So I will just copy paste what I said to them. ​ @brokezy You need to reevaluate calling people smooth brain when you, yourself have not shown any sort of real intelligent observational skills. 1.a. Biker is on a illegal dirt bike on the street. Any vehicle that is going to be used on the streets that goes over 20 MPH has to be registered. This bike is clearly not registered. It does not have ANY of the required equipment. Like a proper Headlight, turn signals, Speedometer, tail light and so on. All that matters. Don't start with "It doesn't matter the car fail to yield " BS. Biker is already in the wrong to start. In the sate of california, where this happened, the state requires that any motor vehicle that can go above 20 MPH (this guy is going well over that) has to be registered. For it to be registered it has to pass an inspection. For it to pass that inspection it has to have mirrors, brakes front and back, signals ect and yes a speedometer. How else are you going to obey the speed limit if you can't tell how fast you are going? " According to citydocs cityoforange org, a dirt bike must have a speedometer to be street legal in California. In addition, the speedometer must be accurate to within plus or minus 5 miles per hour (8 km/hour) at a speed of 50 miles per hour (80 km/hour) and indicate the vehicle's speed in miles per hour or kilometers (km) per hour. Other equipment required to make a dirt bike street legal in California includes: Headlights Tail lights or stop lamps Blinkers Speedometer Mirrors Reflectors Horn License plate mount or light DOT approved tires DOT approved exhaust License plate " 1.b. So in order for you drive a legal vehicle you will also need a Drivers License. You know so that you know the rules of the road. 2. Biker was going 40MPH in a 25 mph residential street. 760 ft traveled in 13 seconds. Wide angle lens doesn't matter when you know the distance and the time it too to travel that distance. My first calculations. These driveways are mostly 2 car driveways. on the small side that is 20ft more common is 24ft, but I am going with 20. The area beside the drives and in front of house (lawn) look to be on average 50ft. Mine looks to be the same as theirs (most of them). So 20 and 50, that's 70ft. 10 lots that's 700ft. He traveled that distance in 13 seconds, that's 58.46ft per second. miles per hour = feet per second × 0.681818 miles per hour = 58.46 feet per second × 0.681818 39.86 MPH = 58.46 feet per second × 0.681818 Now Go to the video on a PC, slow it down to .25, then count the lots/houses And they are big houses. So it may be worse than I am calculating. (turns out I was very close. Not one of the lots is smaller than 72.6 ft.) 3. Biker should have be driving slower than the 25 mph in wet conditions. Directly from the california driver handbook page 61 " Slippery Roads Rain, snow, or mud can make the roads slippery. Drive more slowly than you would on a dry road. Adjust your speed for different conditions: *WET ROAD: REDUCE YOUR SPEED BY 5 TO 10 MPH. *Packed snow: Reduce your speed by half. *Ice: Reduce your speed to no more than 5 mph. " 4. BIKER failed to yield the right of way. (This is the main reason why he is at fault.) Car had the complete right of way. Forget all the left turn BS LOL. In California (where this happened), when passing parked cars on a two-lane road with no shoulder, oncoming traffic has the right of way if the parked cars are on your side of the road. If the parked cars are on the opposite side, you have priority. So the biker has a vehicle parked on his side/lane. The oncoming traffic (the car) does NOT. THE BIKER MUST YEILD THE RIGHT OF WAY. Right when the car comes into view the biker should have been slowing down because there is a car in his lane and he needed to give the right of way to the car. And THAT supersedes the car giving the right of way to the biker to make a left hand turn BECAUSE the biker should have ALREADY been giving the right of way to the car. Biker seeing the car in his lane should have already been slowing down to give the right of way to the car, and the car had already started making the turn. Again the car was already swinging wide to go around the grey/silver car, (slow video down .25. 0:21). A 0:22 the grey car is clearly in view, in his lane. Directly from the california driver handbook page 68 " Choose Between Hazards Sometimes dangers will be on both sides of the road at the same time. For example, PARKED CARS TO THE RIGHT and ONCOMING CARS TO THE LEFT. If one danger is greater than the other, give more space to the most dangerous situation. Suppose you are on a two-lane road with an oncoming vehicle to the left and a bicyclist ahead to your right. Instead of driving between the vehicle and the bicyclist, take one danger at a time. SLOW DOWN AND LET THE ONCOMING VEHICLE PASS. When the vehicle has passed, move to the left to allow plenty of space (at least three feet) to pass the bicyclist. If there is a steady flow of oncoming vehicles, use as much of the left lane as you safely can to pass the bicyclist. " 5. Last Clear Chance Doctrine The law says you have the obligation do everything you can to avoid the accident. In his speeding, on wet roads, he is negligent and should be held liable. If he was NOT speeding he could have avoided the accident. law dot cornell dot edu " last clear chance The last clear chance doctrine is used in tort law for cases involving negligence and is applied when both the plaintiff and defendant are responsible for an accident that resulted in harm. When applied in states with contributory negligence laws, it is often seen as a type of exception or limitation to those laws. The doctrine considers which party had the last opportunity to avoid the accident that caused the harm. Therefore, a negligent plaintiff may recover damages if they can show that the defendant had the last clear chance to avoid the accident. A defendant may also use the doctrine as a defense by showing that the plaintiff had the last clear chance to avoid the accident. " BIKER should have known all of this. So no matter what, bike is illegal to be on the roads, Speeding in wet conditions, failed to yield the right of way and failed to avoid the accident.. Biker 100% at fault. Last, if you slow the video down (to .25), when the car comes into view 0:21, you can see the car had ALREADY decided to make the turn. How can you tell? Because the car is already swinging wide BECAUSE of the grey car that was RIGHT before the driveway they were turning into. What does that mean? Well it means that if the biker could not see the car yet, that also means the car could NOT see the biker either. And because the car did not see the biker they started to make the turn. If it wasn't for the biker speeding so fast that, the distance was closed very fast the car had but a split second to stop and they did. Why because they were already slowing down to turn into the driveway. Seriously. Car decides to turn 0:20. There is no one there 312.2 feet away. And in less than 4 seconds there is a bike slamming into you. It takes NINE (9) seconds to travel 312.2 ft at 25 MPH. Car was already at the driveway when the biker hit them. In 7 seconds the car could have been completely in the driveway. Given the whole 9 secs, this would have never happened. Now if the biker was going the 5 miles under for wet conditions, that would have been 11 seconds.

      @@Zion-t3i DUDE I just gave you a lesson on your other comment. But this one. DuDe what does riding a dirt bike have anything to do with common sense and the law? Biker shouldn't have been on the road at all and should have yielded the right of way to the SUV. Period.

      @@AztecWarrior69_69 the car was coming down, stopped. The biker was riding down the road and didn’t stop. The SUV didn’t have the right of way, you don’t deserve a drivers license tbh
