officer never wanted to her my side of the story and said that everything was my fault. Then she said she couldn't do the report because she was supposedly doing traffic... another police came and started doing the report, and her comes the funny thing, remember the police officer that said she couldn't do the report, she stayed the whole time taking notes, when she said she couldn't do nothing. And she never let me talk with the police that was doing the report.... Now once the report was done (With only the version of the girl that hit me) the police that was doing the report game a ticket for reckless driving 😤, I ask him he was giving a ticket if i was the one that got hit, he said I should fight it in court... so I said okay am gonna fight it in court. Then I was that the ticket had my dad's name, not my. So we suppose that that happen because I was driving my dad's car... we got home, I finish fixing my other car, and the police that made the report called my mom asking for me (she was with me when the accident happened) I talk to the police officer, and he said that he was gonna void my ticket, because it had the wrong name, and that he wouldn't give me another one. So I said " Okay I was going to fight it on court and I also going to fight it court that you never wanted to take my version of the story..." he came to my house took my ticket with him, and ask for my version of the crash...
Now, you think that the girl was innocent for rear ended me? Or should I open a claim against her because she hit me? Because even though I was changing lines, the traffic was stopped, I had my turning light on, and she left a big gap between car, so I thought she was being nice and letting me slide into the second line. I had right of way to enter the lane and when I was coming to a complete stop. About a car length apart the other drive involved, hops in to the emergency lane carelessly and tried hopping back after noticing my car was already in the lane. I slammed on my breaks trying to avoid the accident but the passenger side of the others drivers rear bumper was hit. This accident totaled my car but just barely causing damage to his. WHO DO U THINK IS AT FAULT?

I was involved in a rear accident, and my company gave me a write-up, because they said I was not paying attention, but nothing happened to the car I Was driving, and the accident happened because three cars stopped in front of me as it started to run back on the road, while we were all stop because of heavy traffic. I don't think I was at fault because I didn't hit the car in front of me and the truck didn't hit me in the back either so but the other cars in front of me were heavily damaged due to their impacts. What is your ins co saying? Very generally speaking, you will likely be at fault for at least part of this accident.
Alright so, thank you for the information. I was just involved in a accident. I was turning left onto a street, there was oncoming traffic, suddenly a car comes flying out of nowhere. I hit his rear, causing damage to the rear of his car and the front of my car. I swear the oncoming traffic was far back enough for me to turn or else I wouldn’t have turned. The car came through so fast, of course the insurance is saying it is my fault, they’ll cover my car and his car. Also, the light was yellow, it had turned yellow while was approaching the line. The thing is, I feel like it’s not my fault. Also, I didn’t speak to the driver nor the witness so, I don’t know what they said, I just spoke to the officer. I can’t afford any of this, like my car insurance possibly increasing and I don’t have rental coverage 🤦♀️ so, I’ll have to pay for that too. I want to fight it in court, any suggestions please?
Good morning, sorry you're going through this. Unfortunately, if you were taking that turn, it's going to be very tough to overcome fault for this accident if you don't have an independent witness or video to show the other guy was speeding or otherwise ran a red etc etc. However, if you really feel you were not at fault, you certainly can file a lawsuit against the other party. Check out filing in small claims court. That was made for people to file on their own.... I wish you the best of luck. Barry

What if you had to reverse because it was unsafe to merge into the busy intersection and whilst reversing you got rear ended by a vehicle? That pulled up from behind you and seemed to be trying to cut you off based on the placement of the incident ? In LA I was in a 5 car rear end, cop on scean asked where was the fifth car and iwas the second car. I stated it's the one in front of me. But when I was hit from the rear I felt 3 impact's.. I was coming to a hard stop but came to a complete stop from the car in front of me. Then 2 to 3 sec later was hit with the first hit which pushed me into the first car. I hydro planned on a wet road into a vehicle who came from the right lane into my lane, I thought she was just panicking a little and slowing down because a garbage truck was pulling into the right lane, but she came to a full stop with no vehicle in front of her and the garbage truck never crossed into her lane. I was just rear ended. The light was red and I was stopped to make a right turn onto a street. The light then turned green and there was a pedestrian with his dog standing to cross the street. He pressed the button to cross and the cross walk changed for him to cross. I waited for the the pedestrian to cross and the pedestrian was halfway crossing when the car rear ended me. I recently was involved in an accident where I was braking for a stop light down a hill, with increased stopping distances for the heavy snow at the time, and my tires hit some ice hidden under some loose snow, causing me to unexpectedly hydroplane into the back of a pickup truck. I was already taking precautions given the weather that day, and if the ice wasn't hidden and I could have seen it, I would have increased my stopping distance even further, so based on these factors, would I still be at fault for the accident?

Morning. Sorry you're going through this. What is your ins co saying about it? It's tough to overcome with the ins co's when the police find you at fault for an accident. But if you really feel you were not at fault you can file a claim with their ins co. They will likely deny you. You'd then have to file suit to 'get your day in court' so to speak....
I was rear ended,and my insurance is saying that I was at fault. I do have a witness, a friend who was in the back seat(I was giving a ride) when the coalition happened. The other driver, the one that hit my vehicle was spreading and even though there were other lines with out vehicles coming….this driver did not change lines nor slowed down. Instead, this driver hit the brakes and ended up hitting me. I am a disable person, and my vehicle is the only transportation I have to go to my doctors appointments. Is there something I can do.

So I was in an accident where I was taking a green light intersection. To my right is a “exit ramp” to get off the freeway. So a right turn exit.
It’s a two lane road. Left and right. I was in the left lane. I took my green light and proceeded to drive when I saw a car speed through the exit and jumped to my lane and it was too late. I hit them. The weather had been snowing the last couple of days and my son was in the car. I couldn’t evasively maneuver because I would have put my son and I in greater danger. Would that put that person at fault ? Or is that still my fault ? He failed to stop, yield to incoming traffic and improperly lane changed.

I just got rear ended on the highway. There was an accident ahead and we were at a stand still and he ram into us at high speed. I was told by witnesses he was a drunk driver and was not going to stop. My car spun and hit the median. Do I need an attorney? What are your advise for my case? This is my first highway accident.
It have not been confirmed that my car is a total loss since it’s only been a few days and I haven’t heard from the adjuster/appraisal. But from the pictures and videos I’ve taken the car is beyond repair.
I would also like to add my husband and 2 children were in the car 14 and 1y.o. Insurance reached out and said they would cover medical expenses. I still haven’t received the state police report in the mail yet. So I’m not sure if the witnesses left a statement to help my case.

I have a big truck and I live in Louisiana. I was doing a job in Texas and stopped at a turn signal to far and had to back up I didn’t see anything behind me so I backed. I am getting letters saying I backed into a car and there was 3500 dollars in damage from the insurance company ( now a collection company) I didn’t see anything that made me think I hit a car no one come to stop me to say I hit them. I was rear ended on Thanksgiving night as I stopped at yield sign. Minor damage to my bumper however I have a cervical strain, lumbar strain and lower back pain. Being examined for a concussion. Hi Barry, I involved in a car rear-ended accident one month ago when I travel to California.
I was driving at about 55~65 MPH on the California highway (lane 3), when I saw the traffic (those car are completely stopping) in front of me about 1/4 km away, I starting to brake, and eventually stop my car. But about one second later, the car behind me crashed on my car from behind (rear ended) and rollover.

Good morning, well, if I understand you correctly, you were braking for traffic and got rear ended. I would think that the party that rear ended you would be at fault. Is there some other factor involved that might cause the ins co to put some fault on you?

Hi! Recently I was in traffic and a red light had turned green and the cars in front of me were ready to move. As I started to move, I hit the car in front of me. Her rear bumper was damaged (dent that’s not too large) and my license plate was bent. We exchanged information but she has my insurance information and I only have her name and number. Should I just wait for my insurance to contact me about the incident to explain what happened or should I go ahead and file a claim myself. Hello, I got into a 3 car rear collision in 101 south Cali. I was the 3rd car to crash and receive a heavy crush in the front of my car. None of us got hurt.
These are observations
A. the middle Benz cargo van was almost at 0-5 miles /hour and had no brake lights at all as I remember the moments before the crash.
B. He was either too slow/standstill like 0.5 miles away from an accident-prone exit [414A].
C.Both the first and second guy insisted not to call the cops. I believe I genuinely did the max best when I crashed [slamming the brakes so hard, without changing lanes]. There was no traffic jam before or after the accident. Do you think I have a better standing in the case?
D. it was too tough/late to determine if the second car was standstill/slowly moving due to the brake lights not on.
E.There is also not enough information for me to determine if they both already had quite a bit of bumper touch and seconds later I as well crashed on them.[Glad none of us got hurt but it's discouraging my confidence as I have never been in an accident in the last 7 years]

My car never got hit from behind and there wasn’t much traffic behind my car until for 30 secs after I crashed into the middle van and stopped

It will very hard for you to overcome being held responsible for the accident unless you have an independent witness who can verify those cars stopped for no reason and/or some other reason that you were not at fault. 4 cars mine was the 4th involved the 3 ahead of me had already crashed when i notice the car ahead of me wasn't moving I went to jump out the lane was blocked by somebody flying out the blue to make the light this car ws behind me and jumped next to me and I had to slam of breaks but ended up hitting the person in front of me not who was already crashed and stropped, i know i may be at fault but how much of this is mine

My daughter was in a rear end collision. She rear ended someone she says cut her off. They automatically put her at fault. The other vehicle did not have too much damage but the one she was in was left in horrible condition. Worst thing is that we had her excluded from our policy. Ok, i have a curious question. This was aroused by a scenario that happened to me on a truck simulator I was playing, but, I'm driving my semi on the freeway, doing the speed limit (80kph), ant the traffic was pretty far ahead of me. Traffic all of a sudden comes to a dead stop on the freeway. I lock down my brakes, but my loaded truck won't slow down. I utilized the "last clear chance doctrine" and attempted to swerve, but i still collided with the truck in front of me.
In a real life situation like this, would I be liable for the collision, or the car(s) stopped on the freeway?

I got into an accident today in the rear ended somebody what happened was he was a big truck in front of me and the green arrow turned on for the turn lane and we were in the far left lane and he pulled off with the cars turning basically running a red light and I couldn’t see over his truck and out of nowhere. @@LawFull nothing yet it happened five days ago and the insurance adjuster told me they would reach back out to me within 48 hours and they didn’t. now I can’t get a hold of them because apparently they don’t answer the phone on the weekends to provide information, so I’m planning on calling back on Monday to see what they’re going to say but that’s not good news haha I’m really hoping I get lucky somewhere because he was in the middle of breaking a huge traffic law when I rear-ended him but you’re right, the fact that I rear-ended him makes it bad for me, but right now I’m counting on the fact that he was running a red light and slammed on his brakes because of a mistake he made in the first place, breaking the law.

Someone was speeding up behind me in the left lane in bad weather conditions. They honked for me to move and as I safely merged into the right lane they continued their speed (much quicker then I was going) did not break, and hit the rear drivers side of my car. It’s clear that he was at fault, but their were no witnesses and the officer that made the report took the other drivers word over ours and assumed that we cut him off and chalked it up to unsafe lane changing. How can officers claim who is at fault if they did not witness the accident and their is dispute between both parties about what exactly happened? The officer said that if he flew behind us going 100 and was speeding I would still be at fault because the damage shows we weren’t in the center of the lane when he swiped our back end. I believe the other driver is at fault for not adhering to traffic especially considering the weather conditions. What do you think? What can be done? Thanks in advance
Hi Patty. It's impossible for me to know. The one thing I can tell you is that if you don't agree and if their insurance denies your claim, you do have the option of filing a lawsuit against the other driver. Check your local rules on filing small claims lawsuits - you can do it your self. That way you get your day in court so to speak....

I was in a accident last month. This is how it went. I was driving down the freeway and an exit was coming up with sudden traffic because many people were exiting there. The truck in front me swerved because of the sudden stop then I turn on my right blinkers to switch lanes but the truck who was behind did the same but rear hit me. Now thier insurance is putting me at fault and my insurance is not covering my damages because i don't have full coverage.

They are saying I switched on the truck's lane so it puts me at fault. And yes i don't have collision coverage. They closed my case but reopened it because I reminded them that my witness in the back got hurt. I also want to add that i had two passengers and the truck that hit me was a big Isuzu.

I was driving in the left lane and a car in the right lane cut to the middle lane and as he drifting to the left lane there are two cars in front of me the front car swerved into the turning lane so they wouldn’t get hit by the car from the right lane. The car from the right lane is halfway into the lane and the mini van in front of me starts braking and cuts quickly into the left hand turning lane to also avoid hitting them. I saw the car from the right lane slam on their brakes when the mini van cut into the turning lane I tried slamming on my breaks and I skidded into the car from the right lane. The two cars in front of me were able to cut back into the left lane and continue to go straight. I have all of this on my dash cam. Can I prove that the right lane car made an unsafe lane change that caused that to happen since there wasn’t a safe amount of space for him to merge into the left lane?? Hello, I was in a rear end accident yesterday this lady stoped on the highway but not on time slammed on her breaks. Which made me hit her from the left side since I tried to avoid hitting her and couldn’t break completely to a stop causing a minor accident. I called again this week and the person on the phone said it's listed as 50/50 because it says in the paperwork, when I pulled out, the other car had the right of way. Hi, I'm not really sure. It is all so fact dependent. Have you seen the police report? Does the police report verify what you just said? If so you may have an argument that you're not at fault. However it's still goingna be tough to win.

I was on my way to school last Friday and the roads were awful and there was a guy parked on a hill in the middle of the lane helping a girl I go to school with. Hi, whether she is at fault - sounds like it. If she was the rear car in a rear end accident then more often than not she'd be found at fault. Not always though.... You can file a claim against the other guys insurance theoretically for your meds and your pain and suffering. But I would strongly suggest that you check with a local attorney to learn your rights. Your state may also have laws that dictate how you can recover....

I was rear ended before (more then once) the one time the person took the fault as they know they were in the wrong and their insurance paid for it. The light turned yellow and I hit the brakes to stop and the person behind me must of hit the gas thinking we both could make it thru and bam there went my bumper and I didn't see a scratch on their car. and the other time I was rear ended I had my first car and we had the first snow I ever drove in so I was seeing how my car would do in the snow. So I went out on these side streets. I stopped at a stop sign and here the person flying down the road couldn't stop in time and rear ended my car knocking it into the intersection. Luckily it wasn't a busy road intersection and no one was coming. My car didn't have a scratch as their grill met my rear bumper. I told them not to worry about it as I was fine and my car was fine. Not sure if they turned it into their insurance company or not. This was back in the late 90's.

@@LawFull not injured in any car accident Ive ever been in. I've been in my fair share of them when others were the driver. With me as the driver I rear ended a truck one the car hydroplaned easily. After switching tires never had that issue again. You could be going like 20mph and with those tires the thing would hydroplane. And they were like new tires. I hydroplaned so badly all the time. I thought it was the car. But once those tires wore out and I bought new tires it stopped hydroplaning. That bumper on that car had the imprint of a pickup truck receiver hitch. There was no damage done to the truck at all.

I was in a work zone that had an exit ramp merge into my lane and I had to slow down because I would have ended up rear ending them but two cars behind me rear ended the guy behind me who got pushed into my car. Hi Barry, I hit someone from behind coming off the interstate going uphill to the service road. A lady was slightly parked on the left side of the road, talking to a homeless man and I hit the passenger back side of her car. I tried hitting my brake but to no avail. I rear-ended a semi a couple days ago. And I as write this it makes sound as it was completely my fault. But couldn’t it be possible that the truck in front of my is partially at fault for completely stoping in the middle of the road all of a sudden? A dust storm came in a matter of seconds, visibility went from good to poor. Hi I was in a 3 vehicle accident 2 trucks 1 car 🚗🚛🚛 I was the one at the end? Good morning, if you were the last car in the line then there's not too much you can do. You can state your case to your insurance company. But chances are if they deny coverage you'll get sued.

Hi. A couple of years ago, I was in a turn lane at a traffic light, and red light turned to green arrow, cars started flowing, and once it turned yellow, the driver in front of me slammed on her brakes to stop at the yellow light, perhaps 1-2 seconds into a 5-6 second yellow light cycle. I hit her car causing fortunately only slight damage to her bumper ($1,500). After the accident, the lady told me "I always stops for yellows lights." I could tell she was a very inexperienced driver and did not fully understand the nuances of how other drivers on the road have reasonable expectations about how others drive (not slamming brakes at first sight of yellow light), etc. The police wrote me a ticket for following too closely, and my insurance company paid her claim. Seems to me I should have had anywhere from 0-49% liability, and that she should have had anywhere from 51% to 100%, since her erratic actions, IMO, caused the accident. Thoughts? Thanks.

But I will say that if all drivers drove like her, and if all of the rest of the drivers had to give more car length separations to keep from hitting her, then in the end, only say 3 cars will get through a green light (yellow), whereas with normal drivers that number would be perhaps 10. So I just got in a car accident today , a lot of traffic so it was slow the truck in front of me was already braking a lot and there wasn’t even a car infronf of him. Hi, well first, since you hit him from the back, you're going to be at fault unfortunately generally speaking. Question is what type of coverage do you have on your policy. You need to file a claim with your insurance company and see if you have collision/comprehensive coverage. If you do you'll have to pay your deductible but you'll be ok. I was about ten yards away from the vehicle in front of my vehicle , the traffic was so heavy that the lady in front of me could not go out from the parking lot to the main drag, she was angry slammed the transmission into reverse and kept backing up in the direction of my vehicle , In the Heat of the Moment I tried to reach for the horn in which I did not get to it on time , I was thinking of a parking spot to go into the restaurant , she backed into me , she had a witness in the passenger seat I had none , she apologized and wanted to drive away which I refused , there is the chance that there's a security camera somewhere that caught my license plate and eventuality she will find out that whoever hit from behind is at fault , I've been there before in which someone refused to give me their information then call it in as Hit and Run , luckily I have called the police before he called in .
with this memory in mind I insisted on calling the police , luckily she was young and could not keep her mouth shut , before the cop asked her what's going on she opened up apologizing profusely saying that she didn't realize I was behind and she put it in reverse backing into my vehicle , the officer says "oh yeah "in a shocking way , he knew that she have just screwed up , we ended up with exchange of information , which I decided to settle it without involving the insurance for $300 worth of repairs , in which she quit her job and vanished .

If you think he was at fault, you need to file a claim with them. If it really is a 'governmental entity' it may have different rules than normal - so I strongly recommend you talk to a local attorney about what is required asap. Just type 'personal injury attorney near me' in Google. There should be many options to talk to. You could if you wanted (and I always suggested it to our clients) file a claim with your own insurance.

I have a question so I was cruising the speed limit the car in front of me swerves in between lanes to the right because the cars in front of her were braking. There was no indication that she was merging and I had no time to react to the braking as I couldn't see through her car. So I ended up hitting her left quarter panel with the far right of my truck. The police were called out, but they didn't take a report. I did some more research though and technically she was merging as she wasn't fully established in the lane. @@Jose-pt8gb Hi Jose, I can't answer the 2d and 3d question - that depends on the situation. As far as not having insurance, in CA so far as I know, you can't recover for pain and suffering if you don't have insurance but I believe you can recover for your economic damages and property damages.
My vehicle is completely totaled. The guy clearly smash me in the back on the right corner side. Or should I say the right corner side took the blunt of the damage. He then told the police upon their arrival that I pulled into his life but it is clear to see that he smashed in my whole vehicle which means that I have to be at a complete stop. There were no pictures taken at the scene. No police were called. Nothing until today. If this was done properly when it happened, I'd take care of it, but it's been weeks. I have a question I rear ended the right side of the back bumper of a car in front of me. I drive a 2002 Honda cr-v lx The scene: so keep in mind that about 50-100ft ahead was the distance it took and I noticed the car completely (thought the car was like in motion like driving because no break lights so I was driving down a two lane back road of a industrial Rd with a bunch of warehouses and mechanic shops. To the right there's a ditch /lake pond deep water no fence and to the left of me there was oncoming 🚘 traffic. The car in front was stationary in the middle of the Rd but no break lights on whatsoever. There was mini Cooper that I didn't see as the second vehicle in front of the vehicle of the car I was driving in back of. So that mini Cooper is the first, the car in back of that one is the one I rear ended on the right side of the edge bumper very minor and I'm the last* the Cooper was making a left turn to a warehouse parking lot to the left and as soon as it turned left was when at the 50-100 ft simultaneously I saw the car in back had no break lights indicating he was breaking for someone in front of him to make that left turn because the car was absolutely stationary. It scared me at the last few seconds before impacting the bumper a little to the right side of it and at the same time avoiding a ditch of a non fenced pond lake to the right of me on this narrow road 🛣️,. So I had no choice but to swerve just enough to the right side of his bumper while slamming on the breaks 😞 and avoiding the deep ditch/pond to the right of me. When I finally was able to make a safe stop after tapping his side bumper I parked and and got out of my car asking the driver what happened he says you hit me thats what happened! I saw that little mini Cooper park right in the parking lot short distance from us literally few steps away and he didn't even care since he didn't have any damage he left the scene. So I thought that the driver in front of me who I hit had also hit the guy in front of him the mini Cooper but he didn't. I told the guy that I didn't see his break lights and he nodded like he didn't care. He called the police and so did I because I feel this guy is partially at fault. Cops came and I explained what took place and I told the cop there's something wrong with his tail lights, you're supposed to see the lights coming on when you're breaking for someone in front of you and I didn't see that so I didn't know this guy was fully stationary also he had a mini Cooper in front of him that I didn't see until last second when it turned left and i had to avoid landing in a ditch-deep pond and avoid getting totaled myself due to water damage. So the cop tells this guy go park your car out of the side of Rd and into the left side of this parking lot where I moved my car also waiting for the cop to arrive. When I told the cop that I didn't see his break lights he suggested if I wanted him to check it with the driver. I said yes. So when the cop comes back he tells me what happened is unfortunately his car is an electric car. Some china manufactured car. And the cop tells me that he must have had it on some different mode cruise or something that the car doesn't show the break lights on. When pausing the car. I was like that's ridiculous so us gas driving vehicles have to now be extra careful because a car could be 💯 stationary and not demonstrating and breaking tail lights and I'm at fault. I was given a careless driver ticket and I immediately went to a ticket lol lawyer to let him fight this ticket. This happened a week ago and I have yet to give a recorded statement to my insurance "bristol west" because I was trying to buy time by letting my lawyer fight this ticket first. And now I got an email today from my insurance company saying that ive Been avoiding them and I haven't given my statement to them and that they may disregard the claim and also I haven't paid the renewal yet because it went from 171 to 264. Just because I recently bought this 2002 Honda cr v and that upcharge to having this now only car is really high. So I've been shopping around. This all happened within the first 2 weeks of me purchasing this car for work. And mind you I was on my way to deliver an auto part because I'm a independent contractor delivering auto parts daily. So I was also on the job doing a route. So after all this I investigated that electric vehicle and the main problems it has is the computer module of the car is defective. If in what they call regenerative mode the car automatically shuts off meaning at the moment of prolonged breaking it doesn't show break lights in the back and the driver of the car has to tap on the screen of his car to accelerate at which point the car gets out of that mode and drives but clearly i saw a bunch of complaints about this electric car enough to realize that this is one of the rarest occasions for me because i have never rear ended anyone and have never been involved in an accident. I'm 37 and I have the Florida state minimum of a policy. Do you think I should just give the recorded statement version of above but not renew the policy because of the fact I don't like the ok increase of even having this price hike from adding this one car to my policy. And should I or can I just give the statement and can they proceed with the claim without me staying with Bristol West" because like I said I was shopping in the middle of all this and found a better deal state minimum - policy for $161.000 cheaper then the current 264 renewal price!
