all brothers accepted the property distribution with proper valuations and everything and elder brother also agreed to pay the amount for particular property and wanted time from other brothers. So, all brothers agreed upon him and gave him 15 months time. And the time is about to end and elder brother is violating agreed contract. Saying like he will not give that property to anyone. Sir. my mother has won case in senior citizen tribunal mumbai against her own elder son regarding SRA flat. eviction order is issued one month time given by tribunal upto 12 Nov 2022. this is a civil matter. do my mother shall file caveat in bombay high court or caveat is only good for criminal matter

In the case of Sahab Ram And Anr. vs State Of Rajasthan And Ors. decided on 22 December, 1999 by Rajasthan High Court [Equivalent citations: 2000 WLC Raj UC 464, 2000 (2) WLN 554] delivered through Justice Bhagwati Prasad, the court said thus:
"13. In civil proceedings the caveat is governed by Section 148A C.P.C. In writ jurisdiction as far as possible C.P.C. is made applicable. Thus Section 148A C.P.C. has been made applicable. In criminal proceedings the right has to be searched in Criminal Procedure Code, which is not there.
14. In view of the fact that the Code of Criminal Procedure, substantive law governing the criminal procedure, makes no provision for caveat, the right of the applicant to lodge a caveat is without any legal sanction........."
Thus it appears that the caveat procedure do not applice to criminal proceedings. As far as civil side is concerned, caveat can be filed.

We won case in sdm court under rent control act in jabalpur for eviction of tenant.
For safety we filed caveat in high court in 26 march 2023 and in 27 Aprl 2023 the opposite party filed a case for civil revision in mp high court and on 4th may 2023 high court ordered status quo with out lessoning us.. No notice has been given... Notice is given after 15 days of status quo order..... Is this legal.. What to do sir

Can u please make a video on execution petion and limitation, how to proceed against government where in the government/JDR encroched public land and not conducting survey to restoration the land to DHR . IN this case govt failed to obtain any favorable order from any court right from lower court to supreme court and filed several CRPs since last 41 years of pending cade , and EP also pending for 11 years.
Warrants were issued 3 times, but not doing survey for restoration of possession.
What are the further steps to be taken?, can i file a criminal case against government as they are encroached our Land?, to file attachment petition? Seek

जी आपने पहले से ही केस दायर कर दी है इसका मतलब है कि आपने वकील भी लगाए होंगे। तो ऐसी स्थिति में बेस्ट यही रहेगा कि आप अपने वकील साहब से ही यह सब चीज है जान ले। क्योंकि आपके वकील साहब ही वहां के हालातों से वाकिफ होंगे।
