नमस्कार सर। उत्तराखंड में सरकारी कर्मचारी हूँ। public service tribunal double bench द्वारा प्रमोशन प्रकरण में मेरे फेवर में जजमेंट दिया है। लेकिन एक जज के रिटायर होने के कारण tribunal का कोरम पूरा नहीं हो रहा है जिससे मेरे द्वारा दायर execution suit पर hearing नहीं हो रही है। आगे क्या विकल्प हो सकता है इसी वर्ष मेरा रिटायर मेंट है।

Vakil badalne ke liye ek specific procedure hoti hai. Aapko vah specific procedure follow karni padegi. Aapke side mein vah procedure kya hai aur exactly kaise karni padati hai yah jankari aapko local level per hi milegi. Per Mera sujhav yah hai ki aap vakil badalne se pahle ek Bar unse pratyaksh milkar baat kariye. Agar koi aapki misunderstanding hai to vah dur ho jayegi aur vakil badalne ki jarurat Shayad na padegi.
Sir aapse ek request ki thi mene ki high court me case ko jaldi sunvai kese karaye. Kyoki mera ek case 2004 ka hai civil revision ka usme 2015 me ek date lagi thi jab se ab tak koi date nahi lagi hai. Sir ESA kya karu me jisse mera case ki jaldi sunvai ho jaye case list par ajaye . Koi upay bata dijiye sir please bahut pareshan hu me . Isko kese final disposal karau. Please sir help me 🙏🙏🙏🙏
High Court mein jaldi sunvaee kaise karen इसके लिए आपको हाईकोर्ट में एक अलग से अर्जी लगानी होगी जिसे कहते हैं एप्लीकेशन फॉर अर्ली हियरिंग। उस अर्जी में आपको समाधान कारक कारण देना होगा जिस वजह से आपकी केस को हाईकोर्ट ने दूसरों की केस बाजू में रखकर जल्दी सुनवाई करना जरूरी है। इस अर्जी पर हाईकोर्ट हीअरिंग करेगा और हीअरिंग करने के बाद, दोनों पक्षों की बात सुनने के बाद, अगर हाई कोर्ट को लगा कि हां आप के केस में जल्दी सुनवाई होना बिल्कुल जरूरी है तो हाई कोर्ट इस तरह का आदेश दे सकते हैं और आप के केस में जल्दी सुनवाई हो सकती हैं। अगर हाई कोर्ट जल्दी सुनवाई करने की जरूरत नहीं लगती ऐसे मत पर आए तो वह आपकी अर्जी रिजेक्ट भी कर सकते हैं। दोनों नतीजों के लिए आपकी तैयारी होनी चाहिए। मगर प्रत्यक्ष रूप में आपने आप के केस में क्या करना चाहिए। अर्जी लगानी चाहिए या नहीं लगानी चाहिए अगर लगानी चाहिए तो उसमें क्या कारण देना चाहिए यह सब बातें आप के केस में आपने जो वकील लगाए हुए हैं उन वकील साहब के साथ चर्चा करने के बाद ही तय कीजिएगा। मेरी शुभकामनाएं।

सर, written statment के बाद और issue frame होने से पहले, आर्डर 10,11,12 और 13 का भी अनुपालन किया जाता है,, वो कौन सी स्टेज में होता है,, एवं जब हम plaint या WS के साथ ही अपने डॉक्यूमेंट लगा देते है तो,, ऑर्डर 13 में फिर से डॉक्यूमेंट् का प्रावधान क्यों है,, एवं डॉक्यूमेंट को exhibit करने की प्रक्रिया issue frame होने से पहले करना चहिये आर्डर 13 के अनुसार,,, परंतु practical में जब chief exam होता है उस समय exhibit किया जाता है ऐसा क्यों है सर एक्सप्लेन करे धन्यवाद
If the respondent department is not giving reply then it's not going to be indefinite. Court will give them some chances and in spite of granting some chances they do not choose to file reply the court may order to proceed against the respondent without reply in the case. When will that happen and after granting how many chances to them that will happen that I cannot predict.

आपका मामला अदालत में प्रलंबित है, यानी आपके पास एक वकील भी है। तो वैसे तो ऐसी परिस्थितियों में अपने वकील से पूछना सबसे अच्छा है। मैं यह बात समझ रहा हूं कि आपने लिखा है कि आपके वकील साहब कुछ बता नहीं रहे हैं और इसीलिए आपने यह प्रश्न मुझे पूछा है। तो अब समझ लीजिए। यह ध्यान में लीजिए कि कई बार जब केस एक ही स्टेज पर पेंडिंग होती है तो बताने लायक कुछ नहीं रहता। "केस पेंडिंग है और जब जब लगती है तब तब हियरिंग होता है या केस में तारीख होती है और अगले तारीख को हियरिंग होने की संभावना है" यही स्थिति बार बार बताना पड़ेगा। न्यायालयों में लंबित मामलों की संख्या ही इतनी ज्यादा है कि आपकी केस एक ही स्थिति में लंबे समय तक चलती रहे यह पॉसिबल है। तो ऐसे में जब पक्षकार वकील साहब को बार-बार संपर्क करके पूछते रहता है कि केस का क्या हुआ तो अगर केस में ज्यादा कुछ नहीं हुआ रहेगा तो वकील साहब का जवाब वही रहेगा। (फिर पक्षकार, वकील साहब ने दिया हुआ जवाब नहीं समझ कर फिर उसी बात के लिए बार-बार संपर्क करे तो हो सकता है वकील साहब जवाब देना बंद कर दें), और फिर पक्षकार कहे की वकील साहब जवाब नहीं दे रहे हैं या कुछ बता नहीं रहे हैं। मेरा यह कहना नहीं है कि आपके साथ भी ऐसा ही हो रहा है मगर मैं एक अंदाज कर रहा हूं कि कहीं ऐसा तो आपके साथ नहीं हो रहा है? इसका अपने साथ परीक्षण कीजिए। तो अगर ऐसी स्थिति है तो मैं कहूंगा कि आप संयम रखें धीरज रखें। अगर मैंने जो अंदाज किया वह स्थिति नहीं है और अगर आपको बहुत ही ज्यादा उत्सुकता है यह जानने की कि आप के केस का क्या हो रहा है तो आप सीधे एडमिनिस्ट्रेटिव ट्रिब्यूनल के रजिस्ट्री में जाकर वहां से भी जानकारी प्राप्त कर सकते हैं।

sir , i have qualified ALP post in Railway under ST category . bihar govt issue ST caste certificate for our caste after 2016 with proper notification and no OBC Certificate issue anywayafter 2016 . i have mentioned St category in application and passed all stages of exam including medical and document verification . but railway authority is not giving me joining . Since on same caste certificate other RRB is giving joing but my my RRB is not giving joining . saying that your caste is not present in central list . I have shown them all notification to RRB but they are decling to read . mera life barbad ka r diya hai state aur central govt mil kar , ek govt bol rha hai hum ST ka hi certiifcate denge aur ek bol hai tm ST nhi ho . aise hum kya kare . please sir help

Vakil badalne ke liye ek specific procedure hoti hai. Aapko vah specific procedure follow karni padegi. Aapke side mein vah procedure kya hai aur exactly kaise karni padati hai yah jankari aapko local level per hi milegi. Per Mera sujhav yah hai ki aap vakil badalne se pahle ek Bar unse pratyaksh milkar baat kariye. Agar koi aapki misunderstanding hai to vah dur ho jayegi aur vakil badalne ki jarurat Shayad na padegi.

High Court mein jaldi sunvaee kaise karen इसके लिए आपको हाईकोर्ट में एक अलग से अर्जी लगानी होगी जिसे कहते हैं एप्लीकेशन फॉर अर्ली हियरिंग। उस अर्जी में आपको समाधान कारक कारण देना होगा जिस वजह से आपकी केस को हाईकोर्ट ने दूसरों की केस बाजू में रखकर जल्दी सुनवाई करना जरूरी है। इस अर्जी पर हाईकोर्ट हीअरिंग करेगा और हीअरिंग करने के बाद, दोनों पक्षों की बात सुनने के बाद, अगर हाई कोर्ट को लगा कि हां आप के केस में जल्दी सुनवाई होना बिल्कुल जरूरी है तो हाई कोर्ट इस तरह का आदेश दे सकते हैं और आप के केस में जल्दी सुनवाई हो सकती हैं। अगर हाई कोर्ट जल्दी सुनवाई करने की जरूरत नहीं लगती ऐसे मत पर आए तो वह आपकी अर्जी रिजेक्ट भी कर सकते हैं। दोनों नतीजों के लिए आपकी तैयारी होनी चाहिए।
मगर प्रत्यक्ष रूप में आपने आप के केस में क्या करना चाहिए। अर्जी लगानी चाहिए या नहीं लगानी चाहिए अगर लगानी चाहिए तो उसमें क्या कारण देना चाहिए यह सब बातें आप के केस में आपने जो वकील लगाए हुए हैं उन वकील साहब के साथ चर्चा करने के बाद ही तय कीजिएगा।

सर, written statment के बाद और issue frame होने से पहले, आर्डर 10,11,12 और 13 का भी अनुपालन किया जाता है,, वो कौन सी स्टेज में होता है,, एवं जब हम plaint या WS के साथ ही अपने डॉक्यूमेंट लगा देते है तो,, ऑर्डर 13 में फिर से डॉक्यूमेंट् का प्रावधान क्यों है,, एवं डॉक्यूमेंट को exhibit करने की प्रक्रिया issue frame होने से पहले करना चहिये आर्डर 13 के अनुसार,,, परंतु practical में जब chief exam होता है उस समय exhibit किया जाता है ऐसा क्यों है सर एक्सप्लेन करे धन्यवाद

If the respondent department is not giving reply then it's not going to be indefinite. Court will give them some chances and in spite of granting some chances they do not choose to file reply the court may order to proceed against the respondent without reply in the case. When will that happen and after granting how many chances to them that will happen that I cannot predict.

आपका मामला अदालत में प्रलंबित है, यानी आपके पास एक वकील भी है। तो वैसे तो ऐसी परिस्थितियों में अपने वकील से पूछना सबसे अच्छा है।
मैं यह बात समझ रहा हूं कि आपने लिखा है कि आपके वकील साहब कुछ बता नहीं रहे हैं और इसीलिए आपने यह प्रश्न मुझे पूछा है।
तो अब समझ लीजिए।
यह ध्यान में लीजिए कि कई बार जब केस एक ही स्टेज पर पेंडिंग होती है तो बताने लायक कुछ नहीं रहता। "केस पेंडिंग है और जब जब लगती है तब तब हियरिंग होता है या केस में तारीख होती है और अगले तारीख को हियरिंग होने की संभावना है" यही स्थिति बार बार बताना पड़ेगा। न्यायालयों में लंबित मामलों की संख्या ही इतनी ज्यादा है कि आपकी केस एक ही स्थिति में लंबे समय तक चलती रहे यह पॉसिबल है। तो ऐसे में जब पक्षकार वकील साहब को बार-बार संपर्क करके पूछते रहता है कि केस का क्या हुआ तो अगर केस में ज्यादा कुछ नहीं हुआ रहेगा तो वकील साहब का जवाब वही रहेगा। (फिर पक्षकार, वकील साहब ने दिया हुआ जवाब नहीं समझ कर फिर उसी बात के लिए बार-बार संपर्क करे तो हो सकता है वकील साहब जवाब देना बंद कर दें), और फिर पक्षकार कहे की वकील साहब जवाब नहीं दे रहे हैं या कुछ बता नहीं रहे हैं। मेरा यह कहना नहीं है कि आपके साथ भी ऐसा ही हो रहा है मगर मैं एक अंदाज कर रहा हूं कि कहीं ऐसा तो आपके साथ नहीं हो रहा है? इसका अपने साथ परीक्षण कीजिए।
तो अगर ऐसी स्थिति है तो मैं कहूंगा कि आप संयम रखें धीरज रखें।
अगर मैंने जो अंदाज किया वह स्थिति नहीं है और अगर आपको बहुत ही ज्यादा उत्सुकता है यह जानने की कि आप के केस का क्या हो रहा है तो आप सीधे एडमिनिस्ट्रेटिव ट्रिब्यूनल के रजिस्ट्री में जाकर वहां से भी जानकारी प्राप्त कर सकते हैं।

sir , i have qualified ALP post in Railway under ST category . bihar govt issue ST caste certificate for our caste after 2016 with proper notification and no OBC Certificate issue anywayafter 2016 . i have mentioned St category in application and passed all stages of exam including medical and document verification . but railway authority is not giving me joining . Since on same caste certificate other RRB is giving joing but my my RRB is not giving joining . saying that your caste is not present in central list . I have shown them all notification to RRB but they are decling to read . mera life barbad ka r diya hai state aur central govt mil kar , ek govt bol rha hai hum ST ka hi certiifcate denge aur ek bol hai tm ST nhi ho . aise hum kya kare . please sir help
