Generally government ki taraf se jawab dakhil hone ke liye kuchh tarikhe to Li jaati hi hai. 3 se 4 tarikhen to vah lete hi hai. Isliye utani tarikhon per jawab nahin hona yah normal baat hai. Agar teen ya char tarikhen lene ke bad bhi government samay ko Lamba khinch rahi hai aur bahut sari tarikhon ke bad bhi jawab dakhil nahin kar rahi hai to aapki taraf se nyayalay ko yah request ki ja sakti hai ki ab Court government ke jawab ke Bina Hi case aage chalayen aur nirnay den. Aur aisi request karne ke bad government fir jawab dakhil karne ke liye tarikh mangti hai to use request ko oppose Karen. Aur apne opposition ke bavjud agar nyayalay government tarikh dene ke liye ichchuk dikhta hai to kam se kam yah request kijiye Court ko ki samay dete waqt government per cost bithayen. Dhyan rahe ki aapke opposition ke bavjud bhi ya fir aapke cost bitane ke request ke bavjud bhi, government ko samay Dena ya nahin Dena yah baat, uplabdh paristhitiyon Ko dekhkar, Court ke Adhikar Kshetra mein hoti hai. Aur agar Court unhen uske bavjud bhi tarikh dete Hain to kam se kam yah request kar dijiye Court ko ki government ko yah tarikh last chance karke di jaaye aur Di Hui tarikh mein jawab agar nahin dakhil hua to agale tarikh ko jawab ke Bina Hi sunvaee ki jaaye. Fir se Dhyan rahe ki aapki itni sari request ke bavjud bhi aapki baat manana ya na manana yah Court ke Adhikar Kshetra mein hota hai. @@LegalInspiration सर्व पुरावे माझ्या बाजूने होते सर, तरी सुद्धा निकाल माझ्या बाजूने लागला नाही, जाहीरनाम्यामध्ये नमूद केलेलं होत कि अर्जदार हा ग्रामपंचायत सदस्य नसावा, सदर व्यक्ती हा ग्रामपंचायत सदस्य होता, पोलीस पाटील पदाची ऑर्डर ज्या वेळी आली त्या वेळी सदर व्यक्तीने राजीनामा दिला, पोलीस पाटील पद ऑर्डर ची तारीख ०७/०७/२०१८ आणि ग्रामपंचायत मध्ये राजीनामा मंजूर झाला त्याची तारीख २३/०७/२०१८ अशी होती. तरी सुद्धा त्याच व्यक्तीची पोलीस पाटील म्हणून नियुक्ती झाली, माझ्या जवळ ग्रामपंचायत अधिनियम होता, प्रोसिडिंग रजिस्टर ची कॉपी, जाहीरनामा, मुंबई अधिनियम मध्ये ग्रामपंचायत अधिनियम मध्ये सदस्य राजीनामा बद्दल सांगितले आहे, सर अजून जजमेंट आले नाही.

Dear sir i want to highlight this matter its from haryana state of pharmacy council .i had submited my file in nov 2019 for my registration with all my docoment as per rule but now its sept 2021 i dont get my registration till the date because i have done my diploma course out state. only this reason they are not doing their proper work more than 12000 files pending till date so i want to ask if i m going to writ aganist this matter so what is minimum duration for my solution regards this matter because without registration we are nothing and jobless from 2019
Hello mister Manish Kumar! I think filing a writ petition in your case would be the the proper way. The pharmacy council is not performing its duty of deciding your applications. So you may pray for a writ of mandamus from highcourt for directing the pharmacy council to decide your applications at the earliest. Of course High Court will not be directing the pharmacy council to straightway register you. Because that is the power and function of the pharmacy council only. But the high court would be directing the pharmacy council to take a decision on your applications. In my opinion such type of writ petition should not take longer for decision. There can be no accurate prediction about this but in my opinion if you go for filing a writ petition of this type then it should take only few weeks for decision, say approximately 8 weeks. The procedure would be that after you file a writ petition the court will issue notices to the respondents, and after receiving their response, would it take up the petition for decision. Considering the fact that you would be asking for simple relief of directing the respondents to take a decision on your applications it should not take longer time for disposing of your writ petition with such kind of directions, unless of course the pharmacy council has already decided your applications. Sir kya koi sangathan dwara sarkar se prapt nirdeshoka palan nhi kiye jane se kuch nivedan ya takrar kisi department me dete hai aur uspe department ke taraf se koi karvai nhi hoti to wo sangathan us adhikari ya department ke khilaf pitition dakhal kar sakti hai
Aise mein petition dayar kar sakte hain Sarkar ke khilaf. kyunki takrar koi dakhal lete hue kaarvayi karna yah Sarkar ka kartavya hota hai yani ki legal duty aur agar Sarkar apni legal duty karne se chukti hai to writ of mandamus ke liye Sarkar ke khilaf mukhya roop se writ petition dayar kar sakte hain. Use petition mein use sangathan Ko bhi respondent party karna hoga.
Agar High Court ka koi specific order nahin hai aur aap lower court se acquit Ho chuke hain, to mere khyal se videsh jaane mein koi dikkat to nahin. Magar is baat ka bhi khyal rakhen ki agar chalte hue appeal mein high court ne koi aadesh parit kar aapko upsthit karne ka aadesh kar Diya ya surrender karne ka aadesh kar Diya to dikkat ho sakti hai. Isliye behtar yahi hoga ki aap apne vakil sahab se sala len aur unke Salah per chale. Mere is guidance ko legal advice Na Mane.

Sir mein wp case kiya he lekin govt ke Taraf se koi counter file abhitak nehi kia he,to mujhe kya karna chahiye .mere adv ko mein kya karne kelie bolun.
Generally government ki taraf se jawab dakhil hone ke liye kuchh tarikhe to Li jaati hi hai. 3 se 4 tarikhen to vah lete hi hai. Isliye utani tarikhon per jawab nahin hona yah normal baat hai.
Agar teen ya char tarikhen lene ke bad bhi government samay ko Lamba khinch rahi hai aur bahut sari tarikhon ke bad bhi jawab dakhil nahin kar rahi hai to aapki taraf se nyayalay ko yah request ki ja sakti hai ki ab Court government ke jawab ke Bina Hi case aage chalayen aur nirnay den. Aur aisi request karne ke bad government fir jawab dakhil karne ke liye tarikh mangti hai to use request ko oppose Karen. Aur apne opposition ke bavjud agar nyayalay government tarikh dene ke liye ichchuk dikhta hai to kam se kam yah request kijiye Court ko ki samay dete waqt government per cost bithayen.
Dhyan rahe ki aapke opposition ke bavjud bhi ya fir aapke cost bitane ke request ke bavjud bhi, government ko samay Dena ya nahin Dena yah baat, uplabdh paristhitiyon Ko dekhkar, Court ke Adhikar Kshetra mein hoti hai. Aur agar Court unhen uske bavjud bhi tarikh dete Hain to kam se kam yah request kar dijiye Court ko ki government ko yah tarikh last chance karke di jaaye aur Di Hui tarikh mein jawab agar nahin dakhil hua to agale tarikh ko jawab ke Bina Hi sunvaee ki jaaye.
Fir se Dhyan rahe ki aapki itni sari request ke bavjud bhi aapki baat manana ya na manana yah Court ke Adhikar Kshetra mein hota hai. Magar har Bar koshish Karna aapke hath mein hai uska natija kuchh bhi nikale.

Dear sir i want to highlight this matter its from haryana state of pharmacy council .i had submited my file in nov 2019 for my registration with all my docoment as per rule but now its sept 2021 i dont get my registration till the date
because i have done my diploma course out state. only this reason they are not doing their proper work more than 12000 files pending till date so i want to ask if i m going to writ aganist this matter so what is minimum duration for my solution regards this matter because without registration we are nothing and jobless from 2019

I think filing a writ petition in your case would be the the proper way. The pharmacy council is not performing its duty of deciding your applications. So you may pray for a writ of mandamus from highcourt for directing the pharmacy council to decide your applications at the earliest. Of course High Court will not be directing the pharmacy council to straightway register you. Because that is the power and function of the pharmacy council only. But the high court would be directing the pharmacy council to take a decision on your applications. In my opinion such type of writ petition should not take longer for decision. There can be no accurate prediction about this but in my opinion if you go for filing a writ petition of this type then it should take only few weeks for decision, say approximately 8 weeks. The procedure would be that after you file a writ petition the court will issue notices to the respondents, and after receiving their response, would it take up the petition for decision. Considering the fact that you would be asking for simple relief of directing the respondents to take a decision on your applications it should not take longer time for disposing of your writ petition with such kind of directions, unless of course the pharmacy council has already decided your applications.

Sir kya koi sangathan dwara sarkar se prapt nirdeshoka palan nhi kiye jane se kuch nivedan ya takrar kisi department me dete hai aur uspe department ke taraf se koi karvai nhi hoti to wo sangathan us adhikari ya department ke khilaf pitition dakhal kar sakti hai
Aise mein petition dayar kar sakte hain Sarkar ke khilaf. kyunki takrar koi dakhal lete hue kaarvayi karna yah Sarkar ka kartavya hota hai yani ki legal duty aur agar Sarkar apni legal duty karne se chukti hai to writ of mandamus ke liye Sarkar ke khilaf mukhya roop se writ petition dayar kar sakte hain. Use petition mein use sangathan Ko bhi respondent party karna hoga.

Agar High Court ka koi specific order nahin hai aur aap lower court se acquit Ho chuke hain, to mere khyal se videsh jaane mein koi dikkat to nahin. Magar is baat ka bhi khyal rakhen ki agar chalte hue appeal mein high court ne koi aadesh parit kar aapko upsthit karne ka aadesh kar Diya ya surrender karne ka aadesh kar Diya to dikkat ho sakti hai. Isliye behtar yahi hoga ki aap apne vakil sahab se sala len aur unke Salah per chale. Mere is guidance ko legal advice Na Mane.
