FIR quashing is the most sought after remedy in law. Many people feel hopeful about this remedy of fir quashing against them. But very few people know about exactly how and in what circumstances FIR quashing is done.
In this video Advocate Nahush Khubalkar, a practicing and experienced lawyer explains in detail how and in what circumstances FIR quashing can be done by the Courts. He gives examples and tries to make it as easy to understand as possible. This video is in Hindi language specially so made so that a larger number of people can understand about fir quashing.
For understanding properly about fir quashing you need to understand two concepts : Crime and First Information Report. After understanding these two concepts it is easier to understand fir quashing.
A crime is not what a common man understands it to mean. There is a legal meaning of crime which needs to be understood. Adv. Nahush Khubalkar explains it to you in this video.
Once you understand what exactly a crime means in law you will be in a position to understand what an fir is and what is it's importance in terms of fir quashing.
An fir sets the criminal law in motion causing much harrasment to the accused if the allegations therein do not meet the requirements of law. Why should an fir which does not meed the test of law be allowed to stand?
For quashing of fir there is an improtant test laid down by the Supreme Court. You need to understand that test. Adv. Nahush Khubalkar explains that test to you in this video specially made in Hindi language.

You can go for FIR flashing at the very initial stage, that means immediately after filling of FIR. But you can challenge it later also. It would be in your best interest to actually seek opinion of an expert lawyer.

Hello sir one of my relatives in jail in 420, in his case civil court has already awarded the in the creditors favour, but there was tecnical error the papers are not stamped, so he has to paye penalty for the same. To avoid the same he used this technique to make criminal case on him. In this case since chargesheet already filed can we go for FiR sqashing? Person is sinior citizen still in custody since last almost 2 yrs
Sir, could you please explain FIR quashing in the context of IPC 307. My relative is arrested under IPC 307 but the actual offense is IPC 358. Now should we try for bail or for quashing of FIR or can we do both these in parallel?

The answer to the question that you asked would be the same that I have explained in the video under which you asked this question in the comment box. There is nothing like any special quashing procedure for this section of this law that section of that law. I have already explained the general principle of quashing of FIR. That should apply even to quashing of FIR on the proceedings initiated under Section 8 of the pocso act.

Respected sir,as you explained this in regard of theft ,so please make a video regarding Under section 7 and 7A regarding pc act .
So please explain the elements of above act -for 482 Crpc(jaisa aapne theft wale act dhara ko samjhakar kiya hain)

And sir one more thing ki -in my FIR of section 7 PC act ,complainant one side said that there is no due in our excise department,and in other page of FIR complaint argued that -“ shab ne mujhe meri pending excise duty ka dar dikhakar rishwat mangi hain “so in same FIR he is saying two versions .and in alleged conversations recorded transcript is of only regarding his due in form of excise duty .
Can above situation be explained to high court that this FIR is false and frivolous.

SIR , you are doing great job , and making people aware of their rights. #respect. Could you please help me out . I have filled FIR under IPC 464 , 468 , 471 , 114 for doing my fake sign on electric connection on my brother. He is quite influential person in locality so he prolonged period to file FIR by influence. Now after filing FIR he send me a notice under CRPC 482 to quash FIR . I do have all evidences of fake sign but police sent them to FORENSIC LAB.

Going by your question let me first tell you that the notice that you have received of a case for quashing of FIR under section 482 of the code of criminal procedure must be from high court if your brother has already filed the case in the High Court for quashing FIR against him. If that is so then along with the notice of the high court you must also have received the complete copy of the case that he filed by reading which you would come to know exactly what grounds your brother has raised in the case that he has filed before the High Court. So you will have to fight that case by opposing it by filing a strong reply. In that you will have to mainly point out as to how on a simple reading of the FIR itself, even if the allegations made in the FIR are taken to be true at their face value coma the ingredients of the sections slapped against your brother are clearly made out and therefore the FIR cannot be quashed at the threshold.
As regards sending of documents by the police to the forensic lab I think that is ok because in law when the evidence of fake sign would be produced by the police before the court, the court would tend to believe the experts because they are the experts and their opinions do matter.

If the money is transferred through civil court on the basis of succession basis yet fir is lodged and the police has made accused the person whose accounts money has been transferred by court order. Is it not a contempt of court / defamation case against the complainant who ha s made fir where it is a purely uttara adhikar case hai. Whether i t can be quashed under section 482.

In my opinion the FIR will not become quashable only on this ground. The primary test for quashing of FIR as explained in the video will have to be first satisfied.
If that primary test is satisfied then, in combination with that, the ground raised by you in the comment can be considered by Court for quashing of FIR. But I have my doubts if only on this ground (means the situation stated by you in the comment) whether FIR will become quashable in law.
Sir 354d lower court me proof ho jaane ke baad higher court me quash ho sakta hai ki nhi sir.
Higher court me revisio ke liye lower court ke order ko challengekerte he.
