    Hey, you might think that this info makes me your lawyer, but it doesn’t and I’m not. Sorry, but I AM NOT YOUR LAWYER unless we have an engagement agreement. I am just providing public information here, like a library does, and am not providing you with legal advice about your situation. So, it would be totally unreasonable for you to conclude we have an attorney-client relationship just because you're viewing this information.

      It probably depends on the contract they sign with a client, and if they have a "right to refuse service" written in their then maybe? But theres probably something in federal law either disallowing this or at least deterring lawyers from doing it

    • @jazuii
      @jazuii 2 ปีที่แล้ว +204

      yes i believe so, "an attorney may choose to withdraw from a case in the following circumstances... the client persists in a course of action involving the lawyer's services that the lawyer reasonably believes is criminal or fraudulent;.."

    • @athena608
      @athena608 2 ปีที่แล้ว +69

      Every federal and state court has provisions in their rules for an attorney to withdraw from representing a client. In fact, in some cases state ethics rules require them to withdraw if they feel they're being used by their client to facilitate a crime (like perjury, evidence tampering or witness intimidation). They're even allowed to withdraw if their client is not paying them as agreed in the engagement contract, or if the client is hiding evidence from or lying to their attorney (which makes our jobs way harder and sometimes sabotages the case). We don't even have to explain the full story of why - just give the court enough info to justify leaving without jeopardizing the client's case.
      EDITED to add an important caveat: I'm a paralegal, NOT an attorney. Or in the immortal words of Erin Brockovich, "oh no, I hate lawyers, I just work for 'em!"

    • @stansman5461
      @stansman5461 2 ปีที่แล้ว +2

      @@athena608 What about public attorneys? Can they withdraw?

    • @athena608
      @athena608 2 ปีที่แล้ว +6

      @@stansman5461 under certain circumstances, yes they can, like if the client won't cooperate with their attorney or makes the attorney's job impossible - for example, lying to your attorney about evidence so they are unprepared to defend when the prosecutor shows up with the bad evidence you lied about. Another bad one I've seen: the client contacting the government to offer a settlement or plea deal without telling their attorney, undermining whatever discussions the attorney was part of.
      And in the case of demands to participate in illegal conduct like destroying evidence or blackmailing a witness, they *must* withdraw or risk getting in trouble with the bar.
      A defendant has the right to *an* attorney, just not to force a *specific* attorney to represent them - even if it's a public defender, you can't hold a gun to their head. They can pull out as long as it's for a legit reason that's allowed under the court's rules.

    1. Dress well.
    2. Address to the judge as 'your honor'.
    3. Tell the judge what you are looking for, for example leniency or withdrawal of the penalty, a lighter sentence if you are making an appeal.
    4. Explain your side of the story a little bit, include mitigating factors as to why you shouldn't receive or should get a lighter penalty/sentence, for example you got kids or are a carer or someone or something who is dependent on you, get written statements for this type.
    6. Be honest and to the point, show remorse and apologise for your offences, judges have alot to do and can detect liars, they don't have time for bullshit.
    5. Thank the judge and the opposing party/prosecutor for their time.
    These got me out of a suspended licence in my court case. I represented myself.

Lawyer-“Case Dismissed”. I ask again… “Now I may have a few screws loose up here, but what did you just say to me”? Lawyer-“Are you dense?!” “The case was dismissed due to the cop’s crappy paperwork processing and the fact that the victim was never Subpoena’d.” Me-“ I guess being late didnt really make a difference”.

    There was one case where a woman was charged with embezzlement and she showed up late and that played a part in the judge becoming heavily prejudiced against her. The lady showed remorse and had no criminal history before but the judge during sentencing would proceed to criticize her saying she wasn't truly remorseful and that she was a horrible person. She got prison time.
    Now I don't think that being late entirely contributed to the judges attitude but it definitely didn't help.

    I can assure you that you can still win your case if you do all of the above. Seen it happen to my friend. I was a witness. The defendant was late TWICE, his lawyer skipped a court day without sending notice in advance.
    We caught the defendant lying, and their lawyer had to excuse themselves because they had to hear this story for the first time. Basically all of the above and some extra. The judge was so fed up with it and threw the case away.
    and we were in court because that person had punch and chock my friend... like are you serious....

    Pro tip: never trust your lawyer. Lawyers are necessary devil that we need to clear some disputes that can't be cleared based on understanding between parties.
    But remember if they decide to screw your case, they can do it. It't not like you would have time & resources to sue your lawyer back. You can & some guys do it. But it's lot of work.
    Get a good, somewhat trustworthy lawyer but know that he/she can make or break your case. Don't put your faith in them but also don't offend them. They will act in self interest, like we all do. But if you pay them well, there is a good chance that they will represent you properly.
