The amount of smooth brained comments blaming the biker is crazy.
R u gonna turn left at a green light when you see someone close to the light going 50 - 60 mph? No. Even though this biker is speeding it's not like hes doing 70 through a neighborhood he was doing like 40. The SUV pulled out in front of him when the biker had the right of way. Just because your house is right there don't mean you can just pull out in front of people lmao

@@starchild3215 your right, but even if he was going 40 and that is twice as fast as a residental speed limit, 40 miles an hour isn't fast by any means, thats the normal road speed limit around most of America, people have more than enough time to react to someone thats driving straight at 40 miles an hour. now if the rider was going around 70 - 80 miles an hour then it would be more understandble.

So going 40 on these types of streets even where i live would still seem a little excessive, but i wonder if the driver was actually going 40 or if the sensation of the speed in the recording just makes it seem like the driver was going that fast.

I notice that e-bike riders ride like unskilled motorcyclists. They still think they’re on a pedal bike only they’re going much faster and have not advanced their skill to compensate for the additional speed.
This was not the fault of the biker. It was clearly the fault of the driver. The camera makes it seem much further than it actually is.

Judging by the wind and speed, it looks like 40mph. So yeah, a little too fast for side streets in the rain. Your best bet isn't braking but controlled swerving towards the back of the SUV. Or danger option is to go for the sidewalk or yard. I've had to take the sidewalk a few times to avoid dumb drivers. Also always buckle that helmet. it doesn't do any good lying in the street as you continue to plinko off cars.

In the sate of california, where this happened, the state requires that any motor vehicle that can go above 20 MPH (this guy is going well over that) has to be registered.
For it to be registered it has to pass an inspection.
For it to pass that inspection it has to have mirrors, brakes front and back, signals ect and yes a speedometer. How else are you going to obey the speed limit if you can't tell how fast you are going?

These driveways are mostly 2 car driveways. on the small side that is 20ft more common is 24ft, but I am going with 20.
The area beside the drives and in front of house (lawn) look to be on average 50ft. Mine looks to be the same as theirs (most of them).
So 20 and 50, that's 70ft. 10 lots that's 700ft. He traveled that distance in 13 seconds, that's 58.46ft per second.
miles per hour = feet per second × 0.681818
miles per hour = 58.46 feet per second × 0.681818
39.86 MPH = 58.46 feet per second × 0.681818
Now Go to the video on a PC, slow it down to .25, then count the lots/houses
And they are big houses. So it may be worse than I am calculating. (turns Out I was very close. Not one of the lots is smaller than 72.6 ft.
3. Biker should have be driving lower than the 25 mph in wet conditions.
4. BIKER failed to yield the right of way.
Car had the complete right of way. Forget all the left turn BS LOL.
In California (where this happened), when passing parked cars on a two-lane road with no shoulder, oncoming traffic has the right of way if the parked cars are on your side of the road. If the parked cars are on the opposite side, you have priority.
So the biker has a vehicle parked on his side/lane. The oncoming traffic (the car) does NOT. THE BIKER MUST YEILD THE RIGHT OF WAY. Right when the car comes into view the biker should have been slowing down because there is a car in his lane and he needed to give the right of way to the car.
And THAT supersedes the car giving the right of way to the biker to make a left hand turn BECAUSE the biker should have ALREADY been giving the right of way to the car.
5. Last Clear Chance Doctrine
The law says you have the obligation do everything you can to avoid the accident. In his speeding, on wet roads, he is negligent and should be held liable. If he was NOT speeding he could have avoided the accident.

BIKER should have known all of this.
So no matter what, bike is illegal to be on the roads, Speeding in wet conditions, failed to yield the right of way and failed to avoid the accident..
Biker 100% at fault.
Last, if you slow the video down (to .25), when the car comes into view, you can see the car had ALREADY decided to make the turn. How can you tell? Because the car is already swinging wide BECAUSE of the grey car that was RIGHT before the driveway they were turning into.
What does that mean? Well it means that if the biker could not see the car yet, that also means the car could NOT see the biker either. And because the car did not see the biker they started to make the turn.
If it wasn't for the biker speeding so fast that, the distance was closed very fast the car had but a split second to stop and they did. Why because they were already slowing down to turn into the driveway.
Seriously. Car decides to turn. There is no one there 312.2 feet away. And in less than 4 seconds there is a bike slamming into you. It takes NINE (9) seconds to travel 312.2 ft at 25 MPH. Car was already at the driveway when the biker hit them. In 7 seconds the car could have been completely in the driveway. Given the whole 9 secs, this would have never happened. Now if the biker was going the 5 miles under for wet conditions, that would have been 11 seconds.

Agreed on the speed factor, but his reaction time was good, you can hear that as soon as the SUV started turning he applied brakes. The deciding factor was that the road was wet and therefore more stopping distance was needed. In dry conditions it would've been a bit close but possible to stop.

Common sense says to ride ANY 2 wheeled vehicle as safely as possible because the rider always loses in a battle with a 2,000 - 5,000 pound vehicle. The only victory the 2 wheeler might have is in court, years after the long hospital stay, or rehabilitation, or worse - the funeral & burial are completed. If you ride in the rain on 2 wheels, all the rider does is add risk to an already risky endeavor.

Always have your fingers on the brake, and too fast for the conditions and maybe for the location. Buckle that helmet. The SUV didn't indicate too. Basically both are at fault.

The biggest issue with your bike is that little light. Drivers are not going to be able to see that, and you can be certain they won't be looking for it either. You need a light that is very bright and with a wide cast. The light you have on your bike is about the same as a bicycle, and people will look at your bike the same way. They won't be expecting you to be travelling that fast...if they see you. Personally, I ride electric bikes the same way I ride bicycles...with extreme caution and not in the rain.

People just aren't looking for you and they'll turn right in front of you. When you get your driver's license and a bigger bike it doesn't change except you're going faster when they pull in front of you. Stay safe and try to keep the shiny side up!

In California (where this happened), when passing parked cars on a two-lane road with no shoulder, oncoming traffic has the right of way if the parked cars are on your side of the road. If the parked cars are on the opposite side, you have priority.
So the biker has a vehicle parked on his side/lane. The oncoming traffic (the car) does NOT. THE BIKER MUST YEILD THE RIGHT OF WAY. Right when the car comes into view the biker should have been slowing down because there is a car in his lane and he needed to give the right of way to the car.
And THAT supersedes the car giving the right of way to the biker to make a left hand turn BECAUSE the biker should have ALREADY been giving the right of way to the car. Biker seeing the car in his lane should have already been slowing down to give the right of way to the car, and the car had already started making the turn. Again the car was already swinging wide to go around the grey/silver car, (slow video down .25. 0:21). A 0:22 the grey car is clearly in view, in his lane.

Failed to use their signal too. Probably willingly ignoring it and trying to get this guy to slow the hell down in residential areas. What if it was a dumb kid/animal that ran into the street or had their toy roll out into the road instead of this SUV? They were in no way, shape, or form prepared to brake and were carelessly flying down a hill. Don't defend this guy.

The suv driver was OBVIOUSLY not paying attention while driving through a neighborhood at a time when children are heading to school. The kid on the electric bike could have just as well been a kid on a regular bicycle who also would've panicked and not been able to stop in time to avoid a collision with an suv operated by a negligent driver.

It would all depend on the speed of the biker. Driving 10mph or more over the speed limit is considered reckless driving, which means he played a significant factor in the accident. Probably 50/50 blame.
No as in US laws it’s the SUV’s fault. As when he turned there’s no way to miss him, by law he had to wait for the rider to pass, no other way around it

Always have your helmet strapped and drive appropriately for weather and road conditions, i.e. speed limits. I believe residential is 25. He had to at least be going 35/40. A few bruises but hopefully he’s good. 90% driver fault, how do you not see him.

Biker is on a illegal dirt bike on the street. Any vehicle that is going to be used on the streets that goes over 20 MPH has to be registered. This bike is clearly not registered. It does not have ANY of the required equipment. Like a proper Headlight, turn signals, Speedometer, tail light and so on. All that matters. Don't start with "It doesn't matter the car fail to yield " BS. Biker is already in the wrong to start.
In the sate of california, where this happened, the state requires that any motor vehicle that can go above 20 MPH (this guy is going well over that) has to be registered.
For it to be registered it has to pass an inspection.
For it to pass that inspection it has to have mirrors, brakes front and back, signals ect and yes a speedometer. How else are you going to obey the speed limit if you can't tell how fast you are going?

Biker was going 40MPH in a 25 mph residential street. 760 ft traveled in 13 seconds. Wide angle lens doesn't matter when you know the distance and the time it too to travel that distance.
My first calculations.
These driveways are mostly 2 car driveways. on the small side that is 20ft more common is 24ft, but I am going with 20.
The area beside the drives and in front of house (lawn) look to be on average 50ft. Mine looks to be the same as theirs (most of them).
So 20 and 50, that's 70ft. 10 lots that's 700ft. He traveled that distance in 13 seconds, that's 58.46ft per second.
miles per hour = feet per second × 0.681818
miles per hour = 58.46 feet per second × 0.681818
39.86 MPH = 58.46 feet per second × 0.681818
Now Go to the video on a PC, slow it down to .25, then count the lots/houses
And they are big houses. So it may be worse than I am calculating. (turns out I was very close. Not one of the lots is smaller than 72.6 ft.)

If you slow the video down to .25 @ 0:21 You can see the SUV was already swinging wide to clear the silver car parked next to the driveway. If it wasn't for the EXCESSIVE speed of the biker, the car would have had all the time in the world to make it. One second the road was clear and the next you have a SPEEDING bike coming around the bend at you.
