  • Jack Kowalski, father of Maya, took the stand today.
    Witness testimony continues Tuesday in a $200 million lawsuit against Johns Hopkins All Children’s Hospital that was featured in the Netflix documentary ‘Take Care of Maya’. In 2016, at just 10 years old, Maya Kowalski was admitted to Johns Hopkins All Children's Hospital for severe pain and was removed from the custody of her parents after staff accused them of "medical abuse." Her mother, Beata Kowalski, hung herself in her garage on Jan. 7, 2016 after going months without seeing her due to the medical abuse allegations, according to the family's attorney, Greg Anderson.

      Watch the movie “A Civil Action” to learn how convoluted a case can become because of hidden evidence. The main character is played by John Travolta who does an excellent job. Robert Duvall is a defense attorney for a huge corporation who busies himself with saying no to everything until the basic evidence proves who is at fault.

      Was removals by DCF were at an all time high in the state and in particular removals were much higher with her involvement in them

      This judge has been extremely one sided & he has been on the side of DCF & hospital that has been clear from the very beginning he always seemed aggressive & aggravated by maya her brother dad witnesses for them & there lawyers he allowed the hospital lawyers to ask questions and provide them with there notes & evidence through out the trial but did not do the same for maya & her family

    Alot people bashing the lawyer of this family You guys need to realise they going after very very very powerful people with unlimited amounts of money to chuck at this the family getting to this stage alone is amazing and a great achievement this happens to many many parents and worse but don't have the money and the means to do anything so they admit they in the wrong instead and agree to follow all the recommendations just to please the judges and everyone to just get their kids back so this family reaching this stage alone well done to them hopefully this will give others the courage to do the same

    I was so disappointed how the lawyer treated this dad on the stand. He is just a dad trying to take notes and protect his child after his wife died. He had no law degree. I thought he was just being bullied while on the stand

    I feel terrible for the Kowalski’s Lawyer’s. IDK nothing about being a lawyer but come on this is ridiculous! How can you present a case without evidence! The Kowalski’s team has so much evidence that is not being allowed. This evidence that is being hidden from the Jury IMO proves without a doubt this hospital is in the WRONG! Come on man even a blind person even a child can tell you the fact their was a camera in her room, they knew without a doubt that Maya wasn’t faking! Shame on them! I do believe between this hospital and staff they are the reason beautiful Beta is no longer here! I am a mother of a 34 yr old son, 27 yr old daughter, and a 11 yr old son, YOU BEST BETTER BELIEVE I WOULD DO ABSOLUTELY ANYTHING FOR MY CHILDREN!! Even if it meant I could no longer be with them physically! Maya and Kyle know without a doubt your beautiful Momma Beta did what she did that day not to hurt anyone but to help the family! She might not be with you physically but I can “almost” guarantee she has never left you side!!

      I'm a mother of 3 age 30, 33 and 45 (1 past in the age of 14 month).
      I'm German an I know how much wrong a hospital can do in 2010 my daughter almost past away. I could not do anything about what they all did wrong, because I was working in the same hospital in an office. 😮😢
      In Germany no patient gets justice anyway because the insurance FOR PATIENTS is "payed by all Doctors" 😮

      @@wolke1955 I lived in Germany for 3 year’s and I can say, “I can 250% understand what you are saying!” My youngest son was only 4 months old when we went to Germany. Unfortunately he was diagnosed with RSVP just a month after arriving. I was in awe with how the hospital was. His IV was placed into his head. That wasn’t what I was shocked about. I guess because our status there was with the NATO agreement it seemed liked we stayed 3x’s longer than had we been stateside. Then 2.5 years later my daughter was 17 admitted with dehydration. She protested staying the night and they allowed her to go home at night!? No IV nothing. If you look at her hospital bills she was a patient for 8 days!! However she was only there a total of maybe 20 hours! They did nothing for her but a IV for about 4 hours!

    Defense calling for a mistrial because a PT video made by the hospital was released to the family on the day of a court hearing, so it's the family's responsibility to have shown the video in a court date that day? The hospital should have done what was right after reviewing the video(which must have been done since it was released to the family). They claimed the court would have ruled to released Maya from that hospital. The hospital should have done a much better job of protecting a child and should have automatically been compensated and transferred or at least released from their abusive treatment. No mistrial!! Maya deserves a fair trial and compensation that can never repay for this irreparable harm.

    So many times in the testimony we heard "she didn't express...(pain). My observation is a stoic child, which doesn't present the same and can't be described as NOT in pain. Any true professional should know this and the people involved in her abuse should never have been qualified or allowed to be anywhere near her with such narrow- minded ideas that every child is the same.
    I saw her pain, even when she wasn't saying it. 😢
    Those women testified that she wasn't crying when they held her arms away from her torso (a self defense position) for the picture! You can see her mouth and she was CLEARLY extremely upset!!! HTF do you see that and not stop... as child advocates... no matter WHO told you to take the pictures?!
    Clear example of the people who claim to be advocates being the heartless abusers themselves. Glad she won her case. Those ghouls should never be around children again!

    No matter, document important information if you feel you are being taken advantage of. Keep careful dates, notes, pictures, videos, emails, texts and phone calls. If you are being accused of something you are not guilty of, get an attorney and have them go with you when you speak with a given person. Careful documentation is helpful. Everyone, including law enforcement takes notes and documents. You do it too!

      @@wolke1955of course we dont know the compensation agreement, but my understanding is civil plaintiff litigators don’t charge a fee unless they win. And in this case, if plaintiff wins, it could be a big pay day for this attorney. If you don’t think he is any good, perhaps better attorneys refused to take the case…🧐

    I absolutely LOVE how bothered those lawyers look . Knowing now the outcome , they all LOST BIG TIME. I’m sure they all knew they would win . Their actions OOOZE superiority and confidence . Like how dare he even TRY this ? 😂😂😂 this was a great case to watch

      No, the hospital didn’t fire them. Some of them quit before they even had the chance to get fired or they retired. They knew what they were doing was wrong.

      Yes!!! They received the only justice they could, however Maya deserves soo much more. This should have never happened like this in the first place. All of us as a CRPS survivors understand what I mean.

    I wish I was there before the mom killed herself. I wish I had known about this case because I would have contacted the family and informed them of a similar case out of California where the hospital had called CPS and told them that the mother had took the child out of the hospital against medical advice . The mother in that case out of California did so because a nurse had tried to give the child a medicine that had not been prescribed for him a medicine that could have been fatal for the child.

      No a hospital social worker called cps and made a false statement. The CPS worker called the police and they went to the home of the patient when they were there the police threw the dad against the car and took his keys and they then used the keys to enter the home and they then took the kid back to the hospital. After that there was a big fight for him and it was plastered all over the media.

    Power tripping paternalistic group think phenomenon that I have also witnessed at the Mayo Clinic - there is a real problem with the system. As a healthcare worker myself I have witnessed the defensive stance and antagonism that occurs when family members advocate or challenge the treatment plan and/or approach. Imbalance of power is really dangerous.

    This is so disgusting and horrifying what this child and her family went through. How would the hospital staff and attorneys feel if this had been their child or family going through this? They (hospital and staff) are heartless for keeping maya away from her loving family. Plus putting this family through this horrific ordeal. People should lose there jobs and not be allowed to practice anywhere ever again. God Bless this family. So sorry for the loss of this precious wife and mother. This is criminal behavior on the part of the hospital and it’s staff who was in contact with maya and her family.

      Because of what child services and hospital staff put her through. Not allowing her to see her daughter. Accusing her of things she was not guilty of. It sent her on a downward spiral and she committed suicide.

    It feels to me, the judge, doesnt like the plaintiffs laywer. Watch the whole trail updates, and honesty, i admire the plaintiffs laywer, for going on, its like fighting defense and judge😮

    I know that Jack will continue to take excellent care of his children. He is a father any child workd be proud of. Going through all this has been an horrific nightmare for him how hard to have to face these evil people again… so sad so very sad. It breaks my heart hearing what that beautiful little ten year old girl went through and Kyle is so sensitive and thoughtful boy they are all just extraordinary people a beautiful family destroyed by evil monsters there is no other word that fits them( that I can say on TH-cam) May God Bless Their future with tons of love laughter and peace…

    You have no right to cast judgement on anyone suffering lest you walk in their shoes. One day, humility is taught to those who have, like myself. Cancer chemo treatments poisoning/overdosing, caused the degeneration of spine, and other neuropathic functions for rest of my life! 🙏

    I was reading about comparmental syndrome and it is very interesting, and suprised they haven't tounched more on it. Certain medications can cause or induce it, fractures are common and even have a Compartment pressure measurement test. That is hooked up to see the pressure in the muscles.

      Yes, very interesting. Never heard of this before. Been reading of some people not believing Maya has true CRPS. They say she has pain, but not that. Asked they what they meant. Interested to see now, if they mention this.
      This case is soo sad. Happy she and her family received justice.

    I see the grief,guilt, loss, emptiness … the adjectives go on and on. These emotions all reflect on that family’s face.
    They are all going through this individually yet trying to support each other while they cope with their own traumas.
    Not a lot of things get to me, but this case and situation broke my heart.
    This family did not deserve this
    No one deserves this
    I’m happy they won
    And it’s not about the money
    I’m happy they won the acknowledgment of malpractice and the light at the end of this dark tunnel.
    I’m just so sorry

      Fun fact I just found out from watching a couple of lawyers live stream, Judge C used to work for the Defense lawyer with the quite hair and glasses. Wouldn't that be considered a conflict of interest?
      I would imagine he had refused himself.

      What makes you think he was cruel to his wife? Who is he btw? If you’re talking about Mr. Kowalski he wasn’t being mean to Beata he was up all night helping her do research on CRPS and he was informing her everything what was going on. The hospital was the one who wouldn’t allow Beata to come near the hospital because when they was in the er she wouldn’t allow anyone to touch Maya not even Mr. Kowalski until Maya got 1500 mg of ketamine. Dr told Beata they would have to Maya in the ICU. I know Beata was trying to to do everything she thought she was doing was right but she was be aggressive and the doctors didn’t appreciate that.
