    Hi again thanks for replying my question,
    Q1: My wife applicant didn’t claim any universal credit only me n my 2 son claimed we British citizenships, still will it be any problem?
    And
    Q2: On £18600 minimum wage still needed even she came in UK November 2011 on old categories rule?
    Q3: I’m doing fee waiver application, on accommodations section it’s says do you Own property, i put yes as Hasbend,
    But as applicant what does she put?

    Hi Analiza,
    I have got ILR recently via Tier 2 (5 years), the wife is still as my PBS dependent. We now have a child now born outside the UK, would I be able to apply under Family Visa-Child or should I apply under PBS/Skilled Worker dependent ?

      As an ILR holder, you are already considered "settled" in the UK, so your application for the baby should be under the Family Visa. However, the Appendix FM Child application seems to be only for those who are applying to join a parent who is applying as a partner which in your wife's case does not apply. But if you try to apply under the PBS route there's a chance it will be refused as invalid as you're no longer a PBS worker but "settled" person in the UK.

      @@DIYImmigrationUK Thanks Analiza for the response. I did a bit of reading yesterday and tracked my situation to the immigration rules - it is a bit tricky as it depends on the parents immigration status and where the child is born and it reflects what you have mentioned. I thought I would put some links down & quotes so others might find it useful.
      So the Skilled worker (PBS) guidance points such a situation to section - page 16 of the guidance version 6 under Lead application immigration status quotes "A child born after settlement of the lead applicant, and who requires permission to stay, should apply through family routes - paragraphs 297 to 304 in Part 8" So definitely not a PBS dependent (child) However, my wife can keep renewing it under PBS and cannot renew r switch to family route.
      297 and 304 explains various circumstances that isn't mentioned anywhere else in the PBS dependent guidance or the Family route guidance's. However the rules are well explained with some scenarios.
      Under the family route section of immigration rules, I could track my situation to rule 301"Requirements for limited leave to enter or remain in the United Kingdom with a view to settlement as the child of a parent or parents given limited leave to enter or remain in the United Kingdom with a view to settlement" and details of the rules are for
      301. The requirements to be met by a person seeking limited leave to enter or remain in the United Kingdom with a view to settlement as the child of a parent or parents given limited leave to enter or remain in the United Kingdom with a view to settlement are that he:
      (i) is seeking leave to enter to accompany or join or remain with a parent or parents in one of the following circumstances:
      (a) one parent is present and settled in the United Kingdom or being admitted on the same occasion for settlement and the other parent is being or has been given limited leave to enter or remain in the United Kingdom with a view to settlement;
      There is more circumstances explained here but its a good page to refer to. Also talks about the settlement applications (section 297) and later on till 301)

    Hi can you give me advise please,
    My wife entered in UK November 2011, but they have put in 10 years route because she couldn’t pass her life in the uk test, now her visa ending on 27/4/2021, 10 years route will be complete on November 2021, I received the letter about 10 years route on October 2018 does it mean 10 years route starts from November 2011 or October 2018? If this is the case then which application should I make?
    Is it FLR (FP) ? or any others
    Also I have claim universal credit benefits will it be any problem with application? But she’s not claiming any only me and 2 son,
    I would be appreciate if you can answer

      If she has been in the UK continuously for 10 years (without any gaps such as overstaying) since 2011, she can apply for ILR under the 10 year long residency route but only if she complies with the requirements i.e. passing the Life in the UK test,.etc. If she is not eligible to apply for the ILR, then use the form FLP FP (or partner's visa)

      Just to be more clear,
      Do you mean mean FLR(FP) instead FLP(FP),
      And also kindly tell me
      Q1: Will it be any problem on FLR OR indefinite leave to remain if I claim any benefits example universal credit
      Q2: is there any minimum wages requirement,
      She came in UK before 2012 entered in UK November 2011
      Q3 does she need pass any other test.

      @@mohammedkhan3408 I can't answer your query Q1 fully without knowing all the details. If you apply for ILR the financial requirement is still required.
      Q2 - yes, you and the applicant has to show income of £18600 p.a. before tax to meet the financial requirement.
      Q3 - only English and Life in the UK.

    Hi my partner is an overstayer and has been here for nearly 10 years without visa. We have a child together, and want to regularise my partners stay. We are thinking to make the application without a solicitor do you think this is wise or is it too complex because he has overstated. I’m a British citizen . Thanks

      Go to google and search "family visa". The UK government website will take you to a page that says apply for family visa. There is no specific form for entry clearance for ILR.

    Applicants proving they can speak English makes massive sense to UK nationals... There are increasing numbers of communities moving here from abroad, only speaking their native tongue with eachother in their own segregated communities, never integrating with society here. They build their own religious temples, own their own businesses to supply their own people. Zero interest in being truly British in attitude and culture, which is very frustrating for the other people in that area. The culture clash, without any integration attempt, is frustrating for British people. It sours the situation
