I wish I watched this before the accident happened. I didn’t made a police report. The woman that hit us reverse the story ... she didn’t pay for the damaged. Thank you for the information.
Hi, thanks so much for making this video. If only more people could see it, it would save them so much heart-ache!!!! My story: So I recently learned all the advice you mentioned the hard way. I was in an accident 3 days ago. The person T-boned me in a parking lot. I had the right-of-way. We called the police but waited for 2 hours and no one came. I was stupid in trusting the other person so we left the scene. Later, the insurance company called (we have the same insurance company, State Farm), and claimed that based on her statement, it was a 50/50 liability situation. I was incredulous. It was my first car accident, and I could not believe this girl would lie so blatantly. Lucky for me ( and unlucky for her), despite not having a police report, I had a dash camera in my car that recorded everything. I sent the video over to State Farm, and it was determined at once that it was 100% her fault. However, this situation greatly traumatized me. I learned the hard way that 1. Expect the other person to LIE. No matter how apologetic or sorry they may seem at first, they WILL change the story later to benefit THEM. 2. DO NOT LEAVE the scene until the police arrive, no matter how many hours you have to wait. In my case, it was 3 hours. But once you leave the scene, you will not get a police report. 3. Spend the money to get a dash camera. At the end of the day, that might be the only hard evidence you can generate to save yourself. But yeah, I agree the insurance game is soooo rigged against the consumer. I wish everyone here good luck!
A few days ago i was in an accident. My car seems drivable. Cosmetic damage to the front. My hood and door wont open. I only have this vehicle and i need to fix what i can for work. Do i need to leave it alone? First time dealing with this. 😧
Can you get compensated for doing a non injury and no fault claim, I remember asking farm state many years ago and was was giving $500 is there a technical name for it? Thanks
Morning. Honestly don't know. IL is not a no fault state. I would strongly recommend that you consult with a local attorney on that question. Sorry I can't be more helpful on this one.
ok so at 15 year old uninsured diver who didn't even have a drivers license had hit me and my husband and we where on our way home and well the person who hit us was going the opposite way when she had swerved in to are lane she had crossed the double line and hit us on the back driver side tire causing our rim to bend and our tire to pop off and also causing our drive shaft to fall out and now our Insurance company is giving us the run around. what should I do? do you have any advise that could help us? please let me know your opinion. im from Colorado
I'm a 17 year old and I just rear ended someone during stop and go traffic. It was very small and he looked and said there was no damages and he said were all good. I gave him my number and we both left. Well later today he texted me and said he found a dent and he wants to meet to swap insurances. This is my first accident so naturally I have no idea what I'm doing. It's under my grandmas name and she has insurance on it but she says her insurance company will not cover me and that my mom has to. My mom has personal insurance on me. So on paper I'm borrowing my grandmas car until I'm 18. What insurance do I give him and will it even go anywhere? No one took pics it was a more of a "just be careful next time" and the accident happened at 8 am and were meeting at 6pm for insurance
Hi, that is a bit tricky for me to respond to. I can't tell which of your insurance coverages is actually going to provide coverage. If it were me and you were one of my clients I can tell you what I would do I would file a claim with both insurance companies and let them figure it out but that's just what I would do so it's a little bit hard for me to know what to tell you beyond that.
Thank you Excellent-----some one hit me in the back of my car , I did not do an official police call or report due to I was thinking this is a minor case, not needing to call the police (a the 5pm time frame--- kind of a rural growing area). Well, anyway my issue is I cant find the form on the internet, I have been given all kinds of run around info and still it has not been easy to just------------- --.>>>>>>find what 2 person spoke(of many) with mention (a blue form) and or one said a self crash report...is there any clear way of finding this with ease---on the internet? thanks!!
Hi, every police department is different - so I wouldn't be able to know what form is being referred to.... I'm sorry I can't be more help on this one.
Just wanted to ask, second time commenting here. I was in an accident (hit and run) but we did find the guy. I'm from Indiana, I got myself a injury lawyer (Glaser and Ebbs). My problem is, yes I was injured, a strained neck and lower back. It's been over three weeks and I'm feeling better. The issue is I'm still without a car, my agent (State Farm) still hasn't determined if my car is a total lost or if it can be repaired, all their telling me is their working on it. But did make it clear they couldn't extend my rental car coverage pass the 24 days I had on my policy. So, my question is when I brought this to the attention to the legal aide to my lawyer, she said that my property damage would have to settled through me and the insurance companies involved and that she and the legal team are only working on the injury side of it. Is that the norm? Do you get involved with the insurance companies on the property side of it with your clients. Would you advise me to seek other legal representation. Thanks for your time, Kenny Wixon
Morning Kenny, well, it's split really. Some lawyers do handle the PD and other lawyers don't. At the firms I've worked at we always handled the prop damage for our clients. Your firm seems to have the opposite policy which is unfortunate. Not sure what more I can add to this other than I'm sorry you're dealing with this.... Barry
I have a similar situation. The law firm said they are interested in the medical side and that they would advise on the property damage. I need the auto replaced as it is a total loss.
I was in an accident a few day’s ago and their insurance has accepted liability. I’m now waiting for their appraisal of my vehicle. From my research, my vehicle, I’m pretty sure, is worth JUST above or maybe in the approximate range of what I was quoted for damage repair. To me, my first thought is to see if another garage can repair the damage cheaper. The shop I chose did seem kind of pricey. Otherwise, I’m thinking I should see if my insurance company agrees with their appraisal. Not sure how that’ll help, but I’m thinking it doesn’t sound like a bad idea. Lastly, I’m worried their insurance will try to lowball me. Which I’m sure they will. If they decide my vehicle is worth less than the cost of the damage, then I won’t be able to get it fixed, then I guess I’d just pay off the vehicle, which I still owe $5000 on, but then I’m stuck with a car I can’t drive and no other transportation. This is all very overwhelming.
Morning, listen it sounds like you're doing the right things..... I've done some videos on this channel one in particular about total loss vehicles you might want to check out. A lot of this will depend on what state you're in and its laws. But wait to see what the appraisal says.....
I wish I watched this before I was in a accident back in january on a very late night (I got a attorney). The medics asked if I wanted medial attention I told them no cause I thought I was okay (first time accident & they don't warn you that you may experience problems later) the next day I was sooo achey.
Hey... Nice info. A few days ago someone backed into my parked car. Its good that they contacted me. I contacted both insurance company's and their insurance will be doing most if the work just to keep from coming out of pocket. An appraisal came by today took pictures etc. How do I know that my car will be well taken care of? If im asking this question right. Or maybe whats my next step?
Hi, the appraisal is just the first step. Then you'll take it in to get fixed. They may or may not find more damage. Depending o n where you live you may be able to bring it to wherever you want to get fixed. So it should be taken care of just fine.
@@LawFull thanks. I should be receiving a call by Thursday. Glad to know all should go well after this point. I have a lot of miles on my car though. Will this play a role in how they want to handle it?
hello and thank you for your time and information I was involved in an auto accident where I was at 0% responsible. I went to the hospital on site and it resulted months later in surgery to my hand that got damaged in the accident. My hand was not feeling any better and the pain continued and it has no strength and I can’t really use it to do anything. So I hired an attorney because I needed to get hip surgery because my leg and hip were impacted in the car but then the doctor also saw that there was a minute arthritis there so because it was hard in the accident but I had arthritis although I don’t see how that was a cause because it wasn’t hurting before they went to court to see who was going to pay for it while I suffered for you and a half so I ended up having surgery and to this day I’m still having trouble with the hip and that was in September 2019 so my problem is whether my attorney gave me the right information or not so the individual who hit me had $30,000 of coverage so my expenses were much larger than that $30,000 so it turns out that the attorney got 10,000 my medical insurance got 10,000 and I ended up with 10,000. I was in disbelief because I lost my job I was fortunate that I qualified for retirement but I lost a lot of income in that retirement amounts I had 12 years of work before I retired and my job was 100% secure so I didn’t understand why the insurance of the individual responsible only gave me $10,000 and I don’t know why I have to pay my insurance 10,000 of my dollars. My attorney told me that that was the maximum that I could get and when I insisted that my circumstances required a lot more he stated that that was the maximum that I could get and he said that if I sued I wouldn’t get anything either because the individual who hit me doesn’t appear to have any money and so I would just have to be paid court fees and get no money for the reason that I was there. Can you please confirm that this is possible given all my losses
Hi Lucy. That's a very common scenario. Seen it countless times. If all the guy had was $30k in insurance and he doesn't have any assets to go after, and you don't have underinsured motorist coverage to go after, then you're probably going to be limited to the $30k recovery I'm very sorry to say.....
@@LawFull I’m very upset that the insurance doesn’t cover what he didn’t have because it appears that I am paying the consequences and his car got fixed and who knows what else he got and I lost everything. There is something wrong with the system. I really appreciate your response. You take care.
@kathleennickless1354 I was in a hit and run. I got the other drivers plate #. Filed police report. But my insurance totaled my car but I want to keep it. But I also reached out to the other insurance company and filed a claim. Should I wait to see what that adjuster says? Or just let my insurance company deal with it?
Hi were you injured? If you were then definitely file a claim with the 3d party's ins co. And consult with a local attorney as well. As far as keeping the car, the rules vary state by state so you should really check with someone local about that.
Hello Sir, I met with an accident on Aug 13. It is not my fault. The other car hit me from the back and my silencer and bumper were damaged badly. I dont know that I need to call police. I thought it will be a traffic jam and I took the pictures of the incident, licnese of the person who hit my car and insurance information. I called and reported my insurance team and I was not able to get hold of the other insurance adjuster. She is saying that She reached out to me. How can resolve this issue sooner? My car is brand new. Can I report to dmv and police now? I have video and photos and I have all the proof. Need your help in how to expedite the case as the other insurance is not helping me. I tried every single day to reach out to the other insurance. I just want to get it done as soon as possible and any help is appreciated
You can try reporting it still. The quickest way to get your prop damage fixed is to go through your own ins co. You'll have to pay your deductible but you may get that back. And then you're ins co will go after the other side for reimbursement so you don't have to deal with them......
My insurance company issued me a policy knowing my license is expired. It says on the website that it’s expired. Due to circumstances I won’t be able to get it for awhile. California and I are good. As far as they are concerned it’s just expired. So if I were to get into an accident they would have no other choice than to pay? Right?
That is kind of difficult for me to know. I would assume it would be based upon your insurance policy and exactly on what your personal insurance policy says regarding that matter. Have you asked for a copy of your insurance policy so you can take a look at it and see what it says?
I had 2 car accidents before. First one was minor accident, police did not do a report, even I asked for. Second one, I totaled loss my car. The police arrived the scene still no report, he said I don’t need one. So what can I do after that? Is my right have a report? Can I call to police department ask for a report? Thank you
Hi, I would drive to the police station and ask to file a report. Your insurance company is going to want to see a report - and they should know that. Also, if you called 911 to report the accident, there should be a transcript of the call that you can order (if all else fails.)
I have a question so my mom had been hit in the front fender in the person who hit her went around the person that let her through and the way was only two way but would split much more ahead. He was on top of the yellow line which would also cause an accident on the other side of the lane. She has photos and witness but the insurance company paying him for his damages but not hers how does she deal with them and BTW. He's lying saying she hit him. When she had someone let her through.
Hi Amy, do you mean that your mom hit the car in front of her from behind? If so, that's going to be very tough to overcome. Not impossible but very difficult. Is that what you mean? Thanks, Barry
I had accident it was hit and run then turn around the got the fault driver information a month later I made a claim with my insurance that claim been uninsured motor then my My medical bill ended up being over 8000 and I’m still in pain I’m in the process to go ahead and get some more treatment for my back pain that I have but my own insurance only covered 5000 Medical bills so should I go after the faults driver insurance what do you recommend?I did call the police and I did went to the doctor emergency room all that
I was hit by Allstate policy holder who refused to share Driver’s License and insurance information. My insurance made the claim for me but Allstate denied me after two months of the accident because their driver denied hitting my vehicle. What is my options to get Compensated to repair my vehicle?
You can 1. use your own auto ins to get the damage fixed if you have the right coverage. Or 2. file a lawsuit against the other driver and get your 'day in court' so to speak. Research how to file a lawsuit in small claims court in your jurisdiction. That might be an option...
@@LawFull 🙏 option 2 we will work for me, the small court’s Clerk told me I can sue the driver but not his insurance. My question is can I sue the Gas station where the accident occurred since there was not lit? Or can I dispute it with his insurance?
Hello... A car ran through the Red light and i hit them. He admitted to the fault. I went to the hospital and notified my insurance company. His company contacted me and immediately put me in a rental and offered a total lost for my truck only. How do i get compensated for pain n suffering and lost of work etc...? Do i need a lawyer now?
@@LawFull hi. We had to get our things out of the truck n try to go to the urgent care for headaches. Send off documents to the insurance company. My husband was injured, pain in neck and back and can't sleep but he doesn't have insurance. They won't see him. Only in the er😳
If i in a small accident (literally a tap that caused scratches, was going about 5-10miles per hr) should both parties provide insurance? The person was a "lawyer" apparently and said the did not have to provide insurance Since I hit her. What are your thoughts?
Well.... that's a new one. Never heard that before. However, in all liklihood they're going to file a claim with your insurance anyways and you'll then find out who they have....
@@LawFull is registration required for me to give up to the person? The person has minor scratches on the car and demanded my insurance, id, and registration. Is that normal?
What if you rear end a high way patrol vehicle? But there was no damage to their vehicle? And barely any to your own ? And officer didn’t provide any insurance or I’d instead 3 other officers arrived to take my statement and information leaving me with just a crash card. (The officer merged into my lane then shortly after hits his breaks suddenly I’m assuming someone jumped in front of him none the less I didn’t have enough time to break and before I knew it i rear ended him , pulled over we sat for a while then he came out of the car to obtain my license , insurance and registration, then I had to wait for his Supervisor to arrive with one other squad vehicle with them, the pressure was intense, i didn’t ask for any information from the actual driver of the vehicle which is bothering me.) I just hope I don’t get stuck with a large bill for little scratches that may have already been on the car. I was able to take a picture of the officers rear end and the front of my car even after the officer told me to back up and not take a picture) sorry this is so lengthy guess I’m venting since I have no one to talk to about this matter. Might I add I had my two children and puppy in the back who were also shaken up and experienced whiplash. Well that is all I have just have to wait till Monday to call my insurance company and see what happens from there.
Hi, listen, this is the reason you have insurance in the first place. Don't sweat it. Just turn everything over to your insurance and let them run with it. Let them take this off your lap altogether..... Barry
I broke my tooth in an accident where the other person hit my car. Not much vehicle damage, but enough. I called the cops. My medical insurance only pays to pull the tooth, and I don't want to do that. What should I do? Get medical treatment and then sue to recover the money?
Morning - consult with a local attorney who can help you get the medical attention you need now...that's what I would do. Where did the accident occur? If you email me at info@legalvlogger.com I may know someone local who can help you.... Barry
Hi Hugo, the closest lawyer I know is in Sacramento. If you suffered huge injuries he could get involved. But otherwise, if this is a smaller case, you can just type in Google 'personal injury lawyer near me' and a ton will show up.
Hi, thank you for valuable information. I was rear ended recently. The driver ran away on foot. Police was called, made a report. 1)As I don't have all the info about the other driver. I called to file a claim with their insurance after providing name and address of the person ( owner of the car as police recovered it), the insurance company said they don't have this person in their system and licence plate is not going to work she said. I was like...? What do I do next? I have their Vin number should that be enough to locate the person in their system? And should I go to police and ask them how did they figure it was that insurance company and fetch more information for me, can that do that to help me ? 2) this car was not reported stolen at the time of the accident, but later on when I picked up a police report they said it might be stolen something. But it is not indicated in the report. What are my chances to get reimbursed for my damaged car from the other party? 3) in case they don't reimburse me, can I file as uninsured/underinsured(I have that in my liability policy) to my insurance company? Thanks.
Definitely look to your own insurance policy to get the damage repaired. Hopefully you have collision coverage that will cover the damage. You will likely have to pay your deductible but that's better than not getting the car fixed at all I would think. Your insurance company will also have the tools to look the other driver up and potentially seek reimbursement for the money they put out on your behalf.
@@LawFull Thank you for quick response :)) Actually I only have liability for my car (not full coverage, and I assume that means I don't have collision coverage) should I still file with my insurance or just ask them to help me with the other driver policy identification ?
@@moshka007 Well, I would want to know for sure what coverage I had so I would check with my company to see if I had collision coverage or any type of coverage that might cover the accident. You probably are required by contract to let them know about the accident anyways - though a lot of people don't tell their insurance companies because they're afraid their rates will go up. But in this case, you sort of need their help I'd think.
I was hit by a car going 50 in a 25 3 car's ahead of me at a stop sign. She never even hit her brakes. Totaled her car and my jeep. What are my options??
Hi, well, generally you would file a claim with their insurance of course. If your injuries are severe enough and or you're going to get more med treatment, you might want to talk to an attorney. If you want that, I can probably refer you to someone if you tell me where you're located (major city and state). Thanks for the comment. Barry
Ok, did you want me to try and connect you with someone down there? The one guy I know does big cases. So I would have to ask him for a referral. Let me know and I'll take care of it.
Hi, my car was parked outside my house a car hit my car and landed on my car. It's the first time we go through something like this we don't know what to do feel so helpless.
Hi Adriana, did they give you a reason why they won't pay for all the damage? That doesn't make sense. You can in fact file with your insurance if you have collision coverage - but then you will have to pay your deductible.
@@LawFull they said we have through my insurance because the have a budget that won't cover the costs. The guys insurance said if I want to get a lawyer go ahead.
@@Mattheboss2837 I see - so what they are saying I think is not their budget but that their insured does not have enough property damage insurance to cover your damages. I suggest filing with your own auto insurance then assuming you have collision coverage. You are probably not going to be able to find a lawyer to represent you since there were no injuries. Personal injury attorneys to be frank are looking to find cases where there were injuries and medical bills because they get paid on a contingency basis.

Hi, thanks so much for making this video. If only more people could see it, it would save them so much heart-ache!!!!
My story:
So I recently learned all the advice you mentioned the hard way.
I learned the hard way that

Hi Amanda, what type of run around is your insurance company giving you? Also, the car the kid was driving had no insurance for sure?
Don't give him anything he. Trying to scam you
Thank you Excellent-----some one hit me in the back of my car , I did not do an official police call or report due to I was thinking this is a minor case, not needing to call the police (a the 5pm time frame--- kind of a rural growing area).
I'm sorry I can't be more help on this one.
ok when filing a claim, do i file a claim with their insurance first or my insurance? please respond you've been a great help. Thank you
Hi, doesnt matter, the issue is who do you want to pay for the damage.
Thank for this info, but what if you were hit by an animal and went to the hospital by an ambulance, does that affects you?
Hello Fabian - affect you how? You would file with your own insurance...
Happens a lot unfortunately
Hey...
@@roderickdevon2277 That could be a factor in whether they determine whether to total the vehicle or not.
Do you recommend any personal injury lawyers in northeast Ohio?
Hello, I only know one lawyer in OH and he is in Columbus. . . He does take cases all over the state if there are severe injuries involved however....
hello and thank you for your time and information I was involved in an auto accident where I was at 0% responsible.

I was in a hit and run.
Hello Sir,
I met with an accident on Aug 13.
What if other insurance has liability coverage?
Morning - not entirely sure what you are asking here... Can you clarify? Thanks

Hi, that's really impossible for me to say. Totally varies. I've had cases with $1k in bills and others with $400k.

But in this case, you sort of need their help I'd think.

Hi ugh yes my husband was driving uninsured was pulling out of a parking spot the lady was doing no less than 20miles an hour in the parking lot she dragged us moved her car before we could get pix PD was called they took pix so did her husband it's more than obvious she was at fault can they still sue us as in reporations
Hey, if it's obvious that she caused the accident, call her insurance asap and file a claim for the damage to your vehicle.... were there any injuries? She could sue you but if its that clear she's at fault, sounds like she wouldn't have a case.
I drive into the back of s car the persone infront slam the bracks for 31m get to a dead still stand on thr highways we do spead for about 120km i okso slam the bracks for 57m butcanot stop the vechel the persone infront claim she black out
Note there whas no reason whatsoever to stop to a dead stll stand that time now they claim its my mistake and i whant to claim for damage i did followed the corect distance but its not posible to stop the car on that spead on that short notice
That's a difficult situation but generally speaking if you hit them from the rear you are going to be at fault.
@@LawFull thanks for repply so there is now way i can claim the driver infront of me whas neglect and head the brackes because of a spead camera infront and now se claim se have a black out thats why she stop in the middel of the high way and i have all of this on video and pictures ande where se atmid se did have a black out
@@fransbrewis2594 I'm not sure I entirely understand. But you can 'claim' and argue anything you want. It is possible when you do that the insurance company will put 'partial fault' on the other driver. But I think that in the end you're probaby going to be over 50% at fault for the accident .....
Hello. Im in Houston Texas. I was driving down a three lane local road when a driver neglected to yield before pulling out from a plaza. She then crossed over all three lanes to get in the far left turning lane. There was no way of doing or avoiding her without causing further problems. I hit her from the back. Cop started she was at fault. She had significant prior damage to her vehicle and i sustained new cosmetic damage. Not sure if there's any other issues with my vehicle. 4 days later, im now experiencing headaches and neck & shoulder pain and haven't gone to the hospital yet. Am i still able to go, even though i don't have medical insurance?
& will they pay for my personal damage to the passengers property?, like my cell phone that was broke & my clothes that was ruined! Sounds petty but those things cost me a lot of money & I have a receipt for my items, it was a birthday gift like over 3000$ worth of clothes!
Yes you can get comp'd for personal property damage. But you'll have to take photos and it would help if you had receipts.....
First mistake was titling this a car accident. The correct title is car collision. This places greater emphasis on driver responsibility. Next thing this guy is going to describe driving as a right instead of being a privilege
What happens if your car was parked. No one was inside. Can you still get representation?? It's a total loss
Also it's a 2017 Toyota Corolla less than 60k miles... the driver at fault was intoxicated.
Hi, generally speaking a personal injury attorney won't get involved in a property damage only case. Why do you need representation? Just file a claim with the defendant's insurance. If he/she doesn't have insurance go to your own insurance....
@@LawFull thank you... they were right off the bat speaking of a limits issue.. so I have been stressed .. he does have insurance I just want to make sure I get what my car is worth
Well, your idea of what its worth may differ greatly from what the insurance company thinks its worth
