So, what this boils down to, is multiple officers arrived, did 0 investigating, predetermined guilt, and then openly lied to a business owner to get an individual removed from a property, then lied to the man's faces about it. The flagrant disregard for the truth is amazing

That cop who operated from his feelings saying he is a grandfather... if he can't follow the laws because of his personal relationships, then he should not be a cop.
Mr Hoffman could have said to that grandfather cop "Let me put your mind at ease. I didn't record or witness any children from the public view, naked or in any act that could be construed as sexual in nature". Turn that suspicion right back on the church. The first ones to use their children as an excuse are usually trying to hide their own guilt.
And they in lies the problem with law enforcement accountability in small jurisdictions that don’t have independent oversight. Their biases go unchecked and they violate so many people’s rights.

The cop deliberately disparaged the guy's character and deliberately misinformed the manager in order to manipulate the manager into seeking trespass against the private investigator. *That pisses me off.*

And, interestingly enough, licensed private investigation isn't an uncommon profession for retired law enforcement officers. In fact, in some states, PI firms have to be run by someone with previous law enforcement experience. The officers failed to apply critical thought in this situation.

When someone says "tresspass" they could mean "trespass warning" or "criminal tresspass". One is telling you not to do the thing, the other says you did the thing after notice.
It's a bit of a misnomer, it's like calling a "tissue" a "Kleenex". A trespass warning can be issued once you leave a property, which means you can't come back on the property. Being charged with criminal trespassing is when you violate the trespass warning. Both get blended into "trespassing". So you can in fact be "trespassed" once you've left the property...

I’m a PI and I get the cops called on me a lot. Even if you call the local police and give them a heads up, they still show up. Also, the officers aren’t allowed to blow his cover like that in front of the general public. Paid are not obligated to tell you who they’re investigating or why and in most states (for sure in Florida) what they did is considered impeding/interfering with an active investigation to the same degree as if an LEO was performing an investigation and someone was interfering with them. There was also no need to have that many officers respond. When people say defund the police, it’s because of shit like this. Wasting precious resources, manpower, and taxpayer money to respond to a typical civilian complaint. Gotta love when the cop said “you’re impeding the flow of traffic” and the body camera moves around to see not one car driving even remotely close to his position. As soon as he said he’s a PI and showed his license, the stop should’ve been over. I know when there’s kids around, people get concerned and protective, but the matter of law supersedes those concerns. You’re in public, you and your kids are already being filmed.
Yep, here's my thoughts why these cops were actively trying to blow his cover.... What we know is that his case was a workman's comp case about a woman, the woman was seen entering the church with two children. The cop said he has grandchildren there right now, how should that make him feel..... I'm starting to wonder if the person he was investigating for compensation fraud was his wife who brought the grandkids or his daughter with the kids. I'm thinking the reason he didn't say anything when they claimed he had to notify them upon investigation in their area, is because it was Mr grandpa's wife, and they both knew that.

He was asked to leave from the church and he complied. But the pastor could still(and did) request he be officially trespassed. Same with Winn Dixie. They requested an official trespass.

Technically the statement is true, so therefore not slander. Even though the officer omitted key information that did imply the subject was a pervert of some kind, he never said it.
Language and context is everything. The cop told the store: “There’s this guy illegally parked filming children. Do you want him trespassed?” Instead, had they told the truth which is: “There’s a licensed private investigator working a story in the parking lot. Is it okay for him to stay?” Well, that would’ve provided completely different results and the cop knows that. Language and context absolutely matters.

To play devil's advocate, how does the pastor know he is really a PI and not just a creepy old guy? Not defending him or the cops, however I don't think a good PI would hang out in a church parking lot full of kids and not expect to be confronted when he is filming or taking pictures. It could have ended a lot worse if a few suspicious and angry Dads came outside. Lots of bad things have happened at churches, so I can imagine them being on edge and calling the cops.

As a PI, I've had similar encounters with law enforcement. I was even labeled as anti-cop and a 1st amendment auditor in the police CAD notes, because I was parked on a public street conducting surveillance and refused to provide any identification or assist in their witch hunt. Its really sad as a former law enforcement officer, each day I see videos like this and have encounters like this myself, make me embarrassed to even claim I was a cop.
With one of the businesses I used to own, I hsd an exemplary, hyper intelligent college student employee who worked with me until he finished his two year degree and went on to become a cop. I offered him very good money to stay, but he made it clear that he had this purpose all along. As president of my corporation, I gave him a glowing review to get his job with the big city PD. He lasted 4 years as a cop and after watching a half dozen of his coworkers get mowed down on the southside, he became a private investigator for insurance companies. Smartest move he ever made, doubling his money, and yes, he had his share of idiotic experiences with other cops as a P.I. In this video, this is a clear-cut case of cops getting personally involved rather than following law. It will lead to a federal lawsuit and the cops losing qualified immunity.

My husband works for a particular organization. They have lawyers on standby. My husband is more of cyber stuff. But the ground guys are always getting nicked, they literally just call their lawyer.
I was told this long ago, I wanted to join the force; then the Commissioner himself told me I wouldn't be a good fit as I think for myself too much, and would likely 'over-use' my discretion and result in less arrests. My response was, wouldnt that result in better community relationships, in turn resulting in more closed cases since the police bread and butter in investigations are peoples testimonies. I had a friend then join, and he's a brighter spark than the avg fellow, and he was thrown from entry level straight to special forces unit, because he'd mess up the program that is the basic cop jobs, to reek havoc haha....He'd be more likely to call out BS in other officers interactions etc, still slightly attached to his civilian, empathetic part of him; which we all know gets forcibly thrown out when you become law enforcement.
Blame your enemy for what you are guilty of. Absolutely guarantee if his hard-drive isn't absolutely full of that stuff, he's got it stashed somewhere or indulges in it.
Okay let's be fair. To toss that at the pastor is uncalled for. He was concerned for children, that's a good thing. The COPS were the issue here. I would expect a pastor to call the police if it appeared to him that a man was recording children, that is strange behavior even if it's legal. As a owner of a private security company & have done surveillance on homes for drug activities, I too have been approached by people seeing me video taping the house under surveillance for drug activity & I simply exist my vehicle with my security uniform on & my .9mm on my side & simply identify myself & say I am on a case conducting surveillance on a drug house, after that, they walk away... law enforcement officers should give this guy the benefit of the doubt because he is on a case surveillance probably investigating a cheating wife ..its always a cheating wife or girlfriend...

Pro tip for fellow LEOs. The way to handle these calls, drive by, observe a person filming in public, continue driving by, they aren't doing anything. HBO, its that easy.
Common sense is a dangerous standard. Everybody's common sense is different which is what happened in this case. The cops have common sense, it's just not the same as yours. This is why we go by the law rather than peoples feelings or common sense.
Because they don't want to get caught doing what they do to children. Literally every week another LEO is caught somewhere in the US abusing children. Usually multiple times a week.
As a private investigator, I've personally had a very similar situation with a very different outcome. I was parked on a public street recording a subject in his front yard several houses down from my location. A little boy about five or six years old came out of the house I was in front of and started waving to me. I gave him a friendly wave back in response and resumed watching my subject. A few minutes later, a man came to the front door of the house and yelled for the boy, and a younger (four-ish?) girl I'd not even noticed to go inside. Once they were inside, the man walked over and knocked on my passenger window, asking what I was doing. I told him "I'm sitting in my car on a public street." He eyeballed my binoculars, laptop and camera equipment on the passenger seat, then stomped off angrily without another word. I had no other interaction with him, but I did notice him peeking at me from behind the curtains in his front window several times over the following half hour until the police parked behind me and approached, two officers on each side of my car. I put all my windows down, and my hands on the steering wheel, with my Driver's License and Private Investigator license between the fingers of my left hand. As the first officer arrived at my window, I slowly held the cards up for him and said "I'm on a file". He took them, and the two officers on the driver's side backed away and returned to the police car while the other two remained on my passenger side with their hands on their guns. After a couple of minutes, the officer I'd given my cards to walked back casually and handed them to me with a "Have a nice day.", and all of them returned to their car and left. That was the entire incident. The man and kids never came back outside, and I eventually got the footage my client needed.
After watching all these videos I'm never going to agree to trespass some random person from any business I work at based solely on the word of a police officer. I don't even see why the word of a police officer should carry more weight than any random person in court after seeing how often they lie to the public.

An excellent episode. Just provides additional support that some cops 1) do not know the laws they are employed to enforce and 2) will say and do whatever they want to get the results they desire, acting as judge and jury. The system never worked well and it continues to function poorly for the general public. Body cams are about the only thing we have to prevent cop tyranny.
They spend years trying to find a way to word things to sound better but the best they can do is "we've investigated ourselves and found no wrongdoing."
They use time to diffuse the situation, hoping that it will be forgotten and then can be dismissed quickly and quietly. It is how law seems to work for cops in this country, but not the average tax payers.

I have worked a few jobs in my day and each of them required some kind of oversight, both internal and external. In one job every year I had to get a roto rooter type of thing from the public. Mr Hoffman could have said to that grandfather cop "Let me put your mind at ease. I didn't record or witness any children from the public view, naked or in any act that could be construed as sexual in nature". Turn that suspicion right back on the church. The first ones to use their children as an excuse are usually trying to hide their own guilt.

When someone says "tresspass" they could mean "trespass warning" or "criminal tresspass". One is telling you not to do the thing, the other says you did the thing after notice.
It's a bit of a misnomer, it's like calling a "tissue" a "Kleenex". A trespass warning can be issued once you leave a property, which means you can't come back on the property. Being charged with criminal trespassing is when you violate the trespass warning. Both get blended into "trespassing". So you can in fact be "trespassed" once you've left the property...

I’m a PI and I get the cops called on me a lot. Even if you call the local police and give them a heads up, they still show up. Also, the officers aren’t allowed to blow his cover like that in front of the general public. Paid are not obligated to tell you who they’re investigating or why and in most states (for sure in Florida) what they did is considered impeding/interfering with an active investigation to the same degree as if an LEO was performing an investigation and someone was interfering with them. There was also no need to have that many officers respond. When people say defund the police, it’s because of shit like this. Wasting precious resources, manpower, and taxpayer money to respond to a typical civilian complaint. Gotta love when the cop said “you’re impeding the flow of traffic” and the body camera moves around to see not one car driving even remotely close to his position. As soon as he said he’s a PI and showed his license, the stop should’ve been over. I know when there’s kids around, people get concerned and protective, but the matter of law supersedes those concerns. You’re in public, you and your kids are already being filmed.

What we know is that his case was a workman's comp case about a woman, the woman was seen entering the church with two children.
The cop said he has grandchildren there right now, how should that make him feel.....
I'm starting to wonder if the person he was investigating for compensation fraud was his wife who brought the grandkids or his daughter with the kids.
I'm thinking the reason he didn't say anything when they claimed he had to notify them upon investigation in their area, is because it was Mr grandpa's wife, and they both knew that.

He was asked to leave from the church and he complied. But the pastor could still(and did) request he be officially trespassed. Same with Winn Dixie. They requested an official trespass.

Language and context is everything. The cop told the store: “There’s this guy illegally parked filming children. Do you want him trespassed?” Instead, had they told the truth which is: “There’s a licensed private investigator working a story in the parking lot. Is it okay for him to stay?” Well, that would’ve provided completely different results and the cop knows that. Language and context absolutely matters.

To play devil's advocate, how does the pastor know he is really a PI and not just a creepy old guy? Not defending him or the cops, however I don't think a good PI would hang out in a church parking lot full of kids and not expect to be confronted when he is filming or taking pictures. It could have ended a lot worse if a few suspicious and angry Dads came outside. Lots of bad things have happened at churches, so I can imagine them being on edge and calling the cops.

The pastor went on to basically say say the P.I. ‘still shouldn’t be filming kids’ and that he still trespassed & the cop agreed. The pastor is as wrong as the officers and needs to be in that lawsuit as well. Also, the P.I. didn’t trespass because once he was asked to leave the church parking lot he did and never went back over. Same for Winn Dixie. He was never asked by Winn Dixie to leave and to make matters worse the cops solicited the trespass by LYING to the manager and clerk, knowing he’s a PI but making it seem like he’s just a creep watching lil kids. EVERYONE in this video except the Winn Dixie people need to be SUEDDDDD

As a PI, I've had similar encounters with law enforcement. I was even labeled as anti-cop and a 1st amendment auditor in the police CAD notes, because I was parked on a public street conducting surveillance and refused to provide any identification or assist in their witch hunt. Its really sad as a former law enforcement officer, each day I see videos like this and have encounters like this myself, make me embarrassed to even claim I was a cop.

With one of the businesses I used to own, I hsd an exemplary, hyper intelligent college student employee who worked with me until he finished his two year degree and went on to become a cop. I offered him very good money to stay, but he made it clear that he had this purpose all along. As president of my corporation, I gave him a glowing review to get his job with the big city PD.
He lasted 4 years as a cop and after watching a half dozen of his coworkers get mowed down on the southside, he became a private investigator for insurance companies. Smartest move he ever made, doubling his money, and yes, he had his share of idiotic experiences with other cops as a P.I.
In this video, this is a clear-cut case of cops getting personally involved rather than following law. It will lead to a federal lawsuit and the cops losing qualified immunity.

I was a little surprised because in my experience there's is always some B.S. Fortunately Igot it dismissed after getting statements from my employer and an attorney to help with a stubborn D.A.

My husband works for a particular organization. They have lawyers on standby. My husband is more of cyber stuff. But the ground guys are always getting nicked, they literally just call their lawyer.
I was told this long ago, I wanted to join the force; then the Commissioner himself told me I wouldn't be a good fit as I think for myself too much, and would likely 'over-use' my discretion and result in less arrests. My response was, wouldnt that result in better community relationships, in turn resulting in more closed cases since the police bread and butter in investigations are peoples testimonies.
I had a friend then join, and he's a brighter spark than the avg fellow, and he was thrown from entry level straight to special forces unit, because he'd mess up the program that is the basic cop jobs, to reek havoc haha....He'd be more likely to call out BS in other officers interactions etc, still slightly attached to his civilian, empathetic part of him; which we all know gets forcibly thrown out when you become law enforcement.

I would expect a pastor to call the police if it appeared to him that a man was recording children, that is strange behavior even if it's legal. But once the cops showed up and didn't see a crime, they are at fault.

As a owner of a private security company & have done surveillance on homes for drug activities, I too have been approached by people seeing me video taping the house under surveillance for drug activity & I simply exist my vehicle with my security uniform on & my .9mm on my side & simply identify myself & say I am on a case conducting surveillance on a drug house, after that, they walk away... law enforcement officers should give this guy the benefit of the doubt because he is on a case surveillance probably investigating a cheating wife ..its always a cheating wife or girlfriend...

As a private investigator, I've personally had a very similar situation with a very different outcome. I was parked on a public street recording a subject in his front yard several houses down from my location. A little boy about five or six years old came out of the house I was in front of and started waving to me. I gave him a friendly wave back in response and resumed watching my subject. A few minutes later, a man came to the front door of the house and yelled for the boy, and a younger (four-ish?) girl I'd not even noticed to go inside. Once they were inside, the man walked over and knocked on my passenger window, asking what I was doing. I told him "I'm sitting in my car on a public street." He eyeballed my binoculars, laptop and camera equipment on the passenger seat, then stomped off angrily without another word. I had no other interaction with him, but I did notice him peeking at me from behind the curtains in his front window several times over the following half hour until the police parked behind me and approached, two officers on each side of my car. I put all my windows down, and my hands on the steering wheel, with my Driver's License and Private Investigator license between the fingers of my left hand. As the first officer arrived at my window, I slowly held the cards up for him and said "I'm on a file". He took them, and the two officers on the driver's side backed away and returned to the police car while the other two remained on my passenger side with their hands on their guns. After a couple of minutes, the officer I'd given my cards to walked back casually and handed them to me with a "Have a nice day.", and all of them returned to their car and left. That was the entire incident. The man and kids never came back outside, and I eventually got the footage my client needed.

After watching all these videos I'm never going to agree to trespass some random person from any business I work at based solely on the word of a police officer. An excellent episode. Just provides additional support that some cops 1) do not know the laws they are employed to enforce and 2) will say and do whatever they want to get the results they desire, acting as judge and jury. The system never worked well and it continues to function poorly for the general public. Body cams are about the only thing we have to prevent cop tyranny.

I get so sick of hearing that! How can the police always get to investigate themselves? I have worked a few jobs in my day and each of them required some kind of oversight, both internal and external.
In one job every year I had to get a roto rooter type of thing from the public. None of those people knew anything about my job, they just knew that I was responsible for some things that also touched the public.
