Namaste Guruji 🙏, Although what you are saying is right for Common Citizen to be alert while going to court .But what about Advocates bread & Butter 😁 although Ethics important .Seen advocates charging unduely for Bailable Offences or taking fee's & leaving client high & dry or demanding percentage of Share ,Greedy.not Ethical .But taking Fee's for every advice even not going to Court as you say is not unethical . sir, in my locality and an advocate is drafting illegal sale deeds . he is an advocate for a housing cooperative society.. - he is drafting sale deed for the sites which are reserved for park and cheating public and selling them and he is drafting a site dimension which is not approved in layout plan and he is doing public fraud ... can we file complaint against such advocate .. which forum please advice.

प्रश्न- सर मेरे घर से लगभग 60 से 70 फीट की दूरी पर एक कुआ है जिसे के चारो तरफ खुली सरकारी भूमि है मोहल्ले के लोगो ने मेरे घर से 8 फीट की गली छोड कर मेरे घर के सामने मन्दिर का निर्माण कर दिया है मन्दिर मे लाउडस्पीकर पर धार्मिक आयोजन होते है लोगो का जमावडा बना रहता है मेरा पूरा परिवार इससे बहुत परेशान है इस अवैध कब्जे को कैसे हटवाए ।मन्दिर निर्माण को 6 साल हो गए है ।

देखिए मंदिर वगैरह जैसे धार्मिक स्थल हटाने के बारे में अगर सोचें तो सबसे पहले धार्मिक भावनाएं भड़काने की बहुत ज्यादा संभावना बनी रहती है। इसलिए जब इस टाइप का काम शुरू होता है तभी से इस पर अगर रोक लगाए तो आगे बातें बढ़ती नहीं है। अब आपने 6 साल तक कुछ नहीं किया और अब परेशान होकर यह करना चाहते हैं। यह सब बड़ी सावधानी से और कानून के सहारे ही करना होगा।
आपकी परेशानी की दो बातें दिख रही है। पहली मंदिर का अवैध निर्माण, और दूसरी यानी की नॉइज पॉल्यूशन। आपके इलाके में दोनों चीजों के बारे में कानून बने होंगे। अवैध निर्माण के बारे में म्युनिसिपल काउंसिल या म्युनिसिपल कॉरपोरेशन के कानून लागू हो सकते हैं, और नॉइज पॉल्यूशन के बारे में तो पहले से ही कानून है ही। और ऊपर से सुप्रीम कोर्ट ने नॉइज पॉल्यूशन को लेकर जजमेंट दिए हुए हैं।
तो इन सब कानून का और वस्तु स्थिति का जायजा लेकर एक प्रॉपर लीगल स्ट्रेटजी बनानी होगी और उस पर काम करना होगा। यह सब आप खुद बनाओगे तो रिस्की रहेगा इसलिए किसी एक्सपर्ट वकील की सलाह लेना ठीक रहेगा। इसलिए आप अपने इलाके के अपने पसंद के वकील साहब से मिलकर उचित सलाह ले और कार्रवाई करें। इतना ही इस कमेंट में बताया जा सकता है।

साहेब , व्हिडिओ खूप छान आहे. तुम्ही जी म्हण मराठीत म्हटली ती सुद्धा योग्य आहे कि शहाण्याने कोर्टाची पायरी चढू नये . परंतु आज केस कोणालाही कायद्यांचा धाक राहिला नाही. कळत नकळत खुप वेळा कायद्याचे उल्लंघन होते त्यामुळे कोर्टात जावेच लागते. नाईलाज आहे
कोर्टात जाऊच नये असे माझे म्हणणे नाही. फक्त "शक्य असेल तर कोर्टकचेरी टाळा" असे मला म्हणावयाचे आहे. हे सर्व तुम्हा सर्वांचे हिताकरताच मी सांगत आहे.
जेथे पर्याय नाही तेथे न्यायालयात जावेच लागते याची मला जाणीव आहे.
