    So what criminal offence had ALREADY been committed officer, theft? So did you steal anything? No.

      Now, file a formal complaint against the officer with PSD… YES, the complaint will be dismissed because it’s criminals investigating criminals.. but how many complaints can that criminal rack up before his boss decide to get rid of him..
      Also, apply to have all your details (DNA, custody image, finger prints, police report, custody notes etc) immediately remove from all police systems.

      @@julianchamberlain5399 Expected, partly because he’s uneducated, but mainly because the interview is all about him improving his case against you. He controls the questions and he doesn’t want to make a mistake that helps you.
      Personally my advice may have been say nothing in interview, just give him a prepared statement which states the facts, the events, the Law - and to frustrate the fools keep repeating “you’ve read my statement which clearly demonstrates your arrest was illegal and further malicious charges would be of further detriment to you. Everything else is completely irrelevant”. Answer that for EVERY question, rather than “no comment”. They’ll quickly get tired and the Court will recognise you’ve explained your position throughly. Further, the CPS will have only that to go on. It weakens them.
      If he wants to pick holes in it he can do so in court, and your Barrister can control the answers to a degree. Answering questions may “feel” like it’s the right thing to do. It always isn’t. All answers only help the Police.

    Sergeant Ben Atwood, I’m rarely surprised by the idiocy displayed by police officers, nor am I surprised when they break the law. I have four decades of experience of police officers committing criminal offence.
    But you really outdid yourself and your ilk with this one. If I wanted to I could not only point out the specific pieces of evidence in your conduct during this interview when you betrayed the fact that you were fully aware that you had unlawfully arrested this man, but chose to pursue the matter on the basis that the process is the punishment. Specifically, your purpose for keeping him in detention was to punish him.
    I look forward to the day when glorified policy enforcers and revenue collectors in fancy dress costume like you are held accountable - by whatever summary justice system is in operation at the time.
    Throughout the interview you lead the process towards the point where you expressed your utterly perverse a d warped belief that making a profit is illegal. You are clearly aware that you can not only get away with kidnapping people, unlawfully imprisoning them, steal their lawfully owned property, and face no individual legal penalties. That will not always be the case.
    This type of disgusting behaviour needs to be stopped.

Someone, higher up the chain of command, has questions to answer as to how Attwood has been allowed to get away with the sort of behaviour displayed in the video and not get pulled up about it or warned his job is at risk.

      Yeah, someone not involved in the arrest should have done the interview. Instead, it became an interogation with the arresting officer clearly invested in fitting the guy up for some offence given he was cross examining because his little ego had taken a knock.

    That officer is an absolute muppet and should face an internal enquiry for a wrongful arrest and wasting the publics purse. He should also have established the facts about what is and what isn't legal tender before performing an arrest and then to not wish to discuss the legalities during interview is just beggars belief.

      @@PlayThenSay that's an interesting position, so although perfectly legal tender, where does that leave one legally when you take something in this case fuel but it could be a restaurant meal or something other that once taken you can't give back and then your legal tender is not accepted as payment that is not otherwise displayed before hand 🤔

    thanks for publishing this, certainly educational for anyone that has not been arrested before showing them the interview process. He was holding his head in his hand because he realised he had let his ego get the better of him and arrested you. When you pulled your ace out of the bag (his words) he could have asked if you would show the email to the manager and un arrested you instead of dragging you down to the cop shop.

    I took from this police interview video that it was not about getting you on a hook but getting himself of the one he impaled himself on. The salient point here is that you would reasonably expect both the Tesco Manager and the policeman to validate the authenticity of the coinage or otherwise prior to involving the police and the subsequent arrest. You're a brave man for puting yourself through this.

      I agree the arrest should have stopped as soon as he was shown the email from Tesco stating that they accepted the coins. The Sargents EGO was being tested and he didn’t like it. He then abused his power, knowing he was wrong, to inconvenience Brett. Even that backfired as the video has has gone viral and helped Brett get the message further.

    This cop was trying to dig himself out of a hole. He'd have been better to put his spade down and climb out. However legally the whole case against you falls down because you had no intention of leaving and in fact you didn't. To shoplift you need to leave the store and in this case you would need to have driven off of the forecourt.

    The 'officer' says "I am simply here to collect evidence" (at 40.15) after having made accusations and aspersions throughout the interview; he told the man that what he had done was "dishonest", and TOLD him what his motives were.

    Seems the only way you can settle this once and for
    all is to be charged, found not guilty and Tesco left
    to pay all costs including a weekly discounted shop
    for you to the value of £100, which you can pay for

    If a corner shop owner goes to a cash & carry to buy a box of 20 Mars bars at £9 making the unit price 45p but the sells each in his shop for 70p, is he being dishonest? Your solicitors travel money example is excellent and I can't see why you wouldn't win hands down in a civil claim. I would demand a written apology from this pillock as well.

      Likewise if I buy a collectable 50p coin on eBay for £5 netting the seller a nice profit, is that dishonest of the seller to use the coin to make money? The coin you used has a face value of £100 still, does what's written on banknotes 'I promise to pay the bearer on demand the sum of..'apply to coins too? When Tesco bank it, it won't be worth less than £100 will it.

      @@scotchegg9797 As you say, all Tesco had to do was bank it. Legal tender - bingo! £100 in their bank account. Case closed. This case reminds me of a story on telly a while back. A boss used to pay his staff in gold sovereigns. Giving the staff (say) five sovereigns as their salary, and given the high market price for gold, meant they had a very reasonable income, but the legal tender value of £1 meant a zero income tax liability and no messing about with national insurance contributions. I seem recall capital gains tax thresholds were high enough at the time to allow them to get away with that as well.

    That was a pleasure to watch. You really knew your onions and stuck to your guns, Rimmer was trying all the usualtricks, what a weasel!
    You handled the whole thing very well and made him look the fool he clearly is. The only thing I would have added, when he was suggesting buying them for £70 and getting £100 back was illegal was that Tesco were not being disadvantaged as the face value is £100, and they would have given you £60 in fuel and £40 change. Hence they were fully recompensed in the contract. When they banked the coin with all the days takings they would be credited with £100 so no crime or deception would have taken place. I would also have asked the copper "So if I buy Kruggerands for $1500 and sell them a few weeks/months later for $1800, is that dishonest?"
    Now seeing as he has checked the price and seen the potential here, I wouldn't be surprised if he and his colleagues start paying for their doughnuts with £100 Coins 😂

    There may be an artificial value for such coins on eBay but Tesco could present it at their bank and be credited its full £100 value. This is a no brainer wrongful arrest and the officer knew that a few minutes into the discussion.

    It only just chimed with me that you got these coins, at below market value. I thought it was just a matter of principle. However, now i respect you even more because it a very smart business initiative being used. Good on you & false detention & arrest is a certainty in a civil claim through the small claims Court.
    You take the legal action against the Chief Inspector( by position, not name) i would put in a claim for £5000 as a reasonable sum given the Arrest, Imprisonment as well as the Alarm & distress this experience has caused you . You pay a fee of approx £80 to lodge the paperwork at the County Court. You claim £5000 plus the £80 & a reasonable travel expense. The Police as standard will lodge a defence. However once a Court date & time is set they will fail to attend. If you attend & they fail to attend, you win by default & no inference of wrongdoing can be made against the Police. When its less than £15,000 they rarely attend, as the Costs of Solicitors & bad publicity of a loss like this forces them in most instances to pay up.
    If the Solicitor for Police & Police did defend & you lost the case, you are not liable for costs, other than your own, as its under £15,000 So its a £80 and a 1/2 day effort to gain Justice and £5k The proceedings should Police attend are very informal. You at a table on one side, Solicitors opposite & Judge at the top in the middle. You explain your position. Judge then asks you a few questions to fully understand your position, then Solicitor can ask you questions. Then they put the Police argument, you can adk them questions & the Judge makes a judgement binding on all sides. The Judge could award less than £5k if they felt it excessive, so do not be greedy . Good luck

      Probably wont be able to as the UK does not enforce the taking of these coins: ​ The Royal Mint themselves opinion on the matter "We receive a lot of enquiries about our popular silver commemorative coins (including £5 crowns, £20, £50 and £100 coins) and their legal tender status. Each issue is authorised by Royal Proclamation in accordance with the requirements laid down by the Coinage Act 1971. This means that in common with coins in general circulation these coins have legal tender status.
      Please note that whilst these coins are legal tender, they are not designed for general circulation, so banks and shops are unlikely to accept the coins. The Royal Mint cannot accept returns of such coins outside of the 14 days return policy". Dont feel bad he got what he wanted from trying this.

    Can’t believe he actually admitted on tape that it was legal tender and then calls you dishonest- don’t know how you kept so cool - he needs retraining at the very least but really that should be a disciplinary case - can’t wait for the sequel in the civil court

    Your broke rule 1. You engaged in conversation with him. Should have instructed him that unless he has reasonable grounds that you committed an offence you are walking out to which he would have had no response. He was fishing for something to legalise his action of an illegal arrest. If he had attempted to stop you leaving it just adds to any claim you make against them.

      I think the mistake was that the officer clearly defined the meeting as a conversation (his own words) and then you later allowed him several times to say “I’m asking the questions”. I would refer him to his earlier statement.

    Yes. Please don’t settle out of court. You’ll get a lawful decision from a Judge, but just see what sympathy you get!

    You handled and articulated your position very well during that ridiculous situation.
    That police officer had absolutely nothing, and was desperately trying to get you to incriminate yourself, or at least trap you by getting you to agree that your approach was ‘unreasonable’.
