  • "We want to be free." That's the message of an increasing number of women in the Philippines, who are trapped in marriages they cannot escape. That's because divorce is illegal in the Catholic majority country.
    The only other place in the world, where this is the case, is the Vatican.
    Calls by activists are growing louder for divorce to be legalized - but they face a powerful opposition. Our next report introduces you to a woman who's been fighting for more than decade to legally be separated from her husband.. and who is slowly losing hope.

    People have a hard time grasping the fact that people change in a relationship. Physical and emotional abuse can start years after marriage.

    As a Filipino man living in the USA. I think the laws in my country should remain the same! I am never been a fan of Divorce, Child Support, or worse, Alimony! Women over here in the USA are taking full advantage of the family courts even though they are the ones who initiated the divorce themselves and their men are not the abuser. Women over here are promiscuous and Infidelity is running rampant here, all because women are given more rights and privileges than men! If they change the laws to legalize divorce in my country, I can 100% bet plenty of innocent good husbands who are not abusers will suffer and infidelity will be more popular than the Catholics can handle! I say NO to legalizing divorce!

    I think the video title should be "Why some Filipinos want their country to have a divorce law again?" as we used to have that until 1950s. The annulment law in the Philippines is just like a divorce law but a very expensive & complicated version of it. The annulment case can lasts for 2 years or longer making it more costly but advantageous for the lawyers. Absence of divorce law in PH shows that many lawmakers in PH love hypocrisy, want to please some church leaders who strongly oppose enactment of divorce bill, don't care about the majority who can't afford to spend for an annulment case & many are probably afraid that their spouses will divorce them & the court might order majority of their properties to be given to innocent spouses since the divorce bills submitted before didn't include no-fault divorce.

    Im one of the filipina who filed for annullment and because of lack of evidence my annullment was denied,we file a motion for reconsideration to reverse the decision and now i am waiting for the decision...
    So stressful this annullment our law here is not fair ,how we can move on if we still used the surname of our husband...

    I worked in a law office for five years and filing an annulment costs a million worth of filings, pleadings, appearance fee, acceptance fee and attorney's fee even paying for a psychological report by psychologists but it's doesn't mean that you'll be granted. Worse, it takes several years if you are going to appeal with the higher court after being denied.
    I would agree with this report!
    PS: No wonder how other Filipinos did some shortcuts in a illegal manner.

Or discourage people from pursuing their dreams because there's a chance they might not succeed? Just as in marriage, where love and commitment are the driving forces, life is full of risks, but it's the pursuit of happiness and fulfillment that makes it worthwhile. Instead of avoiding marriage altogether because of the possibility of divorce, we should focus on supporting healthy relationships and providing resources for those who find themselves in difficult situations.

    There is one additional way some Filipinos obtain divorces. That way is where a Filipino citizen obtains residency or citizenship in another country and obtains a divorce there. If so, that Filipino can legally remarry in another country if only have residency in that country. If they have citizenship, they can remarry in the Philippines based on a valid overseas divorce. Various celebrities have done this but need to have some money. Annulment, Philippines style, is very expensive and time consuming and so is largely limited to the wealthy and privileged there. This is an area of law urgently needing reform. The current bills before the Congress are largely modelled on the former Senator Santiago`s model which is in part fault based and in part minimum separation period based. The proposed law is therefore conservative in contrast to countries like Australia where divorce is not fault based. Just 12 months separation required to show marriage breakdown.

      You are not 100% correct. It is possible to travel to the U.S. as a tourist. Then go to Nevada for six weeks and get a divorce provided you plan to get married to someone in the U.S. You get have a divorce finalized in Nevada on Saturday and get married in California on Sunday. So, no you do not need to be a resident or Citizen -- at least not in the United States.

    Anullment is not the same as divorce. It's worse. Anullment is what the Roman Catholic Church has in stead of divorce, but it is not equivalent. It means that the court declares that your marriage never existed. For that, it needs a "proof", and that can be difficult to provide. But saying that the marriage never existed is a lie in most cases. When people marry, they often marry for love. And the marriage is real. When their love disapear, it does not mean they never loved each other. The concept of anullment force people to claim what is not true: to claim that the marriage never existed. The people are forced to lie. And then the court also lies, because it also claims what is not true. And when it is a religious court, then it is a lie before God. That make anullment actuallly anti-religious. Anullment makes lots of harm by forcing people to lie. That is why divorce should be legal everywhere.

      One of the possible "poofs" which the Church acknowledge for claiming the marriage never existed is that it was involuntary. That means that the woman in the video is actually one of the rare cases when annullment is possible, even by the strict rules of the church. The fact that it was denied to her is another proof how unjust the Philipino system is and how desperatlelly the country needs to legalize divorces.

      Because under the Constitution, the State is mandated to protect the sanctity of marriage. To do this, the Solicitor General puts up challenges against any petition for legal separation. Currently, there are only two options in dissolving marriages in the Philippines: annulment and legal separation.

    Don't do it. I support allowing people to end marriages due to abuse, but people shouldn't be allowed to divorce for any reason. Once you make the commitment towards marriage, you must understand that it's a lifelong commitment that can only be broken under the most extreme circumstances like abuse.

If she becomes naturalized Indian and subsequently renounced her Filipino citizenship, she can for divorce in India so, she could marry you. The other party, his former husband, will file his petition for judicial recognition of foreign divorce to nullify their marriage.
      The process time of Judicial Recognition of Foreign Divorce is shorter than Annulment. Your woman must obtain a divorce paper and have it consularized in both Indian and Philippine Embassy before give it to his former husband. Be sure that she is already Indian citizen and no longer a Filipino.
      That's the only way for Filipinos to obtain divorce by renouncing their citizenship by birth in favor of obtaining any foreign citizenship.
      Disclaimer: This is based when I became a legal secretary in a law office about 11 years ago.

      @@seikimachan unfortunately she cannot become an Indian citizen by the process of naturalization as she need to spent at least 7 years in India which is impossible on a tourist visa and a long stay visa can only be granted if she applies for the intention of marriage in the marriage registrar's office with me . Which she wont be able to as to do so she needs to get NOC from Filipino embassy and The Embassy wont give NOC cuz she is already in the married records of the country.

      The laws are based on values. That is our value. Until it isn't, these laws remain. Maybe in another 10 years. There are less religious persons in the Phil, much like the rest of the world. There's no political influence.
      Our body is not separate from our soul. When that happens, the person is usually dead. When a person separates his sould from his body while still breathing, he is basically a zombie.

    the bottom line is, S.X is necessary or essential for the society to survive, while Marriage is conventional but only given importance because of hypocritical in/doctrination. Marriage establishes order in the society and so has to regulate relationship including S.X, but marriage is not absolute across time and life. The point is, divorce is likewise necessary in order to give a formal exit to marriage (being conventional) when it does not work anymore or does undermine the welfare of any in the family. There is no need any more to prove about psychological incapacity, etc.; there is no more need to make a lie or pretensions anymore just to avail annulment in court. When marriage does not work anymore, it is done, unless both are willing to give it a second chance under a favorable circumstance. Further, divorce should not be as dramatic as annulment, for in divorce bill, psychological intervention is part of in the transition framework towards a re-energized life. Yes, there is fear/doubt in marriage as well as in divorce, and the success of someone's relationship does not justify the continued curse of someone else's life. The question of expenses or to the eternal vow of marriage is superficial against the primary necessity of S.X and happiness of each in the society.

    If divorce didn’t inevitably lead to the family destroying disaster that is no fault divorce I suspect there wouldn’t be as much pushback against it.
    But there definitely needs to be something in place for these marriages where there is clear and obvious abandonment or abuse, and it shouldn’t be paywalled behind hundreds of thousands in legal fees.

      Make the annulment grounds include the following: abandonment, infidelity, physical and verbal abused, emotional abused, separation of at least 2 years, non financial support for family, vices such as alcoholism, gambling, addiction to illegal drugs, deception that may affect the relationship and marriage to work. Make the annulment inexpensive, affordable to all. Have more family courts in every provinces that will handle divorces cases only and make the process faster from the time of filing to final dispositions of the case.

      That was a law from medievial times.."Ius primae noctis" was another one like this. Or the inquisition. Contrary to the Philipines, Germany got out of the dark ages. The "Kranzgeld" was abolished because german ladies are educated, self aware and equal to german males. We find a woman still "honorable" after what you descibed.     This report was biased.
    DW presented an emotive case and then misrepresented Catholicism. It presented an anti-Catholic pro-divorce commentator but not any representative from the Catholic Church.
    Annulment is not against Catholic values.
    It actually was not the Catholic Church that was preventing annulment in the reported case; it was the state. In Catholicism, it is not supposed to be the state that grants or refuses annulments, it should be the Church itself.

      If you are in the U.S. it is straightforward. If the woman can get a tourist visa she can go to the U.S. and establish residency in Nevada (takes 6 weeks). She can legally file for divorce as a tourist provided she is planning on getting married to an American. Get divorced in Nevada then bingo, marry an American. I dated a Filipina lawyer -- who was married and she mapped it all out.

      ​@@marshmallowcello7528 My ex and I broke up because she wasn't "Happy". Both of her cats died within 3 weeks and she lost her job within 2 months. "Happy" is a fleeting emotion that HAPPENS to you. Your spouse isnt supposed to MAKE you be happy. Theyre supposed to NEVER leave. If she got cancer and he left because thats not fun or HAPPY...Everyone would have words about "Vows" then.
