    Good morning, my husband spouse visa on a 5 year route is going to expire next month. Needed to apply ilr soon. Do I have to wait for them to send me an email to either book appointment at the service centre or do via U.K. VCAS IDV app? Do you know how long does the email take to receive after completing and paying the form? I am worried by the time he either receives email to do by app or attend appointment, his current visa might expire? Please advice

    I am a widower of a british national. We used to live in the Philippines where my husband spent most of his time. He passed away in 2015,we have two children together. My children and I are now living in the UK since August 2021. I was given 10 year Family Route, is there any chance that I could change this to 5 years route? I work as a care assistant and earns £17,400 annually. I receive benefits and currently living in a council house as I cant afford to pay for a private property. Please help

      To be able to switch to 5 year route, you need to have been granted 10 year route under Appendix FM and have an English Language test as well as meet the financial requirement. If you applied before the new Rules took effect then you will be expected to meet the income requirement of £18,600 pa.       You do need to apply as it is proof of your permission to live in the UK. You apply for a No Time Limit BRP.

    Hi I came to uk illegally 2007 and i done asylum seeker as different country and then 2013 I have partner unmarried which is Birtish citizen and I applied with my original country and my original passport for leave to remain under 10 years route and I have 2 kids which is birtish citizen too I already done (1)2.5 year from April 2016 and another (2) 2.5year from march 2019 and I applied for my (3) 2.5 in August 2021 and I am still waiting is any chance for the new immigration Rules on 15 March 2022 can I apply for ILR if yes can you please explain that and what I do should next .

      @SixPathsOfPain It meant that the 5 year or 10 year route is given if you are on Family visa (limited leave to remain as a partner of settled person or child of a settled person). We are not sure what type of visa you hold and on what grounds. But you will find this from the letter from the Home Office when the visa was issued.

    I joined my partner in 2014 via Spouse Visa and during the extension I was placed on the 10 year route because of the English language was expired. In 2020 during my renewal was put on back on the five years route. Please I need help as my Visa will expire August 2022.. Can I apply for ILR as I will be 7 Years and 7 months since I came to the UK and been together with my partner
    I saw the below on the gov page
    If you're on the 10 year route, you can include time you've spent on both the 5
    year route and the 10 year route to count towards your continuous residence.
    Please can you advise what to do

      There is a Long Residence (10 year) route to settlement. If you have been continuously living in the UK for 10 years then you can apply for ILR; in your case it will be in 2024 when you can apply.

    When filling the online FLR (FP) form, at the end of the application when I go to pay for the Immigration Health Surcharge fees, the visa type FLR (FP) changes to FLR (M) and it doesn't allow me to amend before paying. Why?!? Please help

      Are you applying for spouse visa renewal? If so, don't worry about that. It will still be processed.

    I m an overstayer and I just made application of unmarried partner visa.i m living with my partner together from last 2 n half years. I have A1 English certificate and I submitted all requirements they asked me for in check list.and my partner showed her income over 25 thousands pound.
    I m worried that will my application be approve or not.and if my application get approved then in which route 5 yr or 10 yr route?
    Also they retained my passport in biometrics appointment although I uploaded them online.

    I have flr fp 2.5 years on 10 yes route. (Based on My children (born outside UK) that they stayed more than 7 yrs in UK.) I fulfilled both requirements for 5 yes route. But I am not sure if I can apply for 5 yes route. My extensions due for renewal in September. Please advise. Thanks.

      You can switch to 5 years route if you meet the mandatory requirements, which are: financial income and English Language knowledge. Are your children also on limited leave to remain?

    I'm very confused with 28 days rule when applying for ILR
    I understand that you can apply no more then 28 days before your visa expires.
    Is this 28 days be calculated from the date you make payment for ILR OR from the date when you have booked your appointment??

    I live here for 20 years never over stay but always av legal visa from college obtained good grade from college but was granted 10 year route because I married my husband who depends on my visa as well he was a student of the same college I'm in my 3year of my 10 year route we both have a 14 year old child who has born here an own a British passport honestly I'm can I claims the indefinite off my 20 years living here or I av to continue with the 10 year route

      There must have been a reason why you were issued with Limited to Remain on the 10-year route. The 20- year Private Life route does not grant you a settlement/ILR status. You will be best to ensure that you meet the financial requirements/English Language and then switch to 5-year route if you can to save time and money. If you can't do that, then best to stay on the 10- year route you are currently on.

      Even if you earn over the £18,600 you can get still get a refusal if you have not submitted the CORRECT format of evidence to show that you meet the financial requirements. It is important that you submit exactly what the HO ask you to show you are earning the £18,600. If you meet all the mandatory requirements, you can apply to be placed on the 5 year-route, but only re-apply if you are sure that you tick all the boxes.

      You will get 2 years of work and residence permit with your graduate route visa. But if you've a doctoral degree you'll get 1 more year with your graduate route visa. You can't extend this time limit but if your PSW expires you can switch it to another relevant visa like a skilled worker visa or a student visa again.

      You will need 12 months payslips not 6 months. It won't be an issue if his total income for the year before your application is still equivalent to £18600.

    Hello dear ! I am on a 10 year route visa, as My British husband and I couldn’t comply the financial requirements for a Spouse visa. My question is now we are both working and meeting the financial requirements. My visa runs out in Feb/21. Do I need to prove the English Language and Also Do I have to pay the Healthcare surcharges again to switch ? I still have a seven and an half years on the 10 year route. It means if they granted me a Spouse visa I will have another 5 years to wait till apply for ILR. I was granted ILR back in 1994 and I lived in the UK for 15 years before left, but stayed in Brazil for 8 years and when I came back I had to start all over again 😔 Could you please give me what would be the best “route “to take ? Thanks in advance! x

      Yes, you will need to do the English Test if you want to switch to the 5 year route. English Tests are now only valid for 2 years and you have to redo it again. Unfortunately, you will also need to pay the Immigration health surcharge when you switch.

      @@dollpitcher Yes, you can switch anytime or when your next renewal. If you do switch, you will need a cover letter and request the Home Office to place you on the 5 year route and explain why (i.e. English test, meeting the financial income requirement).

      what my experience will say you should check returning resident rules as well, and if you spent already 7 and half years on 10 years route so it's better to stay in same routes instead of jumping to another 5 years route also if you spend here legally 10 years you still can apply on 10 years route Under paragraph 276B. the best thing is book appointment with a good barrister so he or she can analyse your situation and your immigration history. sorry I am not a lawyer but I personally went through all this crap and reading always about immigration rules and laws

      It depends on where you got your Bsc. If it is in the UK, that will meet the English requirement. If not, you need to check the HO English Language guidance.
      The fee waiver is separate to your main application. If you meet all the requirements for your visa you will be placed on the 5 year route.

    Hi I found your video very useful and giving me some sort of hope my husband is here for 2.5 years spouse visa everything was going well since he arrived in uk he only worked 1 month and since has been very sick can’t work so I’m the main provider I’m no we’re near the £18000 mark maybe £12000 we have 4months remaining to do the English test I’m not worried about that but I’m very worried about the £18000 earning I have 0 saved also what kind of money am I looking at surcharges and nhs as I remember I payed a lot in 2018 do u think I would go onto the ten year route In been so stressed out but just seeing ur video I’m hoping even if he gets the 10year route we can always re do it once we are more stable thank you for your support and kind gesture to help others

      The fees at present (November 2020) are as follows: Home Office fees - £1052; Immigration Health Surcharge - £1,560; Biometrics Appointment fee - from £110.
      If you cannot afford to pay for the Immigration fees and IHS, consider applying for fee exemption. There are videos here on how to apply for the fee exemption, I would suggest you watch those videos to check if you will be eligible.

    Thank you for information. We’re applying for 10 year long residence route( it’s already 11 years for me now). Our visa expires on 10 ofJune 21. She has been on dependent visa with me since March 2011. I think, she can’t apply as a dependent in this route. Can she apply for 10 years route same as me ? Please advise what to do ? Should we both apply for long residence route or should I get ILR first and she apply after my ILR , considering our visa expires on June?

      If your partner is your dependant, you should apply first and then when she qualifies for the 10 year route she applies on her own right. Just make sure you comply with the residence requirements (i.e. continuous residence without any gaps of overstaying).

      Thank you for your comment. You will need to wait for another one year. If you are on 5 year route, you must complete the 5 years on a Spouse Visa before you can apply for the ILR.

      @@abdenourmedjad7155 Nothing to do now. The fees at present are £2389. Fees go up every year, so check before you apply whether it has increased. It is always best to have a lawyer advise whether you comply with the requirements for the ILR before you submit your application. If you are able to do your own application, it would still be best to get a consultation with a lawyer to check that you are on a right track.

      @@abdenourmedjad7155 the best thing to do is trying to start to gather your documents like your whole 5 years correspondence letters .utillity bills joint letters etc . book English b2 test and pass your life in the UK test if you start collecting proofs from now by the time you applying it will be much easier and less stress, the best thing is to use a good lawyer for ilr application

    I got a Question
    I applied for my wife in 2020 for fiance visa as a married couple and I had a Refugee settlement indefinite leave to remain.I show income over £ 20k ,pay NHS surcharge, HomeOffice fees , priority fees, and all evidence that we are married and stay together for two months and also my wife pregnancy proof.
    My wife passed English test and done TB test
    She provided English test certificate and also TB test pass certificate
    As I mentioned that I applied for her fiance visa but she got standard partner visa for 33months mean 2yrs and 9months
    My question is that which route my wife and do we still need £19k income requirements to stay in 5yrs route if we are in 5yrs route??????
    And if we are in 5yrs route and when we will apply for next extension and we don’t provide £19k income that what will happen???
